I have known my Husband all my life.... Our mother became Pen Friends (through a post war School Pen Friend Club) when they were 12 years old, I spent every other summer with him, He was at my 1st wedding. I never thought about him in any other way (more like a cousin). I came over to spend some time with his family to recover from major surgery in Feb 2005 and well by March 2005 something happened (still not sure what) but we were in Love.... We took advice from a Family member who is a Federal Judge and got married and filed for AOS... the rest is history....

Would I do it all over again.... maybe, maybe not.... I miss my children and my beuatiful Grand daughter but I love my husband and I love living here in the US...

If he enters the US and activates his CR1 he will have to be resident in the US.... yes he can travel abroad and could be outside the US for under 12 months, but you would have to show that he maintained a residence here in the US....

Check out the K-1 flowchart to understand how the process works and what each of your entries means. In fact, take the time to read through all of the information posted at the top of these forums to familiarize yourself with the process. You will not regret it. wink.gif

After you have sent your I-129f petition in you will receive an NOA1 (aka I-797). On this form will be either an EAC or a WAC #. This is your case number for the initial petition stage of the process and it is used to track your case. You can also get this number from the back of your cashed check. wink.gif

Once you have this number you can register with uscis.gov website to track your case. It will state that your case is pending until it is either approved or until you receive an RFE.... but now and then you MAY (or may not) see the 'last updated' date change... this means you are 'touched'. Each file, after arrival is given a bar code that adjuticators are to scan each time they are working on, or even just moving, a petition. We know that not all adjuticator's are created equally and not all scan so not to worry if you never see the date changed.

This is what we call 'touched'...

Technically, the K1 is called a non-immigrant visa but since the applicant intends to apply for immigrant status as soon as he/she is married you can buy a one way ticket.

Perhaps some countries are different but I have no knowledge of that.

Even if there was a logical reason to deny this gentleman entry into the Country or allow him to withdraw his request to enter ...we are a dignified nation. Yes, we are trying to protect our borders and I respect that but there is no need for abuse of power.

There is no reason or excuse that an elderly man should be treated that way. He was detained far too long, his family knew nothing of what was going on and had blood in his mouth... that's all I need to know. I'm quite sure he would have admitted had he bit his tongue.

There is no reason a young woman should be detained in a jail cell and denied her medication and end up in the hospital because of it.

Russell was denied entry. He was brought into a private room where he had to wait a while. He was offered water, he answered questions and signed a form. He was offerered tissues, advice.... and compassion before he was sent on his way.

What has happened is barbaric ...it's obviously an issue with that POE... it's obviously an issue with people on power trips... and that is the problem here and that is the reason we show some compassion....even when offering great insight. I don't think the bickering is doing the OP, or anybody else, any good. She's been in this process a long, long time so i'm sure she understands the legalities of how it all works. I think everyone is on the same page in that abuse of any kind should not be tolerated. It's really that simple... there is right..and there is wrong.

As i'm reading this I was thinking of you, Alexandra, and wondering what the he!! is wrong with the officers in Charolette that they think it's ok to treat people this way. So you even suspect someone's a threat... you get the information you need and you send them off. What's so hard about that? My love was sent home as well (from Dublin) but he was treated with much respect the entire time.

You've already been through so much. I'm so sorry for your family and i'm so ashamed that these 'people' represent America...shame on them! Your FIL sounds like such a strong and proud man. I got chills when you stated he claimed he was a 'friend to America' even after all he has been through. I know it's all fresh but I do hope that in time they will come back and experience the wonder that America really does hold. Those very few mashooganas make the rest of us look bad!

Is there a waiver if you have filled out an affidavit of support before but you are no longer married to that person?

No, there is no waiver.
I think you can 'pull' the affidavit of support if the case is still pending and that person has not received a green card yet.
But otherwise, you have to wait until that person has earned 40 credits (about 10 years of work), leaves the country, or becomes a US citizen.
But the affidavit will hold you responsible ONLY if that person gets means tested benefit, which is not possible to get until someone has been a permanent resident for 5 years anyway.

Depends on the individual case.
There is a waiver for having enterred the US illegally, or overstaying
There is a waiver for someone who has been deported/removed
There is a waiver for the 2-year home residency requirement for a J-1
There is a waiver to remove conditions on your own..

Depends on what someone has done or what situation they are in..
