Sorry to hear that...take a break...relax...not a big deal. It is just that you are usually the bubbling force behind this thread and I hadn't seen a post in a bit.

I spoke with our attorney today and nothing on our petition. The trial attorney for the government had stated previously in DOJ court that my husband was not eligible for green card application because first marriage was fraudulent, so the attorney filed a motion to pre- termit our application. Our lawyer received motion a month ago, it was just one page, and the attorney argued my husband was not eligible for 245I, but did not mention previous marriage was a fraud or anything else for that matter, so our lawyer sent out his argument/brief, stating counsel did not mention any good reasons for the pretermit (sp?), therefore he doesn’t think we will hear anything more on it. I am actually kinda glad that the government attorney did do that so now it won't be hanging over our heads anymore.

Our lawyer also said that currently there is a lawsuit about I-130 petitions, and that when it involves someone who is in removal proceedings, they should be put on top of the HUGE pile at the service centers because these people are facing deportation, and because they have to wait immense amounts of time for their I-130 to be cleared and transferred to their local office, it is clogging up the court systems. So we will see what effect this court case has. Not that it will probably do anything to help us...our case will probably be transferred before that case ever gets resolved.

Anyways, our lawyer says it makes no sesne to call the customer service line, it doesn't move things along, but he did say that that if we do not hear back on the I-130 in the next 30 days or so he will draft a motion to the court asking for more time because we were supposed to go back in October for the next hearing in front of the judge. wacko.gif :waiting:

Has anybody noticed that CSC is at least a month ahead of VSC when you sort by the NOA1 date? And when you look at the two centers combined...geesh it is ALL Vermont people who have not been approved until you get like 3/4 of the way down the spreadsheet.

This just sucks because we have reached our six month point...and nothing. I checked the USCIS website and they haven't updated their processing dates.

Yes, thank you so much. I never really look at the spreadsheet with CSC and VSC mixed but WOW...CSC seems to be WAY ahead of VSC. And when I looked at it sorted by NOA1 date...it appears that VSC is working on January dates...PLEASE I hope this is true...this whole process sucks.

I should imagine that the highest incident of "complication" is previous marriages. Behind that, children. After that, criminal backgrounds. So the simplest cases would be in terms of first marriages for petitioner and beneficiary. It'd be interesting if we could collect any complications and see if we could come up with a pattern.

(I'm leaving out obvious expedites due to country of origin. Those make sense and I agree w/them.)

And as far as our case, this is not the first marriage for either of us, he is in removal proceedings, and he EWI. And I am sure there are many other "complications" from his file...but honestly I think USCIS makes complications where there really isn't.

I decided to take the 2 service center sheets and sort them by NOA1 date. I had a feeling that VSC was processing based on NOA1 date, but that theory doesn't stand supported. It has always appeared to random to me...people who have a NOA1 date before and after us have gotten their NOA2. I think it all depends on the details of your case.

I was looking at your signature and if you were married in June of 2007 then you should've filed for 2007 tax year as Married Filing Single/Jointly (with ITIN). You should probably check with NVC agent and based on what they say contact IRS.

Thanks for all the info! I trust my lawyer and do not feel like I am being bilked! There is no way I could have done any of this on my own it is all so very complicated! We definitely "front loaded" the I-130. I just want him here as quickly as possible, it doesnt matter to me, or him whether he arrives as an immigrant (IR-1/CR-1) or a non-immigrant (K-3), we just want to be together here. If the K-3 is so obsolete then why isnt it stated on the government visa websites? ISnt the K-3 designed to reduce the amount of time apart?? I did read the guides and the step-by-step processes but for someone with a college degree it is still hard to understand. Can we use the evidence for the I-130 for the interview? I am the one with all of the evidence so I will have to send it to him. I didnt really have plans to go back, hoping that he will be here sooner then later... but I am starting to rethink that. Costa Rica, if I have read correctly, allows the couple to be interviewed together so that could very well be a possibility. How quickly after the inteview is a visa granted, is it done right then and there?

Your lawyer is trying to get you to file the petitions that would lead to a K3 visa. Unfortunately they are not up to date and aren't telling you that doing it the way they want will take as long or longer and cost almost twice as much. I suggest forgetting the I-129f altogether and concentrate on making sure your husband has plenty of info to take to the consulate/embassy to prove a bona file, ongoing marriage.

He will then have a medical in his country and will not need to adjust status if you continue with only the I-130 petition. The only extra thing he will have to do is remove the conditions on his green card. (A 2 year conditional green card is given to approved couples who have been married for less than 2 years at their interview.)

There are guides and comparisons on this board that you might find very useful. Take a look through the wiki as well. I would post you some links but I'm on my phone atm ;). Much luck to you both.

This process is so complicated, conviluted, and confusing! I have done so much research and read the same information over and over again and still have a hard time understanding it. I am working with a laywer because I dont want to make any mistakes and I am still confused. I met my husband in Costa Rica while on vacation in February 2011. I went back 4 more times to see him, getting married on the 5th visit in August 2012. We just sent the I-130 petition today. My lawyer says that once we recieve NOA1 that we will file the I-129F. What is the purpose of filing both forms? Also I know that my husband will need medical exam but my lawyer said that will happen here in the US before we file for AOS, is this correct or will he need the exam in Costa Rica before he can come here? Anyone else out there filing on behalf of their spouse in costa rica?

Unless you got a Temp EAD at your POE then you can not work until you have one....

As a K1 you can aply for a EAD but it will take about 80 -90 days to get it will be valid up to the date on your I-94.... You will apply for a 1 year EAD along with your AOS and this will take between 80 -90 days as well...

The statement on your SSN means that you must have a EAD to work.... once you have become a Greencard holder you can apply for a new SSN without this statement...

The EAD you can get at JFK is only valid for 90 days then you would have to stop work and wait for the 1 year EAD you will file for with your AOS... unless you must work when you arrive it may not be worth the extra time and effort that will be involved.... and Yes JFK seems to be the only POE giving EAD

I am sorry I know nothing about your customs and beliefs but I am married to a Jewish man and I am Christian... when I first got here I found it very hard that I did not celebrate all the usual festivals Easter, Christmas and others..... I have decided to make my own traditions picking out all the bits I enjoyed most from the different ways I know people celebrate... it is not the same but I can make it as special as I want.... I also know at these special times I miss home more than I do normally.... I hope you will find some way to enjoy your special times here in the US and take happiness from your memories of time gone past instead of sadness...
