K-1 Fiance(e) Visa Process & ProceduresWOHOOOOOOO! RFE!
Crikey........I should know the answer to this question.

No one is completely sure if they are sending out RFE's in order of receipt dates, well, it doesnt seem that they are, judging from some comments ive seen. Do I need to place a call in order to request the RFE? Or, just wait?

K-1 Fiance(e) Visa Process & ProceduresLost Naturalization Certificate?
Its something Ive been thinking alot about. My lost Naturalization Certificate. Im wondering if by any chance the incredible expense for replacing this document, can be avoided?

Ive been a U.S. citizen since I think 93. And have lived in the U.S since 83. Unfortunately I recently learned that my naturalization certificate has evaporated, or dematerialized in some way. Ive searched high and low.

More importantly, I contacted the Brasilian Embassy in Boston to ask if I may have left it there in 2003, when applying for a Brasilian Tourist Visa. They responded that absolutely no documents of any kind of mine were in their possession, or anywhere in the department.

I also wrote an email to the American Embassy in Buenos Aires where the interview for the K1 will be held, to ask them whether or not this Natiuralization certificate of mine was completely necessary for me to provide, seeing as how my passport itself proves my citizenship in the US, and because the naturalization document is incredibly expensive.

By the way: the fee is 165 USD and the form for a replacement is called the N-565, which can be downloaded online.

Does anyone know whether or not id have a snowflakes chance in hell of successfully completing the K1 visainterview for my fiancees visa, without the Naturalization Certificate?

K-1 Fiance(e) Visa Process & ProceduresPlease, Help! Urgent!
Yea! Of course you can get one way!!! That is what you are there for!! To get married within 90 days~!!

The entire visa was granted in the first place based on the idea that you WOULD stay in the USA long enough to plan, and carry out and register a marriage. So, since most people wouldnt be able to tell you exactly the date which by everything would be planned and carried out, a round trip ticket probably must surprise the POE officer each time he sees one.

I just spoke to the Vermont services center. My 129F was received 49 days ago. The rep told me that 129F's are currently taking 8-9 weeks to process.

IR-1 / CR-1 Spouse Visa Process & ProceduresWho's Law are they using?
In the UK if your case was dealt with by a juvenile court then it does not appear on your police report... if your case was dealt with by a full adult court then it will appear on your police report and a wavier will be required...

It is not a case of who's laws they are judging you by it is a case of what appears on your police record...

Good Luck with the wavier..

IR-1 / CR-1 Spouse Visa Process & ProceduresMarriage with a US Citizen
I was one of the people who came on a VWP and got married.... I did not enter with the intent to get married and remain, I entered the USA for a vacation to recover from surgery but my now husband asked me to marry him and I decided to stay...

I was not asked at any time what my intentions were when I entered the USA and I was not asked for any evidence of my intention to return to the UK after my visit...

I would never advise anyone to enter with intent as the risks involved are to great.... but there are a few of us that did do AOS from a VWP/Tourist visa and as far as the law is concerned we did nothing wrong...

Kez,

Your statement "the only restrictions are that she is not out of the country for too long" is wrong. Many people will read that and stop there.

Yodrak

Yodrak I think you will find that the link I gave more than covers the information the OP was looking for he asked if his wife could go home.... my reply states that yes she can go home but she should be aware of the restrictions placed on her as a LPR.....

Again you seam to think my info is wrong....

Kez

And how is it wrong......

A greencard holder goes home to wherever for 2 weeks and then re-enters the US using greencard = not a problem

A greencard holder goes home to wherever for 6 weeks and then re-enters the US using greencard = should not be a problem...

A Greencard holder goes home for 3 months and then returns = may be asked question about time outside US.

A greencard holder goes home for 6 months and then returns = will have to show that residency conditions are met...

So it all come down to how long is not too long.... a normal vacation is diffrent from an extended visit home... Yes maybe I should have given more info about time out of the US but the link is there for people to read... maybe you should have just told them to check with a lawyer as you normally do or just continue to reply to posts where you can pick out a reply and dismiss it in one move... maybe you should try and be more helpful instead of just correcting where you think others are wrong... many many times you pick out a reply and tell the poster they are wrong but do you go on to post the reply you think is right.... no you just leave it at that....

My intention was to answer the OP question and give them a link to the USCIS site for LPR so they could read for themselves what is expected of you to maintain your status....

Yes she is free to travel out of the country.... the only restrictions are that she is not out of the country for too long... read here http://www.uscis.gov...00045f3d6a1RCRD

International Travel
A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

Hope this helps.

Overstay is forgiven if you are married to a USC.... so dont worry about that point... you need to concentrate on finding a way to file for your AOS.... if you truly cant find a co-sponsor then your husband is going to have to find a job or jobs that will give him 125% above poverty line income.... or you can both go and live in another country where you do not need a sponsor or do AOS

QUOTE (Eresh @ Sep 15 2007, 12:59 AM) <{POST_SNAPBACK}>
If you have been married less than 2 years, you will receive a CR-1 visa. You will receive a 2 year greencard which is conditional. 90 days before the expiration of the greencard, you have to file to have the conditions removed. Once this has been completed, you will then receive the 10 year greencard. 3 years after this, you can start the paperwork to become a citizen.
Edited to add: You will be waiting 5 years total to file the citizenship papers.

Sorry but the above info is wrong.....

You can apply for Citizenship 3 years from the date you were approved for Permanent Residency... so if you came on a CR1 it would be 3 years from the date you entered the US.... it has nothing to do with conditional residency or not.....

You can apply for the Citizenship 90 days before the 3 year date....

See here for full info.... http://www.uscis.gov...ticle/M-476.pdf

I dont think you will get any replies to your question, I have been on VJ for over 2 years and I have never seen anyone get advanced parole to allow them to be with their spouse while their CR1/IR1 is being processed...

But if you get the advanced parole please let us all know as I am sure there are 1000's of people who will apply....

If you care to give us a bit more info then perhaps we can help you.... but to answer your question about how long it takes.... well in the US it takes about 70 -90 days.... if you are applying outside the US then I have no idea...

Why would you need advanced parole if you are on a IR-1/CR-1... AP is for people who wish to leave the US on vacation while they are waiting for the outcome of their AOS.....
