Hi, I was wondering if it's possible for my fiance to come to the states on a visitor visa, and we can register here without going through with K1? Anyone know anything about that.

I advise against it - that's what the k-1 visa was created for. However, people ARE still doing it the unethical, illegal way. The choice is yours but it is up to you to decide whether you wanna risk deportation and penalties. If you get married here on a tourist visa, you will have to prove that you never intended to marry when she came here. I say don't do it.



Both of your above statements are not true....

1. It is not illegal to do AOS from a Tourist visa or VWP if you had a spur of the moment marriage....

2. There are 1000s of people who come to the USA to marry each year there is a whole big tourist industry based around marriage in the USA and they do not need a K1 to do so.... if you do marry on the spur of the moment and file for AOS you may be asked about your plans when you entered the USA at your interview but most are not asked anything other than the normal interview questions....

3. You may think that anyone doing AOS from a tourist visa or VWP is unethical and illegal and you are allowed to have you opinion... but be careful about making blanket statement about the legal or illegal ways to do AOS....

There is nothing illegal about getting married in the US.... the problem is if you remain after the marriage and try to adjust status.... if the marriage took place on the spur of the moment ( you could well have talked about marriage before but just not set a date or you could have a marriage planned and than choose to get married earlier, also there has some cases where the couple have a K1 filed and the immigrant comes over for a vacation and gets married and stay and does AOS without any issues.) then you can do AOS and you will not be asked to provide proof of your intent on entry.... most of us on VJ that have done AOS from a tourist visa/VWP did not provide any proof of our intent... Now if you and your SO sit and plan to come on a Tourist visa/VWP and then file for AOS you could well run into problems... but I do know that there are 1000s of couples who do just that and most go on to be approved for AOS woth no problems... do that make it right??? NO...

The only case when you can get married in the US is if she is visiting you and you decide on the spot to get married.

You are already talking about marriage, so in your case there is intent. Therefore it would be considered visa fraud.
You have to give proof that there was no marriage intent when the foreign spouse entered the US if you don't have a K1 visa.



You do not have to give proof of any intent if you entered on a tourist visa.... you may be asked about it but unless they suspect marriage fraud it is unlikely you would be aske to submit any proof...

Hi everyone, I know this might be a dumb question but is there any way for my fiance from Canada to have the K-1 interview in the United States instead of the Consulate in Canada. She's coming over on a B2 visitors visa until she receives word on when the interview is. Are the Consulates outside of the U.S. the only place the interviews are done? Are we going to have to travel back up to Canada for the interview just to get a piece of paper stamped at the border? Man, thats like reaching behind your back to scratch your elbow! It would be so much easier to be able to do it in the state I live in and save us the expense of flying back to Canada.

It really doesn't matter how much stuff you bring with you. It only matters that you don't overstay and that you return to Canada for the interview and enter the US using a valid K1 visa before marriage.


I am sure the POE officer would disagree with your statement.... try telling them at POE well I have a B2 visa but I am moving to live in the US.... I am sure they would say OH welcome to the USA have a nice life.....

Lets hope that nothing is asked at the K1 interview about place of residence....

I agree. I referred to "stuff" not stupid statements to immigration officials. Without authorization to stay beyond the time allowed in the B2 visa, one cannot accurately describe their intention to "move to the US". She can bring as much stuff as she wants as long as she goes back before her visa expires and secures the appropriate visa. How is this "moving to the USA"?

AS you can see from the OP comments.... they feel that to have to go back to Canada just to get a bit of paper for the border is going to cost them money.... most people who are lucky enough to be able to spend time together at the K1 stage would have to return to Canada to close up their home, job, financial affairs.... you know all the things they might ask for as evidence of ties to Canada at POE.... but the OP sugests that they will only have to return for the bit of paper.... so the other things must have already been sorted out and no ties exist.... or they are going to abandon everything.... or they have already taken up residence in the US....

Provided you haven't been married yet, and the visa is not outside its original 6 months expiration, you may be able to revalidated the original visa at the embassy or consulate where the visa was granted.


This is not true. A K1 visa can be revalidated if they didn't get married yet, but the revalidation and marriage must occur within the 90 days from the initial entry to the US.



Agreed.... if the 90 days has expired and she has left the US then the K1 can not be revalidated.... you will have to file for another K1....

I have used skype since 2004 pre webcam support and since they introduced webcam.... I use it to keep intouch with my Parents and my adult kids and my grandaughter.... I also use it as just a telephone for calling international numbers..... very cheap calls...

I have never had any problems with the webcam or the call quality... so maybe you need to look at your hardware/conection....

If your soon to be wife leaves the US before you have filed for AOS and she has advanced parole then she is not going to allowed to return to the US and you will need to file for a K3/CR1 visa to bring her back....

The Advanced Parole normally takes about 90 days after filling to be approved.... you could make an infopass appointment and ask about emergency AP, showing them your orders from work.... but you wouls still need to file for AOS first....

The other option is for your wife to remain here in the US until she has her greencard.... it would mean you would need to fly home for her interview....

I had my passport changed at the UK embassy in the US... Washington DC...

You can ask for the old passport back.. so if she was to get a new passport on her next visit home she can take the old passport and the new one to checkin at the airport and they will allow her to board...

But check out the embassy for her country in the US most do have passport services available to residents of the US...

Yes your in AP and it will take few weeks or longer to finsih the process. Once they have your evidence they will have a CO review the case and then contact you once they are finished. Good luck.

My bf went through that also. He brought in the document he needed the next day and it went into processing too. I just found out 2 weeks later they just prepared the visa. Try not to worry. I know its hard cause even though they said visa was prepared he still doesnt have it in his hand and i wont be happy till he does. Hopefully we will all look back and remember how frustrating this process was as we live our lives with our spouse (L)

I believe the case is still at USCIS.

They sent me an email on 09/01/06 explaining that they have sent an approval notice through regular mail to my house for the IMBRA RFE. So the case is still at USCIS.

Can the USCIS now send the petition back to the embassy again? Or do they first need to send me yet another letter explaining that "it will be forwarded to the proper post".

Hi everyone.......been a long time since ive been able to post.....but I've been reading up on topics from time to time. I havent been able to find out tho about an issue I am having with changing the address to which the beneficiaries packet 3 should arrive to.

My fiance has had a falling out with an aunt of hers with whom she lived during the time that we were filing her case. It doesnt seem like a good idea to have anything so important as packet 3 mailed to that address anymore. Ive been writing to the embassy in Buenos Aires, where her interview will be, asking them wether or not packet 3 will be mailed through regular Argentina national post service, or through fedex or what.

It would be much easier to be able to just keep the packet 3 at a PO box in my fiances post office. If the package is sent fedex though it will be sent right to the address of her crazy aunt, if I cant get it changed in time.

The goal is to find anyway possible to avoid having the packet 3 reach the address at which the aunt lives.

Ill update my timeline very soon.

wow ..... well I have never heard of the local office extending the EAD on a K1 visa that is technically expired... K1 is no longer valid as soon as you file for AOS... that is why the EAD is only valid for 90 days... the time you are allowed to take to file for AOS...

Good luck with getting it extended... you may want to check it out with your local office before he accepts a job and expects to get the temp EAD extended...

The problem with getting the temp EAD with K1 is that unless you file for AOS the day after you arrive you will unlikely receive your 1 year EAD before your temp one runs out.... this would result in you having to give up your job...... until you had the new EAD in your hand....

Most employers will not accept the temp EAD because they know its only good for 90 days... from the day you enter the States...

You cant come to america and do K1 and stay..... you would have to return to the UK and wait for the K1 to be approved....

As for finding work after you have your K1 and are here, it all depends where you will be living... but to work you will have to file for Adjustment of Status and Employment Authorisation Document and wait for the EAD to be approved then get a Social Security Number before you can start work....

Its not just a case of getting here.... you will need about $1000 to cover all the fees and costs of AOS and EAD and your future husband would need to earn enough to support you both (125% of the povery guidelines) or have a co-sponsor...

You should read the guides here on the forum they will explain all...

I arrived in the States a year ago tomorrow and my passport was due to expire in June 2005 I had no problems at POE (and I was here as a tourist) on a VWP... we got married on April 9th and I downloaded the passport forms from the British Embassy website filled them in sent it off to Washington asking for my old passort to be returned as I needed the I-94 for immigration... I got new passport in my married name along with old passport within 2 weeks.... I took both passports to my AOS interview and had no problems at all...

She will not have any problems with the fact her passport has under 6 months left as long as it is valid when she enters the states she is ok... once you are married she can renew her passport in her married name at the Brittish Embassy in Washington... that is what I did and I have had no problems...

Having a temp EAD stamp will not speed up your application for EAD that you submit with AOS.... the temp EAD is only valid for 90 days... if you have not received the 1 year EAD by that time (most dont ) you will have to stop work and wait until you have the 1 year EAD.....

Not all POE's will give you the stamp but some do.....

You can ask.... but you may not get one.. if you do it is only valid for 90 days and then you would have to stop work and wait on your 1 year EAD that you can apply for with AOS... that can and does take 90 days+ from when you receive your NOA...

dont know if its worth going through JFK just for 90 days... and dont forget you have to get your SSN and that can take a couple of weeks..

You can not file for AOS if the marriage did not take place within 90 days.....

AOS from a K1 is dependent on the marriage having taken place within 90 days of entry to the US..... it would be denied and you would be deported.....
