K-1 Fiance(e) Visa Process & ProceduresPlease help me for sending back RFE.

Hello, I need all your advices.
Last sep/20 my finance got rfe by email. Sep/26 he got hard copy of rfe. Then sep/30 he signed and kept in mail box. The mail man came and got it. But we did not have tracking number..Until now we did not hear any update infos from uscis...
So now do you think he should ask post office to check where was doc or we will call uscis to request other rfe.
Thanks for any advices...

If you just let the mailman pick up the envelope at your house you must not have sent it Certified/Registered Return Receipt Requested.  Now you have no proof that you even mailed the letter.  If I were you I would make another document and take it to the Post Office and mail it properly so you will get a receipt that it was delivered.  But that's just me.  I would NEVER send anything to them regarding my future life without a proof of delivery.  Good luck and

God Bless

K-1 Fiance(e) Visa Process & ProceduresPlease Help ASAP! USCIS Not accepting original divorce decree

I just received RFE on September 27 but received hard copy in the mail Oct 2nd.  I leave tomorrow OCT3rd at 5am to see my fiance in Costa Rica.  The timing is hard to believe but at least I can try to get what they want. They are not accepting the original papers I received from civil registry regarding my fiances previous divorce. This is not a copy but an original document with the notarize from this government office.  the RFE states as follows:

MARRIAGE TERMINATION:  Submit a legible copy of the final divorce decree signed by a judge or magistrate that shows proof of filing that terminated the prior marriage between "Beneficiary Name" and :beneficiary ex husband name".

The petitioner submitted a certificate showing that the beneficiary is not currently married and was divorced for her prior spouse. However, it is required that the petitioner submit the actual divorce decree providing the details of the divorce.

Please help if anyone can understand what they are asking from me. I never heard something so technical being requested.  This is the paper given to my fiance when requesting from the civil registry pertaining to proof of her divorce.  Thankfully I received thos in time before my departure in the morning tomorrow, but I don't have any idea of what they want me to get as addition proof. I need someones help and advice asap please. I attached photos of the original divorce decree I sent in and a photo of the RFE I received today.

In our case we submitted the DIVORCE DECREE.  This 7 page document contains the decree of divorce along with how the assets are to be divied up.  It details any future assets that could be discovered, current assets, joint bank accounts, etc...  It sounds like this is the document they are looking for.  It appears you have only provided the page that shows the divorce, not the entire DIVORCE DECREE.  Good luck and God Bless

K-1 Fiance(e) Visa Process & ProceduresGirlfriend visited on VWP and is now 6 weeks pregnant, please advice!!

Hi my name is Chris,

My girlfriend of 2 years visited me from Chile on VWP on August 6, 2014 and her returned flight is October 30, 2014. This was her first time visiting me (I visited her in Chile about a year ago) her arrival went really smooth at POE. She was asked why staying almost 90 days she respond visiting boyfriend and taking advantage of trip since is not cheap and very long flight. She had proof of ties to country but none were needed, they quickly let her in after telling them she was here to visit boyfriend.

Fast-forward: October 8, 2014. We found out at a clinic she's 6 weeks pregnant! They gave us some paperwork which states she's pregnant and her expecting date is on June 3, 2015. Now i've read online and from what I have found out I have different options (Fiancee Visa, Spouse Visa, Adjustment of Status) I want to do things right and would appreciate any advice, opinion or just simply share your similar experience! Her return flight is in less then 3 weeks so I need to act quickly! I wish my baby to be born here in USA i'm a US Citizen born in Los Angeles, CA. Would also love to be next to her during this process and do prenatal care here in USA. Please any advice or opinion is deeply appreciated, as you can imagine im nervous this will be my first time becoming a dad!

Questions:

1: I'm aware as a VWP you can't overstay your visit or AOS. But does this situation changes anything?

2: If I file K-1 (Fiancee Visa) and she returns home would they allow her back in as VWP for Prenatal Care or to have baby while we wait on K-1?

3: What would you advice (Fiancee Visa or Spouse Visa)?

4: What are her chances of entering USA as a pregnant woman under VWP?

5: I'm aware on K-1 Visa she can't get Government help (Medicaid ect) does this mean if our baby is born in USA I will have to cover everything? I want to cover as much as I can but I read online average delivery is $30,000 which is out of my reach.

6: If we get married and I file for her AOS will this be consider a fraud because of entering as VWP? We had no intention to married but as you can imagine I want our baby to be born and have both parents living together.

PS: Thank You everyone for your time and help! From the bottom of my heart im deeply grateful. I apologize for so many questions, I'm just so nervous with this situation and want to do things right and I have less then 3 weeks before her returned flight.

Get married.  File for AOS.  She never has to leave the USA!

K-1 Fiance(e) Visa Process & ProceduresWill Joint-Sponsorship or Loan from parents work as financial proof for Fiance Visa?

Also for a K-1 tack on:

Trip to the Philippines to gather photos & passport/receipt evidence you met her within 2 years if you haven't done so yet: $1200 - $3000 (includes tickets and expenses, costs are cheaper if you stay with her family).

Engagement ring (not necessary but if you are going to do it, do it right and make her feel special): $500 - $5000

Medical exam fee: $150

CFO Fee: $35

Airplane ticket for her arrival: $800-1200

Marriage license: $15 - $25

Marriage fee (some judges/mayors would ask for a donation): $50 - $200

:)

Add to this two round trip tickets to Manila if she comes from another place, such as Cebu.  (Medical and interview)  Somtimes an attorney is used to facilitate the weddeing documents.  We did this at a cost of 100 dollars and it was worth it.  The attorney hired the pastor, prepared and submitted documents required, etc...  This way we got to leave on our honeymoon immediately following the ceremony.  Add another round trip ticket for yourself if you plan to attend the interview wth her in Manila.  They allow you to go in to the embassy there.  I feel for us that was pivotal in the issuance of her visa.  We have a big age difference and the CO was happy to see I was there and supporting my wife.  The CO asked me more questions than she did my wife.  My wife and I boarded the plane to leave Manila 8 months to the day after our first documents were filed.  Good Luck and God Bless.

so whats an acceptable way? is the only way of me acquiring that myself? there's no way to turn to another for money?

No.  What you are suggesting is deceitful to say the least, perhaps immigration fraud.  If you "borrow" the money from your parents it's not really yours now is it?  I also think you would need more like 100,000.  But they will be suspicious if suddenly you have 100,000 in your saving when you have no job.

This is so out of subject but I have to say it ... Everytime I check VJ you are there no need to scroll lol (mostly loging in through the mobile) but with the pc aame thing xD

It's good to have a lot of questions (better be dumb 5min no asking then for ever for not asking) and I kno for a fact that its not easy to always find the right answer to your question but... yea..
Don't go harsh on me (You once did before & I saw you do it to other as soon as they write something you don't like)

I just had to get this out my chest, no problems intended. Have a nice evening & good luck on your visajourney :)

K-1 Fiance(e) Visa Process & ProceduresUS immigration when entering the US

hi guys, i am flying in to America on oct 30th! i just want to know from you guys' own experience if people with k1 visa get stopped at the US customs? and by stopped i mean not just speak to the officer but get actually stopped by being taken some place else to be asked more stuff. i am asking if that is how it is for everyone with k1 visa because a friend of mine that is also from Poland was stopped and i just want to know if that is the case when it comes to all of us.

Yes basically everyone is "stopped".  Depending on the individual circumstances, country of origin, etc some are taken into more detailed questioning.  Most line up in the immigration line, submit their documents, answer a few questions and are then welcomed to America.  Good luck and God Bless.  Oh, and by the way. Here's an early Welcome to America!

K-1 Fiance(e) Visa Process & ProceduresDS 160 without photo

Hey,
Does anyone knows how to submit DS160 without uploading photo? I am submitting one for my fiancé but I don't have her photo. She is taking the photos with her to the interview.

Have her go to an internet cafe or office store., scan the photos and email it to you.  Then you can easily print it or attach it to the form.  This is what I would do just to be safe.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied because I am ugly???

Well, i figured out the BS factor and now I am pissed. I actually lived with her and everything was fine. The last few weeks I have been fed a bunch of lies. When I confront her saying I know she lied about something and I just ask her to tell the truth. It is all I want. The embassy in Kiev contacted me and said she never even scheduled an interview. I did get her on the phone today and I will speak to her in a few minutes on Skype. She does not know I know the truth. This will be interesting.

I am sorry this is happening to you.  It is not fair but just remember: Everything happens for a reason.  Somewhere down the road you will see that this would have been a mistake, especially if you brought her to the US.  What a disaster that would have been.  I wish you the best of luck.  Karma will take care of this evil woman.  My hope is she ends up marrying some young, dashing, handsome Prince and he turns out to be a real douch and she regrets losing you who obviously cared for her very much.  Don't waste your time plotting revenge or having resentments because if you do that SHE wins.  Resentment and anger eat away at your soul.  Pray and let it go...you will be all right.

I'm not saying you're not in love... what I mean is, a younger woman will always seem too attractive for an older guy. It's not a reason for denial.

Amy,

Not necessarily....I've seen some nasty looking young women that I would never be attracted to.  hahahaha

I did not take offense to what you originally said.  It's ok.  GOD BLESS

K-1 Fiance(e) Visa Process & ProceduresVisa Denied because I am ugly???

Folks, if you could deny visas based on ugliness, then pretty much all visa applicants from RUB countries, Thailand, Philipines; ie. anywhere American men go to marry younger women, would be denied.

Oh, and one more thing.  I did not go to the Philippines to marry a younger woman.  I went to the Philippines to meet in person the girl I fell in live with on-line.  Yes, she's 36 years younger than me but we are so in love and are now together in the US.  I am living the dream, married to a beautiful Filipina that is so beautiful inside that she glows.

I did not mean for this to sound snarky.  If it does I apologize.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied because I am ugly???

The simple answer is no.  A I-130 petition cannot expire so if the visa is denied the I-130 petitioner gets a chance to rebut the findings when the I-130 is revoked.  So in that sense it has more staying power. A I-129F just expires most of the time, so people can try again.

But a lot of people think marriage is a stronger immigration case so they get a meaningless marriage and think it is the key to a visa.  It's not.  You still have to prove a bona fide marriage and relationship.  The fact that two people are legally joined is not that meaningful for someone wanting to commit fraud, unfortunately.

And with all due respect I think wedding photos, expenses are a big part of the required proof of a bonafide relationship...just saying.  In the end it is up to someone in the embassy to decide if a relationship is real.  I know in Manila they have many cameras watching people as they wait and it is suggested that perhaps embassy employees are watching the interaction, or lack thereof of persons waiting for an interview.  So if that is true it is also possible that the fiance or spouse appearing at the interview is a plus.  I was there with my wife and we were both sworn in.  I am 36 years older than my 20 year old Filipina wife and I am pretty sure my being there and us having hundreds of wedding photos could not have hurt us.  Even after the American consular asked me, "So your son is almost twice the age of your new wife?"  I answered in the affirmitive and after a few tense seconds the officer said, " Congratulations maam, your visa is approved."  Had I not been present at the interview and were we not married might things have been different, I think so.  But that is just my humble opinion.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied because I am ugly???

Yes, it is correct. We planned to get married in Ukraine in March (I wanted December originally, but it is kinda cold). I was in "busy season" in Florida where I work so I wanted to gain some more money before I returned. So, why not return in April on her birthday, which I did. I needed photos from her within 30 days of filing according to the I-129 petition and I do not trust Ukraine mail system. So, once I returned, I was debating about getting a lawyer or just doing the forms myself. If I had a lawyer, it would cost a lot and most people said just do it yourself because it is only paperwork. I did fine on the USCIS side. She said she will wait 6 months and let's try so we did. I filled out the petition on May12th, but it was the weekend, so it arrived in Dallas on May 15th - right on time from the day we took the photos in Nikolaev, Ukraine.

She said she "Would wait 6 months."?

K-1 Fiance(e) Visa Process & ProceduresVisa Denied because I am ugly???

On a government website somewhere it did say something about as you say "sharks" outside the embassy. I believe this happened to her when she was trying to get a medical exam a few weeks ago. She said she received one at a local doctor, but I was very upset because I knew she went to the wrong one. She had the receipt for it, too. So, I told her where to go in Kiev and she did that last Friday so that was all ok. Thanks so much for those helping and caring as I will continue to read and post as all we can do is speculate until I get the exact reason.

She is at work right now and she works on a 24 hour schedule for a taxi service in Kiev so her replies are minimum. Today she did say that it is hard for me to explain over the phone as she can only text. I told her we really need to sit on skype and take a few hours to discuss this on camera when you are not working, but i asked her a few questions asking reason for denial and did she receive any papers. So far, she has not responded.

You know I hope I am wrong but there are so many suspicious things going on here.  The medical exam at the wrong doctor? Perhaps, but is it possible that she did not take a medical exam at all?  I mean in the Philippines you can buy a receipt from any agency for a few pesos.  They will fill it out for you and one could easily present this to their fiance and it would appear very real, because it is a "real" receipt.

As far as scammers go, yes it's true.  I was at the interview with my spouse in Manila and there were hucksters all over the place.  They were scaring people into taking passport photos because they would say the ones they had brought would not be allowed.(Yes they had digital cameras and portable backgrounds, would take the photos and brought them back in about 30 minutes.  They were selling passport covers saying the embassy would not accept a passport that was not in a cover. Of course I knew this to be false.  In fact, if your passport was in a cover you had to remove it first.

Perhaps she did her real medical too close to her interview and the embassy had not yet received the results. I hope this is the case.  I know at least in the Philippines it takes a minimum of 2-5 days for the embassy to get the results in hand from the only medical facility in all the Philippines that is allowed to do the exams.(St Lukes)

A 24 hour schedule?  She drives taxi for 24 hours at a time?  I hope not.

Anyway, no matter what the truth hang in there.  I will be praying for you.  What is happening to you is really difficult, from both sides I am sure.

Good luck and GOD speed.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied because I am ugly???

Someone is being a fed a line of BS.  Most likely YOU. Possibly US.

If the visa was denied she cannot interview again. The petition will be sent back to USCIS and you will be notified of the official reason for denial.  It will NOT be because you are ugly.

some possibilities...

1. You are making this up for fun

2. She is making it up because she does no twant to marry you, did not go to the interview and is feeding you BS

If you are not making this up, then you may want to check with the consulate and see if she even showed up for her interview

One more thing to consider.  If in fact "she" is hoodwinking you perhaps the suggestion by her that she can go back to re-interview is a reason for her to prolong the milking of your finances...She CAN NOT go back and get re-interviewed in 2 weeks.  If she is telling you this she is lying, and perhaps looking for more support from you as her time runs out in this ruse.  I hope this is not the case but you might want to investigate further.  I wish you well.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied because I am ugly???

In Kiev embassy Ukraine. My fiance said her visa was denied because I was ugly and she was too pretty to love me. This is quoted by an American officer - Is this not sexual harassment? Also, isn't there a law that requires a valid reason? I lived with my fiance overseas and we have been engaged for over a year. I currently am in America proving I can support her. Apparently, none of the documents mattered. I have plenty of evidence for a bona fide relationship as I was overseas working and that is how I met her. I lived with her for 3.5 months. Plenty of photos, etc. She said people outside of the embassy said she could interview again in 14 days. Has anyone ever heard of this? It looks like I will travel back to the Ukraine very soon. Any help here is appreciated.

Sorry this is happening to you.  But perhaps the embassy employee that said that to her was flirting....of course this would be soooo inappropriate under the circumstances.  But then again proving this would be a he said she said circumstance.   Your fiance must be very beautiful, at least you have that going for you.  I am 36 years older than my wife.  She is a beautiful 20 year old Filipina and I an aging 56 year old American.  Talk about beauty and the beast.  The interviewer could see that we were in love and we passed the CR-1 interview in Manila, no problems so I highly doubt the age difference is a problem here.

K-1 Fiance(e) Visa Process & ProceduresVaccination.

Hi. I am just sitting here reading about all the vaccinations you need to take, but is the prices for them included in the medical exam?

Otherwise it's gonna be an expensive story, lol.

And also, are there different requirements for vaccinations considering what country you come from/live in?

All vaccinations were included in the cost of the medical exam in the Philippines.  However I understand that can vary by country.  Check with the medical facility where you will be getting your exam....they should be able to tell you.  By the way, the entire process is very costly but well worth it in the end.

K-1 Fiance(e) Visa Process & Proceduresdenied fiance visa

my fiancé's visa was denied he was told he can reapply in a year. the same day he was denied I found out im pregnant we would like to get married and reapply with a spouse visa he lives in the UK and id like to fly there get married then return home to the US and start the paperwork. ive also read that if not having him with me would cause hardship there may be some type of waiver we can file to bring him faster. im at a loss for what is the best route to get him here I currently work two jobs in order to make enough money to bring him here and with a baby coming I will definitely have to quit my second job as its not gonna be safe once I get further into my pregnancy so not having him here to help me will definitely cause a financial hardship and I cant apply for any government aid because I cant bring him here if im receiving any benefits. ive emailed several immigration lawyers and not received any responses. if I am able to go there and marry is there anything I need to do before hand. my dad was my cosponsor for the fiancé visa and is planning to cosponsor if needed for a spouse visa. my job situation will change by next year and my pay will double and I wont need a cosponsor but that's a year from now and a baby will already be here if anyone can help me figure out what to do that would be great smile.png

This may not be a popular answer but...

Let me see if I understand you.  You are pregnant, work two jobs and will eventually have to resign from one of the two jobs because your fiance made you pregnant. (Irresponsible fiance?)  Your dad is going to sign up to be the co-sponsor because you don't make enough money to support your fiance even once he gets here.  Your fiance smokes weed the day before his medical. (Irresponsible fiance?) Oh come on now, who doesn't know that drug tests will be conducted at the medical exam?  Something just is not right here.

So here are my questions:  Is your fiance working three jobs and supporting you?  Are there any plans for him to do this?

He can afford to buy and smoke weed but you are struggling and can barely makes ends meet now.  In fact, you can't even support him when he gets here and that's why your dad is going to be the co-sponsor.  Are you sure you want to get yourself into this situation?  Sure, you might love him but...think about it.

I am not being judgemental but...Just saying.

K-1 Fiance(e) Visa Process & ProceduresDivorce before applying for K1 visa

You need a total understanding of the situation and we need more info. Please keep in mind we all want to help you not be critical of what you have or will do.

My first question is about her " marriage ". In Thailand it is common to describe a relationship such as she says she has with this Thai man as being married when many people are not really legally married. I would tell her you need a copy of her Thai marriage certificate. You will later need a copy of her divorce cert if she is in fact married. Thais do not marry because doing so gives the man access to the families assets. Thai law doesn't protect women as the laws here do.

Do not attempt to start the K 1 process until you are certain she is divorced. Do not send money or pay for anything from this point forward. Please follow this advise until you have a better understanding of these affairs. Pun intended Karee.

I hope Karee and some other members experienced with Thailand will add some insight today as well.

I will send you a P M later today.

I agree, stop SENDING MONEY NOW!!!!!!!!  Something is very wrong with this story.

So here's my story....  my name is Justin,   I'm from Illinois,  a lil over a year ago I met the girl I want to spend the rest of my life with,  we just knew from the first time we chatted online that we were perfect for each other.   Her name is Pitcha,   she lives in Bangkok.   We chat online all day, every day,  yahoo cam, send each other gifts,  occasionally call,  and so on.       About 6 months ago we tried to get a tourist visa so she could come here and we could meet and see where it goes.   We did not know much about the visa process and the high percentage of tourist visas getting denied at the time,   so of course we got denied.  After she got denied I decided to go her.  My first time leaving the US and first time ever being on a plane.   After my 25 hr journey to the other side of the world,   we finally meet,   and spend 2 weeks falling more in love than we were before.   Was the most amazing experience of my life.   The only bad part of my trip was having to leave her standing in the airport with tears pouring from her eyes as she watched me leave,   not knowing how long it will be before we meet again.                                                                                                                                                                                                 Ok so now my question.......she is separated from her husband,   but not legally divorced.   They have a daughter and he still takes care of her and her daughter.  They remain friendly and civil to each other for the sake of their daughter and their home.   They are able to live in an apartment of his workplace since they are still legally married.   Here is where it gets complicated..........he knows me and her are happy together and want to marry.    but if they legalize the divorce,   then he will no longer support her and she will be forced to move and will create problems for her and her daughter.    I know the visa process takes a lot of time,     so my question is......Can we start the K1 process while she is still married as long as she gets divorced sometime during the process?   I just worry that she gets divorced and our K1 visa process takes up to a year and she is having a tough time there for a year.   Any info helping our situation would be much appreciated.   Thanks for reading.attachicon.gifme and Pitcha.jpgattachicon.gifme and Pitcha.jpg

Wait!!  The woman you are in love with lives with her not yet divorced husband, in the same apartment???  Something is really fishy here.  I knew of a woman in Philippines that had fiance's come to visit her and she would simply leave her husband at home and he was fine with it.  She made lots of money spending time with these foreinors.  Her "husband" didn't care.  They were hungry and she provided for her family.  I hope this is not true in your case but BEWARE...

K-1 Fiance(e) Visa Process & ProceduresCan't find a co-sponsor, what now?

You have to provide it because the form asks.

But the determination of whether an affidavit is sufficient does not depend on those tax returns. It depends only on current income, which is a separate question on the form. If you read the instructions, you prove current income by pay stubs and/or employer letter.

If you didn't work in the past and now have enough income, then you qualify. Conversely, if you had tons of income in the past, but stopped working recently, you have no income and do not qualify.

Thanks, you learn something new every day.  Sure seems like they make us jump through many hoops even when it is not necessary and yet we have millions of illegals here that are to be given amnesty??  It really stinks sometimes.  I am just so grateful that I got my wife here when I did because it appears it is taking longer and longer.  Thanks for the info.

Doesn't have to have any income for any tax years. Just has to have enough current income -- that means income right now.

Really, then why did I have to provide "At least one year of tax returns". I provided three years.  I may be wrong and if I am I guess I did a lot of work for nothing.  How do you prove your income if you have not filed far at least one year?  How does one prove current income?  Just asking.

One more thing.  It does not matter how comfortably your fiance lives...all that matters to the US is that he makes a certain percentage over the poverty guidelines based on your family size.  Sorry.

K-1 Fiance(e) Visa Process & ProceduresCan't find a co-sponsor, what now?

The thing is that my fiance isn't rich, but he lives comfortable.

But his house was destroyed in hurriance Isaac in 2012, which caused him having to take off a lot of days from work so he could rebuild.

So he did not make enough money this year.

Had we filed a year earlier, then all would've been fine. But no one could've predicted that hurriance disaster.

So his mom wanted to co-sponsor, but same problem.

Nonetheless I did go to the interview and explained everything, with supporting documents. And also with assets, like 2 savings accounts, a house without mortage, etc etc.

But the embassy decided that this was not enough and that we need another sponsor.

After asking around for a long time (my fiance has only his mother, his retired grandma and few close friends due to distance).
Then we did find someone, all was set but last minute he decided not to do it. That's the problem.

So now we don't know what to do, since we tried everything so far and still can't find anyone.. because there isn't anyone left. Unless some millionaire drops out of the sky and decides to do it. Lol.

If we go for the spouse visa, then my fiance will first save up until we have enough for a new affidavit. So this is not an issue for the future.
I'm talking about now, just making that clear.

So when I inform the embassy, as you said, do they just withdraw the petion or does that count as a denial?

Your fiance does not have to "save up".  He needs to have a job with sufficient income for at least one tax year as far as I understand it. Now I could be wrong and maybe others will chime in on this.  He needs to have a job and report and file income taxes.  The he needs to provide proof of income and filing of taxes.  These same requirements apply for K-1 or CR-1.  Withdrawal or denial, I am not sure which one and do not imagine that it makes any difference.  I know of no way around this unless that millionaire shows up.  I wish you the best.  God Bless

Heck I don't even know what to do now. Do I call the embassy and tell them we can't find a sponsor? Do they just close the case or do they deny it?

If it does get denied.. will that raise any red flags or cause issues, if we decide to marry & apply for a spouse visa?

Help..

Same problem with spouse visa.  You have to prove that you can support her or have a co-sponsor.  As far as I know there is no way around that.  But then again would it be wise to bring him/her here if you cannot afford to eat and have a roof over your heads?  They will most likely ask for a co-sponsor.  If you cannot provide that the case will just be denied and/or closed.  I suppose when they ask for a sponsor you should then inform them that you do not have one.  Good luck.

Sorry but there are few options.  You have to prove that you can support your fiance/spouse once he/she gets here.  Either by yourself or with a sponsor.  The only option I know is to get a second job to increase your income so you fall within the guidelines but of course even if you found a new job tomorrow you must wait even longer.  Sorry but I know of no other options.  Good luck and God Bless

K-1 Fiance(e) Visa Process & Proceduresk1 visa -- affidavit of support (fiance from philippines) please help :(

Hi every one I hope you can help me, I want to file for k1 for my fiance from philippines, but im worried about my in come. I have income tax for 2013 and is more than the required amount, but I had to leave my job last july. Then I started working again just last week but I get paid by cash. If I file this month and hopefully approved, is it ok if I wont be able to show paystabs, and or letter of emplyment? Would I get denied? Also is it ok to use a co sponsor? Im getting confused, they said in the philippines, they do not allow it. Please please help sad.png

There are many reasons that US Citizens should file and pay their income taxes like the majority of us do.  This is one prime example.  I have been filing and paying income taxes since I was 17 and am now 56.  When people work for cash who pays for the streets to be repaired, etc???? Us taxpayers do my friend.  Proud Americans who live in the greatest country in the world.

K-1 Fiance(e) Visa Process & ProceduresWTF Extra form that goes along with affidavit

Sooooo frustrated!!! We just picked up packet #3 from the Embassy in Costa Rica. MAJOR SURPRISE with an additional document that is supposed to go along with the affidavit that  looks something like this

"IMPORTANT"

This document must read and signed by persons wishing to submit an affidavit of support on behalf of an alien applying for an immigrant visa. A signed copy of this document must be attached to each copy of any affidavit of support submitted on behalf of an applicant.

Then it says stuff about the Social Security Act, and Food Stamp Act and who and how one is eligible to apply for them, etc.

At the bottom:

I, _____________ residing at ____________, acknowledge that i have read the above and am aware of my responsibilities as an immigrant sponsor under the Social Security Act, as amended, and the Food Stamp Act, as amended. The statement I am submitting on behalf of the following persons.:

Then there is a space to put names, sex, age, country of birth, married or single, relationship to sponsor.

I have never seen or heard of this document before... Do any other consulates require it? Did something in one of those acts just suddenly change? Such a HUGE SETBACK as our co-sponsor has already sent the signed affidavit.

If we do have to turn this in, the BIG QUESTION does this form has to have the original signature as well??? I have kept cool and collected basically the whole time, but now I'm pissed.

Too bad different embassy have different rules. Something I have never really understood as they are all American Embassies?

God Bless

K-1 Fiance(e) Visa Process & ProceduresThrow in the Towel and Move to Fiance's Country Instead?

One man's trash is another man's treasure. When I lived in Norway I made $22 an hour (min wage is around $20) and paid roughly 23% in income tax, with free healthcare, free higher education and 5 weeks paid vacation (as mandated by law). Plus, they have a 13th pay month.. The 25% sales tax and fees on virtually everything is a different matter. Plus, Scandinavian winters takes a whole lot of getting used to.

It isn't for everyone, but it's a good place to live.

Oh and by the way.  Norway has no minimum wage as set by the government.  I will agree with you that while most workers make very nice incomes they are easily offset by the income tax rates and all the other taxes charged to citizens.

Yeah, I just don't like socialism.  I want to be compensated for the work I produce not some government mandated garbage.  Unions and government mandates only hold people back.  They keep gifted and hard working people from getting paid what they are worth.  Is our country heading towards socialism?  Of yeah thats right Obama has us going into this terrific medical program and remember he said no one will lose their medical insurance but MILLIONS of Americans have received termination notices of their current medical coverage.....what happened?  Is it possible that socialism doesn't work?  I have also heard many horror stories in Europe, Norway included where certain operations/procedures are only allowed on people under a certain age....By the way search CURRENT taxation rates for Norway and you will see that your 23% is a bit low today.  Of course as you said the 25% tax on everything adds up to.  But somebodys got to pay for all that "FREE" medical.  Plus I don't know about you but I live in Hawaii.  Been to Norway and it's beautiful but it's way too cold for me!!

Not to make light of the terrible wait you are dealing with OP...BUT... given what I understand of Norway and the quality of life, if my Fiancee had been from there and I could get a job... I'd go for the Viking way without hesitation dancin5hr.gifdancin5hr.gifdancin5hr.gifdancin5hr.gif

Yeah that 43.9% income tax rate is great in Norway!!  As compared to 28.3 % in...oh say Florida for example.  Just remember many people came from Norway as immigrants to escape certain persecutions there.  Now while it is different today I would ask why most of the world still wants to immigrate to the US.  Good luck to both of you.
