IR-1 / CR-1 Spouse Visa Process & ProceduresThe Stupid RFE Thread
They wanted my most recent IRS #######, from 2007. Fine. I was living and working in Japan for just about the entire year of 2007 so I sent them the 2555 I filed (income of Americans working abroad). They RFE'd me, asking for the regular W2 or whatever. I explained to an NVC guy on the phone that I didn't work in the US during 2007, which would be apparent should one take the time to look through my file. Still, I had to resubmit the entire AOS complete with this IRS-2555, everything being identical to what I'd already submitted, nothing different, nothing additional. Thanks, dicks.

Luckily this only tacked an extra 10 days or so onto the process, but #######...

Our case stands at what you can see below in our timeline.
No 'touch' since the little flurry that happened the week we got transferred. It's been 11 days now since our last 'touch'.
I'm not getting totally discouraged yet, but I'm certainly not very hopeful for those clods, nor am I ready to sing praises to the United States Customs and Immigration Service. What a racket, a bunch of bums they are.

They received our case the last week of January, and our NOA1 was dated the second week of February. It was at Vermont, and the one and only 'touch' stood all spring and summer at 2/24/08.
I returned home yesterday from a camping trip with the boys in the Adirondacks absolutely pickled, and my veil of blurry stupor was lifted by an email informing me that we'd been transferred to California. This Monday morning, it was touched again- not getting my hopes too high for these incompetent clowns, but it can't be a bad thing...

IR-1 / CR-1 Spouse Visa Process & ProceduresTravelling to USA while waiting for NOA2
My wife (also from a Visa Waiver Program country) risked it and entered the country without incident this past summer while we were waiting for the NOA2. She brought bank statements showing she had money still in Japan and a letter from her old boss saying that she was only taking a leave of absence from work (the letter was bull$h!t- I bribed him with a couple nice bottles of Californian wine that I sent). Basically stuff to show the passport-stamper a$$hole at the airport that she had a reason to return to Japan within the 90 days allowed for the VWP.
She never had to show anything, though. She said the kid who stamped her passport seemed more interested in the arrival of 5:00 than he was in her reasons to enter the country. She even told him that she was here to "visit her husband" when asked.
I have an immigration attorney who told me to have her bring all that #######. He said there'd be no guarantee she'd get in, but that she should be completely honest and not try to pretend she was coming to take pictures of the Statue of Liberty or some bollocks. And if they denied her entry, she should say "I formally withdraw my intent to enter the country at this time" (or something like that), and it would have no negative impact on her visa down the road.
One other thing he told me was that if they really started grilling her, she should basically say "Look- we applied for this visa months ago, and it's taking much longer than we expected. It seems like it's gonna take a bit longer, so we thought it would be nice to at least spend part of the summer together while we wait." I also provided her with a notarized letter explaining just that for her to show if needed, as well.

We got to spend the summer together, and the NOA2 arrived a couple days before she went home, which was nice (nicer would be if those jackasses got their $h!t together and took less than a year to hand out visas to spouses of US citizens from staunch American allies).

I say go for it. You run the risk of being turned around, but the risk seems worth it. Just bring stuff to prove you're going home and be honest with them.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Tokyo
My wife passed as well. She was in and out in about 1.5 hours. Luckily, they didn't ask to see any of the stuff the post office lost, so she's all set.
She said the guy asked where we met, how long we've been together, what hobbies we share, if I'm still working, where in America we'll be living, and what I did for work when I lived in Japan. She didn't have to show any photos or anything. Her English isn't spectacular, but she was able to understand everything, except whatever the guy made her swear to with her right hand up. She just said "yes" and it was done.
What a headache this whole process has been. I'm glad it's over.

Congrats on your husband passing.

My wife also has her interview today in Tokyo, at 9:30am. I have no doubt that they'll approve HER and recognize the legitimacy of our relationship, but I'm waiting to see if she's required to submit anything by mail before she can get her visa- the USPS lost the Express Mail package that had some of the original documents (updated employment letter, my birth certificate, etc.) that the lawyer said she should bring along.

Best to all.

IR-1 / CR-1 Spouse Visa Process & Proceduresadvice for nvc

Wow ! that was quick... I got approved on 16th June but no case# yet....

Thank You! As soon as I receive the letter that my case was approved I instantly called them (NVC) and ask for my case number and they gave it to me.. and yesterday I receive an E-mail .. SO I went ahead and made the payment for the AOS & IV :)

Something very important as soon as your approved call NVC and ask them what email and number they have for you because they will email you what you need to do next and whatever payments you need to make. For me they didn't have my email so it was good that I called :) and then from the 24th that I called and got my case number to yesterday the 28th of JUNE I received the e-mail that I could go ahead and make the payments.

Good Luck! :) you can message me if anything Bye!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Packet

I've been reading on here how many send in a ton of information proving they have a bonafide marriage. On the checklist it said to submit 2 letters from third parties verifying we have a bonafide marriage, which I submitted. I'm thinking now from what I've read on her that sending pictures, phone logs, etc may have been a better bet. I thought all of this proof was more for the actual interview. Did I make a mistake by not submitting these extras? Should I send them in now? Will it make a difference? Please Help!

You don't need to send evidence in because is not a requirement, even though some people send them in it's really up to you.
I didn't send any evidence in, and most of the people I know who are in the same process didn't.

Any evidence/verification of a bonafide marriage have to be present at the interview.
Unless you receive a letter stating that you need to well then thats a different story.

Good Luck :)

Explore your options... Since I was here in the US my husband did everything needed to set up a day so when I did arrive we could get marry.
Where we got marry I dont remember the name out of the top of my head but once i do i will put it in another post.

They charge my husband about 5,500 and they were very strict about giving them the amount in a certain way atleast for us it was like that.
THE WANTED ONLY 1,000 & $50 only.. no change or more of the amount requested.

For my husband he was only require his cedula, and birth certificate.
For me my passport, birth certificate, single letter.

& we needed each 1 ""un testigo"" who was not family related.

They made us and our testigo sign on different pages, the judge talk for like 5 minutes explain what we were signing and all that good stuff... then she said if i accept him, and he accepts me we both said yeah ofcourseee lol...& I was laughing the whole time I dont know why but I was nervours, the whole process took like less than 10 minutes.. than we we're handed are marriage certificate right away :)

Hey, on the entire process I used my last name.. since is in my passport, Massachussets I.D and social security.

If you do change your last name, I would think you need to change it in all your documents.
my thoughts to you is use your last name, and once the process is over with make any change that needs to be made, and than you can use his last name when signing any documents.

Everything I have send in all had staples I didn't use any clips.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat are the main reasons for a visa denial?
I don't believe before you arrive they already have their decision made.. they probably have doubts or see red flags on the case, but once the interview is given is when they make there decision.

:ot: Is rare because for my interview I took more than 200 pictures of different ocaccions and I had than all in order.. and many other evidence and the guy didn't even bother I took my affidavit, and all my paper work that was sent out to NVC, and the I-130 petition I original sent out I took ALL THOSE PAPERS JUST IN CASE and not one paper was ask for.

Than I see other peoples review in which the consul wants to see all the pictures, and paper work... so just go prepare because for everyone is different.

Go with a confident positive attitude, and always say the truth no matter what. You will do fine.

QUOTE (Meliss3108 @ Aug 8 2008, 03:28 PM) <{POST_SNAPBACK}>
I don't know that this is clearly a case of human selfishness I think it is more indicative of how the human spirit handles the complete unknown.

In the US we have been taught to trust our government- many of us will say we don't trust them, however I believe most of us don't ever think the goverment is out to cause us grave harm. We go to work each day and do our jobs, and we expect the same from them. So the people whose files were sent to CSC because that is where it was directed to originally (I am one of those people) have searched and looked at processing times and checked case statuses every day- looking for something to make this process tangible. Something to give us an understanding of how and when we will see our loves again.

I don't dare want to take away anyone's opportunity to be together with their husbands/wives- I wish that for all of us. But, I think, what the original CSC filers are seeing/feeling is this: I finally felt I was begininng to understand my place in this line toward approval. I had some concept of when I could expect an NOA2 if all went well, but now all I see is another line, coming from the side, right in front of me with no end in sight. This takes all that I thought I know and makes everything unknown.

I don't blame those being moved from VSC... in fact I am glad to see that the government is working to correct your injustices. But what I fear is that in correcting what has been done to you, they will displace another entire goupr of people. And yes, that part of this makes me angry.

I can understand your frustration. Us VSC people have been there. It was not too long ago that Vermont received an influx of CSC petitions to help CSC get caught up, and those of us who were waiting saw many CSC/VSC people get approved before us, AND regular CSC people. Than there were all these new 2008 petitions getting approved in both offices while our petitions just sat there collecting dust. For like two or three months in a row the processing date for VSC did not move forward. In fact, one month it moved backwards and just sat there.

My husband and I have been waiting nearly 9 months, and because our case is different, he is in removal proceedings, the only thing we are waiting for is a service center to do the research/leg work, and transfer our case to our local office in Boston so we can have our Stokes and receive a final approval for our I-130. So, yes I understand your anger, but I am also angry that we have waited this long just so our case can be transferred to Boston. It is ludricrous. Especially considering we are physically located in between VSC and Boston and now our petition is being transferred to CSC where we might get a stamp of transfer to local office sometime in the next two months.

Whatever!
