China is an entirely different entity than other Consulates. If you were going through say New Zealand i'd also say.. no big deal. In China, however, chances are they will look for any indescretion they can find to deny the visa. If you haven't already, visit www.candleforlove.com to learn all you can.

That being said, you are at the USCIS petition stage of this process so the Embassy has nothing really to do with it until you are approved here (NOA2/I-797). You can call the USCIS and have it adjusted but be aware, even though they say the changes will be made....they very often, are not.

All you can do is be certain that all other documents are filled in correctly from here on out!

To the OP, depending on what the visa exp date really is, you should call the Embassy first and foremost. As pay suggested, it is at their discretion to extend, or not. In the meantime, do whatever you can to get her accross any POE asap!

Sorry to hear your story, but at this moment nobody can help you to approve your case any faster not even congressman. It's all depend on consular. They review so many case in order" first come first serve". I can't tell you exactly how long you have to wait. However from my experience from the pass few years, my husband and I had to wait about 6 months after we supported all documents as they requested. I saw some case approve less than a month, but some case have to wait longer than mine case.
So whatever going on. I will pray for you both. I hope your wife will come soon.

1. Since you have not changed it with Social Security and I presume you have no drivers license, by which method have you "changed" your name? Getting married does not change your name, it grants a legal method to do so without court action. Being married allows you to present your marriage certificate to Social Security and the DMV and change your name. Since there is no longer an obligation for you to take your husband's name (it was in some states) it has become an action you must initiate and follow through with. I advise, as of now you could use either name for the AOS (therby intiating a name change). Easiest, smoothest way is to use maiden name on everything, get your documents, then send change of name notices AFTER all documents are in hand. Let thm play their name games on their time, not yours.

2. Generally this is overlooked at AOS interviews. My wife had a temp work authorization when she arrived, worked after the I-94 was expired but we had sent the AOS, and proudly put it on her G-325 and announced it to the interview officer without being asked. His response? No response. Completely ignored.

3. No your husband does not need another g-325


I would not recommend using your maiden name when you file for AOS if you are planning on using your married name.

If you do file in your maiden name and wait until you have your greencard to then change it to your married name you are going to have to file a form I-90 and pay $370.00.

Use whatever name you plan on using in the future when you file for AOS. Once you have your EAD you can go to SSA and have your name amended to your married name, same with a drivers license or state ID.

Yes you must include any employment on your G-325.

If I was in your situation where I felt that someone was out to get me and doing all the things you have talked about. the last thing I would be doing is to be on-line in any way shape or form. I would stop using a computer or at least I would never connect it to the internet. I would stop discussing any of my personal business with anyone, including family, I would be keeping a very low profile. I would have my land line disconnected and use a cell phone, changing the number every 6 months.

I feel you are giving more credit to this person than they deserve. They have got to you and you are empowering them by taking the perceived threats to heart.

If you do not put out information about yourself then other can not find out about it.

How is this person going to know that you have filed for a K1 visa. Unless they are getting personal information from someone else they are not going to know. You say that this person has been doing this to you your entire adult life, so how are they getting information about you. You suggest that they are contacting your co-workers and friends, how do they know where you work and who you are friends with.

If this person is getting information about your from a family member or a friend who knows your personal info, then all you need to do is not put this information in the public/family eye.

Keep all your personal information to yourself. What they dont know cant hurt you.

Oh, a co-sponsor is an option as well. The I-134 is asked for at the interview stage of this process (often 6-8+ months after filing the petition)

I know that I am self employed and could only use the net income from my business (located on schedule C) Line 22 of the 1040 sums up all sources of income. This is the number that goes on the affidavit of support. I'm not sure how that works for you, though.

You should probably contact the Embassy and ask them directly what you can use.

Of course we know that some can be a waste of time but there are still plenty of people here who now have their SO's with them in the U.S. only because of a 'good' immigration attorney was involved.

You can state your opinion all you want but it is against the TOS at VJ, which you agreed to when joining, to advise against hiring an attorney.

OP...Your best option is to check with the folks in the waiver forum (as suggested above) to understand if any additional documents should be submitted with the petition due to her working without authorization.

It is on topic to discuss whether or not to move because of the time it takes to process the K.

This seems to be the only reason the OP has cited for such a life altering decision. It is not wrong to point out to the OP that this isn't the best reason upon which to make such a choice.

Life is long and hopefully so is marriage. International couples do have a choice where to live - the choice should be made based upon where their life together will be the most fulfilling, not upon the time it takes to satisfy their governments.

I'm having trouble understanding why any of the particulars of this are any of our business? The OP asked a question... how does he go about cancelling the petition. He seems to have made his decision. Why does anybody care what that is? Does it effect you?

We all know how difficult this process is. Some people handle it better than others. And, no matter the opinions we might have, we must all understand that GUZ is probably one of the most difficult Consulates to contend with..especially when it comes to the K1. Perhaps the OP is hoping to avoid this additional stress, scrutiny and separation. If he has the means and is ok with moving over there to go about this process differently then who are we to tell him that's not the right choice for him?

Pardon me, but your post seems pretty judgemental to me. Nowhere in the OP's post did she claim she was intending to commit fraud or that she was trying to find a way to circumvent the law. Nor did she suggest that her fiance suggested anything so where that comes from is beyond me. She is simply asking if she is to list them as dependants and count them in her household total. I'm pretty sure she can do without the presumptions.

OP, I do not claim my children on my taxes but I did list them as dependants and as a part of the household size. Hope that helps.

The OP stated that they are still married to someone else until July of this year. The beneficiaries visa seems to expire much sooner than that. So they can't marry 'now'.

Overstay's are usually forgiven by spouses of USC as long as your intention was not to immigrate on your last visit to the US (when he/she last entered on the H1b). You would simply wait, marry and file for AOS.

But, as pushbrk stated, there could be special circumstances with the H1B visa and you should consult with a 'reputable' immigration attorney ....or two wink.gif .... to be certain you are taking the right steps.

This is not a correct statement for K-1 filers.

He should use the address he knows that he will receive mail at for the duration of the process. He'll get NOA1 (I-797) and NOA2 (I-797) and perhaps letters from NVC once they send the petition off. If he plans on being in Virginia the entire time and is assured he will receive mail there then he can use that address and file with VSC. If there is someone in CA (a parent perhaps?) whose address is more consistant then he should file with CSC.
