K-1 Fiance(e) Visa Process & Proceduresstill no response going on 3 weeks
Well its going on 3 weeks now since bf interview and still no response. I said to my bf last night why dont you come here on a visit visa whilke we wait and ill ask in forum if thats possible. Well, I forgot , they took his passport at interview. Now even if he wanted to come and visit he cant. He is still in the mind set that consulate said to just wait so he wants to just wait. I dont understand this processing. He has clean record and all paperwork was perfect. His name is oussama but still if they are gonna check it then why take so long. I cant stand this waiting its driving me crazy. Now Ive been writing to consulate and in the beginning they wrote me back but now ...no response. I dont know what to do or who to write. I call the consulate in Morocco and they tell me nothing. I feel so helpless.Anybody know how long this could take ( worst case)They took his passport so thats good right? Has anyone ever had their passport taken at interview then got denied? There is no reason for denial. There is nothing they will find wrong.please :help:

K-1 Fiance(e) Visa Process & ProceduresRFE from VSC

Ok, we have his tickets of 5 trips here, we'll submit that (those include boarding passes), we have our passports, with the visas and stamps (his 5 trips here and mine there).
Then we have pics, e-mails and letters.
Other than that, I can think of translating my degree certificate, that states my graduation took place on Jan 14th this year, and then I'm sending a picture of us together, on my graduation, with me wearing the cape, the silly hat and the diploma. I'm not sure if my own translation and statement I'm fluent in english is enough, or if I should write down that I'm submitting my diploma for proof of having met in the past 2 years.
Any other ideas?

i sent 2 pictures, a copy of my passport and plane tickets. Thats it. They must have something else in mind. I dont know what? Mine was sent to Vermont too and it skated right through.

My husband went for interview in Morocco and they didnt ask for one proof of evidence of our relationship. They ask for signed application from him police report and birth certificate. All the papers. e-mails, affidavit of support taxes everything I spend so much time putting together, they never ask for a single paper. My husband is now in the states and we are married waiting on his aos. We filed k-1 and it took 2 months for him to arrive in the states. So anyone who has doubts about Morocco.... dont get the female officer lol. Get theolder man and you shoulkd have no problem. Good luck to all of u. Sometimes things will just work out perfect.

K-1 Fiance(e) Visa Process & ProceduresUnsure, what is NOA2?
Wow!!!!!!!

Thanks everyone for the responses. Im sorry I havent been able to post much yet. I did fill out my timline but for some reason i do not see it appear on my post.

Im reaaaaaaallllllllly hoping for the best for myself and for everyone of us going through this process. But, I feel that if I have a problem or if any of us have a problem it can be solved thanks to the fact that at this forum we are all helping each other and going through the process together. Its great.

Man, today I found the actual website directly to the United States embassy in Buenos Aires where my fiance and I are having the interview.
Here is the website:

http://buenosaires.usembassy.gov/

There are 2 things that I have found on this website that have blown me away.

1. THE PETITIONER IS NOT REQUIRED TO ATTEND
end of the first paragraph of the 4th step
http://buenosaires.u...immigrants.html

I find this very surprising to see this written on the webpage because for many months now I have been certain that the petitioner must attend also, and that 9 out of 10 cases in where the petitioner is not present, get denied. Maybe for each country this fact fluctuates.

2. Immigrant visas cannot be issued until the applicant's priority date is reached
within the important notice of the second step

This is very interesting. So even if you are approved and they are technically finished looking over your paperwork, even THEY have no choice but to wait until your priority date has been reached. Which makes sense of course.

Ive looked over my notice of approvals and the area where the priority date should be filled in is empty. Has anyone else had this issue?

K-1 Fiance(e) Visa Process & ProceduresUnsure, what is NOA2?
Wow, this Forum is truly truly great.

For many months since my fiance and I decided to go for it,
I have looked hi and lo everywhere for tiny cournels of information about anything that has to do
with the process of fiance visa. Ive collected so many tiny bits of information, but none compare
to this forum. I learned more in this forum in 1 hour than I did anywhere else in months. Thanks everyone.

I do have a question, it is about clarifying what exactly is the NOA2? I thought i was still waiting for the NOA2, but after filling out my timeline, i realize i may already have it?

Ive recieved three letters in total, during this process.

1. reciept notice for the $170.00, by the department of homeland security.

2. An actual NOTICE OF APPROVAL by the department of homeland security.

3. A letter stating that the State Departments National Visa Center recently recieved
an approved 129F petition. This letter includes a CASE NUMBER, and the address where the interview will
be held in Buenos Aires. Also at the bottom of the letter it mentions that my fiance will soon recieve a packet with further instructions. Are they talking about Packet 3?

I really appreciate all of the help that this forum has provided to me and to others im sure. Hopefully everyone that is going through this difficult process will soon find this forum. I will investigate further soon any other informatoin that I can provide about my case, in order to help others.

Thanks very much

K-1 Fiance(e) Visa Process & ProceduresPacket 3 takes a while?

Hi everyone,

Ive noticed while looking at peoples timelines that packet 3 seems to usually arrive to the beneficiary not too long after the petitioner gets NOA2. My fiance has been waiting since April 6 for packet 3. Is this unusual and is the new IMBRA law something that could have affected this. If so is it possible that even I recieved a notice explaining that she would be recieving packet 3, maybe now they will not even send it?

Thanks everyone..

P.S. I notice some peoples timelines appear in each post they make. Ive filled out a timeline but it does not appear on my posts. Ill keep trying to figure it out.

Did you actually ask the consulate to send packet 3 to you, or have you just been waiting for them to send it on their own? If you haven't contacted them yet and are waiting for them to send it along, e-mail them ASAP and ask for it. If I hadn't asked for packet 3 we'd still be waiting for it lol.

Oh my Dios. Are you joking?? No I havent sent them an email or called. I didnt realize I need to, the letter that was sent to me stated that they WILL be sending it out soon, of their own accord. Wow today is Memorial Day, so everything is closed here but the consulate in Buenos Aires may not be. Man, I have to find the email address right away for the consulate in Buenos Aires. Thanks so much for the reply you may have just saved me.

By the way how do you know that if you hadnt called that you would still be waiting? Did they tell you that?

As far as I know, American Consulates are closed during American holidays, but you could try. Good luck!

Thanks Sarah. I think you are right, United States embassies probably are closed on holidays. Thats ok I can try tuesday.

Has anyone else had to actually contact the embassy to request Packet 3??

First petition is sent to Service Center, then that is sent to NVC (National Visa Center) and then that is sent toBuenos Aires where the interview will take place. Yes?

Ok I will do that. I can imagine if I show up there without warning it would be a hassle and very annoying for them and I certainly dont want to get on their bad side. Thanks for the tip.

Thanks Daphne. THANK HEAVENS FOR THIS FORUM. It is amazing how lost I would be without all of this help. Tomorrow, actually TODAY is memorial day.........hmmmm

Sorry for confusion......I am the petitioner. Im from the USA. Daphne did you mean that I should call the local Argentinian Embassy here in the USA? Or that my fiance the beneficiary, to call the American Embassy in Buenos Aires? The interview will be taking place at the embassy in Argentina. Again sorry for the confusion.

The Embbasy suppose to send the packet 3 after receiving your case. Foar situation if you have waited too long and received nothing.. You should contact the embassy to check on status....

For my case, I just can't wait, I communicate with my Embassy and they allow me to pick-up my Packet 3 from the Embassy Service counter.

Oh wow thats great, to be able to just go and pick it up instead of waiting for them to get around to sending it.

Can you guys share your Packet 3 experiences in this thread please? Im concerned about whether or not I goofed up and didnt realize that I am supposed to contact the embassy in Buenos Aires and actually request the packet 3 for my beneficiary?

On April 6th I recieved a letter from the bureau of Consular Affairs.

It says that the letter is to let me know that within a week the petition will be forwarded to the appropriate visa issuing post where the visa interview will take place.

Then it gives my INS Receipt Number, and the Case Number and the address of the Consulate at which the case will be processed.

In the last paragraph it states:

Your fiance will soon recieve a packet with instructions from the consular section at thispost on how to apply for the K1 visa at that post and what documents will be required.

In another thread someone has told me that they had to actually email and call the consulate that would handle their case and ASK them to send the Packet 3. This really surprised me when I heard this news. Has anyone (or everyone) had to do this??

Welcome to VJ..

I know exactly how you feel. I stumbled across this forum only a couple of months ago. Before finding Visajourney.com i was a pathetic, poor miserable #######. I was like one armed 3 fingered man in a canoe up craps creek without paddle. All I had was a bowling pin for a paddle.

since June of 2005 id been looking for ANYTHING, anywhere, asking anyone about anything even remotely in connection with the visa process to find answers to some of the specific questions I had. I yielded nothing, basically. Everything I found was incredibly obvious and generic info. :hehe: I did hundreds of differnt silly keyword searches on google and the info i gathered was contradictory and usless. Then one day somehow I stumbled upon Visajourney.com.

Here you can get everything from broad general information to incredibly specific details about any question on any form or document that you are dealing with.

I can imagine, 4 months ago seem forever and I am loosing my hopes with this IMBRA. Not know when something will change is the most agonizing feeling ever.

Ill admit, for me this isnt as difficult as it is for Maria. For her Id wait forever. Its still very difficult tho. We lived together for months and then sudden seperation. Weve been counting the days and its been almost a year of this nightmare..years from now though this will all seem maybe like a small price to pay to share a future together.

I really respect Maria for putting up with this long distance and seperation and staying faithful and also not to mention the fact that she is willing ot leave her home country for us to be together.

We use skype and sunrocket to stay in constant contact with eachother....and we text each other throughout the day on our cellphones...

Dont give up hope....have a nice long long chat with your loved one and talk it out and decide if you are both willing to go through this nightmare long enough to get through it and be together..

Awesome man.
Im really glad to hear that. Its very encouraging news. I was really hoping that I wouldnt have to go and pay for another Brasilian Visa, so far so good. It looks like I will still have to call the Brasilian Consulate tho and ask them about whether or not the fact that the damaged passport was sent into the washing machine and the pen ink that was used on the Brasilian tourist visa is slightly blurred, slightly, I will ask them if that may be an issue.

It is perfectly readable. I think the only possible flag it may raise is suspicion about whether or not it was tampered with. I will post the Brasilian Consulates answer to that in this thread, in case it can be of help to anyone.

K-1 Fiance(e) Visa Process & ProceduresDamaged Passport Issue

Well, its a longshot...

In May 2005 when my fiance Maria and I were staying with her family in Posadas my passport was sent through the wash cycle.
I immediately cut small squares out of some plastic bags and inserted them between each page. And dabbed the pages dry as well. Then I placed the passport, with the plastic, underneath a stack of books.
I looked at it a day later it looked pretty good. Some of the entry and exit stamps from Argentina were smudged. I got out Argentina and then into Brasil and then into USA no problem, with it.

I recently took it to the passport office and the clerk said it was still usable, but then he tugged at the cover and first page (page with the photo) apart. Now, its not fine. That is the test, if the cover is damaged then the passport is useless.

Ive sent the damaged passport out for processing in order to recieve a new passport. They will send the old one back to me, voided, along with the new one.

Now, inside the passport is my Brasilian tourist visa glued to a page of the passport. I recieved the Brasilian visa in 2003 and it is valid until december of 2008.

Does anyone know if I will have to get a new Brasilian tourist visa for the new passport? Even though the visa in the old passport hasnt expired yet?

OR does the passport office automatically contact the Brasilian Embassy and create a new visa into the passport?? I guess not.

Anyone ever had a problem like this with a damaged passport containing a valid foriegn visa?

Holy Bungetry....

Ive just realized that on all paperwork up to this point I have used the old passport number. I dont even have the new passport number yet. Since they WILL send the old passport back, voided, along with the new one, I hope at the interview in Buenos Aires, the fact that the old passport is voided is not going to be a problem?? Anyone know?

I can only imagine how it must feel for people with a receipt date of march 7th or 8th or something!!
Im trying to remember what i was doing for the week BEFORE I sent in my petition.

I made an appointment for Feb 21st with an International Institute in Lawrence Massachusetts which helped me get some of the paperwork together and provided me with the G325. At the time the Institute was my only help, it would still be weeks before Id find VJ. Hmmm, There were a few delays with some of the paperwork like birth certificate and passport. Also I was waiting for quite a while for snail mail to arrive with my fiances papers and things. Certainly none of it is her fault, she did a really good job in collecting all of her information. I was really proud of her in how she packaged everything up and wrote me a few letters and.......I love her very much. Man....actually I think I may have actually sent out my petition ON March 6th...I still may have the receipt from the post office, Ill try to find it...cant wait to see my sweetheart.... :hehe:

K-1 Fiance(e) Visa Process & ProceduresNOA1 dates

As far as I know they haven't stopped receiving anything. They're just getting in the line on to bottom of the pile.

Like Laura said, it appears they NEVER stopped accepting new cases. Why walk away from the $170? Just throw in a box and let them gather dust while we all go crazy.

BOY am I bitter.

Well, then maybe that means one of two things. Either, its a good sign that they have not stopped accepting new cases because nothing will be changed only an additional new form will be added to the process. Or, maybe they have no idea what will happen so they are accepting new cases business as usual even though they know they will be put on hold indefinitely and will maybe even eventually be rendered useless, if, a new 129F document is created.

It would be good if cases after march 6th recieved a refund or a credit towards the new 129F form fee, if a new form is created.

Well, so any receipt dates before March 6th, will be processed without any problem. So those are being cleared out thankfully that way they dont add to the back up clogging of the cases in queue.

WHEN DID THEY STOP ACTUALLY ACCEPTING NEW CASES??? LAST WEEK?? 2 WEEKS AGO??? I ask because id be interested to know how many cases have accumulated and clogged up between March 6th and the date that they stopped accepting new cases delivered on the old useless 129F forms???

Thank god cut off point wasnt jan 6th or the rest of us would be waiting forever to be processed!!

I dont recieve anything else here in the US...everything else is sent to my finacee's country, right?

Thanks

That is correct. :D

Well, there is ONE thing YOU (the petitioner) will recieve after NOA2, the letter from the NVC. It is a letter explaining that the NVC has recently recieved an approved 129F petition on behalf of your fiance. The letter is to let you:

1. That within a week (of the date at top of the letter) the petition will be forwarded to the visa-issuing post where the interview will take place.

2. The letter will give you a case number.

3. The complete address of the embassy at which interview will place is given.

4. The letter states, "Your fiance will soon recieve a packet with instructions......."

So it goes- NOA1, NOA2, LetterNVC, PACKET 3, PACKET 4

Everything in italics is sent to you and everything in bold is sent to your beneficiary. Great luck!!!

K-1 Fiance(e) Visa Process & ProceduresWOHOOOOOOO! RFE!
Crikey........I should know the answer to this question.

No one is completely sure if they are sending out RFE's in order of receipt dates, well, it doesnt seem that they are, judging from some comments ive seen. Do I need to place a call in order to request the RFE? Or, just wait?
