K-1 Fiance(e) Visa Process & ProceduresI 129f packet

Where is the best location in filing the I 129 packet. I also read articles, that it is easier and has faster service in California? What do you think? Some beneficiary's told me that they got their visa approved after 5 months and some are 7 to 8 months..

From what i know you can't pick where are you going to send your papers. It depends where your fiance is living for example he is living in Georgia/Alabama the documents will be send in Vermont, if he's living in Arizona/Los Angeles it should be sent in California Service Center. From what I read too is that you should send your papers in Dallas, Texas that's what it says on the website of USCIS. The Texas Lockbox will send it out to which Service Centers it is should be delivered. We send our papers to Dallas, Texas and our papers is in Vermont , my fiance lives in Massachusetts that's why.

One more question.. Can I/We just print the forms (G235A,I 129f) then fill it up using black ink ballpen? Cause some of the boxes is not enough for the info.. Like for example, My fiance's name is Allen Jennings, and the country, I can just only wrote there PHILIPPINE.. the box is not enough what can i do?

Sure you can do that. :)

We're planning to send the packet last week of July.. Is it okay not to include the beneficiary's BC.. I don't have original copy of it.

YES, that's what our agent told us and also from what I searched beneficiary's BC is not included on the documents that USCIS wanted.

Just photocopies only , you will need those originals for the interview if the consul will ask for it. They do actually accept personal checks.

That may be excellent advice for some situations, but not "always". In our case, we went through the whole process without ever sending in the USC's birth certificate at all (we used the passport to provide proof of citizenship).

Oh no. I sent only the "short form" of my birth certificate. Our state does have a long form option but it takes 6 weeks to obtain. And I didn't send copies of my passport pages.

Is it possible to make an addendum to an I-129F that's waiting for review. I already received NOA1 with case number. I wonder if I can "pre-empt" the RFE by sending my passport copies?

Thanks,

3AD

yeah.... umm... I tried that.... with evidence of work status, etc, and it got SENT BACK TO ME... stating that they do not yet need the letter but rather once it is approved and sent to the Dpt of State, that is apparently when they will ask me to prove fianancial info.... not sure if they will accept further evidence that's non-financial though... it's certainly worth a try!!! good.gif

Actually, just to add, I too sent the "short form" BC and where it stated to make SURE to copy BOTH SIDES, mine only had ONE SIDE.... wacko.gif So I do wonder if I should attempt the same thing as you are thinking of doing by copying all pages of my US Passport!!!!

What do you all think? Should we try this?

Thanks! cool.gif

The same thing happened to me on my mothers birth certificate her last name was spelled wrong, so than I ask different people just to get some feedback from people that have done petitions, and they all advise me the same thing to leave it how it is on the original birth certificate... and really it doesn't matter much about her error on the birth certificate because the petition is regarding you and your partner.

Good Luck

Thanks love2011 , but what happened i see your missing domucments? did you complete your interview or still waiting for a date?

Opps I actually haven't update it.. well the missing documents aparently I guess NVC had lost my husband 2x2 passport size picture that I had sent in, and
I sent in a copy of my joint sponsor U.S. Passport but they were apparently looking for something that show citizenship of him living in the U.S so I send in a copy of his (U.S Naturalization Certificate)... and after I sent what was missing in I got case complete.

Yes I got my interview date for September 21, 2011 which is just 7 days away. :)
Good Luck on your Journey.

K-1 Fiance(e) Visa Process & ProceduresNOA2 Response Times
Good Evening:

As the deadline according to VJ approaches to, God Willing, receive a positive response on our NOA2, I have observed that some individuals from January have begun to receive responses. I know it's still early in the game, but I'm wondering if the response time also has to do with the beneficiary's country. How is the order of the review process determined?

Also, at what point should I contact USCIS if I haven't heard anything? Should I go by VJ time or give it the full five months as indicated on the USCIS website?

Your recommendations and input are greatly appreciated.

God bless and good luck!

I have read through some of the reviews and read really helpful information regarding what information to include. I have composed a list of documents tabbed by different sections (thanks to a fellow VJr  ), this list is also based off of the Tegucigalpa Embassy website containing the "packet."

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit Co-Sponsor
I am hoping to get some input on the best way to approach the I-134. My 2011 taxes reflect the fact that I did not start working until August of that year since I did a year of volunteer work in Honduras. Based on the income from the W2's, I did not meet the "requirement." However, I do have two employment verification letters, one from 2011-2012 School year and present school year, attesting to my yearly salary (which is more than enough based on the guidelines). My plan is to bring copies of my paystubs that indicate my income in 2012 in addition to the bank statements.

I am trying to avoid any bit of doubt when it comes to the USCIS interview and therefore my parents are willing to be co-sponsors. Since they are married they file their taxes jointly. Is it necessary for both of them to get employment verification letters and bank statements as well? Which one would I write on the actual form?

Any help would be greatly appreciated.

Thanks!

K-1 Fiance(e) Visa Process & ProceduresPort of Entry
We were blessed to have our visa approved and scheduled a return flight for this past Saturday after we were told on our interview Wednesday to pick up his passport on Thursday. Unfortunately, Sebastian and about five other K1ers were told that since Washington only allows a certain number of visas to be issued per day, they would all have to return on Monday to pick up the passports.

I had to return to the States for work and need to ask you for your opinion. I wanted to see what your experiences have been like going through the port of entry. I am really skeptical about having Sebastian come out on his own for the following reasons:

a) He doesn't speak English (TSA officials are not necessarily known for their friendly approach to individuals, I don't want him to get turned back to Honduras)
b) He's never flown on a plane
c) Getting lost in the huge airports (nothing like Tegus)

I myself always get pulled to the side, and in fact just had all my carry-ons inspected (didn't even have a suitcase) and the officers were so rude (I know it's their job, but it gets really old).

Would you recommend that I fly back to get him or do you think he'd be okay going through the POE on his own? Any recommendations of things I could make sure of if he does come out on his own?

Thanks,

Maki

K-1 Fiance(e) Visa Process & ProceduresSupporting evidence for K-1 petition
Thanks for the replies! It's great that there is a community like this for sharing information.

It sounds like the best approach is to go ahead and put together a complete and current set of evidence now and then try our best to make sure that the CO is aware of important updates at the time of the interview.

K-1 Fiance(e) Visa Process & ProceduresSupporting evidence for K-1 petition
Greetings to everyone on this forum from a first time poster! I find myself both nervous and excited as I begin the process that I hope will unite me with my fiancee here in the United States. I'm particularly appreciative for all of the good information posted here by "veterans" of the K-1 process.

I don't expect any major issues with our initial filing, but I gather that the big hurdle will be the determination by the consulate in Ho Chi Minh City. My primary question right now is whether and when we will have the opportunity to submit additional supporting material between the time of our initial I129-F filing and the actual interview.

I feel like this could be very important to our case. For example, we (actually her terrific family!) organized our Dinh Hon celebration on short notice after I proposed to her on my most recent visit to Vietnam in November, and none of my family could be in attendance. My parents are eager to meet her and her family but will not be able to travel until my father recovers from surgery scheduled for later this month. If they are able to go in the near future, I would hope to be able to get that evidence in front of the consular officer.

My current thought is to strive for a relatively short, well organized initial package, but this depends on whether we will indeed have a chance to provide a more complete and current set of evidence later that will be fully considered before she goes in for the interview.

Thanks much,

Eric

My fiance and I also got our approval at the beginning of September. Once we got our approval, we had him get his police report. During this wait time, the NVC logged us in and we got our new case number from the DOS (LND#######) for London. Once he had this, he was able to schedule his Medical. He has yet to receive his "packet 3", but he has already called the embassy and they've logged our case into their system. He should be mailing them all of our forms in the next day or two. I hope this helps you and good luck in your journey!
Cheers!

Hello Everyone, first off I would like to say what a GREAT site this is with so many wonderful people! Congratulations to all of you that found Love and made that dream come true with perseverance and patience (lots of patience!) Anyway, as We (my Fiancee and I) are gathering information to start the K-1 Fiance(e) Visa process we have come to a question we have been unable to answer on the I-129F form. Question # 15 Your fiance(e)'s address abroad? Here is the confusing part, she is Hungarian, owns a house in Hungary but works and resides temporarily in Italy. We would prefer to use the Hungarian Embassy but where she works in Italy will that make a difference as to which Embassy we can use? And which address we should write??

Thank You in advance,

K-1 Fiance(e) Visa Process & ProceduresCosponsor question
The person needs to be a USC.

Please read through the guides and faq for more information regarding the affidavit of support.

There is no 'second part' of the K-1. You have petitioned the US on behalf of your fiance in order for her to immigrate to the United States. Once she is approved at the USCIS she will then apply for a visa with the Embassy. It's an entirely seperate process.

If your boarding passes aren't enough to prove to the uscis that you have met within the last two years then you will be sent an RFE and they will request more proof... your passport stamps. This will come only after your petition has sat in storage for a while and when an adjuticator finally works on your case.

Most proof of on-going relationship is usually reserved for the Visa Interview at the Embassy but many will recommend sending at least some along with the initial peittion. Especially when dealing with a high fraud Embassy.

Most of the answers you are looking for can be found in the tabs and links at the top of the forums. Learning all you can about the process and the Embassy you are dealing with and then preparing as best you can is your best bet!

good luck to you
