Last time I checked the USA was still selling its self as a tourist destination...

I was told not to use on-line sites to get the certificate no mater how real they look...

If she leave before you have AP in hand then you will have to start all over again with a K3 if you are already married or another K1 if you are not....

the date her visa expired will not make any diffrence to her doing AOS.... You need to be married and then file for the AOS paperwork... that will put her back in status while it is being processed.... she MUST NOT LEAVE THE US or she will be banned for 10 years.... start the AOS and get things sorted.... a visit to a immigration lawyer to go over everything would help too...

I came on a VWP/tourist visa and got married and stayed... I have had my greencard since Nov 2005... so yes it can be done and there is nothing illegal about it... Yes there are risks in doing it this way but for the OP's wife to return to her home country would make things 100 times more complicated than just having to file for a K1 or K3... because of the overstay she would be denied and then have to file for a wavier to overcome the ban before she could be givenany visa to re-enter the USA...

If your "significant other" arrives in the US on a B2, and you get married and he/she STAYS in the US, is it harder to file an adjustment compared to if your "significant other" arrived in the us on a K1? I'm just wondering because it would seem more suspicious, at least in my eyes.

Also, once you file for AOS on a B2, are all the procedures the same as a K1 , such as Advanced Parole, EAD, SSN, etc...? Or would it also be harder to obtain?


It is exactly the same process for someone entering on a B2/VWP as it is for someone entering on a K1 and filing for AOS, it is no harder and takes no longer....

I did it and have no regrets... if you enter legaly and had no intentions of getting married and remaining the you can do AOS... why would you want to return to your home country and then file for a K1 when there is a route open to you to file for AOS and remain together....

I applied for a visa for my fiancee in December 2006 with I29F. We have received an interview date for June 18 at the the U.S. embassy in Manila.

However, we were married in the Philippines on April 28, 2007. I would like to change this application from a FIANCEE visa to a SPOUSE visa.

I have some good news and bad news, good news is congrats on getting married, bad news is "What were you thinking, its at the best interest of your wife and yourself not to reveal anything to the consulate because if you do your entire process will be denied and you would be placed on administrative review, which can take a while to fix, they are going to look at you as if you were trying to cheat the system. My father did the same thing back in 1997 and he had to wait almost three years to fix up his mess with the act of congress on his side, and I don't think you want to endure that horrible process, its probably a little faster now but not by much. Like the military says, don't ask, don't tell, keep it your little secret! Best advice!



YOU ARE TELLING SOMEONE TO COMMIT VISA FRAUD.......... and thats your best advice.... I dont think we need it... and its is in violation of the TOS of VJ...

Over the last few years I have seen so many people have to change bookings, lose money, have their dream wedding spoilt all because they booked it before they had their visa..... There have been people who thought it safe to book the big day once they had a date for their interview.... only to have to try and change things at the last min because of a delay that they did not expect.....

Please dont book anything until you have your visa in hand.... it is just not worth the heartache and stress

Looks like you were given bad advice from the begining..... you should never have left the US.. you should have got married and filed for AOS because any overstay is forgiven if you are married to a USC...

You should have filed a wavier to over come the 10 year ban at the time of your interview.... you dont say who gave this advice but I would recommend you do nothing until you have spoken to a immigration lawyer...

To get the K1 revalidated only works if the person is going to have enough time left on the original 90 days to come home and then get married.... as the OP's 90 days expire on 08/03/2007 they will be cutting it very close even if they do get it revalidated... there is no sure gaurantee that it will be....

Hello,

My fiancee is here in the USA on a K1 visa. The visa expires August 3rd. Her mother is in the hospital and she may have to go back immeadiately to tend to things. We were planning on getting married July 15th. Should we consider getting married ASAP before she has to go take care of her mother?

I am really not sure how to proceed. We can start the process of status adjustment (I believe), but will she be allowed back into the country after August 3rd if she has to stay past that date (in Russia).

We are quite nervous of the situation, can anyone offer us some thoughts as to what our options are please?

I think your best bet is make an infopass appointment right away and then get married before that appointment. At the Infopass appointment, apply for emergency advanced parole. They have the authority to grant it on the spot.


They will not grant emergancy AP until the OP has filed for AOS....

get married tommorow get a copy of the certificate ASAP file AOS overnight with a reciept then take reciept to infopass and try for emergancy AP other than that once she is ready to return do a K3/CR1

One you have got married in the US you will need to file for AOS if you file after July 30th when you file for your AOS you will also get an Advanced Parole which will allow you to travel outside the US before your get your Greencard....

Once you have your Greencard you do not need anything other than your foreign passport and greencard to travel....

but you MUST get married in the US.....

There is no other way for him to do it but to file for a K1 if he want to get married in the us and remain here.... the only other option would be for him to come and get married then leave the US and return to the UK then his wife would file for a K3 or CR1 and once that was approved he could then move over here or they could get married in the Uk and file for K3 or CR1....

I agree the post link that was given has nothing to do with this situation... and I did not mention it in my post... There has been posts on here in the last 2years about people having wedding parties before they enter on a K1 and them getting a hard time at POE.... I can not do a search for them as I am at work.... but I am sure they can still be found....

There is a very good reason for USCIS having printed on the K1 instructions the nothing should be planned until a visa has been issued.... if people choose to ignore that then they run the risk of finding themselves in the same possition as the OP.....

Well lets hope that all CBP officers have read your post..... because if they get the smallest inclination that there could have been a wedding/marriage they will ask you to prove you are single and free to marry.... now you are standing in the immigration hall at xxxx airport and the officer is asking for proof that you are single and free to marry... what are you gonna use as proof???? Its very easy to prove you are married (marriage certificate is all that is needed) it is very hard to prove you are not....

So I would never advise anyone to have any sort of wedding or wedding party before they enter on a K1.... its just not worth it....

3. You may think that anyone doing AOS from a tourist visa or VWP is unethical and illegal and you are allowed to have you opinion... but be careful about making blanket statement about the legal or illegal ways to do AOS....

No, you are taking my words/comment out of context. So typical on here for a few people to do that.

2. I am aware of that. However, I also know 2 people who have gotten denied and deported and they had intent. I just don't think it's something worth risking whether 1,000 people do it or not.

3. Nope, I did not say that. You are taking it out of context. If you have comprehension problems whilst reading my post, just do not respond.
