OMG I am in total shock - our K-1 Visa was denied in February 2013 by Mumbai Consulate; today received letter from USCIS saying they are administratively closing the petition because validity dates have expired (we expected this) and the action is without prejudice to filing any future petitions or applications.  OK fine - but attached is a memo to NVC from Chief, Immigrant Visa Unit  Mumbai, which states;.. unusually large age difference , older female younger male, non-Indian etc. . . their fraud investigation revealed that Petitioner made cash payments to Beneficiary and demanded sexual favors in exchange for filing etc.  It goes on to say then we provided highly graphic chats as evidence of relationship and made frequent mention of cash payments from Beneficiary to the Petitioner, as well as Petitioner threatening to "rescind" (her) petition" if Beneficiary does not "straighten up'.

 

None of this is true!  The memo indicates both of us paid the other one for sexual favors to get the visa - what?!?!?!?!?  I do not see how a government agency can state these things without proof.  We obviously did not pay one another, nor did we provide "highly graphic chats" -  we had phone logs and some skypes and emails, but nothing of that nature. 

 

We don't know if we can get any other information or should bother, but it is sickening to think this is in the file now tucked away at USCIS, even thought we can file again.  Just really upset to see something like this about us in writing from the government!

 

Just wanted to share that things can get really messed up - they obviously have us mixed up with someone else - just in disbelief!

 

First off I am sorry this is happening to you.  Secondly, are you sure your fiance did not bring additional documents (chat logs, etc) with him to the interview or that he did not submit additional documents at a later date at the embassys request?  And lastly, I hope I am wrong but is it possible that your fiance deliberately derailed the application without your knowledge?  I hope not but you may have to look into this...

Hey guys! Finally! 8 hours ago, my fiance asked me to open my email account  cause he sent me something. He also wanted to find out what I thought about it. To my surprise, he forwarded to me the email from USCIS that our case is already approved!! Yay! What a relief! I even posted last night my frustration after sending the RFE 2 weeks ago and not hearing from them. Guess, they have heard me! LOL

 

I'm just soooo happy right now! We're just halfway through the process, but at least things will be a little bit faster from here on.

I checked Thursday, Friday and this weekend and no updated status. I usually don't check until close of business. I just decided to check and here it is:

 

Post Decision Activity

On September 20, 2013, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

 

They mailed it last Thursday should arrive this week! NOA1 July 2, 2013

 

I did not load it up with a lot of stuff. Proof of my 4 visits, one pic from each visit, my divorce papers, her annulment papers (even though we did not have everything it must have been enough), Etc. Filled out the forms exactly as VISA Journey examples are done. These were all copies of documents. Even her letter of intent was a copy. So we were worried about not having all the annulment docs and the letter of intent not being an original signature but it turned out OK.

Perhaps you just don't remember putting your nickname on the previous app?  I mean I doubt they filled in the form for you.  How would they otherwise get your nickname?  Perhaps your previous fiance filed some of the forms and included your nickname?  If not I have no idea.  G

My visa was approved yesterday, the lady that interviewed me just asked this questions:

When did you meet your fiancee?

When was the first time you saw him?

Where does your fiancee work?

How many kids does he have?

What are the kid's names?

Where does he live?

She didn't asked me for any evidence at all....(wooow, I had a bunch of it) smile.png

After the questions, she was typing something, then she asked my kids their age.

After she finished typing she smiled and said Welcome to the United States, your visa is approved and you will

get it in 5 days, then she gave me a green paper, that said it was approved and the instructions to track it from DHL......GOD is so awesome. I feel relief, well for now we're finished with the first and more stressful step.

Not Turned down, just asked to bring more documents, thus 221G form. Suggesting we meet again. There is no difference when as long as it is within last 2 years.

 

Yes, I understand you were not turned down.  What I meant is your fiance was not approved, thus the request for more info. (Semantics...)  Does not approved equal turned down? 

 

As far as the 2 year meeting requirement... as far as I understand it that would normally refer to meeting BEFORE the filing of the application.  IMHO I would have to disagree with you.  I think the meeting prior to the filing of documents is of utmost importance and it is possible that the consular officer might become suspicious that the two of you decided to meet after the "Not turned down" decision was made. 

 

You mention that the 221G form is "Suggesting we meet again".  Did they actually note that on the form?  That is very unusual.    I would check with the friend you were with in that single photo you have mentioned to see if he/she has any additional photos of the two of you together.  I mean in this day and age I just can't figure out how the two of you could have spent time together and had only one photo taken and it is my belief that most consular officers might also be suspicious.  I hope for your sake the consular officer does not get suspicious, however lets be real here...  Trust me I am not judging you here.  I am merely trying to help.  In the end all that matters is what the American Consular Officer feels.  If he/she feels there is no real relationship then it's over.  I am simply trying to help you avaoid this situation.

About 7 month of petition, approval, NVC approval and finaly interview in Ukraine for K1 visa.  

Interview result > 221G given due to need more evidence of relationship with photos underlined.

Fiancee said that the photo on file is the only one we have.

Agent did not respond, just said process delayed but not denied. Retained passport at consulate.

What can we do in this situation?

I can travel there and visit my fiancee within few weeks but are there any other alternatives?

 

How is it possible that you only have one picture together?  Sorry but I guess I would also be suspicious.  My wife and I brought 100 plus photos to her interview.  We had submitted at least 8 pictures with our application.  The photos don;t have to be of you and your fiance only...they just need to include the two of you together.  I just wonder if the consular officer will now be even more suspisious that you will come to Ukraine to take photos together AFTER she is turned down?  Anyways, good luck and God Bless.

Thank you. It's a shame yours took so long to ship but I'm glad you finally got the #. So what is the advisable thing to do...call every day, call every other day, call once a week?

 

I called every day.  If a customer "service" representative was rude or it was obvious that they were simply dismissing me I would say thanks, hang up and call back immediately.  I never got the same operator, as far as I know.  If they mentioned that I called earlier I would just say I didn't undertsnad what the representative had told me.  Keep trying, hang in there.  Good luck and God Bless.

Hello everyone, so my fiance had his interview October 16 on a Wednesday and everything went well and got approved, and the consular gave him a pink slip to go pick up his visa the next Wednesday which is today October 23. He went to pick up his visa and on the way there the embassay called him and told him to not come because the visa isnt ready yet, my fiance asked her if there is anything wrong but she said no everything is fine and we will call u to come get it when its ready
Then I checked on the ceac website for the visa and it went from ready to administrative processing!! What does this mean? Will this take long???

 

I have a sneaking suspicion that the embassy just did not get the visa ready and I hope and pray for both of you that it is ready very soon.

Before this K1 application, I have applied for US Tourist Visa twice (Year 2009, for holiday and year 2011 to visit my grandmother who was terminally ill.) Both tourist visa applications were denied. For the question, " Have you ever been refused a US Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry?"- should I answer Yes or No? If yes, what details do i need to put in the "explain" box? Thanks for your help! :-)

I'm looking for same sex binational couples like us who are in I-130 processing AND have been together/married for more than two years.

 

I want to advocate in Congress and at State for a blanket expedite for all couples waiting more than two years: those of us who were denied our rights as USCs to sponsor our spouses because of an unconstitutional law.

 

I have been shocked at how we have been abandoned by Immigration Equality AND the Democrats, both of whom have turned their attention to getting Latino votes in November and who care more about non-USCs than their own citizens.

It's been a little over a week since I've gotten NOA2 and I'm just wondering if I should call USCIS because I haven't received any notice of my case being shipped to NVC as of yet..

 

You can call as often and when ever you want.  I somehow found some kind of strength in calling once a day.  I guess it made me feel like I was doing something positive.  Of course it really didn't make any difference but it did make me feel less hopeless.  I say call not and call every day if you like.  You are paying for these people to do their job so call'em.

My Filipina wife is being given the run-around by the NBI in Cebu, Philippines. They are telling her she cannot get an NBI Clearance in her maiden name now because she is married. So they ended up giving her one that included her full maiden name including her mothers maiden name that was dropped when we were married. Let me explain.
Her maiden name was: Zoila Mae Acebeo Alburo. When we were married her name was changed to Zoila Mae Alburo Olsten, although that combination is nowhere to be found anywhere on our wedding certificate. In fact there is not designation on our Philippines marriage certificate that gives her married name in any form.
Her passport that she got after we were married reads Zoila Mae Alburo Olsten. The Acebedo name was dropped. The uncooperative lady at the NBI gave her one NBI Clearance only that reads exactly like this: ALBURO de OLSTEN, ZOILA MAE y ACEBEDO

Everything I read says the spouse needs 2 NBI Clearances, one in their maiden name and one in their married name. As far as I can tell the NBI clearance we have now is not good for either name because her name is not Zoila Mae Acebedo Alburo Olsten on any other document we have as of this date.
To review: Her birth certificate reads Zoila Mae Acebedo Alburo and her Philippines passport reads Zoila Mae Alburo Olsten.

So WHAT DO WE DO NOW? She is afraid she will be arrested if she goes back to NBI because she says the form asks if she is married and if she lies and says she is not she thinks she will get arrested.

My suggestion was for her to simply line up 2 times at NBI. The first time getting an NBI Clearance in her maiden name using her birth certificate and the second time using her new Philippines Passport to get a clearance in her married name. We were married in September 2012 and I have to assume the US government wants to make sure she has not been arrested under her new name.

Is the NBI clearance she got going to be accepted by the VISA people here or should she go and get two separate NBI clearances???? PLEASE HELP....

Our visa is moving along just fine so far. My wife passed her St. Lukes hurdle early and they made the proper notation in her passport.
This new question is regarding a girlfriend of my wife who also lives in Philippines. To make a long story short, her American fiance was advised by the attorney handling their marriage that he should swear out some kind of affidavit at the US Embassy in Cebu. The affidavit should state that he has never been married. Only problem was he had been married but had been legally divorced months before. But he neglected to bring any copy of his US Divorce Decree with him to the Philippines. The attorney advised them that the form requested by the Philippine government was merely a formality and there would be no problem getting the form, all he had to do was "lie under oath"? It was decided that there was no way for the groom to get his divorce decree delivered in time to have the wedding on the set date so the fiance and groom went to the embassy and managed to get the authorization to be married. Now the wife is worried that the papers between the Philippines Embassy and the US Embassy are going to clash. When they filed their I-130 the divorce decree was of course included. There was no hiding of the previous marriage. Now come the CFO. The wife told them that he had not been married because again if she had they wanted an original of the divorce decree. The wife completed the CFO class after 2 horrifying days. She received her certificate and was told to come back once she got her VISA. She is now concerned that the VISA contains all the papers filed with the US embassy. I have read that the VISA is simply somehow entered into the PASSPORT? Am I wrong? I mean it sounds to me like the two sets of docs are not going to cross paths. And it just seems that since the guy was legally divorced PRIOR TO THE MARRIAGE it just doesn't really matter? CFO ALREADY HAD THE WIFE turn in all kinds of papers before she got the Certificate of Completion. Does anyone know what the CFO does at this point? From everything I have read if the Filipina has the PASSPORT AND VISA the CFO personnel simply verify that there is a VISA in effect, compare it with the Certificate Of Completion and affix the CFO sticker to the passport or visa? What does a VISA look like? Is it several pages or is it stapled into or somehow affixed to the passport? This is one very nervous Filipina...are there answers out there.

Okay, so my spouse has gotten her NBI Clearance in Philippines. The report states: NO RECORD ON FILE. I have read here and there that she needs some kind of a letter of certification in addition to this NBI clearance from the NBI. Is this correct? Her NBI clearance includes a combination of her maiden name and includes her married name. On the form it says, PURPOSE: VISA USA.....does she need to go back to NBI for some kind of a letter in addition to this clearance? The lady at the NBI did not know what she was talking about when she asked for the letter. If she does need to go back to the NBI office exactly what does she need to ask for as far as a letter of certification goes? Please help.

I'm not sure why you moved this post? It really is not country specific as you suggest. It has everything to do with the US Embassy and really nothing to do with the Philippine government. I wish you folks would quit moving my stuff.  This is why I get so few responses. Think about it. I am asking if anyone knows if CR-1 applicants can make their own appointments at a U S EMBASSY.  Not the Philippines embassy. I would think this question would apply to all visa applicants that apply for a visa to enter the US regardless what country they are from.

If it's IR (Immigrant Visa) you can only use the ustraveldocs site if you have to RESCHEDULE an interview in an event that you can't make it to the interview appointment date that NVC had set up.  

 

Its really interesting this Visa Journey process.  The US Traveldocs site allows me to create a profile for my SPOUSE.  They ask if we are K-1 or CR-1. I select CR-1. No where on the site does it ask me for the missed appointment date or previously scheduled appointment date. Now, of course maybe common sense does not always work but why does the US goverenment allow me to create a profile and set an appointment date and time if they really don't allow this? I am so confused. Again this process does not make sense.

Yeah I thought so so I went ahead and scheduled the appointment on-line. Then I called NVC and was told that I cannot schedule my wifes interview, that the NVC must schedule interviews. One would assume that since the US Embassy had a web site and a way to create a profile that it only made sense that they would expect people to schedule appointments for interviews??  I mean I even selected where we want the visa delivered to.  So now I am wondering, if I go to Philippines to attend the interview with my wife will there be any problems. She has already completed her St Luke's Exam and they have made the proper notation in her passort.  After Embassy Interview all we need to do is go back to Cebu to the CFO to get the sticker placed on her VISA/PASSPORT.  (She already took and passed the class.)  I am a domestic violence investigator in Hawaii for the State and the stuff they are teaching at CFO is from 1940's, really outdated and they gave my wife such a hard time demanding more and more papers.  She had to go back three times, each time they asked for more papers, none of which were on the list of required documents by the way.  But she did ger her certificate.  There's a lot of a*s kissing that goes on in some of those offices.  Anyway thanks for the info.  Now I have you telling me it can be done and the NVC people saying it can't.  I wonder how I can be sure that my trip there will not be a waste.  It just seems like it can be done or why would the US Embassy have the web site and a way to do it??  Aloha and Mahalo

Okay so I made what I consider a major mistake. I made a typo on my wifes DS-230. Typed 2019 to present instead of 2009 to present under question 30.  NVC wants a new signed form from wife sent from Manila. Now waiting for newly signed document to arrive here in Hawaii from Philippines. Then I will send it on the NVC. Because of this error I found the US Embassy Manila website.  As I now understand it I can schedule my wifes embassy interview appointment. Even for CR-1.  So heres my thinking. I will have the newly signed document (DS-230) at NVC by Friday 05/03/2013.  NOTE: Due to my job....if I cannot go to Manila to pick up my wife before the end of June 2013 I might have to wait another 3 or  4 months before I can take vacation. So here is my question: Is there any reason why I cannot go ahead and schedule an interview appointment for say 06/03?  I am hoping that the NVC will receive and accept the corrected form within 2 weeks of receiving same. (By May 15) If they do can I simply tell them that I have already scheduled the Embassy interview in Manila and ask that they just send the CASE COMPLETE to Manila?  I understand that if you are unable to make your scheduled embassy you simply cancel the appointment on-line and schdeule a new one.  I have also read from other Visa Journey folks that the NVC take sometimes 2-3 weeks to contact the embassy just to set your appointment and then the appointment is anywhere from 1-3 months off from that date. IS THERE ANY REASON WHY MY THINKING IS FLAWED HERE? I mean the US Embassy Manila needs passport number, NVC case numbers, etc..for me to create a profile for my wife in order to set up the appointment.  We already have all the required information. It just seems like this is a logocal approach to saving more time. Does anyone know if this will work and does anyone know how I would request NVC to send the Complete Package on to the embassy seeing as I have already set up an interview appointment.  P.S. NVC says everything was okay will all documents submitted and the case would be complete if it were not for the typo.  What a bummer.  Can anyone help me with this?

Did they make a notation in her passport? Also I am almost sure that some of the medical reports are forwarded directly to the embassy.  I suppose this has something to do with security, what with all the fixers in the Philippines.  They did not give my wife back the passport photos.  I assume that is at least one of the items that were going to be sent directly to embassy. My wife was given an envelope. I did not ask her if it was a cd or not. I will ask her later when she wakes up and gte back to you. More importantly, the St Lukes personnel hand wrote a notation in her passport that she had completed and passed the exam.  The way I understand it is some papers are given to the patient and others are forwarded directly to the embassy.  I will get back to you on what the passport notation says and the description of the envelope she was given.

Okay we have good news and we have better news. It was probably a good thing that my wife and I both called St Luke's two days before her planned arrival in Manila. We were both told by a male staff member that all she had to do was provide an NVC number. Well as it turned out I received via email one more document the night before she was to leave for Manila. I scanned and emailed her a copy. Following is the page:

April 8, 2013
Dear Principal Applicant:
The immigrant visa petition recently filed on your behalf is now eligible for further processing at the
National Visa Center (NVC). You will need the following identification numbers to carry out the next
steps in the immigration process:

Your NVC Case Number: MNL2013XXXXXX
Your Invoice I.D. Number: 330XXXXX
Your Beneficiary I.D. Number: 332XXXXX

Keep this letter in a safe place.

You will need the identification numbers again during the immigration process.
The first stage of visa processing is to establish communication with the NVC by registering an agent
and your agent's contact information with the NVC. Your agent is a person you choose to receive
communications from the NVC on your behalf. You may act as your own agent, or you may choose your
petitioner, a family member, a friend, an attorney, an immigrant assistance professional, or any other
person you trust to represent you.
If you decide to register another person as your agent, the NVC strongly recommends choosing a person
with e-mail capability and a postal mailing address in the U.S.A. because postal mail delivery can be
unreliable in some parts of the world. If you act as your own agent the NVC recommends e-mail as the
quickest and most efficient form of communication.

Along with this was the i8nstructions to file for the CHOICE OF ADDRESS AND AGENT FORM. As you can see the above form provides three numbers. When the guard told my wife she needed her Embassy Appointment Letter she told him she did nit have one. She turned on her charm and the guard agreed to allow her in. Well, once at the US window the clerk there asked how she got in without the letter. She explained that she and her husband had called two days ago and we were both told by a male staffer that ALL SHE NEEDED WAS THE NVC NUMBER. THE US DESK CLERK THEN ASKED IF MY WIFE HAD ANY DOCUMENTS WITH THE NVC NUMBER PRINTED ON IT ALONG WITH HER NAME TO PROVE THAT SHE REALLY DOES HAVE AN NVC NUMBER. FORTUNATELY I HAD INCLUDED IN MY WIFE'S LAST MINUTE PAPERS A COPY OF THE ABOVE LETTER WHICH INCLUDED HER COMPLETE NAME, NVC NUMBER AND OTHER NUMBERS. The clerk looked at that form and said, okay no problem. So will we ever know if the US desk would have allowed her to the exam I guess we will never know. Here is her report on the services therein: She lined up at 4:00 a.m. outside St. Lukes. She said there were about 100 persons already in line when she got there. The guard began letting them in at around 6:30 a.m. My wife was pleasantly surprised to find that persons were divided into groups based on destination country. So my wife heading for the USA got the number 10. She got her chest x-ray first at about 6:45 a.m. She had completed all of her first days tests by 10:30 and waited for final instructions until about 11:00 a m. At 11:00 a.m. she was given instructions to return tomorrow morning at 7:30 a.m. for her immunizations, five (5) I think. They have told her that upon her return in the morning she will have her immunizations as follows: first shot on the first floor, second shot on the second floor and so on until she has her final shot on the fifth floor. Once she has had her immunizations they will have her stand by for a while while they finalize her report and when they have it completed they are going to give her something (not sure what) and she will be on her way. One word of caution, the medical expires in 6 months so if you believe that you Embassy appointment is going to be way off you might want to wait. I for one am very happy that we got the jump on this. Now when she gets her Embassy appointment we will not have to sweat the physical. So this is what happened. Oh and by the way. She said the staff had very serious face and acted very gruff, but she would smile and tun on the charm and as it turns out everyone was very professional, really no complaints. So in and out of the clinic in about four (4) hours. That was really great because she said she went thru 5 or 6 stations. Everything went very smooth, some waiting but it was understandable. Hopefully tomorrow she gets her shots and might be out of there by noon? Maybe earlier. If that is the case she can fly back home one day early. Does anyone know if Philippine Airlines will change her flight to an earlier flight? A day earlier. I purchased the flight and hotel thru Expedia so I am not sure Philippine Airlines is going to accommodate her wishes. I am sure we lose the hotel room but maybe we can save the return ticket?
