So I married my new wife in Philippines on September 22, 2012. We are waiting for our final marriage license to come thru to NSO. Can we begin process before she receives her Philippines Passport? And which visa do we want to file for? I am confused. Want to expedite matters but at same time want to make best decision. I have read about the K# and the IR-1 / CR1 and get more and more confused each time I read about them. Can anyone help out there?

My wife and I were married in Philippines on September 25,2012. My wife is attempting to get our Marriage Certificate at Cebu NSO as I type this. She has been there 5 times already and no one seems to want to help. We can't apply for her Passport yest because we do not have the Marriage Certificate yet. She already has an appointment for a passport application in about 3 weeks. We hope to have the marriage certificate in hand prior to that appointment. Can I begin the spouse visa process yet or do I have to wait until we have a the passport in hand? I need some direction here. Everything is so confusing I don't know where to start.

My Filipina wife has no immunization record at all. I found the list of the required immunizations and there are at least 14 shots required. I have read various things. Some say you should have all the immunizations before your medical exam at Lukes. Some say immunizations are included at Lukes. What is the truth? For example I know that I needed the Hep B vaccination to visit the Philippines and it required 2 shots at least one month apart. I have read that one should come to the medical exam at St Lukes with a complete immunization record? My wife is 19 and has no record of any immunizations. I have called Chon Hua Hospital in Cebu 10 times and no one knows how to obtain these vaccines for my wife. Can anyone help? I mean if she does not have the shots until she arrives at St Lukes wont that slow down the process of getting the exam results to the embassy? Should I get her the Hep A and B shots at least since they can take over a month in between? I mean what shots does a 19 year old need? Apparently no one at CHONG HUA HOSPITAL has any idea. I have spoken to 6 doctors already there and they say they only give the flu shot and pneumonia. What the heck? How do we expedite this process? Does anyone know a doctor in Cebu that can and will give all of the required shots? We just received our NOA2...when can she go to St Lukes? She will have to fly to Manila 2 times? Once for the medical and once for the interview? I am so confused and tired of all the lack of answers at the hospital. PLEASE HELP.

How much longer can we expect the process to take? It took 113 days from NOA1 to NOA2 for Post Decision Activity. Update says we are in the POST DECISION ACTIVITY phase. Is there any way we can assure that this does not get lost again? I think the only reason this got done was because I called a few days ago and filed an official request to find out the status of our application. Any one have any idea about how much longer before we complete the entire process? I miss my wife so much.

Looks like a cautious congratulations is in order lol... they didn't tell you to DO anything, they just said they put your stuff in the file. Call every other day or three for a status check.

Yeah we already responded to one of these that required a change on the DS-230 submitted. I have to assume that this is the document they are referring to. I have learned that I need not celebrate until my chickens have actually hatched because so much of this process makes little to nos sense.  I just hope I am interpreting this one correctly.  Thanks for the congrats and the reply! Here's what we did.  We provided an original along with a photo copy of each and every document every step of the way, USCIS and NVC.  The way I understand it is the Embassy will give you back the originals at the time of the interview, but they will only do so if you present the original and the photo copy together.  Then they even suggest that the interviewee bring an original and a copy of each to the interview.  Let's put it this way. I am providing them with an original and a copy of everything at every step. 

 

Then try to figure out why they have asked for a total of at least 5 visa photos already. What the heck are they doing with the photos?   I know 1 goes with the medical but you have to bring two there also.  My recommendation, PROVIDE ORIGINALS AS WELL AS COPIES OF EVERYTHING.  HAVE YOUR SPOUSE TAKE A VISA PHOTO and get 8 copies to make sure you have enough.  They are cheap anyway and you can't take one photo and another later because the PHOTOS HAVE TO BE THE EXACT SAME PHOTO.

My wife, now 19 never had a birth certificate as her mother died when she was just 6 months old and no one got one.  So last year September she had to travel to her province 3 times and finally got the birth certificate. She got 7 originals from the NSO on the correct original paper.  The question is this. I read somwhere that a Baptismal Certificate might be a good idea in a case where a birth certificate is never produced until just before beginning the VISA process.  She has a copy of her baptismal certificate that is dated at least 15 years ago. She thinks her church in Cebu can produce an original for her.  Is this is a good idea to get this to take along to VISA interview in Philippines?  Everything went trhu USCIS and NVC without request for additional information.  Should I have her go and get this?  ALOHA KE AKUA

1. If you visit the US for 6 months at a time, you'd then have to prove you still have a full time job, a house, a lease, SOMETHING that would make you want to go back to Canada after that 6 months. If you do not have this, you will not be allowed to enter or they will give you an I-94 with a set expiration date lesser the 6 months.

 

2. You need to stay in Canada while doing the I-130 spousal visa. Your wife will have to prove domicile...house, job, etc.

 

3. IF you decide to come to the US for 6 months and then AOS you are committing visa fraud. This forum is a forum for people who apply for immigration the legal way so when you talk about possibly committing visa fraud, it gets a LOT of people on here REALLY angry because we've all paid thousands of dollars to get our loved ones into the US and that is like peeing down our necks and throwing us to the birds because we did it the legal way. (Just saying)

 

4. You are looking at a processing time of around 8-10 months. Worst case.

 

5. This is my personal opinion but it seems as if you are around the immigration stuff for a few years in Canada. Doesn't surprise me it took them over 3 years with no answer. I'm sure this will get removed but it is so frustrating when people continually want to game the system when everyone on this forum providing the help and knowledge are spending THOUSANDS of dollars to do this the RIGHT way to make sure there is NO way their loved ones will get deported etc.

Stay in Canada. Keep your job. Keep your house/apartment. Visit on weekends. PROVE strong ties to Canada...via a job (letter from employer) house deed, mortgage, lease whatever you have for when you do come visit. Do not try to stay for 6 months at a time. Wait your turn like the rest of us. Don't risk being deported and permanently separated from your wife. That's so not fair to her. Not worth the risk.

Amen brother!!  I agree 100% with you.  It took me 8 months from start to finish to get my wife from Philippines to Hawaii.  We are together now and I have never been happier.  I also get sick when I see people gaming the system for years on end and then expecting us to help them conjure up ways to game it further.  I mean seriously who visits another country for 6 months??  Year after year?? I wonder what the percentage of "VISITORS" like the gamer here actually work for cash in the US, never contributing to the Social Security System or paying payroll taxes?  Of course I am sure this couple would never do that.  Give me a break!

I agree with the advice here as everyone does. But I just want to add that an annulment does not cost that much. It does cost quite a bit, but not as much as said here. Annulments typically cost around 5 to 8000.00 dollars. Around 300,000 pesos. Just thought I would chime in and give my .02 worth.

That may be but I know of a few Americans that had to pay off their Filipina spouses (and families) to get them to agree to the annulment.  It cost one guy well over a million pesos by the time he was done paying off his spouse, lawyers, government officials, etc....  Everyone there has an open hand and yes, almost anything can be bought there if you have the money.  Even annulments can be "purchased". The key word here is money.

It is really simple for him.  Have him check with his local state, county and city where his residence was when he married his wife.  They will let him know if he needs to have it recoignized prior to getting a divorce.  Once he has done this he can fill out an uncontested divorce papers for his the wife he married in the RP.   If he can afford to bring his live in partner now and their kids to USA then he can afford to do the above first.   This will make it clean and easy.   I knew a guy that married in the Phils.  His wife there cheated on him with another guy.  He returned to USA and had his divorce.  He then returned and did just what your friend is wanting to do.  DId a K! Visa and brought his new love to the States.

 

Wow that really would suck.  I mean having your spouse cheat on you. (Your friend)  But I did not know you could file for divorce from here in the US.  I was under the impression that there was no such a thing as divorce in the Philippines.  I had read about annulment and if you have enough money, 1,000,000 pesos or more you could essentially pay off the Catholic Church in the Philippines to annul your marriage.  Oh, thank God for organized religion. (Now that's an ironic statement)

The guy said he is still single in US Public record. The marriage of first wife NOT Registered in US. When the guy petition her. I think it will not track that he already married in Philippines.

 

Unlike the Philippines and some other countries the United States DOES NOT have a national database covering births, deaths, marriages, divorces, etc....  All the current wife has to do to ruin the new girlfriends life is to submit a copy of the Philippines marriage certificate to the US authorities and boom!  Bigamy!!  And that's Bigamy with a capital B!

The foreign guy should terminate the marriage properly if he wants to bring another woman to his county for marriage. It can really cause trouble to both of them. Irregardless of what country he was married, he is MARRIED. Period. The second woman won't be considered a legal wife because the first marriage is not terminated properly. It seems she is the mistress. if in case they wont be discovered immediately, later on they will and it might cause the woman to be deported and banned maybe for having a fraud relationship.

Okay, so don't you see something terribly wrong with this situation??  Even if he gets away with it what kind of a "man" is he?  And by the way.  A marriage in the Philippines is a marriage that is recognized worldwide, certainly in the US, thats for sure.  The NSO in the Philippines keeps very good records of marriages and I guarantee you his, well I won't say ex-wife because he is still married to her can get a copy of the marriage contract (from NSO) and make lots of trouble for your cousin in the future.  Wake your cousin up and ask her what the heck she is thinking.  What kind of a man marries, then splits with his legally married wife and shacks up with another, before being divorced anyway?  OMG!!  And by the way an annulment in the Philippines can cost upward of 1,000,000 pesos.  That's probably why he does not want to get the first marriage annulled.

 

Your cousin is in for a world of hurt if she packs up and moves off with this d*^@!he bag...

 27th sep 2013 i received a call from embassy. the person who called me asked about expiry date of my medical report (will expire on dec 11 2013) he asked that if embassy issued me a visa can i plan to move to usa before dec 11 i said yes then he asked me ok wait we will contact u in 15days 

now my question is what does this call mean?

r they really issue me a visa or investigate about me ?

I am not blaming his cousin because at the end of the day my now husband should have made sure what he was doing was right. Everything we have done since has been honest and legal.

 

I think what others are telling you is the US Embassy will not care if an outside influence (your husbands cousin) was involved.  They are just going to look at the documents submitted and decide if the answers to the questions were answered honestly.  I think everyone here is trying to be helpful.  I think the best thing both of you can do now is to continue telling the truth and pray for the best outcome.  I have a feeling if you are honest it will all work out in the end.  Just be prepared for some specific questions regarding this past VISA attempt and have answers ready...truthful answers.

Thanks.  It does look as if too many things need to fall into place for the visitor visa path to work.  In hindsight, I obviously should have started the IR-1 process a year ago but when I recalled how long it took 10+ years ago, I thought it would only take 3 or so months!  But times do change...

It's okay.  Don't beat yourself up about this.  Now you have some knowledge in hand.  Take it and run with it.  I can say our visa took 8 months, almost to the day from the date of filing until my wife and I laned in the good ol' USA from the Philippines.  And while it was very difficult it was all worth it. If it had not been for VJ I am sure my wife would not have been here so quickly.  Follow all the shortcuts and prepare your documents before they are requested.  You are headed in the right direction.

Thanks for that.  I also think the chances are slim.  Still debating internally whether it is worth it.  I suppose if she can get an interview in a month or less I'll try it.  Anything longer than that may just delay the inevitable for too long.

If I were you I would file for a IR-1 ASAP.  I'm afraid its gonna take 8 months or more but the longer you wait the longer it will be.  This is my opinion of course.  I wish both of you the best and will be praying for you.  Good luck my friend.

The POE will probaly not give her any problems, since she already proved to the Embassy she will return.

 

Unfortunately, all immigration officers at the POE make the (their own) final decision....this could be trouble.  She could get turned away and have to take the next flight back to her homeland.

I don't think I can. I'm residing in the US and I think a DCF requires you to be a resident (at least 6 months?) in the foreign country.  And if I did that I would not have the income requirements.

I am a USC and have been married to my wife (Ugandan citizen) for 12 years.  We have 3 children who are all USC.

 

She previously had permanent residency back in 2002-2006 but we have been residing in Uganda since then and basically forfeited that.

 

NOW...I returned to the USA 2 years ago and I would like my family to join me here but the IR-1 process of 8-12 months seems like an eternity!  As an alternative I was considering that my wife tries to get a visitor visa so that my family joins me quickly and while here I can start the IR-1 process.  If she is granted the visitor visa, she would not overstay but rather she would return to Kenya when necessary. 

 

To prove ties to Kenya, she is the manager of a company we run there (employment) and she also has a small business of her own.  She owns a car and rents a house.  She has an active bank account but not much money in it.

 

 

So I have a few questions:

 

1.  To what extent might the idea of coming with the children lessen her ties to Uganda?  As an academic arguement, would she have a better chance at the interview and POE if our children remained in Uganda?

 

2.  My father is suffering from Alzheimers and one of the reasons for their visit would be to spend some time with him before his condition degrades.  Would a letter from a doctor (I'm not sure if this is even possible) explaining his condition have any positive effect at the interview?

 

3.  If I do start the petition for IR-1 while she's in the US, is there any kind of risk in doing so?

 

 

I really appreciate any advice.  Being away from my family for so long has been torture and I really need to be with them ASAP.  But I also don't want to make a mistake.

I sympathesize with you but I think (IMHO) that the likelyhood of her getting a visitor visa is very, very slim.  I will give you lots of credit as you do not appear to be trying to "beat the system".  Unfortunately, I think you are going to have to file in the old fashioned way, IR-1.  Best of luck God Speed, and GOD BLESS you both.

I am a 22 year old Dominican US Citizen who recently married my girlfriend of 3 years on December of 2012 in the Dominican Republic. She is also 22 years of age. I love my wife and I am trying to bring her over to the USA to start a life together. I have the following questions:

 

1. Will our age cause any difficulty in the process?

2. What counts as Evidence of a bona fide Marriage?

3. What is more or less the TOTAL amount in expenses throughout the process.

4. Will i need to go out there for the interview/What is the interview like?

5. How long does the process take on average?

6. How long do i have to be working for Affidavit of Support?

7. What am I to look forward to or expect?

I understand your frustration.  I like many others have waited this out for so long; you are almost done!  My gosh, just a couple more months and you will be done and can be together where you want to be.   DON'T GIVE UP, PLEASE!  It breaks my heart that for all of us out here who wish to God every day that we were as far as you are, could even say "November" for anything!     

 

This process is gruelling.  You've been over so many hurdles to get so close and not finish this.  Many of us are just like you....my husband is in Japan.  I can't afford to go back to see him; I don't have the money to travel back and forth nor the time that I can take from my job.  He can't come here because of the obvious, but also because the Philippines is not on the VWP.  By the time we're together it will be over a year since we've seen each other.   

 

Remember this always for both of you:

 

God doesn't give you something He doesn't think you can do!   

 

DON'T GIVE UP....IT'S ALMOST OVER FOR YOU!!!

Well, i just worry about the sealed envelope!! , i know when the visa will expire automatically it will be invalid, and expired , like mark 88 he said after the expiration date i will keep the envelope i don't  need to give it back  to the consulat, i just want to make sure i understood well what he said about the stealed envelope

As far as I know the sealed envelope will become trash the day after the visa expires.  But if I were you I would hold onto it just to be safe.  God Bless and I hope you live happliy ever after.

You do not need to cancel anything even if you could.  Just let the visa expire.  You don't have to do anything for that to happen.  Just let the time go by.  You are not required to cancel anything.  Just let it go.  Don't worry about it.

Hi Jesse. I read about your story. My brother was the beneficiary for CR-1 and it took them about 12 mos considering they already have children ( twin daughter, 2 years old ), also from the phils and california service center.

About vonage, try to check if it could give you a pdf file instead of excel. We are on K1 application and already had approval though I am using magic jack instead of vonage. (We used cordia before however Magic Jack plus is better since I do not have to open my PC or laptop to use it and its cheaper). Cordia and Magic Jack provides pdf files and excel for call logs so I was thinking probably vonage also offers the same. We included the magic jack call logs as one of iur conversation evidence. We made sure to include the subscription/payment information so this supplements the claim of conversing via magic jack in your case via vonage.

 

I tried vonage and it sucked!  60% of time could not mconnect.  Vonage would blame Philippine provider (Globe) and Globe would blame Vonage. Never resloved so cancelled service.  Skyped 18 hours a day with video.  Can't go wrong with that for free.

Sorry im new here whats a CO. since I dont live long enough in the philippines, I can not provide a document like apt or lease. I did live at her parents house for 40 days and i am sure i am able to get them to testify in paper that I lived in ther house for 40 days with their daughter. The bank account I dont have her in it but I have docs that I have been sending her money for support. I have tons of picture and I catogerized it as Pre wedding, Wedding and post Wedding. I heard 8-12 months on a CR-1 petition. I am in a process in gather all the necessary paper work. For I-130. can I send copies of everything

You got married overseas.  You can't really be expected to have your wifes name on a lease, insurance, etc... I did open a joint bank account at Bank Of Philippines in both of our names.  Other than that is was marriage certificate, receipt for engagement/wedding ring set, plane tickets, passport, etc... follow the guides.
