I heard 8-12 months on a CR-1 petition. I am in a process in gather all the necessary paper work. For I-130. can I send copies of everything

Jesse

You got married overseas.  You can't really be expected to have your wifes name on a lease, insurance, etc... I did open a joint bank account at Bank Of Philippines in both of our names.  Other than that is was marriage certificate, receipt for engagement/wedding ring set, plane tickets, passport, etc... follow the guides.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed info to file for a CR-1 for my beautiful and loving Filipina wife

How long do you think it will take to bring my wife here. I mean the whole process from filing to her receiving the visa. Thanks to everyone who responded. Thank you in advance for those who will answer my question.

Jesse

Jessee,

It took my wife and I eight months from initial filing to complete the process.  If it had not been for VJ it would have taken much longer.  If your wife does not have a passport yet have her get started on that right away.  Darnell gives good advice...read the guides and follow the instructions to a T.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed info to file for a CR-1 for my beautiful and loving Filipina wife

I met the love of my life last May of 2013 and I went back to the state on July 14, 2013. I decided to go back and not waste any time. This is the one. I have never been married before. So, on Aug. 4 i went back to the Philippines to marry the love of my life. Now, we are both miserable not being with each other specialy, we were together for 40 days, day and night.. We got married on Aug. 22. I went back to the US on Sept 14th which is probably the worst day of my life. Now, I decided to seek help here. I want to file a I-130 visa soon. Please give me some input. Im 51 and she is 24. We truly love each other. Do you see any problem with the age difference? I am Filipino but have been living in the states since I was 15.I speak Tagalog (Philippines language) fluently. Please, give me any warnings or roadblocks that we might encounter. Also, Any past experiences that you might want to give me. I desperatly want to have my wife next to me once again soon

Jesse

Jesse,  Congratulations!  I am very happy for you.  FYI: I am 56, my Filipina wife is 20.  At time of interview in Manila I was with my wife was 19.  The US Concular Officer asked me a really big question.  She said, "So your oldest son is nearly twice the age of your new wife?" (MY oldest son is 34)  I replied in the affirmitive.  After a few tense seconds the CO looked up at my wife and said, "Congratulations maam, your VISA is approved."  Now I have to say that I am not sure the result would have been the same had I not been present.  IMHO it would be best for you to attend the interview with her.  Some people on here might suggest that marrying and being present at the interview makes no difference but I would disagree, at least if the relationship is real it surely can't hurt.

One thing very important is the CFO class your wife will have to attend.  They can be real fussy about things.  They actually made my wife return a total of three times asking for more papers each time.  Just have your wife complete this process before the interview...the earlier the better.  Then when she completes the class she will have to return to the CFO to have a sticker affixed to her passport or she will not be allowed to leave the country, even with her visa in hand.

Good luck and I hope the two of you live happily ever after.

P.S.  My beautiful Filipina wife is here with me in Hawaii for a little over two months.  Last week we celebrated our first wedding anniversary.  I never would have predicted these events in my life.  I have to give GOD the credit because I would have never guessed that this would happen to me.  Check out our videos on youtube. You can see the CEBU engagement surprise, the Lapu Lapu wedding and more. Just Search David Olsten on youtube.

GOD BLESS both of you,

IR-1 / CR-1 Spouse Visa Process & ProceduresExact time to pay 165 $ fee!

Hi everybody, i have a simple question, your help is much appreciated

my wife was told during her interview to pay 165 fee  (few days) before her US entry day, her visa is issued 1 month ago, we still need more time  before we leave together to USA, probably 1 more month  when should we pay the 165 fee ? we still can pay this fee (few days) before the entry date ?not too much ? Because it will be 2 months since visa issuance date?

Thanks and good luck

I would recommend paying it while you are thinking about it.  You don't want to forget.  Of couse, you can pay it after you arrive in the US but I would pay it now.  I mean what if you run into some kind of trouble and run short of money? If you have the money now pay it and you will have no worries.

God Bless

IR-1 / CR-1 Spouse Visa Process & ProceduresVaccination records in maiden name

I just thought of something that probably has a very simple answer.

Can I use vaccination records with my maiden name written on them at the visa medical? Or will they think I have stolen someone else's records? tongue.png

I would assume its okay as long as you submit or bring along your marriage certificate and other id's that you have already changed, if any.  God Bless

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite NVC and US Embassy Interview Manila?

Hi, this jenny.  I would like to follow up on your case.  Did she get an interview on the date you requested on ustraveldocs?  Did they have all the papers from NVC, the one you filed to them?  We are also on expedite case since my daughter will turn 21 3 weeks from now.  I would like to know if they really look into the case and give us this early interview, since I haven't received any Instruction letter coming from them.  What do you need to bring just n case our file isn't there yet?  Thank you and I hope everythings' good on your side. God bless..

Jenny

Hi Jenny,

No, we did not get an expedite despite the danger involved.  But I am happy to report that I returned to Manila in July and she had her interview.  I attended with her and she passed.  July 21, 2012 we arrived togather on Maui.  We have since celebrated our 1 year wedding anniversary here in the USA.  We are so happy...all the waiting was worth it.  My wife is so amazing, she still loves her step-mother in spite of everything she has done to her over the years.  Her true mother died when she was 6 months old and her true father died when she was 2 years old.  She was taken in by a cousin who she calls her "mom".  We are so happy now and we wish the best for both of you.  God Bless.

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite NVC and US Embassy Interview Manila?

Is quite possible to get the expedite at Manila IV, so no worries there, I was just worried about time, timing, and 'the gap' ...

Ultimately, she can set up account on ustraveldocs web site, and get her own interview date set, at this stage (yes, even right now) but it will take some persistence,
and

worse case scenario - Manila IV won't have the casefile, so she'll have to show up with DS-230 and I-864 in hand.

Give it 24 hours, Manila IV is usually fast on turn-around back to NVC with 'the notice of expedite approval', but there's time zones, la.

Good Luck, and God Speed !

Darnell,

Thanks again for the info.  Believe it or not we already registered and set up an appointment for at ustraveldocs site.  We have an appointment date/confirmation of June 3, 2013.  As you mentioned my concern also is that the NVC might not have the case to USEM before that date.  I intend to meet her in Manila to accompany her to the interview and then close up accounts there, pick up Visa, have CFO sticker attached. (She already took and passed the CFO course. Has certificate of completion already in hand.) Of course I don't want to fly her up to Manila and myself there unless I am certain that she can be interviewed, etc.  She already has a complete copy of all the documents I have filed in her possession.  I also have a set which I am planning on bringing there as well.(I also have an original of every document that has been filed, by original I mean with my wifes and/or my signature.)  I am just praying that I can get her out safely before her aunt finds her again.  There is a true threat there and I want to get my wife to safety as soon as possible.  Salamat

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite NVC and US Embassy Interview Manila?

Studying yer timeline, yer just about done at NVC.

Now yer waiting on the interview to be assigned by NVC.

Once the interview is assigned, wait another 8 days,

and then, email the IV Unit in Manila and ask for an earlier interview date.

I say, at this point, chasing an expedite at NVC is pointless.

Getting an earlier interview date with the IV Unit, OTOH, is not.

But you have to wait a bit.

what have you learned about the casefile today, when calling into NVC Hotline ?

----

FWIW, it's actually cheaper to enroll her in nursing school and she live in the dorm there, even if just for a semester or less.  The security at most nursing schools is stellar.

Darnell,

NVC still has not opened the corrected DS-230.  The corrected form was delivered to NVC ATTN: DR via FedEx Overnight envelope on May 1, 2013.  I call every day (sometimes twice a day) and of course they keep saying I should wait 20 working days before calling them back.  Yesterday I did ask the agent when I had him on the phone if an Expedite request could be made at this point.  He said yes and gave me all of the instructions to do so.  Even though they do not have the final DS-230 in the system yet.  So I formatted an email exactly as he instructed and sent it in.  The4 next morning I awoke to a reply saying that they had received my Expedite Request and it was under review at this time.  I called NVC later in the day and the agent informed me that the Expedite request had been forwarded to Manila.  That Manila would have the final say in scheduling an earlier interview appointment if it is approved.  So for now we hold our breaths.  There are reasons that my wife needs to get out of the Philippines and they involve her personal safety.  I hope the Embassy grants the early appointment.  I tell you what.  Without Visa Journey and the fine folks like yourself here this process would have likely taken more than a year.  I used all of the shortcuts and shaved lots of time off of the mailing part anyway.  The hints of having all forms ready before certain steps proved invaluable.  The only thing I would add to the guides is the agent (me) should have at least two copies of every form that the beneficiary must have in hand that are blank.  This would be in addition to the completed and signed forms.  This way if a typo is made, like it was in ours I could have simply completed another DS-230 (if I had one with her original signature on it) and mailed it off to NVC.  That would have saved some money and at least 5 days in delivery of the corrected form to NVC.  Thanks for your help.  Mahalo,  David

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite NVC and US Embassy Interview Manila?

The next time her mom shows up, call the barangay or the police. That's the only way to solve her issues and to teach mom a lesson.

Oh I wish it was that easy.  But as you know the cultural differences are very  strong there.  Her sister, who is just one year older than her has told her she can never call the Police. And in thru Filipina tradition one can never question your older sister.  So unfortunatley the likelihood of this ever being reported is, well very unlikely.  P.S.  Ironically the Barangay Captain is my "daddy".  He was in our wedding.  A very nice guy. The first of 4 sets of God parents.  Due to my stupid mistake I have delayed this entire process for probably 2 or 3 weeks. I accidentally entered 2019 to present in her place of residence on form DS-230.  NVC tells me that once they receive the corrected form which should have said 08/2009 they will have everything they need.  Anyone have any idea how much time passes from the piont where they have everything and have reviewed to the case complete status?  And the embassy interview appointment? Is there a way we can simply request that the NVC expedite the embassy interview portion?  If so, who do I call?  Salamat po

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite NVC and US Embassy Interview Manila?

I have a question.  My wife is literally in hiding in her home country. Her family thinks she is in another city far away. Her mother has threatened to burn down the apartment my spouse was living in on two previous ocassions. As a result my wife has moved and changed her pjhone number 5 or 6 times since we began this visa process.  Of course her country being the way it is there are no Police reports of these threats.  I spoke to my wife and her sister who is a direct witness to these threats and they kind of laughed when I asked if they hasd ever filed a Police report.  As a result of these threats which my wife and I take seriously I have sent my wife away to a private boarding school and she is living in a dorm with security. (Very expensive and we are running out of money also)  My wife fears that her mother will hurt her as she has done so in the past.  My wife has the scars to prove the beatings she has suffered at the hands of this aunt who raised her.  It has been a tragic life but in spite of all of this my wife is an amazing young woman, so full of love and care.  I believe her "mother" has serious mental issues.  My wife has had to break all contact with this aunt and her "siblings" and "father".  I truly fear for my wifes safety and want to get her out of the Philippines before her mother again finds her and possibly harms her.  Is there a way for me to request an expedite? We are waiting on the NVC to open the last piece of mail, a corrected DS-230. Once they open this they will have everything they need.  Is there someone I can call at NVC to request an expedite so my wife can get an interview date in Manila as soon as possible?  Please help if anyone has any ideas.  I live in fear for my wife every day and pray that I will be able to pick her up before anyhting happens to her.  Can anyone help us on this?  Time is of the essence.  Mahalo

IR-1 / CR-1 Spouse Visa Process & ProceduresI-129F fiancee to I-130 spouse petition

Hello , Maybe this is a first of a kind , but any info will be greatly appreciated before i move forward with this process.

I filed 4 month back 129F VISA for my fiancee and we decided to get married in church 3 month later due to a religious tradition before we got the approval notice .

a week later after our marriage we got NOA2 approval letter and than NVC letter stating that our visa info has been forward to the designated consulate.

when contacted by the consulate ,My fiancee was upfront and honest that we have got married and they advised her to resubmit as married couple.

Now that we are married and no longer a fiancee , my wife is Pregnant and i'm in USA and she is overseas !!! what are the specific steps to do ? would form I-130 void the approved 129F ? would the Alien Number issued cause any conflict on the I-130 form ? Should i Email NVC and let them know ? is there any leniency towards processing time ?

any additional info will be nice to help restarting the process

Thank you

Hate to say it but you blew it when you got married in the middle of the process.  You will have to file all over again for a spousal visa. CR-1.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan I file for spousal visa while I-129F is in AP at New Delhi Embassy?

She did not deny the visa . She meant she needs more info before she can approve our visa petition.  She took his passport and gave us white paper saying its in AP. And yes, I am sure he was interviewed because I was present with him.

I'm sorry.  I guess I misunderstood you.  I am glad you were there at the interview.  I hope I did not upset you because that was never my intent.  I have read about many cases where an interview was wschduled and the spouse claimed to have gome to the 9interview but had not.  I am glad that is not the case with you.  It really sucks that they took his passport and have been holding it for over 9 months.  I will pary for you both. IR-1 / CR-1 Spouse Visa Process & ProceduresCan I file for spousal visa while I-129F is in AP at New Delhi Embassy?

So here is my story. I got engaged to my fiancé and filed for I-129F, after the successful interview, the interview lady told us that "there are no doubt about the relationship but however we can't grant the visa to you at this time". No additional documents were requested. They even took my fiancé's passport. We have not heard any response from them since the interview. It has now been more than 9 months of AP and his passport is still at the embassy.

We both are tired of waiting for their response and are thinking of getting married next month. This means we will be filing for spouse visa after we get married.

My question is, can I file for spouse visa while I-129F is in AP at New Delhi Embassy? Or do I have to withdrawal I-129F in order for me apply new spousal visa?

Or what are my options, What else can I do?

Any help will be greatly appreciated.

Okay this does not make any sense.  We need further info.  Why would she deny and then take his passport?  You say he had a sucessful interview?  Are you sure he interviewed? Are you sure this is what the embassy told him?  And if you go to India and get married it will effectively cancel the fiance visa and you will be starting all over again on a spousal visa if you get married.  Something is fishy here.  I hope not but is it possible that you are being scammed?  I am not saying you are but you need to check with the embassy yourself to see if he really attended the interview. I will pray for you.

IR-1 / CR-1 Spouse Visa Process & ProceduresDocuments Larger Than US Letter Size

My wife and daughter's Philippine birth certificates are larger than the standard US Letter size (8 1/2 x 11). So is our Philippine marriage certificate. I made actual size copies to submit with I-130. Is that okay, or do I need have them shrunk down to Letter size?

I used legal size paper so the entire certificates showed up.  Spouse from Philippines also.  Remember, you can NEVER have too many copies. Make sure you and she have originals in hand at the interview also.  I bought 7 of each while in the Philippines, all originals.

Good luck and God Bless you both

IR-1 / CR-1 Spouse Visa Process & ProceduresMy extremely bizzare and complicated process...

Hello well this is whats going on, bear with me its complicated...

I am US military stationed in Europe. Around late July 2012 I met my mexican national wife on POF.com haha. We talked up until November where she visted me in that month and stayed till January. She is a divorced single mother. She came back in March and stayed till April and in that time we got married by double proxy. She came back in May and stayed till August. I was able to get leave approved to visit her in Mexico a restricted country and visit her for 3 days in TJ. She is from Durango and we are not allowrd to go there under any circumstances unless she or my stepson were dying or her immidiete family. She and my stepson are her again with me now in December. We have a legitimate relathiomship. I provide for her and my stepson, we have a joint bank account and we stay togeyher as often as possible under European laws and when I can take leave. Im leaving in May and so am looking at doing my wife's immigration paperwork but im so confused. Obviously we cant live together for longer than 3 months because its illegal and she cant go to the United States with me.

I dont know what to do. I want to do the I-130s for them but it seems as though living together all the time is a requirement. That is impossible due to laws and now even viisiting is impossible because I cant go to Durango or Mexico easily becsuse that country is restricted to us and she cant come to me in the US. What should I do? What type of process am I looking at for my family? How can I be successful in immigrating them to the United States as fast as possible. She does not leave Europe until March and we are trying to do all the paperwork we can together and then I leave in May for the US. Help me please!

Ain't bizarre, ain't complicated.  Just read the guides...

But the instructions do not say one need to send the entire passport. It says copy of passport. I don't under stand the need to send copies of blank pages. No info is given by the blank pages. When requesting green card, they specifically say, front and back.

That's correct, a copy of the entire passport, blank pages cover and all.

Is it really true? I actually thought of hiring a lawyer n contacted one. He gave me all the check list of documents that i need to submit to him, also a joint sponsor check list. He didn't say that he will find a joint sponsor for us when i told him that we don't have a joint sponsor. That's y i'm doing everything on my own. Please let me know if some lawyer do that and give information about that lawyer.

Thank you

one more question, my husband never entered the United States, so he doesn't have form I-94. or does he really need one or have one?

A legitimate lawyer is NOT going to find you a co-sponsor.  That's just silly, unless of course you come across a crooked lawyer that will "arrange" for you to get a sponsor for a fee I'm sure.  But that smells really bad if you ask me.

I have a question not related to the AOS. My husband lives in Antigua (12) years but he was born in Guyana would his interview be in Guyana or Antigua which i think they go to Barbadoes?

Please start your own thread.  Mahalo

IR-1 / CR-1 Spouse Visa Process & ProceduresRegarding police clearance certificate

Hello,

I have got a question regarding police clearance.# Please somebody help.#

I was recently approved (IR/CR-1 visa) from USCIS and waiting for NVC case number. But when I went through some posts, I read that police clearance from all the countries that the applicant(beneficiary) resided is a must.#

My story is a little complicated as I was born in Saudi and when I was 5, I moved to India, stayed there until 2007.

Then moved to UK for studies and stayed there until 2010, then back to India.

After that, from 2012 until now I am residing in UAE.

Can someone kindly update me whether I need to get Police Clearance Cert from India and UK too, besides UAE (current residence)??!

My understanding is you must provide police clearances from all countries you have resided in for over 6 months time since the age of 16 years.  This is true for Philippines as far as I can remember.  Is it true for your neck of the woods I cannot guarantee.  So where are you a citizen of ??

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC TO SEND PROOF OF RELATIONSHIP [ QUESTIONS PLEASE ADVISE ]

i you want a Vice-Consul to make the time to review it, see the photos,

then it's best to include the photos

with the civil docs submission

for

the DS-260.

Having them on interview day is too late, the Vice-Consul only has about 4 minutes to make a decision on interview day, but note the casefile is inside the IV Unit about 24 days prior to the interview.

Darnell,

I dont think they have to include all 300 photos, do you??  I think that might be overkill... I would think 8-12 photos would be sufficient...

I can tell you what we did and it worked in the Philippines.  We got married in Philippines, took hundreds of photos of days before, during and days after the wedding.  When I submitted proof I had 8 photos printed in 6 x 9" format and included those with the application.  It was all that they needed as we got scheduled for interview at embassy in Philippines.  Of course I brought along our photo album I had made to the interview with my wife.  It contained at least 200 photos.  We had all kinds of documents and photos in a 20 pound bundle.  They never asked for anything but we had it if we were asked.  So just be prepared.

God Bless

IR-1 / CR-1 Spouse Visa Process & Procedureswhen is the best time to take vaccination?

St Lukes just told my wife to get her shot record from her Municipality in her home town just a heads up

Yes.. if you HAVE immunization records you should bring them with you.  Even then there is no guarantee that St Lukes will honor them.  For example if they were given by a particular smaal town doctor in a province setting they may not count those.

In my case my wife had basically received no "real" medical care or treatment in her life.  She was probably given some standard immunations along the way, in school, etc but there was no evidence of this.  The doctors at St Lukes simply interviewed her and determind what immunations she needed based on her age, history, did you have measles when you were a child, etc...

I had read the list of required immunations and thought that I had to get those for her before the St Lukes exam but learned from St Lukes directly that they will include any and all immunations she needs free of charge at the exam.  This is not the case for all countries but it is the case for the Philippines.

guys sorry it's only now i found out that i accidentally put armania inmy timeline instead of manila philippines....

charlynn,

Okay great Philippines!!  All immunations are included at NO EXTRA CHARGE at St Lukes.  Most people do not have medical insurance in Philippines so the free shots are the best bet.  My wife had no records of any immunations.  She went to St Lukes, they asked her questions and then based on her answers and the lack of any records they gave her all the necessary immunations at no extra charge.  As I recall she only ended up having like 4 or 5 shots.  Many on the list are age dependant so there were several that she did not need.

GOD BLESS

David

IR-1 / CR-1 Spouse Visa Process & Procedureswhen is the best time to take vaccination?

i just got confused as to when the vaccination will take it's place... is it during the medical examination schedule or it should get vaccination first in family physician before the medical examination and just bring the proof of all the vaccination that is taken?  thanks...

Not sure about Armenia but all vaccinations required are included with the cost of the medical exam in Philippines.  If you have the immunations ahead of time you must make sure you have proof of them...  No one needs all of the vaccinations on the list, many are age dependent, etc... so don't rush off and get 10 shots...it will be a waste of time and money.
