I had asked this question a few weeks ago but no one answered it.  Now that our interview is only 3 weeks away I want to ask again just to be sure.  My employment letter is from late August.  I thought the NVC process would be really 3 weeks as per the letter but little did I know.  Anyways, should I ask for a new letter from my employer to have it more recent or will the old letter with current pay stubs be sufficient.  I will also be providing copies of my last couple tax returns.

If I were you I would ask my employer for a new letter and I would bring all the paystubbs I could as current as possible along with me.  This was you will be prepared.

So my fiancée and I have been preparing the I-129F Package, and have more or less gathered everything, I (the foreign, non-US Citizen part of this) have prepared a signed copy of my G-325A (might make a second one just in case something should happen) and passphotos for her to have, is there anything else I should send along while I am at it? or Is the G-325A and the passphotos the only thing needed from here.

Why is this process so inflexible and inhumane? 

 

I spent three years going in and out of her country at will.  I served my country as a Peace Corps volunteer for over two years, have waited one year for my fiancee to be able to come over and marry me.  And it seems, that as my wife, she still won't be able to come visit me without first waiting for over another year.  Sometimes I really hate the US government!

 

Before you go off the deep end perhaps she needs to rethink her schooling.  Could she not wait until the second semester and return for that?  Just seems to make sense to me.  This way she can come now and stay until she is allowed to exit and re-enter the country.

Another option which I took is, once you arrive, rather than cancel the ticket - postpone to a much later date - up to a year away. That way you can always use for a trip home. I travel back to the UK several times a year since I arrived.

I decided to by a one way trip and found a really not expensive ticket between Xmas and New Years Eve. I jumped on the occasion and booked it with Opodo.fr. 

On my confirmation receipt: everything is fine, it is considered as a one way ticket. But on the itinerary, the company booked me a round way trip with a flight back home that I have never asked for... Of course, I called the booking company to understand why they booked me a round way trip and not a one way trip like I ordered. The nice customer service guy told me on the phone that they booked me a round way trip in order to provide me the lowest price, the only thing I have to do is to not take the plane back home. 

 

Do you think it could be an issue at Port of Entry?

Hello, in the excitement I forgot to include my payment in our initial I-129F form.  I called FEDEX to have them retrieve it before delivery, but lets just say FEDEX dropped the ball and lied about having the package.

 

Now it has been delivered and I don't want it refused or thrown out, what should I do?

 

Everything was clearly filled out, just that one piece very important piece I just forgot.

I am really sorry this is happening to you but I think you are going to have to wait for USCIS to return the packet.  We all make mistakes and unfortunately I think your error will result in this taking more time than you wanted but it will all work out in the end.  Don't beat yourself up over it.  We will pray for you both.

Hello all. My fiancée Kelly was approved in May. I had just lost my job so I planned to wait a few months before bringing her to the US. When I didn't find a job by October I decided to come to Colombia this week to get Kelly before her visa expires. I thought since the interview was May 29th the visa expired on November 29th, 6 months later. I bought our plane tickets for the flight to New York on the 24th. I just realized today when I looked at Kelly's visa the visa expires on the 23rd! Will Kelly be able to travel on the 24th or do I have to change our flights to the 23rd? Thank you for your help.

 

I would change her flight to the 22nd and quick!  The 24th might be too late depending on which bozo is checking her into the US.

Your petition will be denied if you don't.

Not so sure if this recommendation applies to Philippines.  They want to see that yhe two of you jhave sepnt significant time together, not a few minutes at an airport. IMHO

You can't apply for a spousl visa with someone who is not yet your spouse.  He can visit you and get married to you but you will start process all over again as a CR-1 visa applicant.

You MUST meet within 2 years...no exceptions.  Answer: Meet each other and document evedence of a bona fide relationship.  Do not waste your time and money applying at this point.

Aloha.  I don't think you have to fear a lifetime ban.  That is highly unlikely.  But the non US citizen attempting to come the USA at this point is not something I would do.  I just would not attempt that at all.  But many here have accused me of being a doom and gloomer but I always play it safe.  Used to be a Boy Scout and I believe in always being prepared.  As a result of planning and preparedness it took us just under 8 months from start to finish on a CR-1 VISA landing together in the USA from Philippines.  Not bad time thanks to VJ.  I left the US and visited my wife three times in the process.  I didn't even consider attempting to bring her here before we had our CR-1 because of all the advice I was given on VJ.  Why take a chance when I could go there?  So the sacrifice of my wife not visiting all paid off as far as we are concerned.  We are together now and I have never been happier in my life.  My wife makes me laugh and smile until my face hurts.  You can get through this and you both will be fine.

I am from England I was refused entry in accordance with section 217 in May 2013 this was down to me and my American fiancée saying we were going to get married whilst I was using a VWP. I know this wasn't the greatest thing to say but neither of us had a clue about the visas we needed. Anyway in my sworn statement it said before I was allowed re-entry I would have to apply for a fiancée visa. We have now started the process and have received our first NOA and RFE. I was just wondering in the meantime while this is going ahead is there any chance I would be able to use the VWP To visit my fiancée for a holiday as the processing times for the K-1 are around 6 months and we want to see each other.

Anyone got any ideas or have been through this experience?



 

The odds are against you considering you were already refused entry to the US as well as while you have a K-1 visa in process.  But who knows...  Of course you would be taking a risk of being denied entry again and the expense of airplane tickets is to be considered.  Good luck and God Bless

My fiancé had his interview on Sept 30, 2013. When he finally got to the interview window he was asked a few questions:

 

What is your fiancé name? Ans. My Name

When did you meet? Ans. 2009

When did you start your romantic relationship? Ans. 2010

When was your fiancee divorce? Ans. 2012, however they have been separated for over 10 years.

What is your fiancée religion? Ans. Christian

What is your religion? Ans. Hindi

 

The interview walked away briefly, came back, and gave him a piece of paper that basically said our petition was being returned to the USCIS office for review and possible revocation. He did not say why the petition was being returned, however, I guess it has something to do with my divorce becoming final in April 2012 and immediately getting engaged, June 2012. USCIS approved our petition and enclosed in our I-29F application were a copy of my divorce papers.

 

All of the answers my fiancé gave to the interviewer were true. My now ex-husband and I have been separated for well over 10 years and in fact we have not even lived in the same state for 8+ years. He didn't bother to look at our proof of relationship, he asked no further questions. 

 

I am real upset over this and I just don't know what we need to do next. 

 

Any assistance or advice you could offer would be greatly appreciated. crying.gif

If you send it through USPS you can send it to the Dallas address. The Lewisville address is for couriers such as Fedex, UPS, and other express couriers. These companies cannot deliver to a PO Box. Priority mail is plenty fast. Express mail costs way more and might get there one day sooner, if not the same time.

Plain manila envelope could be a HUGE mistake.  The postal workers, electronic readers all look for the white postal envelopes and THEY ARE FREE!!  Why buy a minila envelope and have it get passed over?  USPS is designed to use there envelopes.  So maybe you can save ten bucks...is it worth it?  Spend the lousy 10 or 15 bucks and use the USPS envelope.  This is of course my humble opinion.

Use a USPS envelope.  I used EXPRESS MAIL.  Go to the Post Office in your area.  Don't drop it in a box...?  Make SURE you get a TRACKING number.  This is critical.

Hopefully, one day all this paperwork will be over and we will be united with our loved ones.

 

I know that the rule is, that we have to get married within 90 days. My question now: Is it okay and "enough" to get married by a judge right away after I arrive in the US, let's say two or three weeks from when I arrive and then have the real big wedding ceremony etc two months later?

 

I am asking, because I am hoping to get my visa by April and then I'd love to fly to the US right away and we'd get married asap so that I can apply for adjustment of status and I could hopefully get my permition to work by end of August so that I could start to work as a teacher when the new school year begins.

 

That's why I wanna get married asap but without any time to plan, it is hard. Plus: I really want my family and friends to attent the wedding. And they would need some time to plan their vacation, book flights, take off and so on.

 

So that's why we are thinking about getting officially married right away, with just two witnesses and then plan everything and have the wedding in August.

 

Do you think that would cause any problems? Could they say that we weren't serious about the wedding in the courthouse maybe? I am only worried about the interviews for the adjustment of status and the Green Card.

 

But that way,it would solve to many problems and take away a lot of pressure smile.png

As long as you are legally married within the 90 day time frame you are fine. In fact you could, I guess, at least in theory get married 27 times if you like.  Just make sure the first one within 90 days is legal and binding.  Happy Weddings!!

So hey everyone...I have been searching for a place that could give me some much needed answers and advice...and I think I finally found the place. Yayyy smile.png Okay here's the story (I'll try to keep it short lol) A few years back I felll in love with this wonderful guy from Nigeria.....he was attending school in London and I went to visit him a few times there. While on my last visit he proposed and we were all set to plan a wedding....then suddenly things took a turn for the worst and due to  distance and frustration of my work schedule and his school schedule constantly conflicting we seperated and stop talking sad.png While seperated a year later I met what I thought was another great guy from Ghana (Who came to the USA on a tourist Visa and lived in Chicago during his stay) and instantly feel head over heels.....He propsed to me within only 2 months of dating and stupid me *I already know no need for bashing sad.png * went and got married to him, only to find out he only married me to get his papers.......I was so pissed at the idea...I immediately broke things off and filed for a divorce. Meanwhile, guess who was there to support me and be by my side the entire time (MY EX from Nigeria) he was so caring and understanding and the experience drew us back closer together. A few months later after filing for the divorce me and my Nigerian love have been planning our lives together. I know for a fact this is the man that i want to spend the rest of my life with, but i know it will be hard to explain this to Immigration (seeing that he does not have his papers either and I want to apply for a K-1 Visa). I never applied for any type of documents for the guy from Ghana....but I want to apply now for my fiance that is from Nigeria. On the G 325-A (Biographic Form) & the I 129-F (Petition For Alien Fiance) it asks about Prior Spouse info such as when the marriage started and when it ended (The marriage lasted approx 2 months and we seperated but we couldn't file for divorce until 6 months after our seperation due to laws and restrictions in Illinois, in which time I reconnected with the guy from Nigeria). Do you think this previous marriage that was so quick will affect my application process in any way and if so how long after my divorce should i wait to apply for the K-1 Fiance Visa or would it just be smarter to go ahead and get married and file for the Spousal Visa?? I know this all seems complicated and crazy but...mistakes were made i have moved on...and i would love to words of wisdom instead of criticism..Thank You Soooooo Much In Advance... Hey guys, me again! Just a quick question involving birth certificate copies that I did not see the answer to anywhere.. 

 

When filing the I-129f form, I know you're supposed to include a copy of your birth certificate. I was just wondering if a regular copy would do, or if it needs to be a certified copy with the official seal? I know you are also supposed to make copies of everything and hold onto them.. does the second copy need the seal as well? I'd hate to send the wrong version either way. 

 

Seems as though the instructions are always vague and there aren't many places with answers. This website is the best thing I've ever come across!! Thanks everyone! 

 

I can tell you what we did.  When my wife got her birth certificate in the Philippines I had her pay for 7 originals.  We had all we needed and sent originals to everyone just in case.  No RFE's.

I'm in the exact same situation. Took a year off work to go back and forth to see where this relationship goes. Well he proposed and we were going to get married but I had to come back as I have family visiting and wanted to tell my family in person that I was engaged. When I left to go to the US I was denied at POE and got finger printed and took a picture of me too. (like is that necessary? I'm not a criminal) was told I may enter when I have the proper documents. the customs officer never told me I was banned for any amount of years. I also signed a form stating I won't appeal? I was too in shocked to recall what I signed. He also never gave me paper to keep. Apparently, I overstayed by 3 months but I was honest and didn't know there was such thing as a total of 180days only. I just got my case number today from the NVC. now what next? do I call the embassy to see if they've received it? or just wait for my package and fill out the DS-160?

Like, yes it was necessary.  How do we know you're not a criminal?  Oh I see, we should just take your word for it?  We want you in our database.  You were in and out of the country illegally.  Over-stayed...  I think that might just constitute a criminal act.  Perhaps you are a criminal?  At least we have your fingerprints and photograph now so we can keep an eye on your possible illegal activities.

As for all the advice of how to fix an overstay...that is pretty good advice, too, for people who broke the rules.

 

It is a good idea with USCIS to NOT BREAK THE RULES because you will be questioned about that.

Saying someone screwed up isn't helpful at all, it's putting me down, and at the point he made that post he didn't answer or add to my inquiry, so yes I did think it was valid to report him, not to mention the part about someone telling anyone what "true love" really is and implying that I'm not in it is insulting if not down right rude. 

 

I wasn't asking if I should falsify her places of residence, I was asking if her places of residence included time she spent in another country as a visitor.  Since you know, she was a visitor in USA, I certainly could say that she resided here, but then it's just blaringly pointing out that she overstayed her visa by 5 months and change, not 11 months, I mentioned on a previous post the dates she was here, not the dates she overstayed.  Really the two questions I had still aren't being responded to in any of the posts, but maybe it's because I'm not clarifying enough...

 

A) Is the File Number given from CBP issued forms (like Notice of Inadmissibility) the same as the File number requested on the G-325A? 

 

B) I'm just going to withdraw my second question since it seems pretty obvious that I should include the time spent in USA, but the question was considering that she was merely a visitor is it really considered a residence?  I certainly wouldn't consider someone who went backpacking across Europe and decided to stay in Paris for a month as having resided in Paris for a month, just a traveler.  I know 5 months is a lot longer than a month, but seeing as how I've never done one of these forms I thought I'd inquire on these forums.  They have been helpful for the most part.

 

I'm sorry that I don't have the answer to A.

 

This is my opinion on B:  Did she reside (live) at an address in the US or anywhere on the planet?  I believe the answer is yes.  Now if you do not include all of the addresses at which she resided you will be committing visa fraud (IMHO).  I believe this is tantamount to lying by ommission?  Plus the application will be returned to you as incomplete because they want to see a continous timeline of residency. (No missing time periods)  I know this becasue I mistankenly put the wrong date (1 day off) on one of my spouses residences and had to correct it for them.  It added 4 weeks to our process.  I think most, including myself here are trying to help you.  Just remember, It's easier to remember the truth than a lie.  So keep it honest and you will be ok.  God Bless

You love her so much? Move to Canada and marry her there and live there. That is true love and devotion my friend. Sounds like you screwed up on the American side.

 

 

 

 

This is wrong and not helpful.

 

While they have complicated their lives, they can still have a life in America.  She does not have a life time ban, so why would your tell them to marry and live in Canada?

 

No need to be mean especially when your reply is wrong.

 

 

Thanks Aaron, I reported that reply as well when it got posted.  If anyone knows anything about my questions above:

 

1) Should I put the File number given to my fiance from the Notice of Departure from the CBP on her G-325A?

 

2) Should I list her extended stay in the USA in her residence history or is that a technicality that I should not use because she wasn't listed as a resident on my lease?

 

I posted the details clearly on an earlier post, but it got merged with another topic I made hoping to get my questions answered.

 

I am not sure why you would have reported verysadguy for his post.  It sounded to me like he was offering up another possibility for you two.  I mean you could move to Canada, yes?  And I am quite sure you would agree that you guys messed up by your fiance over-staying her visa by about 11 months?  Now you are asking if you should falsify her places of residence on the application?  I hope you are joking.  A person does not have to be listed on a lease to reside somewhere.  The immigration people want to know where she lived, plain and simple.  If I were you I would never lie again.  I would have thought you would have figured this out by now.  I am not being mean, just realistic.  Do not be offended I am just trying to help.  Despite your mistakes so far I still wish the best for you both.  Don't make any more mistakes.  That includes leaving out information that is requested on a form or application.  Be honest.

I need some help, but my story is a little long:

 

My Fiance moved here in Sept 2012, and was here as a visitor.  She told the CBP that she would only be staying for 2 weeks, but ended up staying a little less than a year.  A lawyer advised that we would need a I-94 to get the ball rolling on any documentation, so she advised us to return to Canada and pretend that her trip here didn't happen, so we intended to get a I-94 with the story that she had only been in the US for 2 months instead of the 11 she had been.  We drove to Vancouver and expected a quick return with the I-94, but unfortunately the CBP stopped us and long story short, she was refused at the border under 212(a)(7)(A)(i)(I), and we had to return to Canada.  What followed was the worst 3 days of my life, I had to drive her back to her parents home in Alberta, and I had to return to USA without her.  Now I am working on getting her back here ASAP, and my question is this:

 

When do I disclose that information?

 

The CBP officer told us that we should have no problem in getting a K-1, and that was the best route to take.  I'm filling out the I-129F and all the documents that go with it according the very helpful guide on this website, but I'm afraid that if I do include this information in the packet that it will hurt our chances of getting approved, but that if I don't include it, it will hurt our chances when she goes to interview at the embassy.

 

Also, are there any extra steps I need to take, aside from the ones to listed on the guide, because another lawyer told me that I would have to file a I-212, even though it specifically states that I would not have to because we were merely refused entry into USA and were not removed by the Government.  Suffice to say, I won't be using either of those lawyers again.

 

So sorry this is happening to you both.  Here's my two cents:  ALWAYS tell the truth...NEVER overstay.
