No, they don't tend to for K-1's in Manilla unless (in very few circumstances I've seen) the beneficiary is just out of school.

What pushbrk is saying is that where he used to work will not matter. What they care about is where is currently working and that he is making enough so that you will not become a public charge once you are here.

His tax papers should show his past income and the fact that he has been gainfully employed in the past. Hopefully that will help prove that he is a worker.... but what he puts on the I-134 needs to be as current and accurate as possible.

rockhouse, please dont take one members remarks to heart. We all started this process with many questions ...and some of us with many mistakes as well. wink.gif As I said, I too had many questions when filling out the forms and I certainly do not consider myself a moron. I'm sure you're not either! They can be very confusing at times ...which is why this website is such a great resource. Really, the hardest part for most of us is the wait after the forms are all filled out and sent in.

This is rude and uncalled for. I consider myself a relatively intelligent and educated woman but the forms gave me ageda as well...and I know i'm not the only one. Please try to be a bit more respectful when posting.

OP..I don't think anyone was hassling you for asking about a firm to help you. What we're trying to say is that we often hear of more horror stories than anything here and perhaps it's the frustration on all our parts talking. The process is difficult enough and those who have paid even more only to have someone screw it up have a right to be frustrated. Please don't take offense to others opinions...afterall, you did ask. wink.gif

pushbrk is right.. the example forms are great but the instructions are of utmost importance. You can find some here as well as uscis.gov ...right along with the forms. As he always states.. interpret the questions literally and answer as honestly as possible. If you start thinking about them too much you will start to question yourself.

Please dont be afraid to ask anything... we all had the questions once.

Go through all the links I gave you yesterday and read, read, read..before you fill out anything. wink.gif

Regardless of the legal ramifications which may very well play into the equation here...

At certain Embassy's the 'age factor' can have significant bearing on the CO's decision whether to issue a visa or not.

Sydney is not a high fraud post. In places like HCMC, China, Vietnam, PI, the Middle East...etc...a relationship can be scrutinized a great deal. The significant age difference can, and very often does, add yet another level of doubt about the circumstances of the relationship.

In these situations it is best to know just what to expect and prepare well ahead of time with as much proof as you can.

To the OP, that age factor does not always come into play but it really matters what Embassy you are going through as not all are created equally. Your significant age difference, and the fact that your fiance is so young, may very well play into the CO's decision. There will be much higher scrutiny involved at a high fraud Embassy. More details are needed to get a more accurate answer.

The decision whether it's considered legal or not is often left up to the perception of the CO.

As stated earlier in this thread, even if you say it's not legal... your CO may come to another conclusion. We've seen this scenario played out an awful lot here on VJ. People having ceremonies, people wearing rings, people referreing to each other as husband and wife. Even though we don't think these things should matter when the law states otherwise..it often still does. The process is difficult enough without adding yet another equation.

Personally, I woudln't take the chance.

Gemmie, Russell's poe from NZ was always LAX but Logan has a pretty good rep from what I have gathered over the years.

He was actually denied entry in Dublin, IRE where they have US immigration before you enter the plane...sent through London and onto Auckland.

It does make a lot of sense that they would scrutinize places that are not known vacation spots here in the US. I think even moreso, they look at previous travel dates and length of stay. With ESTA now in place I would hope there would be less worry for those like us.

POE officers dont normally have a record of the petition or your relationship with anyone in the States (unless you've mentioned it at some stage). But I would not recommend someone saying they are coming to 'visit their USC fiance' just because you got lucky. Some of us know what it's like when you aren't so lucky. sad.gif

I can't see the point in adding the extra scrutiny when it is just as honest to say you are on vacation or staying with your friend? That's still the 'truth'. wink.gif

Gemmie, you have a great point. I would assume that being that you've crossed the border so many times already, there would automatically already be added scrutiny on your visit. In that case, I would think that being completely honest (the whole truth and nothing but the whole truth) may work to your benefit. I hope it continues to. smile.gif

I too am self employed and submitted my tax records and 1099's.

The NZ Embassy (which is very lax in regards to the I-134) also suggested I provide a letter from some of the people that I work for stating that my position with them was ongoing and that my income was to be at least a certain amount for the foreseeable future.

Maybe that will help in HCMC as well.

If you have been working for the same people all that time it shouldn't be hard to prove.

The income you need to prove is based on how many people that are/will be dependent on you. If it is just you and your fiance, right now that 125% is at 17,500. It may go up some in the months to come as it will be a new year but I would imagine $50,000 will be more than enough. wink.gif

If you are told your case is held up in security checks then there will be little/nothing they can do about it.

Just thought i'd mention that for some people the I-797 is really the easy part. Even though the CO is not suppose to re-evaluate an approved petition, we all know that this happens and the interview can be the more difficult part for those going through higher fraud posts. The good news for you is that Canada is not a high fraud Embassy. smile.gif

We've known each other since 1998. Have spent our savings travelling, living together both abroad and here in the States. We were sort of forced to be apart for more than a year as we waited out this process. It was VERY difficult and highly stressful for both of us... and I was a psych major. laughing.gif Now that we're finally married and together for good, we can now look back and see all that it's added to our already strong connection. I'm sure it will be the same for you. Your time will come.

The online system is unreliable...at best. It's more a courtesy.

OP.. it has everything to do with where your fiance lives in the U.S. That is where the approved petition notice (I-797/NOA2) will be sent.

CSC is notorious for taking their time getting approved petitions over to NVC. Your next step is either to call NVC to see if the case has arrived there (need to talk to a human as they're not entered into the automated system). Or wait a bit and call DOS to see if/when it was sent to the Embassy.

...or, simply wait for word from the Embassy.

If you have a question, first do a search of the forums to find your answer. If you can not find it then post and ask.

It's against TOS to tell you not to use a lawyer, so I wont say that. wink.gif But, if you case is straightfoward...meaning no overstays, criminal background...need for waivers...etc. Then you can surely do it by yourself... with the help of VJ. wink.gif

Yup, my love was 'allowed to withdraw his petition to enter' last year for visiting too much. Of course, he basically lived here. whistling.gif We are now happily married with no hold up because of all the time he spent here.

Basically they care if you are spending more time in the U.S. than in your home Country.

ESTA pre-screening will soon be in place so VWP travellers will need to apply for travel at least 72 hours before entering. An approved Travel Authorization is not a guaranteed entry, but a prerequisite to travel to the United States by air or sea carrier and should help with those worried about a possible denial of entry. It will probably also stop those of us who used it to spend so much time together.

As Carla stated, it has everything to do with the Embassy you will be interviewing with. February seems a long way off now but in the scheme of things, two months isn't so bad. There is a possibility you can contact the Embassy to try to have it expedited... doesn't work for all.

Manila does have a unique process but it's possible your fiance misunderstood. After approval you are put into AP which COULD take up to 6 months or more. I don't believe most people wait that long at all. Read here for more info on the process in Manila.

I believe everything you need is downloadable anyway.

Nich is one of the resident experts on London and I know she printed out all the forms instead of waiting.... hopefully she'll stop back in.

Also, are you aware that, even though you're using a co-sponsor, you are still the primary sponsor for your fiance and will also need a notorized affidavit and supporting documents? Read the FAQ. wink.gif Everything else you need to send as USC fiance is listed in the GUIDE.

Like Nich stated, it's very likely your scrapbook wont even be asked for at the interview. Proof of bona-fide is important but usually a much greater concern at higher fraud posts.

It will be a nice keepsake for you though. smile.gif
