Hi, my fiance and I have been in the K1 process for a year now.  He got his interview date today for october 7th.  He has already purchased a plane ticket for the 16th to come home.

 

After reading horror stories...I have this overwhelming sense of dread.  Im so nervous he will get denied.  I sent him all of the forms and tons of evidence.  I just worry that they will say no.   

 

How many of you have been denied?...any words of encouragement?....what else do i need to do?...

 

IMHO just make sure he has ORIGINAL documents in hand in the event that they are requested.  Yes even if you submitted them already it is a good idea to have a complete set of the application in hand at the interview...all original.

 

Just my two cents.

hello to all..its been 3 weeks now since i had my interview in USem Manila..my case status  still in 'READY' and no updates since then.

Back to my interview, I was told by the consule that my visa is approve and then wait my name to be called for the last step. On my last step the filipino guy there told me they will do an internal checkings first and this will be done at Washington and they will email me as soon they see some problems. AS of now no email received from them.  I called them last week and told me that my passport still in the office and still under process. I just want to ask if this is normal? does anyone experience this? and what the best thing that me and my fiance cAN DO...

Me and my fiance were so worried about this,,,hope you can help us..

Not sure if this is the right place to post my question, but I would give it a shot. 

 

My wife is scheduled to have her interview in Montreal on Dec. 11th, 2013. I know that she needs to bring my AOS I-864 with her to the interview (along with W2s and IRS tax transcript). We used electronic processing so everything were scanned and sent to NVC prior to the interview. Now, When she goes for her interview, does she need the ORIGINAL copy of the AOS I-864 with her? Or is a copy ok for the purpose of the interview. 

 

If the original is needed, I would need to send her the I-864 documents ASAP via postal mail. If the original is not needed, she can just simply download and print out a copy I send her. 

 

Please let me know if you have any information on this question. Greatly appreciate your help!

One more thing.  You should send her an ORIGINAL of each and every document submitted including documents that you/she has not yet submitted, if any.  She should have them in her hands at the interview.  Make sure you use mailing or shipping with a tracking number (USPS, UPS or FedEx) so you can be assured that the package gets there.

If I am not mistaken she needs to have the original signed documents to present at the interview because they do not have the originals yet.  Original documents need to be signed.  I used blue ink so there would be no question as to whether they were originals or not.  Good luck and God Bless.

So. I'm at the final stages of filling out all my information on that dreaded ustraveldocs website. I get to the page where it gives me a few options how to pay for my visa. I chose electrontic funds transfer (EFT). The next page gives me the unique account number I'm to deposit the funds in, and then the amount of $240AUD. I hesitated, briefly concered that I'd read on the other page that I was supposed to pay $264 with the current exchange rate, but this page, WITH THE BANKING DETAILS, CLEARLY SAYS $240.

 

So I pay it.

 

Of course, I'm wrong, and I realise my mistake minutes later, so, in a panic, I pay a further $24 to amend my payment error.

 

I have my own banking reciepts to as proof of payment. My question to you guys: IS THIS ENOUGH? The small print seems fairly unforgiving and I'm afraid I'm in a state of panic, what with my interview being six days away. I'm very nearly tempted to pay it again through the post office and count that $264 as a loss. Maybe sell a kidney or something.

 

You said the payment site generated a "unique" account number.  Was this number the same for both payments?  If it was different I would just pay the amount again in it's entirety in US dollars.  But that's just me.  If I lost the 240 I would simply chalk it up to a mistake.  I would hate for a mistake like this to ties things up for day, weeks or months?  But that's just me.  It's possible you could get a refund of the overpayment but I would not consider that in making my decision in what to do.  Good luck and

Hi there, new to the site and trying to find immediate help/advice on a bit of a tough subject.

 

So I was flying out of London Heathrow tonight and upon check-in I was told that I am not authorized for travel to the US.

After a lot of digging I found out that it was due to me overstaying my VWP for a total of 29 days due to my wife suddenly becoming pregnant (which we are both elated over). It's understandable after reading and knowing all the restrictions and guidelines in place under the ESTA program and I am by no means looking for a resolution on that matter, what I am curious is to how I go about getting back relatively soon. I, or should I say we, are under the presumption I will not be back for the holidays this year. My question falls under the fact as to how I can get back for the birth at least.

 

We were going to go down the route of adjustment of status when we found out about the pregnancy (hence the overstay) but the savings I had left did not permit that to happen given the cost of all the forms and vaccinations I would have needed and decided to do it via consular processing, especially as we are now married and have a child on the way my ties to the UK do not outweigh that of a life in the USA.

 

Can anyone offer me up a solution, bit of advice or point me in the direction I should most likely take?

Any help would be greatly appreciated.

Hello VJers'

I am hoping someone can help us with this K1 process. Fiance was interviewed October 10th and was approved. Was told to go pick up VISA in 2 days but was later called and was told he would be contacted, this was due to RAMADAN/EID. It will already be 3 months this coming January 10th, 2014 and I or we are worried that we have not received not even a message for information. CO told fiance to come back in 2 days as previously stated but to this day we have not heard anything. It is so useless to call consulate since I am always being put on HOLD, transferred or they do not answer and calls are so expensive.... I am always getting the run around and have not and more than likely will never get that phone line to inquire as to reasons why my fiance has not received his VISA...His status on CEAC is AP, again, numerous emails always say same thing and I believe it is an automated message. 

Has anyone ever been in this situation? I even resorted to sending email to my fiance in Morocco so he could deliver by mail to consulate to see if we can at least inquire as to reasons or answers. They have told my fiance to wait 3 months but what will happen if the 3 months expire and still no VISA in hand? Again, I am relying on anyone out there that might have gone through this situation and or process... Thanks in advance...

I would say - "K-1 visa gives us 90 days for consideration after the arrival in the US. I would like to live together with my fiance under the same roof and to figure out what kind of person he is on his own territory. BAD ADVICE, do not follow the above advice...

Oh my God no!!  Holy #######!!!  That would be a crazy answer.  You are definitley going to get married once she gets in the US.  Never say it is a trail period because that is NOT wahat a K-1 visa is about.  Say it's a trial period and you are sure to be denied, I guarantee it!

I don't think his or my appearance should play any factor as opposites attract. his dreads are always well kept and he doesn't "look" like a "low life" or anything he is a hard working man. No one really cares "What you think".  That's the point exactly.  You are refusing to see the points made by others.  RED flags...are not based upon what you think.  They might be based on what the CO thinks, however.  I will assure you that many "Upstanding and law abiding citizens" have been turned down for jobs because of their appearance.  Of course the job interviewer will never admit to that because it might be discriminatory.  They will just not hire the person.  Same goes for his interview with the CO.  They rarely tell you why you are being denied...they don't have to.  So IMHO, have this sweet man of your cut his hair, wear some very presentable clothes and attend the interview as if his life depended on it.  Being stubborn and refusing to cut ones hair won't get the two of you anywhere.  Good luck.

Okay so I have the same question.  I called NVC yesterday they said package had not yet shipped.  I called today they said file was in mail room being prepared for shipment.  I checked CEC site today and it now indoicates IN TRANSIT.  Our package should be going to Manila and I can't for the life of me figure out how to do this DHL tracking thing.  I could swear I am following instructions but I can't see anything leaving NVC today for Philippines.  Can you help me out?  Do I have to wait until Monday or does DHL update on weekends or so I jusy have to wait until NVC says packge had shipped and go for there.  Sorry but I am just so confused....such a long drawn out process.

Wow, I didn't even go to hubby's interview but he didn't say anything about needing his dl.  Guess you could always say you don't have one? and use a utility bill to verify your address?

 

I would never recommend lying to anyone along this process.  It could derail everything one has worked for.

Part H has a few questions that ask:

"If law requires it, are you willing to bear arms on behalf of the US, willing to perform noncomabtant services, perform work of national importance under civilian direction"

 

The woman is 71 years old.

 

I mean.... what the hell do we put? Just "no"? and attach a letter explaining that at 71 years old she is not capable???

I would reply in the affirmitive.

I got the date for my Biometrics appointment, and it says to be there at 1pm. I have to work that day, and I'd hate to miss most of the day on this.

I am very confused. I moved to the U.S. in 2009 marriage based cr1. Filed taxes from 09-11 with my wife. We divorced in 2012. My source of are annuity from settlement insurance company and CPP disability. I choose monthly annuity as it is non taxable. I have been to all the accountants and hr block to file for 2012 and get the run around. They all tell me that I am not required to file tax return.

The H&R person whom.I spoke to said send returns from 09-11. I am lost who is right. If I don't need to file taxes and during the interview they may ask how do I live? I do not get any assistance from the govt, so I am not a burden on the us govt/tax payers. I am very stressed. I don't know why to do. I need help. Thanks

Of course, the hotel stay counts towards your residency.  You should never "adjust dates".  Just put down where you have "resided" since arriving there.  One resides at a hotel just like any other domicile.

Complete the form as it happened.  I would also make certain you have filed your most recent address using the AR-11 on-line form before filing the N400.  I would send in the application after the 15th of March just to be on the safe side.  Put in the different apartment numbers and list the hotel stay.  You do not have to prove any of the addresses, but you should have completed the AR-11 change of address for each move and then it would be documented.  I would be as truthful and correct as possible when completing any form used by the US government.  For immigration, any misrepresentation can have serious consequences and is not worth the risk IMHO.

I agree, don't "adjust dates on the application" to suit your needs.  Use the real dates and you should be fine.  "Adjusting dates" is visa fraud...you don't even want to go there now do you?

Yah, I will probably wait for the green card to arrive, but once I have it can I travel without any specific limitations or do I need to get some form of additional US travel document ?

 

I would carry every ID I have to be safe. Passport, Green card, drivers license....you can never have too many ID's.
