If you need to change the country of residence and you have not received your NOA2 but are a few months into the process (have already received NOA1), the best time to do it is when your case gets transferred to NVC because at USCIS it may be difficult for your request to get to your file. When your file gets transferred to NVC, call NVC and request the change. Just be sure to stay on top of things so that your case doesn't get sent to the wrong embassy.

No, they do not need to know about a job change. You can inform them of this at a later time.

I have a second question. Is there anybody out there a duel national, like myself?(Britain & South Africa) I just want to know if anyone has info on this, like if it makes the process harder or if there are particular steps that need to be taken that are different from normal?

I have no direct personal experience with this but I have not seen it create a problem.

EG. a question on the packet 3 form that asks what your nationality is. They only have space for 1. I know I need to put the nationality of the country I am applying from, but I'm sure the US government would like to know if I'm a duel national?

If there is not enough room on the forms attach a seperate sheet and note the attachment in the space provided.

If someone could enlighten me on these questions that would be fantastic!

There is only expedite which is VERY rare.

Do not worry about touches... some people go the entire process without a 'touch'.

There are different forms at every stage of this process. If you've just begun then all you've done is petition the US govt to get an approval which will then allow you to move on. The DS-157, along with many other forms, is used at the interview stage when your fiance is actually applying for the visa. Then there will be a bunch more at AOS once your fiance is here in the US and you are married.

Yes, you can normally use child support.

If you use a co-sponsor, she will need to provide all of the same documents and supporting evidence that you will proving that she plans to make what she has in the past. I have no idea if your friend being on maternity leave will effect the income as each Consulate is very different in their standards for the I-134.

As pushbrk stated, it's very dependent on the Embassy your fiance will be interviewing with. Each one has different standards they use when it comes to the I-134. For instance, in the Phillipines, you can not normally use a co-sponsor for a K-1 visa... in NZ they care more about the beneficiary's ability and desire to work. So, the answer to your question is dependent mostly on which Embassy your fiance will be applying for her K-1 visa with.

In many places, what they will care most about is your present income and if that income will continue. While you do need to place your present employment record on the initial petition, the financial responsibility doesn't often come into play until the interview stage which is often about 6 months after the initial I-129f petition is sent in.

Whether you can use a co-sponsor or not is dependent on the Embassy your fiance will be interviewing with. Most will accept a co-sponsor but some will not.

If you are using a co-sponsor you are still the primary sponsor and must provide all of the same documents and supporting evidence as your mother. Your father will not need to fill out the same even if he is on her tax forms unless you are using his income as well.

OP... i'm sorry for your circumstances and what you went through. That is truly awful and do hope you took some valuable life lessons away from it.

I don't think we're saying that you will be denied.. but you will certainly be asked about it at your medical appointment (where you MUST be truthful) and you may even be sent for an evaluation (to a us approved panel physician) to confirm that you are 'ok' now.

In NZ my now husband needed his A# to schedule his medical. If you don't already know this, it should be noted on your I-797 (noa2). There was a paper in P3 that he needed to fill out and take to the doctor's but the office also had these forms and after all of the info was submitted, the paper was destroyed, so i'm not sure how important it is to have.

Hmmmm the real people you're talking about consist of uscis phone call operators who have standard 'you are within the processing times call back again after XX days' and really know very little. You will learn even less from them. There's a reason we call it the misinformation line. wink.gif

The adjutication process is very different for everyone as there are security checks at every stage of this process that can hold you up... yes, even if you have no record. wink.gif Petitions are stored away until an adjuticator is ready for the box yours is in.

The best estimate you can get for adjutication is in your timeline. This is based on VJ data, which is just a very small percentage of actual filers, but it's still the most accurate 'guess' you'll get.

While it is suggested at some Embassy's to have the USC there for the interview, the same rules do not apply to all. I would hate to see others worry needlessly about not being able to attend the interview. $2500 flight and 20+ hours of air time.... I certainly didn't attend.

You need to check with others from Costa Rica to find out whether there is a packet 3/information packet sent out from the Embassy. Each one is very different in how they handle the process and what they request from the petitioner. check your portals link, embassy info, embassy reviews... The best thing you can do is contact the Embassy directly and ask.

Normally you will need to include at least one year's tax return, pay stubs as well as an employer letter stating that you have a job, what you make, and that that job is going to last. I believe there are plenty of examples here if you do a search.

Well, the good news is that you've probably found the best resource possible for international couples wanting to be together in the US. Also, you have two years to get through the process so you have plenty of time to do your homework. wink.gif

You will want to start here with the K-1 GUIDES This will tell you step by step what is needed to file a petition on behalf of your fiance.

There are several stages to the process. You can learn more by reading the K-1 flowchart here.

Basically the process can take from about 6 months to a year depending on how fast the processing centers are working and the Consulate you are going through. So much has changed over the past couple of years that it's hard to use the historical data to guage how long it will take. Also, if you're not filing any time soon ...things could change again. wink.gif

Once you fill in your timeline with dates you will be given an estimated adjutication date range. This is based off of the vj users database but is normally pretty accurate. This is for the petition to be adjuticated at the uscis center. Once approved it will be sent briefly to the NVC (national visa center) and then off to the Embassy. I believe London is taking a couple of months to interview but you can learn a lot more about that in the regional forums here on VJ. We've got lots of very nice folks coming from London. wink.gif

Once the visa is issued you will have 6 months to enter the US and then 90 days in which to marry before adjustment of status.

wow... the question was asked and answered. I dont think anyone was rubbing anything in anyone's face and I do think that post in response was quite rude.

At the beginning of this year VSC was approving petitions in less than a months time whilst CSC was taking 6 months, still trying to catch up with the backlog from last year's fee increase. Sure, the disparity is quite unfair (I even wrote my reps about it even tho I filed with VSC) but how is it the fault of those who get approved fast???

The system isn't always fair... it needs an overhaul..sure. But that should take nothing away from those who are approved faster than others. We don't know their stories... we don't know what they've been through or how long they've waited to be together.

Let's try to be tolerant and understanding instead of bitter. We all suffer through this. I'm happy for anyone who finally gets to be in the arms of the one they love.

Oh and just FYI... i've known my new husband for 11 years and we were forced to be seperated for more than a year before he was able to come on the K-1 visa so i'm not just blowing smoke here.
