My fiance' and I have prepared everything that we need to send our I-129f package tomorrow. I have read from 

Step-by-Step Guide on How to File for a K-1 Visa that we need to make TWO copies of the entire package before we send it in. Why is that? Is it okay if my fiance' just scan the paper works he filled in and email them to me instead of printing out the entire package?... what about our photos that he sent.. should he print 2 copies also?   

 

 

Here's my suggestion.  Make two copies of everything you are turning in. (2 complete sets of the entire package. Cover page an all)  Your fiance mails you one COMPLETE SET (just in case he cannot make it to the interview) and he keeps ONE COMPLETE SET.(In case yours gets lost in mail, etc... 

 

Also I learned the hard way, fill out and SIGN ORIGINAL SET OF DOCUMENTS leaving the date blank.  This way if something gets lost, needs to be changed in the event of an RFE or misplaced by USCIS or NVC a "NEW ORIGINAL" can be sent out quickly from the person closest to the US offices....

 

As far as I am concerned you cannot have too many copies.  Just my thoughts...

I am 100% sure about it . It's at the embassy right now and I did call them . They told me to go on the website and that I could cancel a K1 from there . I did not see where I could , so I sent an email . The Perdue oven popper has popped on this one LOL . I am so done with her and moving on . As the Muppets sang " Moving right a long ! "

 

Good for you!  I am so sorry this happened to you.  Don't give up on the Philippines.  There are thousands of women there that are serious and want to get married and live happily ever after.  You will be fine.

I do not feel she used me for the money . She made her choice to sleep with him and got pregnant . I made my choice to forgive her and work out our relationship . I believe she truly is in love with me , but things got so messy and became impossible for it to happen . She told me she hates this man and even hate is a feeling of love . She hates him for what she has done in her life . Perhaps her parents influence and desire to keep there grandchild in the country played some role in her choice . She knew all of these things , but kept them from me allowing me to think this was going to be a reality  . Did he steal her phone ? I really do not know and at this point it does not matter anymore . Its done and I am going to withdraw the petition .

 

With all of this I have met some very nice people . I met an older woman who owns a FIL AM market near my house . I spoke to her and she told me she knows someone at the department of state . She said she would help me start the process and do the things properly to withdraw this . She said she would most likely be blacklisted from the United States . I am not going to be vindictive I am just going to tell the truth .  I just want to end this and give that visa to someone else who actually deserves it .

 

Thank you all for the kind words and advice on my journey . I will most likely be removing my name or at least changing it if I can . If I do meet another I will be more careful for the next time . This one rotten egg will not ruin it for me nor shake my confidence about the filipina's  and their culture . I will find friends who know friends who can be more trust worthy . I have a kind heart and as you know this can get me into trouble , but I can not change who I am . I will just have more wisdom in the future about who I meet .

While I certainly agree that this is a sad and bad situation and I feel sorry for the OP, let's not confuse girls you might chat with a time or two and ask for money vs. a fiancée you are about to marry. Many guys I know who were in the k1 process sent their fiancée some sort of allowance. Of course if the girl said she needed 20k/month for food that would be a red flag. But a guy who wants to help the woman he is about to marry isn't itself a red flag.

O course in this case a scam seems likely.

 

I think you misunderstood me.  I did not say that an allowance is a negative thing.  In fact, I sent my fiance to a private school (for 5 months) where she attened English as a second language classes and she boarded there for safety reasons.  I had visited the place where she lived and I would not walk the streets alone during the day let alone at night.  I paid the school and dorm fees directly.  What I meant about the red flag was when a girl asks for money on the first or second chat...that's a bad sign.  Now of course there are many people in the Philippines that are literally hungry so in a way you can't blame some of them.  I have been there many times and I have seen the terrible poverty too many times.  My wife was raised in a squatter area and I could not even imagine living the way her family was forced to live.  But they had no choice.  I am 95% sure that this poor guy got duped by the 2% or 3% minority of the Filipina population that takes advantage of others.

Everything is so messed up now . I really feel that the guy stole her phone . he claimed she was there , but she was always out or he was . Then he said she is here now but is quiet . So i said just have her give me any personal things only she would know . Like our room number we stayed in or anything for that matter and it was never said . He claims she is his wife and has been for a year at least . That gets past the USCiS NVC or Embassy ? I guess if they did not do a back round check on her maybe . That would mean she was out for my money , but ignores my many pleas for us to set the interview . Thus paying nearly $500 for the 2 fees . Then the nearly $500 for the medical .  Other then that I gave her nothing barely $50 maybe every 2 months . Also just last week this guy sent me messages on my facebook telling me I can have her I do not want her .With no talk about her being his wife ! I contacted someone on her facebook and she called her and claims she spoke to her . She said to me she said this " I am with my BF " what happened to the Husband ? Now I have had her facebook account passwords and I checked it out once and she had my name blocked to a few people and that person I contacted was one of them . I do not know if that person has ties to the BF/Husband or not . Also while this guy has been contacting me non stop tonight . He sends me a message " OK babe I will be right home " and then says oops wrong txt sorry . They are visyan wouldn't it be in Visyan language ? Nothing seems to fit at all . If this is all just BS him trying to break us up or keeping his baby from coming here . I would hear from her at some point . I don't think this is me trying to grasp a hold of her still . It really makes no sense at all . Oh and the baby's name . She told me Isabel the guy says Cybell . Said Cybell Pernito Domus . Now my fiancee middle name is pernito , but don't they use the mothers maiden name for the middle name . Pernito being her moms maiden name . Tambis is my ex fiancee middle name , so would it be Cybell Tambis Domus ? OK if they are not married I thought the father name would not appear on the birth certificate nor his last name for the child .

 

What does make sense to me is that this is way way way too much for me now . BS or not I can not do this anymore . A year of just stress of waiting for Vermont then the transfer . Then she want to delay the visa interview . I just had enough and I am going to withdraw it this week .

 

Sorry man but just let her go.  It's for your own good.  There is something going on here for sure. And it stinks.  Why would she postpone the interview???...because she is not planning on coming to you.  The money you sent, did you see the medical exam results from St. Lukes? That is the ONLY medical facility in the entire Philippines that does these medical exams.  If you do not have a hard copy of the results and a receipt in hand it is highly unlikely that she ever got the exam.  Quit trying to figure this out.  It doesn't matter whether she changed her mind along the way or if she was scamming you from the beginning.  What matters is she got pregnant and is cheating on you.  It's over.  If she really loves you she will figure out a way to contact you.  The guy contacting you is probably her brother or a friend just helping her out.  Dude, the fat lady has sung.

Being a Filipina and knowing what kind of reputation we had regarding visa's, I made it my absolute rule not to accept anything from my fiance, except for the normal birthday or anniversary gifts. I wanted to really show him I am not like "those girls" that he heard about. This frustrates him until now because he wants to give me lots of things. They are right, her asking for monthly food allowance and all is a major red flag. Unless the guy forced himself into her home and stole her phone and he hacked her facebook, you should be worried why they still have contact.

I want to make one thing perfectly clear.  I was not singling out Filipina's as far as lies go.  I found a woman just like you that never asked for money and was always refused to allow me to send her more money than was absoultely necessary.  I have to say that Filipina's are probably 95% or more legitimate.  Unfortunately, there are a few bad apples that make everytone look bad.  I hope I did not insult you as a Filipina, if I did I apologize.

Sending someone money for food is not the norm. How did she support herself before you met, did she not eat? Never at any point before my husband arrived here did I send my him money, nor did he send me money. 

I would agree.  If a prospective mate starts asking for money that is a sign.  Usually bad. I had smany girls on line prior to meeting my one true love that asked for money on the first or second chat.  Guess what I did with those contacts???  I deleted them and blocked them.  And BEWARE of the my baby, grandma, granpa, uncle, mom, dad, aunty, cousin, sister, brother.....is in the hospital.  This is a commonly used ploy.  It seems this scenario has been passed from one generation to the next.  In my case I visited my girl before I ever sent her any money.  She never asked me for money, even after my first visit.  Believe it or not there is a web site that Filipinos often use.  It is a site where you can learn lies and stories that work.  You can cut and paste one lie after another.  You can make up a whole person that does not exist.  I am not saying that the Filipino girls are the only nationality that have a site like this.  I am sure they are available in many countries and languages.  Sad really.  I am serious, I have seen the site...I will not mention it here because as far as I am concerned it is evil.  I mean people share their stories and excuses like it is a joke.  It's really horrible.

I do not know what do now . I keep calling back and he picks the phone up and she has been at the market now for 1 hour and 40 mins . The last known message I got from her was 24 hours ago .  I saved the messages from him . When I do cancel I will write in detail everything that happened . For some reason I feel this is BS and he is trying to get me to leave her . I just do not want this to come back to haunt me if I even decide to do this again .

 

I can understand that you want this to be all the fault of the guy answering her phone.  And it might be...you will just have to take a wait and see approach.  I would suggest you take a deep breath and wait at least 24 hours before attempting to call her again.  Or maybe try every 7 or 8 hours, perhaps this douche bag has to go to work and she will get access to her phone again.  But you must remember this whole thing may have been a setup from the beginning.  I have heard about live in boyfriends that "allow" their girlfriends to go and stay with other men to perpetuate their scam.  While I cannot fathom how a man could do that it does happen, more often than we would like to admit.  She might be supposting him for all we know.  Whatever you do don't go out and get drunk or do anything crazy.  It's not worth it.  Find your best friend or family member, confide in them what is happening to you right now.  Ask for their moral support.  Be strong.  I know this is easier said than done but pray, pray, pray.  Whatever happens is happening for a reason.  I will also pray for you right now.

Death threats??  Not sure if you can prosecute someone in the Philippines for making death threats to you but if I were you I would do this for sure:  SAVE ANY AND ALL COMMUNICATIONS YOU HAVE GOTTEN AND MAY GET FROM HIM IN THE FUTURE.  Save them to cd and take photos of them if they are phone texts, etc...  I know of a case exactly like yours.  It involves a distant relative of my spouse.  She had a fiance in US and was running around with a male friend from college.  They were just "friends".  Of course the US citizen was paying for her college.  Long story short, she ends up getting pregnant from her "FRIEND".  At least in this case she had the integrity to inform her fiance of the situation. He wisely broke off the relationship even though he still loves her.  They are done and now it is the responsibility of the Pinoy to support her.  No more dreams of America for her.  All that is gone now.  She is destined to live out her life now in the Philippines....not something that she wanted.  Of course what has happened to you could have happened to you regardless where the girl is from.  Even if she lived around the corner from your house these things happen.  In your case it is difficult to know what to do.  Were you not paying for her phone and load?  You know this guy might be the father of the baby, that is assuming she even is pregnant.  The pregnancy could be part of the scam.  Perhaps she thought you would give up when she told you???

Just remember...there are literally thousands of wonderful Filipina girls out there.  I found one and she is with me here in the US now.  She has made me happier than I have ever been in my life.  She is devoted to taking care of me.  Not due to my insistance...she just does this on her own.  She is beautiful inside and out.  If your fiance cheated on you you proably are looking at trouble anyway so maybe God is ginving you a sign.  I say, Filipinas are raised to respect their husbands and my wife has been a testament to that.  I am sorry American woman but I find it hard to believe that I could have found a woman as loving and caring as my Filipina wife.  God bless the Philippines.

It COULD be a lie.  Could have been a scam all along I am afraid.  I hope you have not sent her too much money.  I have seen this happen before.  A Filipina has a live in boyfriend and gets all kinds of fiancees on dating sites.  She gets them sending money and taking care of her.  Asking for money for shelter, food, school, etc...  When you visited her did you suspect anything?  It's also possible that an ex boyfriend just happend to pick up her phone and he figures he can eliminate you by telling you a lie.  You MUST get ahold of her.  But try to look at everthing that has transpired so far as if you are on the outside looking in with an open mind.  Could it have been a scam all along or did things change, or is the guy answering the phone even involved with her/

 

So sorry,  life must suck for you right now.  I hope it all works out in the end.  I have one positive thing to say and that is the are thousands of good girls in the Philippines that are serious about finding a spouse and they can be the greatest women on the planet due in part to their upbringing.  So if this one was not the right one there are many more out there.  I believe that all things happen for a reason and if she did scam you there is another girl out there that yoiu are supposed to meet.

Aloha,  Yes I stood with her and we both got sworn in.  It was in US Embassy Manila.  Really funny part in our interview was the questions that were asked of me by the American Consulate...

1.)  So David you have any children from your previous marriage?

      YES, three boys, they are all grown up and live on their own.

 

2.)  So David how old is your oldest son?

      36 years old.

 

3.)   So your new wife is almost half the age of your oldest son?

       Yes, and he has made fast friends with his new 19 year old step mom on skype.

 

Then a few moments of silence and stress.  The American counsel had a big red pen and made x's over our marriage certificate and several other docs, I mean x's the size of the entire pages.  So now we are both sweating.  After a 30 second moment of silence the American Counsel says, "CONGRATULATIONS, YOUR VISA IS APPROVED."

 

Well my wife and I wanted to jump up and down but we managed to control our emotions.  But those were perhaps the best words we had heard for a long time.  The next great words were when we passed through immigration in Honolulu and the officer there said, "WELCOME TO AMERICA"

I am 37 years older than my Filipina spouse.  Of course this is very different than your situation in that we are dealing with very different countries.  And of course your age difference is the opposite.  I decided to marry her in the Philippines and went with the CR1.  I visited her three times in the Philippines in less than 1 year.  We had so much documenation and evidence with us at the embassy interview and low and behold no additional evidence was requested.  But of course we had submitted our marriage certificate, etc....

Hello, 

My fiance has his interview this week, and I want to make sure I have everything correct on the I-134. 

 

I've filled out the I-134 and attached 3 paystubs, a letter from my employer, and a print out of all deposits to my checking and savings accounts.  

 

My father filled out an additional I-134 to be safe, and included paystubs, and a letter from his employer.  

 

Is this sufficient information, or should we also include tax returns? (we are not self-employed)

 

The instructions didn't seem 100% clear on what was mandatory to include, just said "Evidence should consist of copies of any of the documents listed below that apply to your situation.".

If you and your dad are employed and as such file income taxes if I were you I would include them with the packet. Front loading never seems to hurt.  GOD BLESS.

Hi everyone,

 

My fiancé and I have been dividing our time between Singapore (business trips for him, college for me) and the US (where he lives and where I visit in between semesters). This year, I graduated in June and we spent the summer together in the US. Now that we are both back in Singapore, I sent off the required materials last week, and received my appointment letter a few days later- Oct 23 for my K1 visa interview. My fiancé leaves Singapore on Oct 31, and is looking to come back in early Feb 2014 for an important conference. My issue is that I might not be able to join him in Singapore if my AP doesn't come through before then (considering that we're looking at early Nov for me to get the K1 in hand). 

 

I still have a valid ESTA and think it may be a better option for me to not use the K1 yet so I could still leave with my fiancé in early Feb. He is planning to return from Singapore to the US in late March. As such, I would then likely use my K1 to enter the US in late March as well, although I'm not sure what other implications would entail (expired medical etc.). I would really appreciate some good advice on this matter. If anyone has faced similar issues, please share as well! smile.png

 

 

IMHO I would just stay put and wait for a few months.  Why risk potential problems?  It sounds like the two of you are coming along in the process.  Just skype every day and wait a little longer to avaoid any possible problems/suspicions, etc... In the end all the waiting is worth it.  Wahtever your decision I will be praying for both of you.  GOD BLESS you both.

Hi everyone

 

I am from Australia and am currently visiting my fiance here in the US on a B2 tourist visa. When applying for the B2 visa, I told the embassy that the purpose of my trip was tourism, and did not disclose that the primary purpose of my trip was to visit my then boyfriend, now fiance.

 

At the time I did not consider this to be a risk, as I had no intention of overstaying my B2. However, after reading some of the posts on here, it sounds like what I have done may impact our chances of getting a K1 approved.

 

Has anyone dealt with this situation? If so, can you provide some info? Anything would be great - freaking out a little bit!!!

Children Have Derivative Status

The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is long than one year from the date of visa issuance, a separate immigrant visa petition is required.

Remember that in immigration law a child must be unmarried. The stepparent/stepchild relationship must be created before the child reaches the age of 18.


Ok I am a little confused. We are doing the K-1. And now I hear from people that my son needs a visa of his own. He is 5 years old and my fiance (the US citizen) putted him on the !-129F.

Andrew would be receiving the letter from NVC...it will have your case number on it.......

I am not sure about your consulate but for mine........you need to complete the DS230 form and mail it back to the consulate...you should do that pretty quickly!!! My consulate schedules the embasy interview and medical appointment immediatly after receiving back the DS230.........

Ok I checked my online states a few days ago and nothing changed. It still said that it got approved may 15. (noa2)And nothing ever happened after that.
But today I checked my mail. And what did I find in my mail box? A nice big envelope with my what ever packedge of papers this is. From the consulate in amsterdam.
My heart is pounding realy hard. I am shacking over my whole body. I am so exited.
Hopefully I can concentrate and read the whole thing trough ;)

It must be really hard to be in your shoes right now...My wife is a nurse and I know how hard the work is. ...However the silver line just maybe that you found this side of your fiance at this stage and not after marriage and immigrating to the US. I imagine it would be a lot harder to deal with then. Atleast now you can dump this guy and move on with your life. You can send NVC / USCIS an email that you will not be participating in the immigration process because you have broken up and then not respond to any other communication from them. This way, at a later stage if you do plan to immigrate, you can have a record of the email communication advising the NVC/USCIS of your withdrawal from the process.

I have read about "red flags" :Things that may make the interviewer suspicious of fraud.  According to the source I read, me and my fiancee have three of those that they listed.  Although proof of our relationship was provided when filing the I-129f and my fiancee will have more proof of our relationship when interview time comes, should I be concerned?  Actually I am.

 

I will share my experience.  I met my now wife on-line on July 29, 2012.  I first visited her on September 15, 2012 in her country (Philippines).  I proposed on September 18, 2013. (Hired a video production company to video the event and take hundreds of photos)  We were married in Philippines on September 22, 2012. (Hired the same video production company to video the event and take hundreds of photos)  Five photos of both the engagement surprise and the wedding were included with the CR-1 application.  I flew to Manila to attend the interview with her at the embassy.  This trip was my third trip to visit her.  The CO asked me more questions than they did my wife.  A total of eight months almost to the day after our application was filed we flew to the US together.  By the way did I mention that she was 19 at the time and I was 56?  So talk about red flags???  We had no problems.  I am sure you guys will be fine.  Wanna see the video's?  Search youtube for David Olsten Best Ever Surprise Marrriage Proposal In Philippines 9/18/2012.  You can even watch out wedding!

Hi guys.. I saw a topic about this but now I can't find it. So my fiancé called nvc to ask for the case number. The person on the line asked for my birthday so he said it but she said it's incorrect. But he said it correctly. She said our case is already in Manila. What would I do?

 

Have your fiance call back and ask someone else.  He will likely get a different response.  If that doesn't work ask for a Tier 2 representative.  Good Luck and God Bless

Well, I officially do believe in miracles and there IS fairness in life:)

We were advised that docs will be sent back to US and USCIS will review the denial reason in 120 days. I made a decision not to wait and go ahead and fly to Azerbaijan to marry my fiancee and apply for a Spouse Visa. I got all documents ready, the only thing we were waiting for was marriage certificate. The problem I had was that In order for me to get married here, in Baku, i need a paper from US that i have never been married before and eligible to get married right now. I had gotten that paper and had it notarized and everything but i forgot it at home when I was flying from US to Azerbaijan. My step-dad mailed it to me here, but it got lost on the way here. As a result we missed our registration date, which was Sep. 27th, as they needed that paper. Since we missed that registered date, we had to wait another Month to get a new date. Well I found a way how to do it without waiting a month. My step-dad overnighted new needed document and i got it this morning. We took the document and rushed to the translation center where they would translate and certify needed doc. and then we would be on our way to get married.Right before we walk in to the translation center, Kristina gets a phone call as we walk and suddenly stops and becomes WHITE. It scared everything out of me as I thought somebody passed away or something. and then she states: "Visa got approved!" then I become White too. They said they reviewed our case and decided to approve her fiancee visa. If they called 2 hrs later we would be married and Fiancee visa would be expired.

We already sent a passport to Us Embassy in Georgia and they said it will take them 10 days to provide a k-1 visa. I will be returning to US with my baby. We cannot believe this! Everything happens for a reason. If I didn't forget that document when I was traveling to Azerbaijan, it would have been too late and we would have to wait forever before we meet again.

We think one of the reason they reviewed our case again is that I went to US Embassy in Baku and asked their help to get a new document that I am not married. So US Consular in Baku talked to me personally. Maybe they have centralized system where they saw that I am planning to get married. I have no idea. that is the only explanation.

 

Well, there is my short but super happy story.

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-129F "Proof" Pictures Submission - Format?

Good afternoon, all!

We are about to finally finish our I-129F and I have attached our 57 or so pictures with double sided tape to white paper, then labeled the pictures clearly with names of all in the pictures, what is happening in the picture and where the picture was taken. I also put a heading at the top of the page and wrote my (petiitoner's) name and that it is I-129F. This way it's easier to see which ones go together; ie "Family retreat" etc.

 

I did this because I read it on visajourney somewhere, but I've now read that others have submitted the pictures in a clear plastic bag.

 

Can I leave my pictures as they are or should I change the format? Thoughts? Thanks in advance!

 

5 or 6 photos is enough. Don't give them more than they need.

We are makng our decision to go for the K1 visa this month but we do have many red flags in our story. One of them is that we have 16 years age difference. I (27) Egyptian am younger than her (43). We have been for one year and 2 months and she came for a visit 3 times and the last one was with her 2 kids  ( a boy (4 yrs) and a girl (6 yrs) ) and they look pretty much like my kids although I don't have any yet. Now I see some cases has been declined or denied because of their age difference although its illegal but they do look for reasons and sometimes it doesn't make the case seem legit for them.

Now my question is how do I answer their questions about our age difference in a good convenient way?

Oh one more thing.  The CO will NEVER admit that they are denying a petition based on gae difference.  They just won't tell you why they are denying.  And by the way.  Talk about age difference I was 56 at the time of my spouses interview in Philippines and she was 20.  We were not denied but then again I was present at her interview.  The CO asked me more questions than my wife.  But I believe my being there helped because the CO could see I was real.  And I believe she could see that we were so in love.  But in your case the female is older than the male.  That is not so common, even in the Philippines.  But much younger Filipino females ofter marry older Filipino men so it is accepted in their country.  Is it accepted in yours?  Good luck and God Bless you both.

So I married my new wife in Philippines on September 22, 2012. We are waiting for our final marriage license to come thru to NSO. Can we begin process before she receives her Philippines Passport? And which visa do we want to file for? I am confused. Want to expedite matters but at same time want to make best decision. I have read about the K# and the IR-1 / CR1 and get more and more confused each time I read about them. Can anyone help out there?
