Unfortunately, I don't think the US is to blame. As we've learned here and as pushbrk showed us in this thread, China is quite a high fraud Consualte and many USC are 'conned' (for lack of a better word) into bringing over their Chinese 'fiance'. It really does hurt the couples that are truly in love and that's too bad ...but that's just how it is. I suppose the CO's see you as guilty until proven innocent. China is not the only Consulate like this. sad.gif

OP.. i'm very sorry about your situation. Take pushbrk's advice, as he is the resident 'expert' on China, and find out exactly what the paper they gave her says then go from there. This is a very common scenario at the Embassy in GUZ.

You have only to visit the Regional Thread here on VJ or www.candleforlove.com for proof of that.

It's imperative you do your best to try and keep your petition at the Consulate and not let it be returned to the US.

Filing another I-129f to 'try again' will do you no good.

hmmm they're not married.

Having a tenative wedding date is ok but I wouldnt put any money down just yet. The K-1 process can take 6-12 months (+/-) depending on many circumstances. But the process and timelines change all the time.

The initial petition stage can take up to about 6 months to approve and then the petition is sent to one of the two Embassies in Canada where you will wait to be interviewed. Have a look at the Embassy info/Review link above to find out wait times for that Embassy. I think it's a couple months.

Once you have the K-1 visa in hand you will then have 6 months in which to use it to enter the U.S. and then 90 days in which to marry. So, plan your filing and interview for the visa accordingly.

K1 requires the marriage take place in the US after the visa is issued but within 90 days of US entry. You will not have the visa in time for a June 10 wedding, meaning you'll either need to change the date or considerably or wait until after the marriage to file for a spouse visa. As of today, traveller's must now register their trip with the ESTA system . So, whether they will know about our K-1's now or not has yet to be seen.

There are no restrictions against travelling while a K-1 is in process. The problem that can arise is that it shows that you may have immigrant intent... that's to say that you'll come into the U.S. and marry and adjust while here. This is illegal to do. Therefore, if they suspect this, you will be denied entry. Ask me how I know. wink.gif

Travelling to the US for a visit is usually fine as long as the beneficiary uses the priveledge for just that... a visit. Also, that they can prove that he/she will be returning to their home Country and does not plan to attempt to circumvent immigration laws by 'visiting' and then adjusting status while here.

Being denied entry (as long as there was no overstay or any other circumstances) does not effect the outcome of the K-1 either.

He can probably be interviewed in Australia but if you're only going for 6 months, it's possible you will not yet be at that stage by then.

If you do list Syndey as your Embassy you will probably want to make absolutely sure it's listed as the interviewing Embassy before it leaves NVC. wink.gif

You can travel wherever you like whilst you await the process as long as you have a mailing address in the US where your paperwork can be sent and keep in mind the requirements for the affidavit of support.

I know you're just venting so i'll refrain from reminding you it's only been a couple of months ....since i'm sure others will. wink.gif

As far as getting together and 'doing something'... well, when i started coming to VJ in 2007, it was right after the fee increase which caused a huge influx of petitions that backed up the system for months! Also, only two service centers started handling all K-1 petitions. These approvals that are now taking 4-6 months were taking more like 8-12 with no end in sight. During that time people tried everything they could to try and light a spark under the uscis... including sending kisses (yes, hershey kisses) to the USCIS in Vermont (which they could not accept). So, not even chocolate worked! laughing.gif

To continue the story... then in January of 2008, VSC was approving in less than 30 days while the poor people from CSC were still taking 6+ months! Now it seems CSC is quicker than VSC.

What i'm trying to tell you is that you're not the only one who feels this way and that it has been much, much worse. What I tell people who are frustrated is to contact their representative.

Even before we were able to file I sent emails to all my reps stating my opinions regarding the process the long waits and time apart ...and the disparity between the two centers at the time. They are your voice... use them.

Until then, love your fiance... spend as much time communicating as you can and know that this will end and you will be together!

As long as you've met within the last two years, you are both free to marry and you are a usc you can file whenever you like.

I think you answered your own question... you are not yet ready for marriage and you're going to see how it goes. So, she is not entering the U.S. with the intent on staying. She is entering for her education and to spend time with you... if you decide while she's here that marriage has become an option for you then you can marry and adjust status.

The way I see it becoming a problem is if she leaves and then crosses the border again WITH THE INTENT OF STAYING.

In NZ they request the CV/Resume of the beneficiary at the interview. They seem more concerned with the ability and desire of the alien fiance to work once approved to do so in the States. I doubt very much that's the case in SA and I dont think it will help with the question of the affidavit, although it may help to sway the CO's decision regarding the visa. wink.gif

Russell has his master's in Geology/Chemistry and he did have some prospects here in the States before coming too. I am self-employed and he could have easily worked for me too BUT until that EAD is good to go it is simply not legal.

The I-134 is not a legally binding affidavit, it is used for non-immigrant visa's (such as K-1's) to help demonstrate that the alien fiance will not become a public charge.

A provision of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 created a new Affidavit of Support, Form I-864, which is much more extensive than the I-134, and creates a legal obligation on behalf of the person who signs it. This legal obligation means that the sponsored immigrants, the federal government or any state government can sue the sponsor if the sponsor fails to support the immigrant. The Affidavit is enforceable either until the immigrant naturalizes or has worked for ten years/40 quarters. This form will be filled out after marriage when Adjusting status in the U.S.

Your estimation for approval seems a bit off. First rule of thumb...don't believe everything you're told. wink.gif

Have a look at the timelines here and understand that they can change dramatically at any point. Ours took 120 days. Just two months before we filed...some took less than 30 days. wink.gif

If you have the opportunity to stay with your fiance in her home Country and file for DCF that may be your best option but do your homework and be sure you will meet the new criteria as set by the Adam Walsh Act in her Country.

You do not need a waiver (even at interview) for being allowed to withdraw your petition to enter the Country. There just isn't one. All it means is that you are not longer eligible for the VWP. The process is very similar for all...as explained above. The couple mentioned above must have incurred overstay or must have been deported (big difference) not allowed to withdraw.

Many people are turned away at the border for the same reasons we were.

You can be held up for any length of time, yes. But, the majority aren't held up as long as that.

People get 'stuck' for all sorts of reasons. It could be something as simple as having a name similar to someone on a watch list.

Being denied entry (aka allowed to withdraw your petition to enter the U.S.) should not be a problem... wasn't for us or the many others I know of that have had the same experience. wink.gif

Often we hear that even though someone has called for changes at the uscis, rarely is it actually done. wink.gif Best to address most changes after noa2/I-797 with nvc or dos/embassy.

I wouldn't worry about a wrong date too much. Can you imagine the errors with dates that must be made considering the standard for dates is different all over the world? wacko.gif Lots of people report putting the wrong dates 23/1/70 instead of 1/23/70...etc. or other small errors and they get through ok.

I forgot to change the letter of intent so it stated that we would marry within 90 days of me entering the US... only, i'm the USC. laughing.gif

You could perhaps try to call but it probably will do no good...and at worst, it's an rfe for clarification. have a look through the RFE thread (sticky topic) to ease your mind.

As cdneh stated, there are security checks at every stage of this process. Each is different and each can hold anyone up for any length of time.

National Visa Center is located in New Hampshire, therefore, Vermont filers tend to get there faster. Normally, an approved petition (I-797) is there only a matter of days for processing and shipped to the appropriate Embassy via DHL in a very short time period. It does seem that more and more people are getting held up in security checks at NVC but it could just be that more of us are so aware of the process and are paying closer attention too. wink.gif

There are security checks even after the interview and final approval. This is why you are told not to plan anything until that visa is in your passport and in your hand.

The majority of people don't seem to get stuck too long but the idea of it alone adding more time to the process is daunting. sad.gif

Separating the check from the petition is the very first step in the process and it is not done by adjuticator's so nobody has gone through yet to see if all conditions have been met.

I will tell you that if you have not met in person, you will be very likely denied and lose the money you sent in. Extreme hardship for not having met this most important condition is virtually impossible. Sorry.

You need to register with uscis.gov if you want to get automatic updates to your case. Simply enter a user name, password and your EAC/WAC number from the back of your cashed check or your NOA1 (I-797).

Each petition is put into a standard format and given a bar code that is 'suppose' to be scanned when the petition is moved from one location to another, worked on, looked at...etc. When the petition is scanned the date on your case status online will change (see below)..this is touched. We have learned here that 'touches' are very inconsistent and although they can mean an approval is on it's way, they often mean very little and shouldn't really be taken too seriously. wink.gif

Touches are more of a luxury in this process... they actually mean very little so don't worry about no touches.

Call NVC... you will need to talk to a person at NVC as K-1's are not entered into the automated system.

NVC 603-334-0700. Press 1 and then 5 to talk to someone.

You will then be asked for the petitioner's name and DOB and then the beneficiaries name and DOB. If they have received your approved petition (usually in a matter of days for VSC filers and soon thereafter for CSC...usually ) they will give you a new case number.

If they tell you that your petition has been sent off to the Consualte then you can track your petition with DHL (optional) to find out when it arrived at the Embassy abroad. Usually within a matter of a couple days of it being sent off. Please use the search option to look for threads on how to do this.

Another option is to call DOS to see if your approved petition has arrived at the Embassy. (202) 663-1225 Press 1, then Press 0.

At most Consulates you will need to supply them with the most recent year's tax transcripts to prove income. If you collect everything now you will not have that.

Also, my guess is that the Consualte will want much more recent proof of income (employment letter/pay stubs...recently dated I-134) as the process is likely to take at least 6 months.
