Whether or not you get an RFE is mostly dependant on the adjuticator handling your case. You can make the effort to contact USCIS and ask that the city be changed for you but, as mentioned above, whether they do it or not is a ####### shoot really. I would not panic about this.

Be sure to visit the regional forums here and read up on the Embassy in Pakistan to prepare as much as you can for interview and possible AP.

No, they should not. In fact, there is not even room for it on the updated form. This, however, is a recent change so not everyone is up to date with it. wink.gif

How about paycheck stubs and tax transcripts? Do you have those as well? You should check with others from DR in regards to what is required by you. Perhaps even contact the Embassy yourself and ask.

To enter the U.S. on any other visa besides a K-1 (or a dual intent visa) with the intention of marrying and then immigrating (filing AOS) is immigration fraud and it is against the law. Misrepresentation is punishible by ban. Do you really want to risk that? Some people, even lawyers, suggest this as an alternative to waiting out a K-1 but that does not change the fact that it is against the law. To propose one does this or to support the idea of this is against the VJ TOS as well.

Don't forget to prepare and have her sign a letter of intent (see example forms) and she will need a passport photo for the G-325 as well. While you're there take plenty of pictures and save all evidence of your trip.

Best bet is to visit the K-1 Guides here on VJ and read through all you can in the links at the top of the forums. Go down the checklist and put your petition together so you can get it sent straight away. wink.gif

All they require is 'how you met' within the last two years. If it fits in the space provided then put it in..if not, simply add an attachment explaining (a few pages is way too much wink.gif ) ...sign it and note the attachment on the form.

We had a 10 year history of travel before we filed so we included a timeline sheet as an attachment noting all the times we had been together. Probably wasn't necessary but I didn't want to leave anything to question... I also didn't want to take up more time than needed to get to my approval. wink.gif

As long as you send her your G-325 (you didn't mention passport pic), letter of intent and copies of any passport stamps and supporting evidence you have and as long as she has everything else listed in the K-1 Guide you should be good to go.

Just to reiterate, there has been at least one case I know of personally that was expedited due to the health of the USC fiance (last year) and at least two humanitarian cases (beneficiary well-being). But yes, most are denied.

It's important to understand that even if your case is expedited at the USCIS (petition) stage, you will still need to have it expedited through the NVC (if needed ) and the Embassy. If CSC tells you that your petition was approved (NOA2/I-797)... it means only that your fiance has been approved to apply for a K-1 Visa in her Country. They wont just say 'here's your visa' ... you will still need to complete the process and that will still take some time. wink.gif

I've seen military deployment and a couple humanitarian cases expedited, but i've personally only seen one case expedited for SERIOUS (Stage 4/USC) medical reasons. All had different timelines...some days ..some weeks.

Supply them with what they ask for, keep on top of it and then hope for the best.

I doubt you'll have any luck with getting vaccination requirements waived. Can she not get them at her medical before she heads over like everyone else does?

GUZ refers to the Embassy you'll be dealing with not the 'certified translator'. And yes, the interview is Embassy specific and you will do well to follow pushbrks advice there when the time comes.

It's common knowledge that China is a high fraud Country. There is a high level of immigrant fraud. You will most certainly face added scrutiny so do your best to prepare. Visit the Regional forums here on VJ as well as www.candleforlove.com for starters.

The OP's question was pertaining to the original filing of the petition in which USCIS clearly states their policy.

However, pushbrk is right in that when the time comes it's important that THIS OP understands that dealing with GUZ is going to be an uphill battle. There will be added requirements as well as added scrutiny at the interview stage for sure. It's best to prepare yourself as early as possible when dealing with a high fraud Embassy.

Joe & Nadya, because you decided to use a translator for your own petition does not mean that the answer to the OP's question is 'yes' like you stated. A translator does not need to be certified for uscis purposes. It's really that simple. Anyone else coming in here is going to look at these threads for answers to their own questions and it's imporant that accurate information is posted for that reason. We are dealing with people's lives here.

Because we had 10 year 'relationship' before we filed I sent along things like screen shots of phone bills/text message bills..etc... also used more for proof of on-going later on in the process. I also sent cc statements with highlighted charges from when we were together to go along with the timeline and photos I sent of each of our trips together.

It's not normally necessary to front load the initial petition with evidence of on-going relationship. I doubt it will be of much use in Canada but you can send it if you want. I wouldn't make a huge deal out of the details tho.

Having a US fiance most certainly shows that you have immigrant intent which is what you can be denied entry for. wink.gif Don't mention it unless specifically asked. If asked always tell the truth...misrepresentation is a much bigger issue for US Immigration than is being "allowed to withdraw your petition to enter".

With ESTA now in place for VWP Countries, I would assume being turned away will happen less but it's still up to the POE officer whether to let you in or not.

Just FYI.. being 'allowed to withdraw your petition to enter the US' and having to return to your home Country does not usually have a bearing on your visa. Unless you broke some laws or were legally deported (before a judge), It just means you can no longer visit the US because you showed intent. Ask me how I know... whistling.gif laughing.gif

I agree with pushbrk and brnidokiegurl and would NOT use money transfers as a sign of on-going relationship.

While it may be ok in some places to show financial support of your fiance, in some of the higher fraud posts it most certainly will add extra scrutiny to an already difficult process.

do your best to collect proof and familiarize yourself with the process. You will also want to visit your portals link as well as the Regional forums here on VJ to learn all you can and prepare yourself as much as possible before the interview.

Did you already obtain a SS card in your maiden name when you arrived (hope so)? You should be able to change your name for your SS card but we have learned here that they are not all created equally!

AOS is a total cost of $1010. This includes EAD and AP. Have a look at the AOS Guide to see what will be needed.

The link above explains it well. There are checks at each stage and you can be held up for any length of time at any point.

The Embassy routinely extends the validity period of the I-797 automatically if you're not going to make the 4 month timeline but I would still contact them to be absolutely certain.

At some higher fraud Embassy's things like a recent divorce (or short relationship, or being introduced by family, or supporting your fiance...etc..etc) can all throw up a red-flag that will cause your case more scrutiny but for the most part, and in most places, I believe a CO understands that a marriage can be over long before a final divorce decree is issued. This is most likely the case in Manilla

In our case, I had the packet ready to go and filed the very day my divorce was final... we had already been separated for years. wink.gif

... just to add a bit.... as already stated above, this is very much dependant on the Embassy you will be dealing with at the time of interview.

The I-134 is filed at the time of the interview. This is not legally binding. It is simply used to show that your USC fiance or co-sponsor will be able to support you and that you wont become a public charge after you have arrived in the US.

Some places, like NZ, care very little about the actual document and more about the beneficiaries work history and ability to work. Then there are some that will not even accept a co-sponsor. So it is very much Embassy specific.

They are looking at gross income not net.

The I-864, which is filed at AOS, is a legally binding document.

You will want to familiarize yourselves with each step before it comes so you are well prepared for whats to come. You're lucky to have found VJ early on. Read through all of the links above.

Read through the K1-Guide and go down the checklist using the example forms to help you fill out all you need.

The requirements are that you must have physically met within the past two years. You must both be legally free to marry and you must meet the financial requirements so that there is no risk of the beneficiary (alien fiance) becoming a public charge once here in the US. In most Countries you can use a co-sponsor to help you meet this requirements. This isn't something you need to collect until after you are approved.

You are lucky to have found VJ before you even file. Do yourself a huge favor and read through all the links at the top before you do anything. Familiarizing yourself with the process and preparing as best you can will save you a lot of heartache in the future. wink.gif
