Also would like to add that although proof of ongoing relationship is not necessarily requested at the USCIS stage of the process, if you are going through a higher fraud Consulate it is often suggested that you send some proof with the initial petition.

Many times the CO will have an opinion regarding the 'bona-fide' relationship before the beneficiary even gets there for the interview and based on the evidence sent with the initial petition. If you can answer any questions and prove that your relationship is authentic early on it's often a better outcome.

There is no length of time you must be in or out of the U.S. The basic 'understanding' is that you must not be in the U.S. more than you are in your own Country. The VWP is to be used for visiting ...not for living in the U.S. If you are merely visiting then chances are you will not have any issues getting in as long as you bring enough ties to show you are going home but that being said, there are no quarantees. Every entry is left up to the officer at the POE. All you can do is prepare and hope.

BTW... ESTA will begin in January of next year (it's voluntary now) so, if you are approved beforehand, I would think that should help ease concerns about being denied entry. wink.gif

Read through the K1 GUIDES and the K1 flowchart. It will explain each stage of the process in simple terms.

Once your petition is approved at the USCIS it will be sent to the NVC who will send it off to your fiance's Consulate. The Consulate usually sends out a Packet 3/information packet explaining the medical and other documents you need to gather. Not every Consulate does this so it's imperative for you to educate yourself regarding the Consulate you will be dealing with. You can do this by visiting the Embassy info link at the top as well as your portals page.

Read all you can. Ask questions of those who have gone through your Consualte.

You can not file for a K3 unless you are legally married. As long as you've met your fiance in person in the last two years, you can file for the K1 today and be that much closer to being together after your visit.

The 'engagement ceremony' is shaky ground because there are some couples who filed for K1 and after having the ceremony the CO believed they were truly married. Although many have also done this, it is seriously frowned upon to mention any kind of ceremony when going through the K1 process.

If you do choose to have this ceremony just be sure not to wear rings, refer to each other as 'spouse/husband/wife..etc' and do not include pictures of the ceremony. You may think that it only proves your relationship is real but unfortunately, we have seen that this is not how it usually works. wink.gif

marriage and immigrating are two completely different things. As pay suggested, it is the intent to immigrate that is illegal. However, depending on the officer at the POE, letting them know your intention to marry a US citizen will most likely throw up a red flag for your 'intent to immigrate' and therefore may give you problems when trying to enter.

The K1 process will most likely be the quickest course for you to be together quickly. If you can get all of the documents you need gathered right now you can get it sent off asap and hopefully will have your visa shortly after your intended visit in March.

Have a read through the GUIDES at the top and simply go down the checklist. There are example forms to help you out here as well. The 'search' feature is also a great option if you have any questions.

Every Consulate is very different. The higher fraud Consulates will require more bonafide evidence. You should be ok in Manilla as long as you can provide proof of your ongoing relationship.

Keep saving your chat logs.

If you chat on cam take a couple screen shots as you are chatting.

If you're anything like we were, you have thousands of emails to/from each other.... What you can do instead of printing each and every email is take a screen shot of your inbox (maximized) and perhaps just print out a few over the course of your relationship.

Do you have updated photos you could bring?

credit card bills showing charges when you were together?

cards and/or gift receipts sent to each other?

text message records?

anything that proves you are together.

Simply use the K1 Guide... go down the checklist and add each item to your package. It's very thorough. There are also example forms (link above) to help you fill out the forms properly and avoid an RFE.

As an added note, dont forget Q2 in Part C on the I129f. It's simply a box that needs to be ticked but seems the most common reason for RFE's. wink.gif

As mentioned above, you are best to use an address that will remain consistent throughout the process (such as a parents) and file that the USCIS office (CSC/VSC) for that address.

If you notice the historical timelines given here on VJ you will notice a huge disparity in both the processing times in general and between the two centers now processing the K1's. The time it takes fluctuates a great deal depending on many different circumstances.

Karin gave you a great estimate for what looks like current processing times. But, it's important to note that there are security checks done at every single stage of this journey and any one of them can hold you up...whether you have a checkered past or not. wink.gif Here is a current list of the checks done.

You can be held up for any number of reasons. Neither of us have a criminal past at all but we were still stuck at NVC for 3 weeks. wink.gif

Expect the worst, hope for the best.

This is addressed in the FAQ's and just about every day here on VJ.

Yes, your fiance can visit the US but much depends on whether or not he/she can show ties to his/her home Country and how often he/she has spent here previously.

If they are coming from a VWP Country then by January they will need to register with ESTA (Electronic System for Travel Authorization) This is intended to track those travelling to the US and being sure people aren't taking advantage of it.

If your fiance needs to apply for a visitor's visa and if he/she is honest with the CO and tells them he/she has a US fiance and K1 in process then it's unlikely they will receive a visa because they already have intent to immigrate. At higher fraud Consualtes it's hardly worth the effort and expense. wink.gif

In any case, even with a valid visa to the U.S. it is still up to the officer at the POE to let your fiance in or not. Always be honest but do not offer more than is asked...always bring plenty of ties to the home Country (letter from employer, bank records, mortgage/rent agreement..etc).

Your fiance's father will fill out a notorized I-134 and supply all of the same documentation as your fiance will.

You can apply for your social security card 10 days to 2 weeks after arriving in the U.S. on your K1 visa. Regardless of what you read or are told...this alone does not allow you to work. You need authorization from the Department of Homeland Security to legally work in the U.S.. You get this after you are married and apply for adjustment of status. The cost of adjusting status will include AP (travel) and EAD (work) along with your temp green card.

You have found the best resource for the process you can in VJ. Read through the GUIDES, the flowchart and the FAQ's links at the top of the forum. The example forms will help you fill out your paperwork. You will learn some invaluable information to help you prepare for this journey.

At some of the higher fraud Consulates it's sometimes recommended to send additional bonafide proof of your relationship along with your initial petition because many times the CO handling your case at the Embassy will form an opinion of your relationship even before the interview. Therefore, it's often recommended to send along as much as you can when dealing with these Consulates who seem more common to deny a visa ....before they approve. wink.gif

However, at the lower fraud Consulates this is not as necessary and in most cases, the additional information wont even be looked at.

I wouldn't worry too much about not sending more at this stage but do have it available for the interview stage just in case they ask. wink.gif

In your explanation of how you met and when you saw each other simply state the trip you took and note that you were together.

We had an 10 year relationship before we filed, travelled all over the world living together and seperately. We simply included a timeline that went along with our proof. They just want the facts and proof that you are a 'true' couple.

Over the course of the last year this has been very common for CSC filers. It used to be that CSC held up skids of approved petitions to be sent overseas in bulk but now it appears they are just screwing up certain cases. I don't know what their excuse has been for others but I do know of a couple recently who were told it was CSC error and that their approved petition was in the wrong place.

If you do a search here you are sure to find these posts.

As a side note and probably not relating to the OP...there are security checks at every level/stage of this process. We were held up at NVC for three weeks (no clue why). So it's common enough to get held up once your petition reaches the next stage BUT when nobody seems to know where your petition is, as seems the case in these circumstances, it's a whole different concern! wink.gif

OP.. i'd keep calling until you can perhaps talk to someone that actually might know what they're talking about.

I am self employed, receive 1099's.... I simply stated that I was self employed, the kind of work I do (anything and everything computer related) then listed the company's I do the most regular contract work for.

For the I-134 stage, I also included a letter from this Company stating I had guaranteed work. (this was suggested by NZ the Embassy)

Do you have extreme circumstances? Previous overstays? IMBRA issues?... etc?

If not then have a look at the GUIDES (specifically the K1 Guide and checklist). You will find a list of everything you will need as well as example forms to help you fill your paperwork out.

Even if you are hiring someone else, you will still need to gather everything they will need to send in so it's important to familiarize yourself with the process so it goes as smoothly as possible.

The OP has yet to experience the JOYS of waiting for the Guangzhou Consulate. GUZ has the habit of placing everything into storage for 3 months before they get around to "RECEIVING" the petition, that is package leaves NVC where it will enter a BLACK-HOLE for 3 months, no indication that the consulate has received it, it looks like it is LOST for 3 months.

Right. The validity of the visa is 6 months. Once she enters she will be given an I-94 (arrival record) which will be valid for 90 days in which you must marry.

Packet 3 and 4 and now referred to as the information packet (3) and the interview packet (4).

Packet 3 will be sent to the beneficiary after the approved petition is sent from uscis to nvc to the Consulate handling the interview.

Packet 4 is sent out after what is required is sent back to the Consulate and they are ready to schedule the interview.

It's important to note that not all Consulates send out a Packet 3. Each USEM has their own system to follow so it's important to check with others going through the same Consulate to find out how it will work for you.

Going through PI, you are going to want to visit the Philippine Regional forum and read the sticky at the top posted by Sherrif Uling... he outlines the process in PI very well and you will find the information invaluable as PI has quite a unique process after approval of the petition here in the States.
