i forgot to sent a cover letter (what is in the package) and write our name on passport pictures.
and for bonfire, i just had marriage certificate, and marriage pictures. is that good enough? will they delay my application because of my errors. i do not know what do they do. pls help.


There may be a slight delay. They might send you an RFE (request for evidence)
I've heard of of RFEs for people forgetting to tick a box, but then again maybe you won't
It wouldn't be too long of a delay if the things you forgot can be fixed right away

Hmm... I don't know.. I wouldn't chance it if I were you. It doesn't cost that much to use a translator. USCTS.com is a very reliable firm that does this service. You can scan and upload the document you want translated and they email you a draft of the translation before they finalize everything. After that the certified translation is sent express mail so the whole process only takes a week or so. This is the company I used for my BC translation and have had no problems with USCIS.
But.. I guess it is up to you if you want to translate yourself :P

I am not terribly familiar with spousal visa process but I believe that your husband should be able to petition for you with your sister-in-law as the co-sponsor for the financial support/affidavit part.
Just wanted to make the distinction that she can't actually file the petition for you.. she can just be a co-sponsor for the financial part. Your husband will be the one that will have to file.
Hope someone else who has gone through a similar process will come along here and give more info.
But I just wanted to say that I am almost sure you can do it as long as sister-in-law's income qualifies. Good luck!!!

No, you do one or the other.

If you want to stay here do the AOS, file 130 together with 485.

CR-1 process is for if you are not here yet and your husband wants to bring you here.

yes, be consistent with name and address. Use married name and US address for all forms.
You can enter your maiden name where they ask "other names used"
And yes, calm down, read the instructions for the forms. Read the guides that some have linked you to.

from you location, I'm assuming you are a canadian citizen. Most canadian here have reported writing down:
'none/Canadian' where it asks for I-94 information.

You can also do a search on the canadian specific forum to ask what the other members have done.

I meant later on in the immigration process, be ready for USCIS to ask about your intent when you entered (past tense)the US.
I say this because you got married relatively soon after arriving here.

Yes, file just the 2 forms (130 and 485)

If you would like to get work authorization while waiting (thats i-765) and permission to travel/advance parole (i-131), you can file these forms together with 485 and 130 also.
Not necessary, can take a few months for these to be approved themselves, but can be nice to have.

No, send the i-130 together with i-485. check reason 'a' on part 2 of form i-485.
Just be ready for them to question your intent when entering the US. They may not ask, but be ready.

They've had to re-file for everything. It sounded like a hassle but looks like it worked out for them. Do a search for it, you might find others in your similar situation :)

This whole process is a bunch of horsesh!t. I'm a taxpaying American with no criminal history married to a virtual saint from one of our staunchest allies, and there's no reason the damn government should be able to take a year of life of our marriage to twiddle their thumbs while they #### around with us (and every other couple involved) in this ####### process. They made a man walk on the moon four decades ago, there's no reason in hell they can't establish that my wife and I aren't up to any monkey business in less than a couple of months.
I'm just shy of 50 days since my NOA1 at VSC, so I don't have much to crow about yet, but if I get 3 or 4 more moons with nothing, I'm gonna get on my congressman about it. Hell, I might even pro-actively shoot him a donation.

So I filed for my wife's I-130 the first week of January '08, got the NOA1 the second week of Feb. Vermont.
I know it's still early, but I've been reading all kinds of stuff about people who've been waiting since 2006 or whenever. What are we realistically looking at before she steps foot in the country? A year from now?
What's this "about 6 months"? Is that how long it takes at VSC before some other government agency takes another 6 months with it? Or is that when she should be here?

I'll move back to Japan before I make my old lady wait a year and a half...

While in many countries a translator must be licensed, that is not the case in the US. A 'certified translation' here is simply a notarized translation accompanied by a notarized statement by the translator that he/she believes the translation to be accurate. The notary need not understand the language, but is notarizing the statement of accuracy.

My kanji-reading skills ain't so hot, and luckily my uncle is Japanese. He translated my wife's birth certificate and our Japanese marriage certificate for us.
If you or anybody other than a professional translator (that you will likely pay a pretty penny for) can do it, that's what I recommend.

My immigration attorney said everything looked fine. Granted we're still waiting for an NOA2, so who knows- USCIS could come to us later and say our translation isn't the way they want it or some ####### like that, but as far as I know, we're cool.

Fair or unfair, I don't think getting mad about other people getting approved does much for your case. How about getting mad that YOU have NOT yet been approved? The fact that someone from Iraq gets through in 2 weeks isn't what makes the process screwed up. The process is screwed up because the average tax-paying, law-abiding working slob (most of us) has to wait about a year for some a$$hole in a USCIS office somewhere to put his coffee and donut down long enough to yank our file off a shelf and do 15 minutes worth of work on it so that we can reunite with our loved ones.
And as for Iraq, I'd expect my wife would deserve expedited treatment, too, if she risked having her house blown up should her Japanese neighbors learn that she was married to an American.

At any rate, I just bought my old lady a ticket to visit for the summer on the VWP. After the summer, she's gonna go back to Japan, and hopefully, her interview will happen soon thereafter.
If she gets turned around and sent home at the port of entry and this USCIS ####### goes beyond August, I'll likely cancel our application and move back to Japan for good.
I'm American, my wife is Japanese, and she's half of me. If they don't want her here, that's the same as not wanting me here. So #### 'em. I'll leave.

To hell in a handbasket this country's going. They'll turn a blind eye to anyone who sneaks in over the border and takes some high school kid's summer job. Then they'll arrest the high school kid for selling pot because he couldn't find a summer job. I'm hoping to have my wife visit on the VWP this summer. Her boss is gonna hook her up with a letter that says she has a job to go back to at the end of the trip, and she'll be armed with the letter, along with a translation.
My concerns are that a) her English ain't so great (might be a hindrance if she gets grilled)
and, cool.gif she took my last name and it's on her passport. I imagine she'd scoot right through with a full Japanese name, but a foreign-sounding last name might raise an eyebrow.
Any experience/advice would be appreciated.

If I had known back when I filed that Uncle Sam was going to take at least a year to let my wife into the country, I'd probably have bought a one-way plane ticket back to Japan and filed from there. That way, we could at least be together while Uncle Sam twiddles his thumbs for however long he thinks he needs to drag this ####### out. And if that took too long, I'd probably apply for permanent residency there and turn my back on my country.
This process is just an insult. It's an insult to us law-abiding, tax-paying, working American slobs, and it's an insult to those whom we love. But it's pretty obvious that America doesn't want immigrants coming here, and they're trying to discourage them from doing so.
You could always sneak your spouse in on a turnip truck from Tijuana, I suppose. Then they'd probably be eligible for free health care, a driver's license, etc. But if you play by the rules you get the shaft. What do they need to know? They need to know that you aren't a tax cheat or a child molester, and that your spouse doesn't have AIDS or a criminal record. Send them the relevant paperwork and what should it take them to look it over? Twenty minutes, maybe? But a year? Give me a friggin' break. And the sad thing is, most of your America friends and neighbors will say "What the hell? I though when you marry a foreigner, they get right in."

My suggestion is don't even bother filing this #######. If you're American and dead-set on living in America with your spouse, move to your spouse's country for now and get some crappy job teaching English or something and do the consular filing. That way you can be together for the next year and beyond. Otherwise, you simply won't be.

I found this article this morning. It is about a letter written by Senator Patrick Leahy at the end of November 2007 to Emilio T. Gonzalez Director of USCIS asking him to please deal with the fact that because a different employment agency (?) won the contract at VSC, "approximately 200 long-time employees will receive serious reductions to their hourly wages. Some of these employees stand to lose almost $3.00 per hour"

SOOOO, not only do they not have enough people to meet the increased amount of petitions filed, they are going to backstab the employees who are there by lowering their wages! No wonder the employees on the other end of the phone are moody, cannot answer your questions, and tell you they don't have the time. I would be moody if someone was going to cut my pay by $3.00 an hour. And if a possible job loss was constantly looming over my head I don't think I would feel too motivated to work efficiently, effectively, or expeditiously.

Geesh, I wonder if this has anything to do with the increased processing time, never mind the fact that they are advertising the directors position is open up there.

Oh, yeah, and here is a previous article from Sept. 2007 in which Leahy is pleased that VSC will be appropriated 300 additional positions...

hmmm...well I guess to be able to ADD 300 positions they had to bring in a new employment agency/contract, and lower wages on current employees so they could stay within the budget even though they increased the fees of petitions for immigrants...something isn't right. Especially since the processing times for Vermont have increased.

Sorry...didn't mean to burst anyones bubble...but I am the type of person that NEEDS to know what is going on at all levels.

Last week when speaking to our lawyer he had mentioned that recently there had been a big conference/meeting for all types of professionals regarding the backlogs being experienced at USCIS, but particularly VSC...they were all given a standard BS line that they were dealing with the situation and doing the best they could, but there was no way to speed up the process. Our lawyer asked what about people who are in removal proceedings, shouldn't they be allowed some type of expedited service considering they are in court and the answer was no...

Sooo...I felt motivated to dig up some information to find out what is going on up there because I knew there was more to it than "oh we received tons of applications, and are in the process of training new employees"

I don't know how many of you have ever been to Vermont...but it is quite RURAL, and the population is LOW

It is my opinion...that IF USCIS is SCREWING their current employees...and any new applicants are TEMPS with no bennys for up to the first year...and are promised NOTHING...they are having a hard time filling those positions...bad news travels quickly, particularly in rural areas...and who the hell is going to want to work for them...and than when you consider the requirements to even apply or be considered...geesh...you started with a limited pool of possible applicants already...why not needle it down to nearly non-existent....

Its easier to go work at the local Wal-Mart.

I looked a little further.

The town of St. Albans Vermont has a population of approximately 8-9,000 people. The county of Franklin which includes Burlington and St. Albans and a whole mess of other towns has an approximate population of 50,000. Not much of an employment pool if you ask me.

Their racial make up is almost all caucasian. If you added up all the others I doubt it would even break 5%.

And the majority of constituents are REPUBLICANS, and were big fund raisers of BUSH. Which to me is odd because we are talking about Vermont a predominantly Democratic state, where the tree huggers, and crunchy granola people migrate to...

I also went to a local newspaper called the St. Albans Messenger, and there was a front page article about the low morale and dis-satifaction of DHS Border employees in Highgate Vermont (I know its different, but they are still under the same umbrella) and how people are leaving, they cannot retain many, and they are having a hard time getting new ones...part of this due to internal reorganizing.

Sigh....I just want our petition OUT of Vermont and at our local office so we can get our damn interview and approval on our I-130!

Hey, let us know how it turns out. Our timelines are pretty close to each other. VSC received ours on 11/21/07, sent out NOA1 dated 01/25/08, and I see people who filed after us who have received their NOA2 which I do not think is fair.

I had same issue this year. I just filed I-130 last week so we don't have a SSI # for my husband yet. I spoke with IRS on their helpline for almost 2 hours and the agents I spoke with told me...
- you have to file married if that was your status EOY with SSI (either married jointly/married separate)
- I was told you can send W-7 with the 1040 for approval at the same time (hoping they gave me accurate info)

Personally, I decided to file jointly as my husband's income falls under the amount set for worldwide income and essentially we are filing for 2 people with 1 income (mine) so our return works out to be almost 4x's more than if I didn't file jointly. It will be more of a wait than if I filed separate, but worth it in the long run for me. Hope this helps.

I believe our case was "touched" 2/28. I could see our case online the day I received the notice, so I don't think it was just the date entered into the system! good.gif
