My husband and I are filling out form I-864 Affidavit of Support and have a question about Part 5 - Household Size.

My hubby is the Sponsoring USC, and I am the Principal Sponsored Immigrant. The instructions say not to count anyone twice, so should he enter "0" under 21/C PERSONS NOT SPONSORED ON THIS AFFIDAVIT, If you are currently married, enter "1" for your spouse.

I suppose I am accounted for under 21/A PERSONS YOU ARE SPONSORING ON THIS AFFIDAVIT

I am assuming it is just you and your husband, in which case you did it right.
Everything else on that section should be zeros from c) through g) and then for h) you enter "2"

and by employment verification I mean a letter from your employer stating that you indeed work there and how much you make.

I believe that you just need to prove that you will be able to support your fiance and yourself (at 125% above poverty level is a safe bet)
You do this by showing employment/salary verification and recent tax return.

FAQ Note: Revalidating a K1 has been done only once in the newsgroup experience, early in 2000. The Consulate was unwilling to cooperate, and help from the US Citizens Congressional Representative was required to achieve success. The Representatives office contacted the State Department to verify the situation regarding revalidation. Correspondence between the Representatives office and the Consulate helped assure the revalidation. The revalidation process took about two weeks.

Looks like it is possible and has worked for someone before..

She's still here in the USA. They can simply marry and file to adjust her status. Since the marriage occurred after the 90 days allowed, he'll need to file an I-130 concurrent with the adjustment of status filing but there is no need for a new visa.


I agree. If she is here, you should go ahead get married and then file i-130 & i-485 concurrently.
Don't think there should be any problems because she entered legally on an immigrant visa.

Hi everyone...

So, heres my situation. I was living in the US for 7 yrs, my family and I came to the US late 2002 and we were there applying for asylum. Anyway, we were denied all the time and we supposed to leave the US the end of Jan 2010. My lawyer at the time screwed us up by not filing any extension to stay because we were planning to leave the end of August 2010.

With that being said, Last october I met my boyfriend and we started our relationship Jan 2010. BUT i was detained on March 2010 and given the 10 yr ban. My boyfriend really wanted me back and i wanna be with him soo bad too.

We wanted to apply for K1 visa, but i realized that we only have 1 pic together. I started to save our chat conversation and gift receipts that we have sent each other.
We dont have any visa stamp or ticket or anything.
He was going to come see me next month, but unfortunately something came up that he has to work so he wont be able to come. we want to start as soon as possible, but what should we do? Are those evidence would be enough? I have some pics of me and his kids!

And is it possible for me to obtain K1 visa with the ban that i have?
Is it true that if we are applying for K1 and get it approved, I would have an interview and I will be denied, but I have to turn in i-601 (the extreme hardship) and i-212???

I'm not sure about the amount of evidence. It might be enough. Usually they want to see that you have met within the last 2 years and most people send boarding passes showing the USC has visited the fiance's country. But in your case you were herein the US.., so maybe show evidence that your mailing address in the US at the time was near where your boyfriend lives.. in addition to evidence you listed already.

Yes, you will be denied at the interview and then have to file the waivers.

I don't think mistakes on checks will result in RFE.
They will probably return the check with a letter stating that there is a mistake
Or they'll return your entire application.
No biggie, you'll just re-send everything with the corrected check :)

I wrote a check that they didn't need and they returned it, stapled to an NOA letter.

Not sure how fast it is for K-1, but I recently filed for i-102 and it was approved super fast!
Took less than a month from filing to getting the approval in the mail, eventhough their "current processing time" for that type of application is 3 months.
I don't know if that means they are currently processing everything else as fast though..

Yes, you guys can start the K-1 process while you are here visiting. But if you are coming here to stay for a few months, why not get married and file for CR-1?
Either way, no, you being in the US in the beginning won't delay the process as long as you make it back to your home country in time to complete forms in the later stage of the process and also for the interview at the embassy.

If you are ready to spend the rest of your lives together, IMO it would be better to marry and start a CR-1 application.
With the K-1/ fiance visa, after you come to the US you still need to apply to adjust status to become a permanent resident.
But with the CR-1, upon entry to the US you will become a permanent resident and will get the green card in the mail, no need to adjust status.

It will be paid in Manila including the Medical. But the Visa Processing Fee will be paid in BPI and the medical will be paid inside the SMLEC :)

This sounds nit-picky, but the terms people use can confuse others.

The visa processing fee is not sent to the USCIS. The I-129F petition filing fee is. That is $340. Current fees for forms are always listed on the USCIS website and in the form instructions.

The visa processing fee of $240 is paid later, after there is an approved petition, when the foreign fiance(e) is applying for the K-1 visa at the consulate in their country.

my fiance received a notice last june 27 2012 that the petition for I-129F has been approved, were just wondering whats next step should we need to do in order that we can push it all through....


The Petitioner should send this documents to the beneficiary includes W2, Employment Letter, I-134, Income Tax Returns (3 recent tax years), 3 Recent pay stubs and bank statements.

Beneficiary should gather this documents Philippines Passport, Birth Certificate NSO copy, Cenomar NSO (but she should get it like a week before her interview) , Baptismal Certificate, NBI CLearance (she should get it like a week before her interview). And also those proofs of engagement and relationship like pictures, chats, phone bills, stamped passport, boarding passes. PLUS the DS FORMS too : DS 157, DS 156, DS 156K.

You mean, if my fiance will choose to send it through Express mail or courier deliveries, we will address it in Lewisville.

From what i know you can't pick where are you going to send your papers. It depends where your fiance is living for example he is living in Georgia/Alabama the documents will be send in Vermont, if he's living in Arizona/Los Angeles it should be sent in California Service Center. From what I read too is that you should send your papers in Dallas, Texas that's what it says on the website of USCIS. The Texas Lockbox will send it out to which Service Centers it is should be delivered. We send our papers to Dallas, Texas and our papers is in Vermont , my fiance lives in Massachusetts that's why.
