my situation;

fiance comes to usa via k-1 fiance visa.

we marry in the states, but personal family situation require her immediate return home before we complete her change of status in usa.

now in her home country, her passport near expiration. time to renew.

do we renew her passport with her previous name?

do renew her passport with her new/married name?

after passport is renewed, then we can begin her k-3 spouse visa process.

You probably want to go ahead and file either K3 or CR1, in either case your wife, after approval, should receive her 10-year green card instead of a 2-year conditional card if at the time of approval you have been married more than 2 years. The only difference between what you filed for K1 and what you need to file for either K3 or CR1 is that you file the I130 (and I129F for K3) for her as your spouse, in her new name, and submit your marriage certificate (US) as proof of marriage. 10 year green card because our being married 2 years?? gosh, for once i have something to feel real good about regarding this matter. is there some link or anything for more information about this? and when filing, do i need to make reference to this in order to take advantage of it?

how do i choose which way to go, k-3 or cr-1? what are pros and cons of either?

hello everyone,
so, it goes like this - we do everything by the book (K-1 fiance visa) with great assistance and advice from this amazing site and terrific people. my lovely wife joins me in hawaii to start our new life. we get legally married and begin our aos process. one month before our scheduled biometrics appointment, my wives family experiences a emergency situation which require her to go home immediately (parents health).

wife and myself fly immediately to cambodia - thus forfeiting our visa application entirely.

as my wife was the only child that had not yet had a child and immigrated to another country she has had to stay in cambodia to assist her family through the situation for the past year. now things have cleared up and we wish to reunite back in hawaii.

where do we start? what process and forms do i begin to bring her "home"? cost is not an issue, we want to be together as soon as possible.

we are leagally married in usa, but NOT legally married in cambodia.

also, my wife now legally carries my surname and also now posses a new cambodian passport which also names her with my surname. so then, her legal name is not the same as it was when she first came over on the fiance visa.

or just 1 plastic bagged photo behind the set of 4 g- 325 pages?

is it true that the $355 I- 130 fee also covers the fee for the subsequent I- 129 fee?

and in putting together our I- 129 package, how do i word this or show proof? do i just incluse a photcopy of the $355 check as well as the NOA1 stating the reception of the check and transfer of the case to the service center?

i have tried to follow the guides as best as possible, but i feel kind of like im a bit adrift on a river and no paddle nor rudder......

we have filed for k-3, then i-130 and 1-129f.

my wife had previously came over on k-1 fiance, we married in the states, then emergency sent her home before AOS.

we have now been married 2 years.

so i-130 and i-129f have been approved. i have then received packet containing AOS (affidavit of support) as well as ds-3032 (choice of agent)

i have emailed her ds-3032 for her to sign and email back to me. listing myself as the appointed agent - because of her lack of english skills and because i am doing all the filing myself, i presume this was the correct action, is that correct?

she then received in her country the same form, ds-3032. is she also expected to fill one out as well? or is the one that i have emailed to her to sign adequete?

sorry if this seems like a stupid question.

on feb 28th i received a letter from NVC stating the address of my spouse (cambodia) that NVC's records indicate. it is correct - no action needed.
the letter also states that i must pay the affidavit of support fee to begin processing my petition, as well as the link and instructions to do this.

i am confused about the part that than reads "if the applicant intends to adjust status with USCIS, please contact the NVC before making any payments or taking further action"

my wife does intend on adjusting status with USCIS....isnt that a given?

so then, on march 4th i receive a letter from the bureau of consular affairs, stating that the NVC has recently received an approved I-129f petition, and that within a week that the petition will be forwarded to the visa-issuing post overseas that is responsible for processing visa cases originating in the country where we were married.

i am confused because 1) we were married in the USA, and 2) this letter has a different case number than the feb. 28th letter.

im a little mixed up about this.

Second, yes, you now have to processes going on. But I'm not sure if you can apply for K3 when you are married more than two years, I think you can.
But the I-130 is for the CR1/IR1 and the I-129F for the K3. These days they are approving both in the same day, like happened to mine.
Check out my timeline.
Since CR1 is a better visa I'm gonna cancel my K3 interview and wait for the CR1 interview only.

sorry i did not point out....my wife arrived on k-1, we married, then a family emergency had her return home before change of status.

so we started all over again via k-3.

so i filed i-130. after approval, i then followed guide and filed i-129f.

so do i have 2 cases in the works? am i now waiting for both?

do i keep em both and then take whatever comes first?

and how does this affect our application for ir-1 or cr-1?

we have now been married 2 years.

i understand that a new 75 million dollar american embassy had opened for business on january 18th, 2006. does this mean that anyone doing visa application witha cambodian national fiance can close the deal without going to thailand? i sure hope this is the case......

Well, things are going faster than i expected. I mean, i filled out and mailed the RFE the day i received it. And then was informed that my case was approved and forwarded before they even received it !

So, today, almost unexpectedly i receive the package 3. So i go thru it and plan on Fedex'ing it to my fiance tomorrow .....when i come across an I-134 form (affidavit of support)

Is this for me to fill out about myself?

Is this for my fiance to fill out?

sidenote - I was never asked for one in the form of a RFE, i was only asked about any spousal abuse i may have been convicted of (no, of coarse)

Would the nat'l service center disregard my financial situation, only to have the embassy in Bangkok raise the issue? and if so, wouldnt they address this to me exactly?

gosh, i hope someone has an idea on this one, it sure would be nice to enjoy turkey day and Xmas together!!

So then,

I receive the Packet 3 from bangkok, and the visa instruction page states -

"FIRST: Complete and return immediately to this office the enclosed form OF-230I, biographic data. This office cannot process this case until this form is received."

So, does my fiance (beneficiary) send only this form to the bangkok consular office, and bring all the other completed, unsigned forms and documents to the interview??

Logistics for this is already difficult enough, as my fiance in cambodian, and all is handled thru American Embassy in Bangkok. I would really like to get this right the first time.

if your fiance from cambodia arrives in usa in december 2006, is there any possible way that she could go back to cambodia in may 2007 for a sisters wedding? i thought i had read something on this site about either being able to fast track her status at a certain cost and by way of a certain application, or by getting some sort of 1 trip exemption out of the us and then back in.

am i crazy? or is it possible for her to travel back to her home and then return?

we are sooooooooooo close now, the stamp is licked, but.....

.......in sending in my I - 134 affidavit of support, i will be attaching my most recent income tax return - which is a joint filling with my ex-wife. it doesnt really identify my individual income, so is the income that i write down on question 7 pretty much all they have to go on?

and also, with quite a good size of cash in accounts and stocks, will that also help my case?

1) is a w-2 form enough evidence for an i-134, or should you submit your full last tax returns (thats a big file!)

2) when an i-134 is included in your fiances(petitioner) packet 3, should you do an i-134 for both petitioner and beneficiary?
