Packet 3 and 4 and now referred to as the information packet (3) and the interview packet (4).

Packet 3 will be sent to the beneficiary after the approved petition is sent from uscis to nvc to the Consulate handling the interview.

Packet 4 is sent out after what is required is sent back to the Consulate and they are ready to schedule the interview.

It's important to note that not all Consulates send out a Packet 3. Each USEM has their own system to follow so it's important to check with others going through the same Consulate to find out how it will work for you.

Going through PI, you are going to want to visit the Philippine Regional forum and read the sticky at the top posted by Sherrif Uling... he outlines the process in PI very well and you will find the information invaluable as PI has quite a unique process after approval of the petition here in the States.

From the K-1 GUIDE....

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.

6. A copy of the NOA2 that you received in the mail.

7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)


All of the answers you need are in the links at the top of the board. Read through all that you can and then ask any additional questions you may have here. I will add that it's important to check with others who have gone through the Consulate where you will be interviewed or contact them directly to find out if there are any special requirements at interview time.

K1 is for those with immigrant intent. Since you are not planning on moving to the US I don't understand why you would want it.

You can just marry in the US and then leave as you have been doing. Immigration is not concerned with your marriage and you do not need a visa to marry a US citizen...just to stay in the US.

My only concern would be getting in the US on a regular basis. It is up to you to prove there is no immigrant intent when entering the US.. having a USC husband may raise more red flags than you have now when you enter. Each port of entry is not created equally.

That being said, there is also the new ESTA that will become mandatory in January for VWP Countries... not sure the same rules will apply for Canada but it's something you'll want to look into if someone else doesn't chime in here in regards to that.

As long as you are both free to marry and of legal age you can apply for the K1.

Financial details come into play at the Embassy stage of this process. If your fiance is working by that time he simply needs to state and prove the fact that he will now meet the minimum requirements. They are concerned with current income...not so much past...usually. If he still does not meet the minimum, then a co-sponsor is usually an option (note: he is still the sponsor and will need to supply all documents and supporting evidence as well..even if he does not meet the requirements).

Having said that, it's important to know what Consulate you will be dealing with as some do not take too kindly to co-sponsorship for a K1.

Do as pushbrk suggested and read all you can here on VJ. Pay special attention to the K1 Guide and Visa FAQ sections. Educating yourself to the process will help you make the best, and most well informed, decision for you.

As pushbrk suggested, it's not a sure thing. Each Consualte is very different in their standards for the I134 (affidavit of support) so you will want to check with the Embassy in Chile or those who have ventured through there to find out exactly what will be needed.

If you fill in your timeline you will have a portals page that will show you all other US/Chile VJ members and you can also visit the Embassy info/reviews pages. Better yet, contact the Embassy yourself for answers.

The process is very different for spousal visas than it is for fiance visas. wink.gif Many times a married couple can claim hardship reasons for expedite.

For a K1, the case will not get expedited because the beneficiary or petitioner are pregnant. As said above, and dependent on the Country, you may need to prove through DNA that your fiance is the father of the child.

She can get turned back at any point. It is always up to the officer at the POE. The best one can do is bring plenty of ties to his/her home Country. Starting in January visitors using the VWP will need to apply for travel authorization which may or may not help when it comes to this. See ESTA for more information.

One thing you must consider, because of your situation, is that if she does come into the US on a K1 visa you will need to marry within 90 days and then apply for adjustment of status. If she leaves the Country before approval of the adjustment of status (3 months or so) she will need AP (advanced parole, also filed for with AOS) to re-enter the U.S. So, without AP or approved adjustment she will not be able to re-enter the U.S. and you will need to begin the process again with a spousal visa if you wish to reside in the U.S. This link will explain it more.

In regards to legal assistance, I think you'll find many here would suggest filing yourself unless you have special circumstances. If you do choose to use a lawyer, understand that they are not all created equally and it is just important that you understand the process as well to make sure things go as smoothly as possible.

I hope my point remains clear... it's important to do whatever it takes to keep the petition at the Consulate and fight the 'reasons for refusal' and not let them return it to the uscis (where it seems to just dwindle and die) for final decision.

IMO.. candle for love and others who have fought there way through GUZ are the best source of information on the process there.

She will also need the envelope marked 'DO NOT OPEN' (commonly referred to as the mysterious brown envelope) that should have been given to her along with her visa. This contains paperwork that will be forwarded to your local office.

Any US Port of Entry will do...

I have heard of two expedites for K1's for extreme medical emergency for the USC. Both were VERY serious (stage 4) illnesses.

As Rebecca stated, your best bet is to provide all medical documents you can from your fiances medical staff and any other documents requested and hope for the best.

I've put in bold the exact reason we are telling them to wait for the originals. MANY people here have waited MUCH longer than a week for an RFE even to be delivered... and much longer for the approval after the documents are sent back in. I dont think i've seen one that has been issued by USCIS, sent to the beneficiary, replied to, mailed back and approved.... all within a week in all the time i've been here.

You usually dont even need the bank statement if your fiance meets the income guidelines so I would venture to guess your copies are fine.

As I said, i've not heard of this, ours was up right away, but considering the issues it seems VSC has been having with updating lately (more commonly seen with CSC in the past) that could very well be it.

As pay suggested, I woudln't really worry too much... you'll be seeing the same received and pending letter with the same )*$)(#&$& date for way too long anyway! As long as you have a number you know they cashed your check and you know it's there. wink.gif

I think we've learned that the divorce decree or the decree of absolute... comes in many ways. Some are one page (with raised seal... like in MA) and some seem to be 20+ pages (like in TX). You could certainly send copies to take to the interview. Canada is a whole different creature than is China. You will most likely not need as much proof of bonafide in Canada.

To the OP.. anything you can find that will help you prove your relationship is going to help you in China. Do check out the regional forum here and candle for love for more ideas and more of what to expect. It's an uphill battle but going in prepared will help.

I dont know if this will help you or not but, as mentioned, this may just have much to do with how one is raised... We spent years apart because I couldn't uproot my children and move them to NZ or leave my family here for any great length of time. We made those sacrafices for the good of everybody else we love. it was the right choice for us at the time.

It had nothing to do with how much I love my now husband or how much I wanted to be with him compared to how much I wanted to be with my family. I knew he would be coming to me.... for all of the same reasons your fiance is probably taking this time to say her 'goodbye's' to her family.

I say follow your heart and what it's telling you but give her the benefit of the doubt for now and dont make it a choice.

This is not the right advice.

Anything you send now will never get to your petition so sending it is a waste of your time and energy. Can you imagine them digging through the thousands of petitions they get to find yours??? no0pb.gif

Not everyone has sent a cover letter or letters of intent and not everyone has received an RFE for doing so. Just prepare the documents just in case and sit back and hope for the best.

Becasue the I-134 has no real standards most consulates simply follow the guidelines set by the I-864.... others do not.

If I were you, I would have all the documentation there just to be on the safe side but they sound a lot like the NZ Embassy who did ask for the I-134 but certainly cared more about Russell's ability and desire to work once in the States. They paid special attention to his work history as well as his education (masters degree). They actually requested his CV/Resume... perhaps have yours ready for them to see as well?

All you can do is the best you can do to be prepared... sounds like you will be. smile.gif

Each Consulate is different when it comes to this. The NZ Embassy cares little about the income requirements/co-sponsor as well.

Just keep in mind that you will need a co-sponsor once your fiance is here and you file for AOS if you do not meet the minimum income requirements.
