There are security checks at every stage of this process and yes, it's common for some to get caught up in AP/AR (administrative processing/review) even after the interview... Unfortunately, nobody can tell you how long this will be if it happens. There is usually nothing that can be done about it. People can be held up for days, months... or even years.

Although it's not necessary to attend the interview, in some higher fraud Countries it's often recommended that the petitioner travels to be there with the beneficiary at the interview, even if they can not take part. I have no idea if this is the case in Iran. You will want to check your portals link (which, if you fill in your timeline, will lead you to others who are going through the same Embassy), the Embassy info/reviews links and perhaps the Regional forums here on VJ to get a more precise answer on this.

I don't believe the OP was asking for advice on her relationship...

Your dad's info should be as current as possible for the Embassy to review. There has to be a way for him to get the info he needs to you from wherever he is in the world. You can email/fax/snail mail from anywhere. He and you will both need a notorized I-134, letter from employer stating income is ongoing, paystubs and tax transcripts. As stated, if he meets the requirements, he will most likely not need bank statements or proof of other assets.

Each Embassy can be very different in the requirements so your best bet is to contact the Embassy directly, explain your situation and get an answer from them.

Most likely but tt depends on how many people you are/will be responsible for (including your fiance).

See 2008 poverty guidelines here Keep in mind, these figures will most likely increase a bit in the coming months.

If you do need a co-sponsor then that person will need to supply all of the same documents that you will. A notorized I-134, employer letter, pay stubs, tax trancrips.... it's all in the GUIDES.

Because of the Embassy you are dealing with, the latter stages of this process are probably not going to be as smooth, or as quick, as you are assuming. Expect much more scrutiny in dealing with GUZ.

Do your very best to collect all bona-fide relationship evidence you can now... record everything... save everything that proves an ongoing relationship... visit the China Regional thread here on VJ and www.candleforlove.com.

CSC seems to be taking 5-6 months for the adjutication of the initial petition... the approved petition (I-797/NOA2) is then sent to NVC briefly before it is sent out to the Embassy. From this point the process is Embassy specific so it's best to check the timelines of those who have also been through GUZ. Try your portals link, the Embassy review/info links and the Regional threads for more info.

They can put into the system anything that you tell them. Some put more than others... hard to know.

If you tell the truth (not offering more than is asked) and bring proof that you are returning to your home Country....well that's the best you can do.

Whether you get in or not has everything to do with the POE officer who is interviewing you. It is up to you to prove that you do not have immigrant intent. You can have a valid visa and all the proof in the world and still be denied. The officers decision is final.

ESTA is before you go... not when you're going back home. wink.gif I do know people who have voluntarily used it but have to say that I don't think i'd add that extra scrutiny before I had to.

Sorry i'm just getting to this now hon. Ummm lets see.. first visit was 2003... then...

2006 - april - stayed 2 weeks
2006 - kids and I moved to Aus/NZ for a bit
8/2006 - russ home with us for 90 days
12/2006 - left for a few weeks and back to the US again for 90 days
3/2007 - Russ and I to London for the weekend then back to US for 90 days
6/2007 - Russ and I to Iceland for the weekend and back to US for 90 days (close one... had to talk the officer into letting him in whistling.gif )
9/2007 - Russ to Dublin for the weekend... Dublin has their own US immigration.. denied entry. sad.gif

So, as you can see, we really took advantage of the VWP as I was waiting a long drawn out divorce and we really just wanted to be together as much as possible. I certainly wouldn't recommend this to any one else especiallly now that they seem even more strict with the VWP guidelines and I imagine much of this will stop now that ESTA is starting.

Of course, there are those who have been denied entry for simply not having enough ties. It's really a ####### shoot but i'd say that on average most people are allowed to visit as long as they are not taking advantage of the VWP. It might be presumtuous of me to say but I think you'll be fine... as long as you dont do what we did. wink.gif

Yes, I agree, it has everything to do with the person asking. That's why I said checking with the ESTA might not be a good idea as it just adds another factor.

But I still say that if you're already being questioned (at POE) about your fiance (in case they mentioned it anywhere...etc) then it's always best to tell the truth. Misrepresentation is a far bigger offense than is being 'allowed to withdraw your petition to enter'. wink.gif

We spent more than a year coming in and out of the US every 90 days so I feel your concern.

Unfortunately, nobody can tell you what is going to happen at the POE. I think you are as prepared as you can be but it seems that they are getting much more stringent because of so many taking advantage of the VWP.

It's important that she tells the truth but does not offer more information than needed. Of course, if she is asked, she should tell the truth about you and about her intentions in the US. Seems likely they will ask if she spent the summer here. Perhaps even bring a copy of your NOA1 so they understand that you are going about this the legal way and just want to spend time together. Again, bring it out only if things start to get steamy. wink.gif

ESTA is voluntary until Jan '09 but i'm not sure i'd risk that at this point.

good luck... i agree, it's an awful long way to travel to get turned away. Perhaps have a backup plan in another Country just in case?

Also, it will have no effect on the K1 unless you/she breaks the law. Russell was turned away in Sept 07. The only issue he had was that he was still on the 'watch list' when he entered the Country and needed to wait about 20 min for them to clear that up.

Incorrect.

This couple just filed the I-129f petition so they do not have a new case number issued by the NVC. Also, not every Embassy is created equally so please do not advise without looking at the timeline of the OP and if you are not familiar with the Embassy in question.

Although the medical is suppose to be valid for up to one year there have been several reports of the CO wanting a recent exam. Also, after the beneficiary enters the US and you are married you then need to apply for AOS. No additional medical is needed if your overseas medical was recent enough..usually within a year.

Another thing, only a panel physician designated by the Embassy is allowed to perform the medical. This list is often published on the Embassy website but you will need to double check that the information is accurate and that you are going to the right place. This doctor will send the Embassy the results of your medical... if the Embassy has no record of your case (because you just filed) they wont even know what to do with it. (this is something that the Embassy in NZ told us happened recently and the person needed another medical)

You still have quite a way to go with this process and any number of things can hold you up...for any length of time. The average for approval (I-797 noa1-2) now is 6 months then there is the wait for the interview (also dependant on the Embassy). So nobody can tell you if and when you will reach that point. Your best bet is to wait and have your medical closer to your interview date so that it remains valid for the entire process and for AOS ..otherwise you're just wasting your money and time. What you can do is get all the vaccinations you need from your primary care physician if they are covered. This could possibly save you some time and money later. wink.gif

If you plan on residing in the US then marrying in France and then filing for a spousal visa, is not going to get you here any quicker. If anything, it will take longer.

If your check has been cashed then your process has begun. NOA1 (I-797) is of little importance. It's the second one (approval) that you need. You can register at uscis.gov with the EAC # on the back of the cashed check.

Having a child together will do nothing to help speed the process.

There is no easy answer for this.

It used to be that an RFE was issued when the original signature was missing but there was an interoffice memorandum issued to all Service Centers in 2005 explaining that an RFE is not to be sent when there is no original signature and the beneficiary is residing abroad.

However, not all adjuticators are created equally and not all follow the guidelines as set.

In simple terms, some people receive RFE's for this and some do not. If it were me, I would wait for the originals but perhaps sending the copies with a copy of the memorandum I posted above would work? Your choice.

Remember, there are 4 pages that should print out with each G-325. wink.gif

I may have already told you this but just be sure Part C, Q 2 of the I-129f is checked. Many people do not realize they should answer this as the question above it is military related. It is probably the most common RFE I see. They should change the form but eh, it is the gov't.

It depends who is the beneficiary and who is the petitioner really. Might depend on the Embassy as well.

I agree with pay that it is ambiguous... Really hard for anyone else to say one way or another.

If it is the beneficiary you are speaking of, it depends on the results of the medical and possible psychological evaluation she will endure.

You should fix your timeline. wink.gif Control panel link at the top. You have the wrong Country, the wrong filed for info and the wrong local office listed. People here will be able to help you a lot more if your information is accurate. Also, if you enter the correct information you can use the portals link which will put you in touch with others who have gone through Lima.

I'm going to assume that your U.S. Citizen filed a petition (I-129f) for a fiance visa for you???

If this is the case then here is the K-1 Flowchart which will explain how things normally progress with this visa.

Depending on whether he/she filed with CSC (California) or VSC (Vermont)..there are threads dedicated to June filers here in this forum. Many of whom are still waiting for the approval from the USCIS.
