Mother UKC ...... Father LPR of USA..... Baby will not be a USC, baby will be UKC and may have claim to citizenship from Fathers home country....

I did not come to the US with the intent of remaining I came to stay with family friends to recover from major surgery.... I met my husband here and we decided to get married... I tought I would have to return to the UK and wait for a visa...when we went and spoke to an immigration officer at Boston we were told there was no need for me to return and file for K3 as I was legally addmitted to the States I could file for AOS and I-130 together....

Why would I know anything about immigrating when I have never thought about moving to another country to live.... I have always come to the States on a VWP as do most tourists from the UK....

There was a thread posted a while back about a woman who was engaged to a permanent resident. She came to the United States on the VWP and apparently stayed until he got his citizenship. Perhaps some clever searches will unearth that thread. I know Meauxna commented in it and I just read it a few days ago, but I can't find it...

What you are sugesting the OP do would be immigration fraud..... To enter the USA using a VWP with intent to remain is illegal...

Thans . I really appreciate your help, one more question , do I still need to submit 2007 and 2008 transcript or just 09?

2009 is the only one required. They give you the option to send 07 and 08 if you think it will help your case.
I would say that because you made less during those tax years, that it wouldn't really help any.
But it is up to you.

You should be OK. Assets are only needed if you are below the 125% poverty line and need to make up the shortage.
You can only count the net value of your home anyway (minus loans)
Plus I don't know that a home is considered an asset that can be readily liquidized.
Just go with your current income. Get a letter from your employer stating how much you make per year. Send copies of a few months worth of paystubs too if you can.
Oh, and don't forget 2009 tax return docs of course.

How many people are in your household?
See attached form i-864p for poverty guidelines.
For household of 2, 600/week, if you work every week of the year, should be above 125% poverty line.
Make sure you include letter from employer

Same here I vote no lawyer if your case is straightforward.
I have definitely heard of lawyers slowing things down.
USCIS have been known to send certain correspondence only to the lawyer and then the applicant does not hear about it immediately.

Adding alien spouse to bank account

Hi,
This topic was briefly touched on, but I am wondering if anyone knows for sure if you can add an alien spouse to USA bank account with no SSN. I know I can't open up a bank account, but can my husband (USC) add me jointly to his. If so how does he go about doing this?

Just trying to find other ways to show co-mingling of finances, considering I don't life in the USA yet.

Do the immigration services understand this?

It all depends on the bank.
I believe someone here mentioned that Bank of America won't do it without SSN.
Someone else said Chase(?) will let you.
But I think that because you aren't even here yet (correct?) it will not be held against you if you don't have joint account.
You could maybe try the reverse? Add husband to your existing bank acct in UK?

Hello to all VJ Followers,

Before i say...How are you to everyone here in Vj this is my 2nd time posting because the last time is for my son crba, now this is for my spousal visa. i really dont know or what are the following we needs for IR-1 because we are married in many years now. we have been filed before but nothing happened. someone taken care our paperwork (lawyer) but one of our files destroyed by a contracted employee fired and charged for distruction of government property... so nothing happened to our paperwork. so my husband and I decided to stopped it for a while. Now my hubby we talked about it for my spousal visa. he told me to ask here this furom about IR-1 requirements... he wanted to get a lawyer again. i told him that. we can do it for our own without lawyer....

so member's of VJ please give me a following list of IR-1 requirment especially to all filipina are done for this IR-1 PLEAse HElp ME GUYS.... my hubby wanted to be with him before his b-day may 2011......

Keep in mind though, if you plan to do either fiance or spouse visa, this is not the same as marrying and adjusting status (AOS) while your husband is in the US.
For fiance and spouse visa, spouse has to leave and wait for visa to be granted.
Can visit the US while waiting but must be able to prove strong ties to home country.

Best way for you two to stay together and not have to be separated during the immigration process is for fiance to stay here, get married, AOS, and have husband wait here in the US until AOS is done.

You can most definitely get married and adjust status while he is in the US.
But this won't be the IR-1/CR-1 Process.
Lots of people get married and adjust from different visas all the time, including H2B.
The company may have said that because H2B is not a dual-intent visa like the H1B, which means one is not supposed to have intent to immigrate.
But barring other red flags, marriage to USC trumps most visa types.

pdf half filled out by hand, half by computer?

Yikes hi everyone, finally I'm ready to send off my I-130 petition for my wife. I just received in the mail her signed form G325a form but for some reason about half of the fields printed with nothing in them but the other half of them are filed out,(I filled them all out on the pdf before emailing it to her) she printed it out there, then signed it and sent it back to me here in the USA.

Is it okay to go back and fill out those boxes now? I'm worried that USCIS might raise an eyebrow when looking at the form half filled out by computor and half by ball point pen. thoughts on this?? anyone sent in forms half and half like this?

I had to write some things in by hand because they didn't fit when trying to fill the form out by computer.
My forms are mixed too..

I-864: a complication

I would say write a short statement to explain the recent separation, hence tax return was still jointly filed, and send along the separation documents.
Also send a letter from her employer + pay stubs just to show without a doubt that her income alone is enough.

Form G-325a -- Print your name?

The Form G-325a has this at the bottom of it: "Applicant: Print your name and Alien Registration Number in the box outlined by heavy border below." This field in editable in the form. I am a little confused: do we need to put the data in handwriting in this fields, or can we just fill it out on a computer? Please advise.

It is up to you. You can fill the entire form -- including this heavy bordered box -- using your computer or by hand.
I even mixed handwritten and computer because some fields didn't have enough room for my answers..

When they say "print" they just mean don't write it in cursive

Does the Co-Sponsor just have to come up with the 125% or does he/she also have to "cover" the main sponsor's debt?

Main sponsor's debt is not considered in this matter.
They only want to see the ability of the co-sponsor to support the intending immigrant (plus co-sponsor's household members).

I am not 100% sure that the co/joint sponsor can be any other third party, but I MAY BE wrong as well. That's why, please pull other expert opinions as well.

As per I-864A, the co/joint sponsor must be a household member as defined below (So how can a friend be a household???):
1) A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;
2) A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;
3) The intending immigrant - if the immigrant can show their income/asset that will still be continuing even after migrating to the U.S

Need serious help!!! please

I do not want to panic yet please help me understand this I-864 form when using a joint or co sponsor whatever you may call it.

I am bellow the poverty guideline (by 2,00 dollars) to sponsor my husband, so I will be using a co sponsor. I have two children that live with me so that makes us three... do I include my husband as well on the form when I fill it out?

When my co-sponsor fills out form I-864 she has 4 people in her household (herself and three kids) who does she sponsor?? my husband only?
She is not sponsoring my husband and myself and my two kids correct?

Your household size is 4. Yes you include your husband as you are his main sponsor.
Your co-sponsor is only sponsporing your husband, the intending immigrant.
No, the co-sponsor does not sponsor you or you children.
But s/he must have enough income for your husband as well as his/her own household members.

We are managing now to send in the required evidence
I am wondering after the USCIS receive our complete required evidence, how long it is gonna take to hear from them again ?,
because it already took 5 month for them to send us this request for evidence

When I got an RFE, USCIS updated my online status 2 days after delivery confirmation from the postal service (USPS)
Of course I applied for AOS not spouse visa.. so I don't know if that makes a difference..
I should think not..

I864A Question (Please help)

we are submitting I864 form when the bill shows as paid.
In question 21(a) we have entered one (my husband sponsoring me)
so again in 21© (If you are currently married, enter 1 for your spouse ) do we have to enter one or leave it blank. I m confused in this part.

In ques 23. current individual annual income will be shown with or without taxes ?

Therefore my husband is only sponsoring me with no dependants so the total household size will be 2 ?

put zero for 21 c because you should already be counted on line 10 as the intending immigrant
total annual income is gross income.

My bf had his interview in Morocco 2 weeks ago. They took his passport and told him to leave his cell phone on they would call in a week. Well it is now almost 2 weeks. We wrote consulate and they just say under further administrative processing. Everthing was perfect... paperwork evidence. His police report is clean. I dont know what the hold up is? Has anyone been through this? I heard if they take the passport it is a good sign.please respond. Thanks

Got my passport back this morning with K1 visa! (London)

Well 47 hours after I got told I was approved I got my passport back. The relief is amazing! I felt more stress fall away after actually seeing the visa in my passport than being told at the Embassy!

Congratulations! How come your fiance didn´t know he had gotten an approval from the interview?

he did but they said they would call him in a week and we waited and never a call. Then we e-mailed them and they said its under administrative processing. So then we got nervous. Today i called and they said it was prepared today. I just called again and got the same guy lokl and he said i know your excited but they will call him to pick it up. and he said he has the visa its all prepared and ready to go just wait till he gets the call. I had to double check to make sure lol and called again.Im not dreaming!!!!!!!!!!!!

I wrote this morning and some girl gave me a number to call for my pending visa. After waiting a half hour a man came on and i begged him to put my case number on computer and see if any change in the processing. He said seems like its still under processing. I said oh. Then he says oh wait a minute.... Looks like something new here. I said what???? He said looks like visa was issued today!!!!! I said nooooo wayyyyy he says wayyyyyy. I said so he got his visa??/ He said yes he did. So now i dont know what to do i forgot to ask if they will call him or send it or what? Today is friday so he cant do anything today. I sure hope they call monday. I am sooooo happy. I called my boyfriend and he said " that is good now i talk to u on pc this call costs money

. Guys are so emotionless lol. Im jumping for joy over here. Ill let u know when visa is in hand. wish us luck.

still no response going on 3 weeks

With a name like Oussama, it's going to take a little while longer right now. Remeber, the US govt. is tapping phone calls and e-mails of average citizens IN THE US. Imagine how scary it is for them when a guy from Morocco, who just happens to be named Oussama, is applying to come here.

Just be a little more patient. They're probably checking and rechecking just to make sure all the paperwork is accurate. He will get the visa, it's just going to take the govt. a little more time to remove their heads from their asses.

Don't worry, I'm sure everything will be fine. Your fiance is most likely just in standard administrative processing, which means they have to run his name through the FBI database. It is a good sign they took his passport - he should be hearing something any day now.

You can call the Department of State at (202)631-1225 to enquire about his check. Most likely they will just tell you that his case is being processed and he will be notified by the consulate when processing is complete. At least it might make you feel like you're doing something...
