Each Consulate is different when it comes to this. The NZ Embassy cares little about the income requirements/co-sponsor as well.

Just keep in mind that you will need a co-sponsor once your fiance is here and you file for AOS if you do not meet the minimum income requirements.

The short answer is no. Only the person co-sponsoring will need to fill out the documents. The co-sponsor will fill out all of the same forms and will provide all of the supporting evidence that you will.

What is requested often varies by Consulate but normally bank statements are not needed if you meet the income guidelines.

Just to add to the conversation... the US Embassy stage of this process can be very different depending on the Consulate you are going through. Some are a breeze and hardly ask or check out anything and at some, higher fraud Consulates, it is the norm to ask for more information / proof of bonafide before issuing a visa.

Send all photos,
any emails (or print sc of your inbox/sent), credit card records of payments made in that Country,
all chats (you can black out personal conversation)
cards or letters or receipts from packages you've sent each other,
letters from family members,
all proof of travel you can find,

As stated, if you are planning a legal marriage in Vietnam then the K1 visa is not for you. A K1 is a fiance visa and you must be married in the U.S. (within 90 days of her arrival).

As far as costs involved. The initial petition is $455. To file for AOS (including AP (travel) and EAD (work) after marriage is it another $1010. There are also medical/vaccination fees when your fiance has her medical in her home Country as well as the visa fee of $131(usd) to consider around interview time. On top of all that there are are travel charges, fees for any paperwork you must get or copies of (divorce decrees, birth certificates..etc) any translation fees and passport pictures..etc, etc. It all adds up.

The process at HCMC is not an easy one so you are looking at an uphill battle either way. Check out your portals link and the Vietnam Regional thread here on VJ for others who have or are dealing with this Consulate.

You are going to want to start here and decide which visa will be best for you.

Yes, the "+" means there are more leters. This is a common problem. Normally, when something does not fit, it is recommended you print the form and fill those spaces in with pen.

I have not heard of people receiving RFE's for it but there's nothing you can really do about it now anyway.

Just thought it might be important to note that last years petitions were taking much longer because there was a fee hike and an influx of petitions. Also, from several centers processing K1's to just the two they are using now. 7 months was quick by last fall's standards for approvals...now it's more like 4. It's important to take that into consideration when looking at the timelines. wink.gif

VJ is a very accurate representation of approval times. That being said, every case is very different because there are any number of security issues that can hold you up along the way.

OP.. if you fill in your timeline you will be given a fairly accurate range of dates in which you may see your approval, based on others timelines.

If you are registered with the USCIS website then this is the page you are looking for. The date change means you were 'touched'.

As pay suggested, the online database is very problematic so I would not depend on it. Also, every adjuticator is not created equally so whether your file actually gets scanned when it is moved to a new location or put through security checks is a ####### shoot as well.

While using Igor's list and VJ's database is a great way to help gauge your progress there are far too many variables in this process to understand why your file is worked on before or after someone else's. If you're close to approval then this is usually the hardest time... stay strong and positive and it will come. smile.gif

Hmm I think people forgot to mention that you will need to talk to a person at NVC as K-1's are not entered into the automated system.

You need to call NVC 603-334-0700. Press 1 and then 5 to talk to someone.

You will then be asked for the petitioner's name and DOB and then the beneficiaries name and DOB. If they have received your approved petition (usually in a matter of days for VSC filers and soon thereafter for CSC...usually wink.gif ) they will give you a new case number.

If they tell you that your petition has been sent off to the Consualte then you can track your petition with DHL to find out when it arrived at the Embassy abroad. Usually within a matter of a couple days. Please use the search option to look for threads on how to do this.

How you obtain the forms depends on which Consulate you are going through. Most forms can be downloaded but every Embassy is unique in their requests so it's important to check with others who went before you. There is a great reference in the Regional forums for Manilla so you will be served well to visit there and have a look. wink.gif

For the benefit of others, I should probably also add that the expedite needs to be requested through the USCIS ...and then again at each stage of the process thereafter. It will not just happen because they have a deployment letter on file with your petition.

I respect your opinion. However, it is just that and others are entitled to their opinions as well.

Your comments in this thread suggest that others do not deserve and/or will not be approved if they request an expedite. I am assuming this perception is based off of your lawyers comments to you. What we're saying is that this is one of the VERY few reasons we do see an expedite and that it can and does happen. If you choose not to request it then that is your choice and nobody should try to convince you otherwise but the same holds true for you.

I happen to feel that if the USC fiance is facing deployment and the couple is forced to spend that much more time apart in the near future then that couple has every right to request an expedite. And I, for one, hope they get it. wink.gif

As pushbrk suggested, what they want to see is that you are 'currently' making, and plan to continue making (employer letter normally requested at the Interview) that money.

Also, just fyi, your co-sponsorit doesn't have to be your parents or anyone that lives with you.

In the end, only you and your fiance can decide the best course for the two of you.

All of this is really Embassy specific as the I-134 does not have any legal standards to go by.

Most Embassies will use the standards set by the I-864 (affidavit filed at AOS) because you will need to meet these guidelines once you're here and married.

Normally, if you meet the income guidelines you do not need to supply bank statements and/or proof of any assets anyway. Some Embassies will require 3 years of tax transcripts but the standard seems to be 1.

Oh you're talking about a different kind of hardship.

In PI they don't generally accept co-sponsors. I'm really not sure if there is an exception to this or not or if a hardship waiver would work in your case. Your best bet would be to go talk with the folks in the PI Regional forum to find out from those who have been through that Embassy. Then go from there.

Do you mean hardship in the case that you have not met in person in the last 2 years?

It's very unlikely you will be approved for this...

Meeting Requirement: Exceptions
There is a provision in the law that may exempt the petitioner from the meeting requirement "if it is established that compliance would result in extreme hardship to the petitioner or that compliance would violate strict and long-established customs of the K-1 beneficiary's foreign culture or social practice, as where marriages are traditionally arranged by the parents of the contracting parties and the prospective bride and groom are prohibited from meeting subsequent to the arrangement and prior to the wedding day." INA § 214.2(k)(2). Unfortunately, such waivers are very rarely granted by the USCIS. The "extreme hardship" exception has been interpreted by the USCIS to mean something very close to "impossible". It generally is available only to people who are so disabled that they can't fly at all. As for the second grounds for a waiver, very few people qualify for this exception, and those that do often have a difficult time proving it to the government's satisfaction.


This is just one link I found but there are hundreds regarding this topic. I don't believe I've seen a case for hardship approved here but I wish you much luck.

The reviews for the Consulate seem pretty good even though the information on how the process is handled is not so current in the links I left you above. Hopefully they can help ease your mind a bit.

What you can do, after you've gone through the process or find others from Croatia that have, is enter a thorough review of the Consulate for others so the information is available.

Just like to reiterate that there are no specific guidelines for the affidavit of support (I-134) sent by the petitioner for use at the interview stage for a K1 visa... most Consulates will use the standards set by the I-864 (affidavit of support filed at AOS) because they know you will need to be prepared for that once your fiance is in the U.S. but there is no law stating they must or mustn't accept a co-sponsor at this level of the process.

It's common knowledge around here that using a co-sponsor at certain Consulates is just not an option.

It's important to reiterate the fact above that the I134 has no real set standards. Most Consulates use the guidelines set by the I-864 that needs to be filed at adjustment once you're in the states, but some do not.

Manilla is well known for not allowing co-sponsorship as are many other higher fraud Consulates. The Embassy in New Zealand cared very little about the I-134 and more about the beneficiaries work history, education and ability to work once in the U.S. The point is, each Embassy is very different which is why it's of utmost importance to educate yourself to the process with special consideration for the Embassy you will be dealing with.

You file the I864 which has legal guidelines when you are filing for a spousal CR1 (immigrant) visa. You are married, not engaged. Same reason you can file an expedite for hardship when you are petitioning a spouse... not a fiance. wink.gif

The instructions for the I-485 (adjustment of status) says under #7 of "who may use this form" That it may be used if you were admitted as a K-1 fiancé(e), but did not marry the U.S. citizen who filed the petition for you.

A guy that works for immigration told me that the government would rather just change the immigrant's status than go through deportation, etc. It sounds iffy, I know, but check out the instructions, it says it right there.

Might we just file the I-485, with the appropriate affidavits, etc, and see what happens?

I am an American man, married to an Ethiopian, who I brought here sucessfully via a k1 visa over a year ago. This web site was a lifeline through the whole long and painful process. Thanks!

My wife's sister recently came here on a K1 visa. With a month left before her 90 days is up, her fiance decided he does not want to get married after all, and wants to send her back to Ethiopia. She wants to stay here in the US.

Can she? How?
Can she at least get an extension on her K1 visa?
Can my wife and I, as family members, help her in any way with another kind of visa, or sponsorship?

They do not take electronic media.

If you were going through a different consulate i'd recommend printing them all out for the Interview but you should be good with just the logs from all of your chats.

It's not always cheaper to get them done in the US. This is why most people get them done before they come over by their own physician or the panel physician.

Nobody can tell you what the vaccinations costs will be. If you know you've had many of them and have a record of that then bring it to your medical. You will still need some blood work and xrays. My fiance had all his vaccinations as well and the appointment cost him about $200.

As pushbrk suggested, you will need to know exactly what was said on the paper she was given. Then contact your Senator's office and perhaps a good immigration lawyer in PI. It's essential you keep your petition in the PI and not let them send it back to the US where it is bound to get lost in a black hole.

London seems to be less critical of the I-134 than some Consulates but I would assume they consider it.
