Your request to expidite based on medical emergancy is likely to fail for the very reason that the person who is ill is a USC and there is nothing to stop him from returning to the US.

It is of no concern to USCIS who you would have care for him if he was to return. The fact that his mother would have to remain outside the US again is not there issue, her visa application will be delt with in due course.

Do your son a favour and bring him back to the US where he can be treated and deal with the financial issues as they come along. Your 1st priority has to be your sons well being.

Most people wait until the I-130 has been approved, then apply for the Police Certificate. The New system for the UK is much faster than the old one where you had to wait about 40 days to get the certificate, now it only takes about 2 weeks.

You need to do fresh Biometrics for every application, even if you did them just a few months ago. Once you get the NOA1 for your re-entry permit you should get your biometrics appointment soon after that.

If you do not depart the US on the last day of your approved stay then you are out of status and everyday after that date is a day of overstay. There is no grace period, if the person leaves the US anytime between 1st day of overstay and day 179 days then there is no ban impossed. If they leave on day 180 or before day 364 then a ban of 3 years is impossed, if they leave on or after day 365 then thay are banned for 10 years.

Any visa that has been issued before the overstay occured is revoked and it would be unlikely that any further non-immigrant visa would be approved.

I would be contacting my congressman and senetor pointing out the you were going the K3 route bu as USCIS has approved the I-130 faster than the I-129 they(USCIS) have cancelled your K3 and now the children have lost their derivative benefits and you are now being forced to delay the visa for your spouse as you now have to file I-130's for the Children and wait the 6 - 8 months for them to be approved. If the K3 had been allowed to continue then the Children would have been able to accompany their father on K4 visa's.

If you have been apart form your wife for 5 years and you have not seen her since you left, it is very unlikely you would get a visa to immigrate to the USA as the spouse of a USC. How can you prove you have a bona fide marriage? Does your wife claim you as a spouse on her Tax Return? are your names on the utility bills? do you have joint bank accounts? are you the benificiary of her 401k or life insurance?

If you have had no contact with your wife in 5 years then sorry but you dont have a on going marriage and would not qualify for a IR-1 visa or a K-3.

Yes Just file I-130 and if she becomes a Citizen she can have it upgraded, wait time is many years so dont expect any results for a long time They are just issuing visa's to people who had an approved I-130 from Dec 1997.

You only have to tell the interviewing officer that you are being forced into a marriage you do not want and that you do not want to go to the USA, also explain that you fear being blamed for a denial of the visa so you do not want your family or your husband to know you told the officer this. A international driving license is only a translation into other languages that you hold a valid license in your home country. It will not help you get a driving license here in the US. You are still going to have to take a written test and do a driving test to get a license from your state.

Every state has different rules about what is needed to take the test so check with the DMV for your state.

I did what you intend to do..... came on a VWP and got married and stayed... We filled for AOS and we had no problems.....

I was never asked about my entry to the US or about my intentions at entry... the evidence that I had that it was not planned was a house back in the UK a job and I had just had major surgery and was ment to return for follow-up treatment...

You do give up the right of appeal..... so if you were denined your choices are limited... but you are not put on the next plane home.... it goes to a court for a deportation order and at that time you can have a lawyer argue your case....

There are many people on VJ who have done it this way.... but at the end of the day it is your choice....

The I-90 is taking between 3 - 6 months to get processed... you could make an infopass at your local office once you have the NOA for your I-90 and ask for I-551 stamp... it is as good as the Greencard....

You dont need a SSN to get married.... I did not get my SSN until months after I got married... we just told the town hall that I did not have one and they took a note of my passport number...

If you want to do CR1 then why not get married on your trip to Canada... instead of in the US....

Quite possible - the people who write blurbs for web sites should be reasonably knowledgable, but they are probably not lawyers.

Further, the person who wrote this particular blurb probably had the same mind-set as many VJers and fail to distinguish between 'marry and stay' and 'marry and leave'. There seems to be an assumption that 'marry' and 'stay' are inseparable, when in fact they are not.

Finally, the advice given by the government cannot be relied on and the government is not responsible for the consequences if someone does rely on it. The Supreme Court has so ruled (folinskyinla).

[EDIT] Finally finally, I suspect that you have mis-stated what the website says, or have taken it out of context. My non-USC wife did not have a visa when we married, and she is not a Canadian, not from a VWP country, nor did she enter the USA 'illegally' (without inspection or undocumented). Everything was done quite properly and legally.

The website says that a non-USC planning to marry a USC needs to have a visa. I guess they don't know what their own rules are.

homesick_american You are giving wrong information..... it is not illegal to enter the USA to get married.... it is only illegal to enter with the intent to remain.... there are 1000's of people who come to the USA to marry each year... many to a USC... there is a whole industry around wedding planning for people from another country...

The OP should make sure they carry enough proof that they intend to return to canada after their wedding... dont lie at POE.... but only answer the questions asked...

You were admitted as a greencard holder that is what the I-551 stamp is (a temp greencard) so no you do not need a I-94..

The person at the DMV has made a mistake.... go back and explain your I-551 is a greencard and allows you to remain and work in the USA...

If USCIS are saying the greencard was mailed and has not been returned to them... then you are going to have to file the I-90 and pay the fees.... that is exactly what happened to me.... I even had our congresman involved as I dont see why I should have to pay again for the card.... but no joy USCIS claim once it is mailed it is no longer their issue if it goes missing.... I was told to take it up with USPS...

So I just paid the money e-filed the I-90 and waited for the new card to arrive.... took longer to get a replacement card than it did to do AOS....
