Hell, I was fed up with it years before we ever even filed! It's not easy but it is what it is and being upset about it isn't going to change a thing. The one thing we do have control over is our attitude. We all HAVE to remember that we are all really in the home stretch now and that even though the process is taking more time than it did just a few months ago.. it's still taking less time than it did a few months before that...and still less than CSC. Perspective! This will not be the hardest thing you ever do. I do find myself checking email more often looking for that 'CRIS' in the from column....and watching the vj timelines even more than I used to. I suppose that's a sign that it's getting close! It probably doesn't help that I have to be on the computer all day... and sometimes night too. We try to stay positive by dreaming of the day he comes back home to me. That feeling of knowing he will never have to leave my side again. Even now I have to catch my breath at the mere thought of it. It's coming... and that's what keeps me going. I would assume that since it found you, you should have no worries about it setting you back any. Did you sign up for email notification with uscis? The only other thing you should be expecting from them is your noa2 which you will know about before it comes. So it's a beautiful day here in MA today.... only one thing could make it better. Russ is done with his kiwi fruit for now and on to building what is really our home when we are in NZ. He'd be a lot happier being here working on our new bathroom but ...sigh... not yet. He's getting a tad antsy now that the time isn't passing as fast as he'd like but he's hanging in there. Although, I think if I say "soon" one more time his head may very well explode! The kids are well. Only a couple more weeks left until school is out. I let them stay home yesterday as it was close to 100 and I felt that making them sit in those classrooms in that kind of heat is just child abuse! I did, however, make them work! It's really amazing how fast the time passes and how quickly they grow. Do be sure to take the time every day to enjoy your new addition as he/she will be grown before you know it. Our famlies and friends are very supportive of us but I find that many people are simply ignorant to the process, especially when they know of others who have simply flown to the U.S., married and adjusted status that way...or even worse, are here illegally. Even the most educated professionals I know are amazed at the process and time it's taken to get Russell back home to us. Brian, I can't imagine having a fiance from Mexico and waiting through this process when so many mexicans are already here illegally! It can't be fun trying to explain the process to them. I'd point those folks to www.immigrate2us.net and let them read over the 601 waiver forum! In the end, we know what we're doing and we know why we're doing it. And when we're sitting at the appointment waiting to adjust status we will not have to worry about being denied, facing bans or proving there was no intent. If there was an easier way to make sure our SO could stay here legally dont they think we'd be doing it? I say the hell with the naysayers... kill em with kindness (and sarcasm ) and tell them you really appreciate their support and will look into it... and always with a smile. That'll shut em up! Well today marks 8 weeks to the day that we sent off our petition and honestly we were hoping to see our approval by now. I try to remind myself what a small percentage of filers we are and tell myself that there were probably hundreds of people approved this week, just not vj'ers but when the timelines here are all you really have to go by, it can be quite disconcerting to see so few approvals. It's a good thing my glass is half full! Perspective is the word of the day! We are in this because there is something so magical waiting on the other side of it and when that day comes... every single moment of this torture will be worth it! Your estimations with London seem right on. It seems about a month from NOA2 to receiving packet 3. Email is the best way to communicate with that Embassy and if you have a solid wedding date you probably want to mention that as 'sometimes' those who have a date get pushed through quicker. Brian..u so silly Well Monday has come and gone and we have yet to crown our first April VSC VJer. I suppose that's ok with March filers still waiting but I wish they would speed things up. They supposedly go by date received so hopefully we'll be looking at the same approval time as well! Good luck to you. Stephanie, I don't know what the hours of the vermont office are but I do know that many adjuticators work nights and weekends and some even take petitions home to work on. Wow, very hot here in MA this weekend. We're just home from the firefighter's memorial (all the men in my family are/were firefighter's) so all our family, friends, (even our state reps and senator's ) were there. Everyone asking about when Russell's coming home. Frustrating to have to always answer "I don't know". I sure hope we do see an April approval this week! K-1 Fiance(e) Visa Case Filing and Progress Reports	APRIL '08 Vermont K-1 Filers	The way the process is explained by a former adjuticator our files (the hunny-bunnies ) are received, a bar code is affixed, they are processed for payment and stored in a box with others received around the same time until an adjuticator empties their previous box and goes into the 'holding' area to get the next. He/She then brings it to their desk and starts to adjuticate the files one by one. This includes running checks and database searches. A touch is explained as that bar code being scanned into the system. An adjuticator is supposed to scan the petition each time it is moved so that the uscis always knows exatcly where that petition is at any given time. Some adjuticator's take files home which would explain Friday/Monday touches. My assumption is that, of course, there are some adjuticators who 'touch' more than others and that if your name(s) gets a 'hit' or if you get an RFE, then you will perceivably get more touches. I also think that many people do not understand or even realize all the times they are 'touched' and/or don't track them....BUT judging by recent months, and by those who I know understand what 'touched' is ), this seems to be a new little pattern which started to devlop not too long ago. Everything is just speculation but it's something new...and it's something to pass the time. Oui! I've been here way too long! QUOTE There may be a more practical reason for touches, but my thought is that the RECORDING of touches is a bone they throw us. Could you imagine waiting, blindly, for two or three or four (or more) months hearing NOTHING after your NOA1? Plus, I'm sure back in the day before they had the online case status service, people would get worried after hearing nothing for months and call them incessantly. I think the 'touch' is just a way to soothe the impatient AND for them not to get quite so many phone calls. Many people do actually go months without being touched and many even find they get their approval without a single scan (touch). I doubt very highly the uscis cares much about appeasing those they serve. It is, afterall, a government agency. The people they hire to answer the phones are not brain surgeons and often dispense inaccurate information anyway. It would probably cost them more to have an adjuticator scanning files so the public 'stays happy'. Whatever the case. We're in the home stretch and that feels good. Even though they supposedly process based on date received, it seems we are all getting touched close to a month after our NOA1 dates...and two days in succession. It kind of throws a wrench in the idea that the petitions sit in a box until the adjuticator is ready to work it. Perhaps there is a new procedure that runs you through database checks along the way. We are such similar creatures! I used to do the same thing until I realized I was working on that more than the work I actually get paid to do! How much happier you seem having left that place and coming to work for us... on stats! I'm still quite curious about these two touches in a row after so much time. It's good to have you. No, there do not distribute petitions based on the beneficiary's country. Here is a thread posted by a former aduticator that explains the process. Thanks for asking about Angela's sweet 16... it was a madhouse! Must have been 60 kids here at one point and many didn't leave until close to 1am...when I made them. I had some friends here as well to help me keep watch over things. About 10 of her closest friends spent the night and we all spent a good part of yesterday returning the bouncy...cleaning the yard and putting everything back where it goes. A lot of work and it was good fun for her but i'm SOOOO glad it's over!!! Now that we're in June we are getting so excited for that next step! NZ is a fast consulate to go through so after the noa2 it will only be a matter of a few short weeks until Russell is back home where he belongs! He will fly home the very day he has his visa in hand. I know we only filed in April and that it could very likely be a few more weeks until our approval but we've been waiting so many years to get to this point and now that we're so close it's hard to contain the excitement! I wonder if that will make the wait feel longer now. Chatting last night, we were reflecting back on when he was denied entry last September and the tragic phone call and realization that it could be up to a year before he was back home again (they were waiting much longer then due to the influx). He had already 'moved' here over a year earlier so all of his belongings are here. I took his things from the closet and put them in storage but the rest of his things are still out collecting dust...just waiting for him to come home. It's almost time to get all his clothes back in the closet and prepare for him to be back...and for good this time! What a feeling!!! We saw quite a bit of movement from VSC on Friday and i've read that they are through the H1b visa selection so perhaps we'll be back to the many approvals per day soon. We can hope for that anyway! I will admit that I spoil my kids more than most but ummm yeah, I don't care if you've got money or not, that's just crazy to spend that kind of dough on a party for a 16 y/o ...especially one who obviously just 'expects' it. Gotta question those parenting skills! I mean, what happens when those kids don't grow up to be trophy wives or god for bid...ever have to get a job and work for their $$$??? Well it was nice to see something coming from Vermont last night and, as much as i'd love to see April approvals, it was good to see that they are catching up on those 'left behind'. It just seems fair and just. Now lets get on with the rest of us! No idea where Brian is. Maybe he's just taking a mental health break from the wait ...although that really doesn't sound like Brian. I do hope he checks in soon just to let us know he's ok. Russell is kind of the same boat as he's working a contract job right now that is well... beneath him. I don't want to sound cruel but the man has a master's degree and he's working with kiwi fruit with lots of people who are normally unemployed! Anyway, he feels very much the same as you are right now but he's been there for a while and this week will be his last. He pretty much keeps to his own and wishes the days away....all the while cursing the USCIS! At least you know that if you are pushed enough that you have somewhere to go. Perhaps you can pick up a different job where your parents are? Even if it's just a few bucks before your interview comes. Every penny will help. Remember, this is temporary! My guess is that they see Hospitality Management as a skill you can use in Brazil and that it falls under one of those categories. I think it's the "including, but not limited to..." that allows them to say you are still subject to the rule. So your passport says you are subject to the HRR rule and your paperwork and government state that you are not. Oui! I'd try contacting DOS again maybe including a copy of your paperwork and visa to see if they can help again since there is a discrepancy in your documents. At the very least, you know that if you have to file for the waiver that you could most likely get the 'no objection statement' from the consulate to make that happen and it shouldn't be too long a wait. Because I have no personal knowledge of this i'd advise you to talk to others who do. Ana&D would be a good start. I'm sure he/she wont mind you sending a pm.
