Right.. But you pointed out that someone in their own country should... Throughout their life... Not do something that is considered illegal in another country in the off chance you want to immigrate to that country in the future? I think that is their point... So the punishment of a ban for ever, in your entire lifetime EVER tried something (which might happen to be legal when you tried it in your country) would be a ban? Now abuse of any such things I think is a fair question... But having a ban for trying something, even if it had been 10-20 years ago, even if it was legal where you participated I think is a bit outrageous. I understand you have to follow the USA laws, however, reading into the future to anticipate that you will meet someone from a country where something that is legal,in your country but illegal in that country so you better not do it... Well that is an ability that nobody has...

Now with regards to the OP, we obviously do not have that issue since there was recent contact and a positive test..

 

But what one decides to do throughout their life is not based upon the possibility that they may move to another country, is it?  What one does in their life is determined by their character, morals, etc...yes?  And if someone admits illegal drug use how in the world does the US Government know that they really tried it once "when I was young and stupid" or they quit smoking weed 90 days ago so they would test clean?

Then, coming back again to how it is legal in some countries, you wouldn't be committing a felony. You did something that was perfectly legal in your community, in your culture. How is that a crime of moral turpitude? Or are you expected to follow the rules of the game for every country, because you never know which one you might intend to immigrate to, later down the road?

 

I mean, it's not like any of us has this dream, as a kid, to one day find an American fiance, right? Things just happen the way they happen.

 

You are missing the point.  It is not the country of origin that is allowing you to leave in as much as it is the United States Government (Federal) that is deciding whether or not you are allowed to enter this great country.  Marijuana use is illegal in the USA as per Federal law is concerned and the Federal Government is deciding whether you can come here or not.  End of story.

I say let them prove that you smoked pot.  No reason to admit it.  If there is no THC in your bloodstream or urine and no drug ocnvictions, it is done.

 

But the US does have a zero tolerance policy about drug use.  As some of us may remember, John Lennon got a one year ban from entering the United States because of a misdemeanor hashish bust in England.

 

 

I trust you are not suggesting anyone lie if asked the question?  If you are asked the question...and for some reason they ever find out you would be facing a possible lifetime ban.  What would anyone prefer?  I'd be honest and take the 1 year if it applied to me, but that's just me.

Does anyone know why the US is so strict on this issue anyways? Is it part of the war on drugs thing? Just curious.

 

 

 

I don't know, but obviously they've become more lenient (as you say, 3 to 1 years).  

 

I do wonder if they'll be forced to get even more lenient in the future (particularly for marijuana users) as there are states in the US now legalising usage - See Colorado for example (and many more with legal medical use already).  Who knows. smile.png

 

I believe the answer lies with the Federal Government.  The Feds have not legalised marijuana use, "so-called medical" or not.  States can decriminalize marijuana possession and/or use (like Colorado and California) but we know that Federal Law supercedes all State, County, local laws and ordinances. 

 

The Federal Government is in charge of immigration and their laws apply as far as illegal drug use goes.  It's really just that simple.  I don't forsee any change unless the Federal Government decriminalises marijuana and I don't see that happening any time soon.  Remember the immigrant is coming into the USA where the government (read Feds) has deemed marijuana use and/or possession illegal.  The laws of the immigrants country do not apply here either.  We must remember that we are dealing with Devil Weed, after all.

We actually agree on this matter.

 

I know you have an underlying distate for those that smoke marijuana. I share the same sentiments with you but as a health care worker I am morally flexible enough to consider that it might help certain members of the society. Do I wnat my train driver or pilot to be doped up? This is the moral/legal issue that we will have to consider.

 

In terms of the medical, guess what, the customer is the guy that is getting his blood drawn adn getting his body xray'd. DOS/USCIS is merely the recipient of the result, they are not the customer. They get to make the ultimate decision if the examined gets to come in the gate.

 

Hwo can we be good friends if we don't disagree once in a while and then make up after wards? What will we toast to then?

Well, it's also his job to question in such a way that is relevant to the intent of the medical, no? I agree that it is the doctor's job to find the truth and it could well be that the OP's fiance felt pressured into admitting something where there was no pressure at all. But again, I would think there's a difference in the way things are asked.

As for the legality of it, there's another issue to think about and that is that marijuana is legal in some countries, like mine (Portugal). So, you would not be breaking a law if you used it here. It would be tantamount to smoking plain cigarettes. I wonder if that influences the medical in any way as I have not done mine yet. I'm sure the people who use it here can't see into the future and see that one day they might be applying for a visa for the US. tongue.png
 


 

You're 100% right!  I am sure the doctor is supposed to ask patients if they have used and/or currently are drug users.  The patient replies and it is the duty of the physician to then report their findings.  Relevant, yes. 

 

As for legality it Portugal, it's irrelevant.  The laws of Portugal have nothing to do with US immigration laws.  Marijuana is, according the the United States Federal Government illegal.  It is the United States Federal government that is asking the questions here.  Simple.  The laws of other countries do not apply here at all.

FIrst and foremost it is his medical examination. He is a customer paying the Doctor (yes I know the embassy considers themselves the customer). He should have been an active participant in the medical examination.

 

Secondly, he wasn't prepared. He should have researched to fidn out what happens during exams in London. I researched for my Wife ad nuseum so that she can know what to expect.

 

This is not meant to flog the OP and her SO but as a guide for others to involve themselves in this process actrively by doing research. This immigration thing is a big deal and needs to be taken as such.

I disagree wholeheartedly.  The United States Of America is the customer.   These medical exams are designed to "help" eliminate persons from coming here that should not.  I paid for my wife's medical in Manila.  The physician there had a duty to report his or her findings to the United States Government.  The reason for the exam is to protect the citizens of the greatest country in the world.

GOD Bless the USA and let's all say a prayer for our brothers and sisters in the Philippines who have lost friends, family and loved ones in the most recent typhoon.  Thank God my wife's family survived, but thousands were not so fortunate.

The point here is not that he had previously used marajuana it is that the doctor pressured him to admit it when it was irrelevant to his future actions in America , just because he might have smoked some pot at university by no means hel be shooting up in America . His lifestyle did not include drug use and did not appear to look like there would be any future drug use so why would the doctor knowingly focus on it
The horrible thing is I lived in California for 2 years and they were the biggest potheads I ever met, all holding their little medical marajuana cards

 

The doctor wanted your other half to tell the truth.  The doctor was doing his job.  The doctor is supposed to ask the questions and he is supposed to report his findings.  He is supposed to examine the patient and this line of questioning is not unusual.  Whether your spouse felt "pressured" into telling the truth or not is irrelevant.  The truth is the truth.

 

And I never said your other half was going to end up being a junkie.  

 

And California potheads?  Yeah, you are right.  Medical marijuana, we both know that's a lot of nonsense.  But despite California's laws you must remember that marijuana possession or use of any amount is illegal in the USA as per Federal Law.  It is the Federal Government that oversees who comes and goes here, albeit they might be doing a poor job of it at times.

 

Now if your other half had simply said no we wouldn't be having this discussion.  I don't even want to think how a 1 year ban would have meant to my wife and I.  It would be heartbreaking so I will pray for both of you.  I wish you the best of luck.

You must remember.  You are wanting someone to be allowed to enter the USA.  In the USA it is against Federal Law (which supercedes any State, County law or local ordinance) to possess or use marijuana.  It is illegal, not cultural.

This is horrible, I would say well over half of perfectly healthy law abiding people have tried some kind of drug and it was cruel for the doctor to do that to him, maybe he hates his job and just wants to play with peoples lives, was it the Asian doctor by any chance?

 

Sorry, but I have to disagree with you.  You state, "Well over half of perfectly healthy law abiding people have tried some kind of drug."   Where did you get those numbers?  Perfectly healthy law abiding people, like my self have not, do not, and do not plan to ever use illegal drugs such as marijuana.  Marijuana is illegal, plain and simple.

Sent our I129F today....rechecked it 50 times before I finally sealed that envelope....and as I sealed the envelope all this waiting to file after 4 years has become so surreal....I was overcome by emotion...Didnt know weather to laugh or cry....I took a picture of the clerk at the post office holding my packet and was even tempted to ask the cute catholic nun in line in front of me to sprinkle some holy water on it or something lol....but as I walked away and left what is technically the determining factor of what our future and happiness will be....I prayed to God and said let your will be done....now Im at peace....AMEN

 

Amen.  Just remember many things will not necessarily make sencse on your journey but accept that you will overcome any possible obstacles and everything happens in HIS time.  God Bless, we will be praying for you both.  Oh and congratulations on your filing.

My fiancé filed June 2012 we received NOA1 exactly one month later and I do agree I think we may have been a few days out which is something we discussed after it was filed. I would rather appeal than reapply the process is so long and drawn out

 

If you were a few days out you were not eligible to file. It's that simple. You are not entitled to appeal if the error was yours.  The two year meeting is not flexible.  Sorry you are going thru this and sorry for the loss of your family member.

Maybe it depends on the airlines and time of year. Whenever I booked with United, I always noticed the round-trip was crazily cheaper than one-way. They do this to discourage people from turning up at the border on a visitor's visa with a one-way ticket. I think (at least for the VWP) you won't be admitted with a one-way ticket and the airline would be fined by CBP for your denied entry.

 

It's bizarro... When I picked up my wife in the Philippines the ticket counter agent asked why she only had a one way ticket.  I pointed out that she would be a new immigrant to the USA.  The ticket agent (Hawaiian Airlines) then looked closer in her passport and saw the VISA stamp.

 

But out of curiosity I have searched several times and never been able to find a round trip ticket cheaper than a one way.  I mean yes it is usually cheaper "per way" but always more expensive than a one way ticket.

 

I wish someone could show me an airline site where the round trip is cheaper, many have said it is but I have NEVER found this to be true.

I wish someone could show me how a round trip ticket can cost less that a one way.  I searched and searched and never found this to be true.  I know I have read dozens of times that this is true but I have never been able to find such a fare.  Maybe it's just me but I've searched all airlines, kayak.com, expedia.com, etc etc...

 

Help me out here, I'm losing my mind.  I would like to get this straightened out at least in my mind.

He said it was required so in the outside chance that they didnt get married, that she had airfair back home. Is this true? My girl is almost at the embassy interview point and I want to know what am I likely to need. She is in the Philippines and just took her medical.

Your friend is silly. You don't have to buy a round trip plane ticket.  I just picked up my spouse in the Philippines in July and we bought her a one way ticket.  Perhaps your friends bride did not have 100% faith in her decision before she flew?  Good Luck & God Bless

Alhumdulilah my fiancee got her visa approved and it has also been issued. 

 

I would like to thank everyone here who helped us through the process. This forum was definitely a big help. Those interview questions were very helpful and all other advices. I am sure I will using all the guidelines here for all the future steps until she becomes citizen.

Called DOS and was very quick. They said it was not received and won't be for about 4 weeks at moment so I'm going to call again next Friday as that's the 4 week mark for us.

 

You realize the people answering the phones just throw out time periods at a whim do you not?

Our file was sent to NVC on 12-17-13.so we are just about at 3 weeks.  I know there is no harm in calling too early, but is 3 weeks too early for the call to be productive?  I sent email one week ago, and i hear the turnaround time on that is 2 weeks.

 

If it takes another week or two that is OK.  I just dont want to be sitting on my hands while things are happening with our file.

 

The holidays have to slow things down a little bit.  After all, how many of us work hard at our jobs over the holidays?

 

So what it the consenus?  Call or sit on it for another week?

Was approved on December 20th which was over 2 weeks ago and was wondering if it's still too early to call NVC for case number? I know it was taking between 4 to 6 weeks for them to get it anyway. Also I'm the beneficiary so is it ok for me to even call them?

 

Yes it's okay to start calling.  I called twice a day until they had info.  Just always be polite, whether the employee there is or not.  If you get an employee that acts rude or is obviously not checking anything for you just be polite, say thanks, hang up and call right back.  It is highly unlikely that you will get the same operator.

I have talked to a lawyer about this cause he" thought" my boyfriend overstayed his last visa. Anyways the only way around that is you Have to go to his country and marry him. Then come back to the USA and petition for him here. You MUST prove extreme hardship without him here. Depression, maybe he is the breadwinner of the family you may have to see a doctor to claim depression for him not being here, etc... 

 

Sounds like more advice on VISA fraud.  I would not do this.

What?  You aren't suggesting that they should have lied about his illigal entries?  That would be VISA fraud.  At least now they know that they can try again in 10 years.  Had they lied I can only guess the ban would be even longer, perhaps a life time ban.

 

I'm sorry this has happened to you guys.  I hope you can stay together as a couple perhaps visiting each other several times a year.
