That being said, having a US fiance (if they know about it) is likely to bring up the quesion of immigrant intent but it certainly does not stop you from being able to travel so i'm not sure why your lawyer told you that you could not come.

In most cases it's 'ok' but certainly not all.... My then fiance was turned away in Sept of '07 but he had been spending more time in the U.S. than he was in NZ and had no ties to his home Country. It kept us separated for a year sad.gif but did not effect our K-1 at all.

You sound like you have good reason to travel. File with ESTA. Tell the truth. Don't overstay. Bring all the proof you can and have a wonderful time! smile.gif

Yes, question is asked quite a bit so do some searching to find out what to bring to prove there is no intent to immigrate.

Also the rules are changing.... beginning Jan 12, 2009, VWP travellers will require an approved ESTA prior to boarding a carrier that will bring them to the US.

This approval does not guarantee that you will get into the Country. That decision is still up to the POE officer, however, it's likely that anything that would prevent you from entering would be caught early enough on to prevent being turned away.

Tell the truth, answer only what you are asked, bring ties to home and do not spend more time in the US than you do in your home Country.

Most would recommend saving proof of on-going relationship until interview stage of the process but it's very dependant on the Embassy you will be dealing with. If you will be interviewing with a high fraud post, it's often advisable to load the initial petition with some secondary evidence and then collect more as you await the interview. However, when dealing with a 'lower risk' post, this is not really needed ...but very often people will send something that shows ongoing relationship either way. wink.gif

The most important thing is that you educate and prepare yourself as best you can.

Neither of those documents require a notary's signature. The only paperwork that needs to be notarized is the affidavit of support (I-134) which is filed after approval (NOA2). However, the new form and directions for that are still unclear on whether it's even needed anymore.

The K-1 Guide will list all documents needed by both of you.

i did not mean it the illegal way.
i meant if the fiance already had the visitor's visa, why not marry there? since the OP's problem here was how much they were gonna spend and if it was worth the expense.

i meant IF the partner already had a tourist/visitors visa.
i had a tourist visa and still came flew back to the PI then apply for K1. if i only knew it was that costly and with USCIS delaying things, i should have just stayed and got married. but still regardless... weighing it down... i was glad we went through the K1 cos it got me thinking if i really wanted to be with my bf and vice versa.
USCIS really shook the insanity in both of us. and made us realize how we really felt for each other.
it turned out to be a blessing in disguise.
you truly find out how important you are to the other person. everything was worth it.


Just to be clear...

Having the visitor's visa issued is not the problem.. just because you have a visitor's visa to the U.S. does not mean you can use it to immigrate.

Entering the United States with a visitor's visa with the intention of marrying and then adjusting status so that you can stay ....is illegal.

Obtaining a visitor's visa with every intention of using it to come to the US, marry and then adjust is misrepresentation and is also illegal.

Any way you look at it, entering the Country on anything but a fiance/spousal visa (or a dual intent visa that allows for it) with the intention of adjusting status is fraud and punishable in the form of a ban. It is also against the VJ TOS to suggest any form of immigration fraud.

I realize some so-called professionals may suggest this (entering on a visitor's visa/marrying/adjusting) as an option but it is a slippery slope to go down and one I believe could result in many legal issues and heartbreak for these couples.

The folks that enter the Country, meet the 'love of their lives' or simply decide (after arrival) to marry and adjust status are not breaking any laws because the person immigrating did not enter the Country with the intent of immigrating.

I hope this clears things up and makes sense.

Phone messages are only secondary evidence for proof of an on-going relationship so it would really depend on what else you have as far as evidence. Do the best you can to document all interaction you have with your fiance. Visit the PI Regional forum here for more advice on this.

It depends on the document but copies are usually fine for uscis. The K1 Guide clearly states which documents need to be 'original certified copies' and/or 'originals'... things like divorce decree can be a copy of the certified document but you may want or need to send the 'original certified copy' (the one with the raised seal) for the interview stage. All signatures should be original... letter of intent, G325...etc.

3. How important are letters, we send lots greeting cards but we speak each day so only a few letters, which we will begin writing more as I can see we need them but up to now were they important.


4. Chat logs, I have months and months worth should I just narrow down to a few, especially ones that talk of marriage as each day gets to be 20+ pages, and how many would be a good amount to include.

Again, all secondary evidence that will be needed more for interview stage to prove this is a bona-fide relationship. USCIS cares that you are both free to marry and that you are legally able to petition your fiance. Evidence of ongoing relationship is not required with the initial petition. However, it's often suggested to load the initial petition when dealing with a high fraud Embassy but i'm not clear on how well that helps in Manillla. Check with the folks in Regionals. wink.gif


5. When I read the Assembling the I-129F Package it says "Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1." Does the word certifying here above mean "we are certifying, as in saying our intent" or does it mean these have to be CERTIFIED COPIES?

Use the example forms and simply sign them. No notorization needed.

6. When I read :Assembling the I-129F Package: Checklist " it says "Declaration of how you met in person in the last two years. This should be a single TYPED page attachment regarding question 18 of the I-129F." but when I read VisaJourney.com > K-1 Fiance Visa Tips K-1 Fiance Visa: Tips on Forms and Documents it says "

Declaration of how you met is a question on the I-129f. Because there is only little space provided on the form, some people attach a addendum to the form and reference that addendum in the space provided for the answer. This addendum needs to be signed. I'm not sure why the tips section says to have the fiance write their own up but I will address the issue with VJ administration.

It's important to keep in mind that processing times change ALL the time. For instance, a year ago, VSC was processing petitions in less than a month's time while CSC was still trying to recover from the backlog caused by the fee increase the previous year.

How long it takes to process your petition depends very much on the adjuticator handling your case and/or security checks that can hold you up at any stage, even if you think there is nothing to hold you up. wink.gif

How long your interview will take is very much dependant on the Embassy you are dealing with. You can check the Embassy info/reviews link above to find out the average for the Embassy your fiance will interview with.

Most will advise you not to plan or pay for anything in advance as this process can throw you for a loop at any point.

It's a good thing you found VJ.... wink.gif and it's awful that lawyers are giving this advice to people.

Canadian special entry privledges, VWP or visitor's/work visas (without dual intent) do not allow you to immigrate to the United States. As stated above, if you enter with the intent to immigrate you can be charged with misrepresentation and banned from the U.S.... = bad. wink.gif

If you were already in the Country, with no intention of staying when you entered, and decided to marry, you could then adjust status. Some lawyers seem to see it as an option to circumvent immigration laws but it really exposes you to much greater problems down the road.

Start here... to decide which Visa you want then read through the GUIDES & FAQ. Be sure to visit the Canadian Regional Thread here on VJ for Country specific questions. There's lots of great people there that will be of great help along the way.

Since we dont know if you're the beneficiary or the petitioner it's hard to say wink.gif In answer to your question the petioner is the primary sponsor, whether they meet the income guidelines or not and they must fill out the I-134 and supply supporting documents as well as the co-sponsor, who must be a US Citizen, however, that person does not need to be family.....

the GUIDES have all of the answers you need. Scroll down to find 'what to send your fiance once the petition is approved'. You will find the FAQ very helpful as well.

The affidavit of support tips can help answer many of your questions as well. And the example forms can help you fill the paperwork out.

Most likely your adobe reader is corrupt and/or you are running more than one version of the program on your system.

go to > add and remove programs (xp) or uninstall program(vista) (depending on what OS you are running) in your Control Panel

Doesn't sound too harmful as you did put the name listed on her documents. We've seen worse go through fine and some rfe'd for simpler things. It's really at the discretion of the adjuticator working your case. Any changes should be made through the Embassy, as noted above, or by calling DOS once the petition has been approved. Unless, of course, you receive an RFE.

It's not really because a case is 'easier' than another... Russell and I have known each other for 11 years, plenty of documentation, no criminal history, no common names, no issues whatsoever. We are just all put through security checks.

If a check comes up with anything... you are at the mercy of those doing the checks...which often takes time. Some much, much longer than others. The file is then put aside until those checks are complete.

As I stated, you may think there is nothing in your background that warrants this additional wait, and you may be right, but it doesn't stop them from making sure. wink.gif Many can argue that the system is flawed and that the checks take too long ...and they are most likely right but we have to remember that this is all in the interest of protecting the Country from those who wish to manipulate the immigration system and/or cause harm to the United States. Not to say your fiance is one of those people...but how do the rest of us know for sure unless it's checked?

The fault ultimately lies with those who have caused harm to the U.S. and that is where anger should be directed.

There are security checks at every stage of this process. Any one of which can hold 'anyone' up for any length of time.

Many from the middle east will have similar names and/or affiliations which may send up a red flag, therefore, many tend to be stuck in checks and/or AP for longer periods of time but, as you see above, anyone can be held up. We have nothing in our backround at all but we were still held up at NVC for several weeks because of security checks.

Just for the benefit of the discussion... Military deployment of USC is grounds for expidite so those folks certainly do get processed faster but unless you ask for it you're in the same boat as the rest of us. smile.gif

We can blame the CO, the Country, the system, even people on power trips... but ultimately it is those who have abused the system that make it so much harder for the rest of us.

Therefore, it's very important to provide any and all evidence of a bonafide relationship that you can, especially when dealing with these places. If your relationship is true and you are prepared and diligent in your efforts it's very likely you will succeed in bringing your loved one here...eventually. smile.gif

Hi Marie, welcome to VJ. You have found the best resource for this journey and have already got some good advice but I did want to point you in the direction of the GUIDES.

This link will provide you with a checklist of items/forms needed to file a I-129f fiance petition with USCIS. The example forms will help you to fill them out. Ever hear of the term if you want something done right... do it yourself? wink.gif Have a read of all you can from the links above..being a teacher I would suspect you are more than able to complete this process yourself and very likely save yourself time and money as well. Do some research here, read all you can and then decide.

Just so you are aware, an approved petition can take 6 months (+/-). Once approved, the I-797 (petition approval/NOA2) is valid for 4 months(possibility of extension).... this would mean your fiance would have up to 4 months to be interviewed from the time the petition is approved here at the uscis level. Once he is interviewed and issued a visa he will have 6 months from that day to enter the U.S. Keep all of this in mind when choosing the best time to file. smile.gif

It seems that sometimes they are allowed in Manilla.... and sometimes they are not. I'm not sure what the difference is but i do know of a couple that was allowed to go through where the petitioner had just graduated with a degreee and that is the reason he did not meet the guidelines. You will probably want to ask in the PI forum here.

USC can travel wherever he/she likes while the petition is being processed. The beneficiary is usually fine to come to the US for visits as well. As long as that person can prove ties to their home Country to show they have no immigrant intent when entering the U.S..

Just to clarify a bit regarding the K-1 route... once the beneficiary arrives on the K-1 Visa you have 90 days in which to marry. As soon as you are married you can then apply for AOS. With the cost of AOS ($1010), AP (travel) and EAD (work) are also applied for. This normally only takes a matter of a couple months and it is in that time only the beneficiary should not leave the Country (without AP).
