i just got confused as to when the vaccination will take it's place... is it during the medical examination schedule or it should get vaccination first in family physician before the medical examination and just bring the proof of all the vaccination that is taken?  thanks... 

 

Not sure about Armenia but all vaccinations required are included with the cost of the medical exam in Philippines.  If you have the immunations ahead of time you must make sure you have proof of them...  No one needs all of the vaccinations on the list, many are age dependent, etc... so don't rush off and get 10 shots...it will be a waste of time and money.

How relevant is the applicant's employment in the CR1 process? I am the applicant and have not worked for the last two years. My wife is the petitioner and she works only three to five months of the year. We are having my sister be the joint sponsor and she works full time in the US.

Will me being unemployed for the last two years affect our application negetively? Any views/experiences are welcome.

After paying the AOS and IV bills, I am finally ready to send the DS-230,...I just wanted to make sure that I have all the things in order for the DS-230. Here's what my packet contains -

1. Cover Sheet
2. Covering Letter with all details and contents of package.
3. 2 US Visa size photos with name, NVC Case number and Date of birth written on the back of the photographs
4. Passport copy (Biographic page)
5. DS 230 Part 1 & Part 2
6. Original Birth Certificate from Hospital and copy
7. Original Government Birth Record and translation and a Copy of both
8. Original Marriage Certificate and copy
9. Original Passport Office Police Certificate and copy
10. Original Local Police Verification Certificate and copy.

Please let me know if I am missing something....

Hi,
Either he could fedex the documents directly or he could fedex them to you and you can send them to NVC with your return address in the United States. But either way, you have to send all originals and copied of originals. Also search this site for the DS-230 cover letter and send that too. After paying the fees for IV and AOS you will receive the coversheets that must be printed and must go on top of each submission.

This is a terrible thing that happened.  I am from Laos and I know that people who sponsor music video are doing a good thing for the people in Laos.  The people in Laos are one of the poorest in the entire world.  Most of them have no work opportunity so having in opportunity to make some money using their singing or musical talent is not illigal at any age.  Do we not allow minors to audition for American Idol so they can become stars and make millions? I buy music CDs and movie CD made in Thailand and Laos because I want to support them.  I am sure other nationalities do the same. 

 

Accusing the OP for sexually exploiting minors because he is in the business of making Music Video in Laos is ignorant and irresponsible accusation.

 

Now what he is being targeted for is very serious and he should follow the advice of many on this Forum.  Get a criminal attorney not an immigration attorney to help you get out of this mess before thinking about going back to Laos.

 

Marrying a wife from the old country of Laos and brininging her here to the US is not uncommon within our community. Unfortunately there are families who take advantage of the situation to con for money. There have been many instances where young girls and their families have gone through marital engagement solely for the purpose of extracting money.  Some even engage their daughters to 2 or 3 at the same time and have the engagement celebrations at restaurants or places away from their villages or town districts so their neighbors cannot alert the poor fellow getting engaged that he is being conned.  Unfortunately foreigners have no legal recourse from fraud or being conned in Laos.  As a matter of fact during my first and only visit to Laos I was led to the left corner of the airport away from all other travelers and forced to pay a $10 bribe to the custom agents so they would let me out of the airport in Vientiane.

 

The fiance lied about her age, gave him their family registration book so he believed she was a legal adult, provided the altered documentations so he can get the Fiancee visa apllication processed.  Did he know of her age?  was he involved in altering the documents, did he lie to this forum?  There are too many unknown variables at this time to lynch this poor OP.  

 

Get an attorney and good luck in clearing your situation.

Spot on dude!  Most everyone here just assumes this guy is guilty of a crime with absolutely no evidence whatsoever.  While he could be, no one has been presented enough evidence to find this guy guilty.  And yes, I have heard about elaborate scams and multiple "engagements" also occurring in the Philippines and entire families being invloved.  So it is just as possible, or even more likely this poor guy was taken to the cleaners by this girl and her family.  Mahalo for your comments.

It looks like the girl lied to OP and USCIS, I don't know why everyone is jumping on him he already said the girl disappeared after she didn't get want she want she is clearly a manipulator and a user so its not unlikely that OP believed her originally. Other than the wanting to go back to make videos (buhahahahhahaha) that comment seriously just made my month, I don't know why people are attacking OP for sleeping with a minor just based on the information he has shared with us. ( Also when I was 16 I could have passed for 20 especially with make up.)

They are NOT going to write that concerns have been raised without a reason. SOMETHING has triggered this.

 

Yeah of course something triggered this.  It appears that the woman/girl falsified her age and name on Lao government documents.  There is no indication that the op was invloved with that.  And perhaps she is under the age of 18.  But we don't actually know that yet, now do we?  Concerns being raised...the word concerns.  This could indicate that they don't even know how old this girl is.  Many people in these countries have no birth certificate.  It is possible that she fabricated the entire scheme.  Is it not?

OP said "I make music videos" then he said "I sponsor their music so they can make a living". No wonder the State Department found evidence he violated the PROTECT Act. In my academic career I've done plenty of research on exploitation of minors and human trafficking worldwide. I know exploitation when I hear it. He can sugar coat or innuendo the hell out of it but it's not full grown Laotian women who are making "music videos" for foreign audiences.
 

 

The state department never said that they found evidence that he violated the Protect Act.  That is not what the letter says....  Why do you keep making stuff up?  So your brilliant academic career has made it possible for you to read between the lines and come up with guilty verdicts???  What stock should I invest in today???

After she was denied we broke up.. been 5 months since her denial and uscis haven't receive back my f129 application. What should I do.? Please help....!! This is what the email says:
We have completed the administrative processing of your case.  Our consular office is unable to verify the true identity of the beneficiary as she misrepresented and changed her identity on official Lao documents in an attempt to circumvent U.S. immigration law. As this information was not known to USCIS at the time of the petitions approval, the consular section has returned this petition for reconsideration with the recommendation that it be revoked. Furthermore, evidence also exists that raises PROTECT Act concerns which were not known to USCIS at the time the petition was approved.  The PROTECT Act is a federal law that enhances the ability of U.S. law enforcement to investigate and prosecute U.S. citizens and legal permanent residents for the sexual exploitation of minors overseas.  A victim as defined in 18 U.S.C. 2423© is a person under the age of 18.  Our consular office is legally responsible for reporting cases that may involve PROTECT ACT concerns to appropriate law enforcement agencies and has forwarded the information to our ICE and other law-enforcement liaisons in Bangkok.......

At this point what should I do.? Just found out that she was aftering the money and had no feelings whatsoever.

If this op is innocent I hope he is exhonorated, if he is guilty I hope he gets locked up.  He is just lucky that none of the persons making all of these accusations of guilt will not be on the jury (assuming there is ever anything that gets investigated) or he would be found guilty for sure, irregardless of the truth.  Remember, in America a person is innocent until proven guilty.  That is one of the reasons people want to immigrate here, it ties in closely with freedom.  It seems many have forgotten this.

That's a lot of bull.  Many Asian girls have a very young appearance.  My wife was 19 when I went to meet her prior to our engagement and subsequent marriage.  Before I ever got to her country I had her get her birth certificate, passport, etc... I took precautions where it looks like it is possible that this op did not, perhaps he was naive?  Depending on the way my wife dresses she can have the appearance of a woman anywhere from 15 to 25 years of age.  You can't say that spending a little time with a girl will prove their age.  My wife is very mature for her age.  If you talked to her you might think she is 25... so who are you to judge???

So visa approved, YAY, passport in hand, YAY, finace flying over next week...WHOOT WHOOT....

 

But can anyone tell me if, anything, needs to be kept from all the documents we have put together for this K1?  I have a copy and so does he, but is it needed that he has his whole file when entering POE?  Or at any time during the AOS process?  Trying to eliminate the need for such a heavy carry on for flight back.....

 

I went to the Philippines to attend the interview with my wife and we flew to the US together 12 days later.  We carried literally 30 pounds of documents with us just in case in our carry ons.  We wanted to be sure that she would not encounter any problems and we did not.  Just saying, you can never be too cautious, why take any chances?  Whats a heavy carry on worth to you?  You have a lifetime ahead.  Don't take any chances.

Salaam and peace, ya'll. I'm getting annoyed with the differences between embassies. Some K-1 visa holders can go the next day and pick their visa up at the embassy and others (like my fiance in Kingston, Jamaica) have to wait 2-3 weeks to get it delivered via DHL. There is no other option.

 

Is there something I'm missing here? I don't understand why the services offered aren't equal between embassies. They are all US government installations and USER funded entities so it's not like it's dependent upon the host country to determine the level of service.

 

I'm so happy we are approved but lack of info from Kingston coupled with their history of lagging behind makes me very uneasy. I just want an assurance from them that they are indeed processing it and not on "island" time, either.

 

It's been 5 business days and there have been no updates on my fiance's status. Nothing entered since Nov. 7th even though he dropped off his passport Nov. 12th. Just want to know they are doing SOMETHING.

Yeah you would think if they are all US Embassies they would all have the same procedures.....but then again that would make too much sense!  Our took 12 working days to be delivered 1/4 mile away from the embassy in Philippines. Don't make sense.

...and likely feel a heck of a lot better about it all.

So, some brief background. My fiance and I met near on 8 years ago now. We met up a few times over the years, more and more often as time went by, until we both came to the conclusion that we wanted to be together for more than a scant few weeks here and there. We wanted to be together forever. We wanted to be married.

 

So, in the spring of 2010, we filed for the K1 visa. And from there, things went sideways.

About a week after we filed, we found out that she was going to lose her teaching job at the end of the school year, due to cutbacks. We were both upset, but we knew it'd be easier to put our plans aside for a bit, at least until she found a new job. So, sadly, we had to cancel our visa application. We both hoped that she could find another job again soon. In the end, it took over 18 months. She finally got a new job in the winter of 2011.

 

After a few months of work rebuilding at least a little of her savings, we decided to restart the visa process. This was in the early spring of 2012. For a couple of months, we didn't hear anything. Our money had been cashed, but we had no NoA, no letter, no e-mail, nothing. We started making phonecalls, trying to find out what was going on. We kept getting the run-around, passed from person to person, with no progress, no details, no news at all. And eventually, every person we were in contact with stopped responding.

We tried supervisors, we tried lawyers, we tried her congressman, nothing was working. This takes us up to around September of this year, where we got put in contact with another supervisor. At this point we were pretty cynical, expecting more of the same. By this point we were both horribly stressed out, depressed and both fraying a little at the edges. But finally, at long last, we found someone willing to take the time and effort to help us. After a couple of months of work by him, we finally recieved our first NoA1 notification last week.

So to those of you stressing out, worried about RFE's and delays, I hope you can take some sort of Schadenfreude from our situation, and know that there are definitely some helpful people working there, even if you occasionally have to dig. And, on the slim off-chance that he reads this, my deepest thanks to the supervisor who helped our case. You've given us both a reason to smile again. Thankyou.

Yes.  I met her in Manila and attended the interview with her.  It was really advantageous that I was there because I am 37 years older than her and the US consul asked me more questions than her.  We had so much evidence in our hands and she never asked to see any of it.  She could see that we were truly in love.  When the consular said, "Congratulations maam, your VISA is approved" we both wanted to scream.  15 days later we flew together from the Philippines to Hawaii and my son who is 14 years older than my spouse was there to pick us up.  Thank GOD for all the blessings.  I pray that the both of you experience the joy that we are living now.

Salaam and peace, ya'll! BOTH of their visas were issued as of today! We are anticipating them being ready for pick-up by early next week. There is a possibility they could come here before Thanksgiving even or directly after; I don't think they should travel during the Thanksgiving weekend due to the volume of traffic.

 

So happy! Our CEAC timeline:

 

Nov. 1st interview, CO gave temp rejection while they adjudicated my foreign divorce

Nov. 7th created our account in CEAC, switched to "Ready"

Nov. 8th Called fiance to tell him to bring in passports for visa issuance

Nov. 12th Dropped off passports at embassy in Kingston, no paper or confirmation given

Nov. 12th his son's status was updated, kept at "Ready" but fiance's was not

Nov. 20th  both put into AP... getting close!!!

Nov. 20th fiance now updated to "Issued" but son kept at "AP"

Nov. 21st his son is now updated to "Issued" as well

I understand and feel your pain, I been away from my spouse for way to long. This might or might not help you, but this is how I kept sane in getting everything together and started. 

 

 

1. Walk- I walked 10 Miles every other day by the water (helps relax me)

 

2. Mind Blockers- Find something that brings your joy and do it. 

 

3. Mindset control- In my life business I teach my clients how, what and how they think become how they feel. That becomes how their life results to become. I know it?s hard, but keep a positive mental picture of you and your mate together here. 

 

4. Find a Visa Buddy- Find someone that has been through what you are going through to help and relate too.

 

5. Just Believe it is going to happen. 

 

 

Loneliness is one of the hardest feelings to think rational with, this is where having a mental picture and a visa buddy comes in at.

I sure hope you are wrong.  I remember a female that was having an affair with a Filipino "boy" and she got pregnant, all the while she was "engaged" to an American.  Poor guy really loved her and took care of her for 2 years.

So sorry this is happening to you.  On the bright side at least you know you can get an interview in January.  VJ saved me and my wife's sanity.  I spent so much time here on VJ just to keep occupied and keep from going insane!  It helped me pass the time.  Our process of 8 months was worth it.  By irrational decisions I hope you do not mean you are thinking about cheating because that would not be worth it.  My wife and I are together now and in hindsight the waiting was worth it.  If you are still in love do not give up.  If you are no longer in love then by all means give up and move on.  Either way I will be praying for you.  GOD BLESS

Some say I am over-zealous but here's what I would do.  I would type up and sign a complete set of all documents and take them with me or send them to my fiance/spouse for the interview.  It is possible, and has happened where USCIS or NVC has lost a page or two and they might ask for an original signed document at the interview phase.  This is just what I would do.  As far as I am concered you can never have too many documents.

marijuana possession (caught for the first time) is a misdemeanor offense in Wisconsin...equivalent to ditching school for a day. though, this is irrelevant to the beneficiary. maybe the CO will consider that marijuana is decriminalized throughout most of the U.S.

jamaica... currently in process to decriminalize, though I assume the beneficiary was cited while it was still illegal. however, possession (first time offense) is a misdemeanor in jamaica as well.
 


 

 

Regardless of how many states have "decriminalized" small amounts of marijuana that has nothing to do with it.  The Federal Government has not legalized marijuana use or possession of any amount, however miniscule.

 

So state laws do not apply as it is the Federal Government that decides if you can enter the good 'ol USA.

So is drinking under the age of 21 ... I dont think youmshoukd mix the decision tomuse marajuana with a question if morality, they are not equalivient... And as far as legality... There are MANY countries where marajuana is perfectly legal (and soon will be for all states in the USA)

I believe there Should be a statuette of limitations for what is included in the ban... Saying "have you EVER" tried marajuana to a 40-50 year old... Well that covers a LOT of time and what you did 20-30 years ago should not label you for life, especiallymifmwhat you were doing was not even illegal where you did it!

 

What you "believe" and what is "legal" in "other countries" makes no difference.  It does not apply.  And if I were a gambling man I would bet that the Federal Government does not make marijuana use legal in our lifetimes.  But that's just me.

Your preaching about the "morality" of pot use getting old.  In many places, pot use is not "immoral" or anything bad.

 

In many places in the US now, pot use is not immoral or bad, and is perfectly legal.  Perhaps in the near future it will be federally legal.  Just a few months ago same-sex people could not do immigration for their spouses, yet now they can.  See how that works?  The law is not always on the side of morality.

 

What would you have said during Prohibition?  That alcohol was immoral, and that anyone who had had a drink before Prohibition was a person of bad character? 

 

People who commit petty crimes are allowed to get visas, but people who smoked pot 10 years ago cannot?  Which is the worse offense?  I would go the the former, any day.

 

Marijuana use and possession is illegal in the United States Of America.  I am not preaching.  I am merely stating a fact.  I am done here because there are some that want the laws of other lands to apply here.

I'm not missing the point here, and it is a moot point by now for the OP as he tested positive. What I am saying is, creating a hypothetical scenario that probably has happened in real life, a person that smoked marijuana when they were a rebellious teenager, knowing that it was legal in their country, kind of like when a teenager drinks or smokes cigarettes or goes out to party - they're having a good time with friends and want to try something to feel more grown up. They aren't breaking any laws, They're not doing anything illegal. Sure, stupid maybe, reckless, but not illegal. Fast forward many many years down the road, they fall in love with an American citizen and get banned from entering the US because they happened to do something, way back when, that is illegal in the US. It just makes no sense to me.

 

We're not talking about someone who last smoked three weeks ago, or two months ago, or some such. I'm talking about years and years ago, something done when they were much younger, when their plans for the future didn't involve coming into the US. When they did something that wasn't even illegal, when it's been several years since they did it, why should they be barred from entering the US?

 

I don't disagree with the law, I don't think that marijuana smokers should be free to enter, I don't think the urine tests should stop. I do think that there should be some limit, like ten years for example, before which what you did shouldn't come back to bite you in the rear end (assuming all else is clear, obviously).

It is not logical, it it is not rational, it is what it is.

 

I would agree, there are many things along this immigration path that don't make sence but we must follow them, regardless of our personal feeling.

Show me the law and the country that allows "rebellious teens" to partake of marijuana. If in fact marijuana is legal in their country what makes them rebellious?  Yes it's moot for the OP but there could be others following this thread that need some information.  Is that not why we are here having a rational discussion hopefully helping others at the same time?  You can rationalize all you want but marijuana use is illegal in the USA...that's all that applies here.  End of story.

Right.. But you pointed out that someone in their own country should... Throughout their life... Not do something that is considered illegal in another country in the off chance you want to immigrate to that country in the future? I think that is their point... So the punishment of a ban for ever, in your entire lifetime EVER tried something (which might happen to be legal when you tried it in your country) would be a ban? Now abuse of any such things I think is a fair question... But having a ban for trying something, even if it had been 10-20 years ago, even if it was legal where you participated I think is a bit outrageous. I understand you have to follow the USA laws, however, reading into the future to anticipate that you will meet someone from a country where something that is legal,in your country but illegal in that country so you better not do it... Well that is an ability that nobody has...

Now with regards to the OP, we obviously do not have that issue since there was recent contact and a positive test..

 

But what one decides to do throughout their life is not based upon the possibility that they may move to another country, is it?  What one does in their life is determined by their character, morals, etc...yes?  And if someone admits illegal drug use how in the world does the US Government know that they really tried it once "when I was young and stupid" or they quit smoking weed 90 days ago so they would test clean?
