what i think now is that the earliest to move with the greencard in the lottery would be janary 2008. hopefully i will be in the states already then. but after the k1 the greencard is only temporary, righ? and the one in the lottery is a "Normal" one. or am i wrong? could i even take advantage of the lottery greencard after being issued the other one?


The Greencard you get after doing K1/AOS is a normal Greencard.... it does have conditions that have to be removed 2 years after it was issued.... but you have all the same rights as any other Greencard holder....

I do have to ask "what is more important to you? Being with your loved one as soon as you can OR getting that Greencard????

There are not many offices that are issueing I-551 stamps anymore... so she does not need a valid passport at the time of interview.... she only needs to take her expired passport so the I-94 can be removed if she is approved.... most people get there Greencard with a few weeks... so once she has it she can file for a new passport....

I take it you are aware of the conditions of residency that she will need to comply with....

Responsibilities
You are required to obey all of the laws of the United States, the States, and localities. You are required to file your income tax returns and report you income to the US Internal Revenue Service and State IRS. You are expected to support the democratic form of government and cannot attempt to change the government through illegal means. If you are a male, age 18 through 25, you are required to register with the Selective Service.

International Travel
A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

* Move to another country intending to live there permanently.
* Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Fail to file income tax returns while living outside of the US for any period.
* Declare yourself a “nonimmigrant” on your tax returns.

In a perfect world everyone would do their job acording to the law and would follow procedure exactly.... but we do not live in a perfect world... everyone including CBP officers and USCIS staff have their own interpitation of the law and how they do their job.... we as the users of their services are very much subject to how they are feeling (bad day) how they see themselves within their jobs and all outside influences that make them who they are....

Us as immigrants are not in a position to tell them that we know the law and their interpitation is not correct... we turn up at the POE or USCIS meeting and hope to get out the otherside with as little hassle as we can... If they are having a bad day or they take a dislike to you there is very little we can do... this is especially true at POE because if this happens you can find yourself denied entry and on the first flight back from where you came.... you at that point are in no position to argue the law or the procedure...

I think what people here have been trying to say is why have something you feel the need to hide or not mention at POE or AOS interview when there is other ways to achieve the same result....

We all know that if you read the law for immigration it tells you one thing but in practice that is not always what happens in real life.... yes that is wrong and yes it should not happen and yes you should be able to do something about it.... but for most of us there is nothing we can do but just try to get through this journey as quickly as poss with as little hassle as we can... so that we can get on with our new lives...

All the legal statements and processes are not going to help you if you are stood at the POE and they are about to deny you entry.... maybe after the fact you can do something about it but would you really want your SO to have to go through that? I know I would not...

am1996 I find your posts interesting and they do give an other insite to immigration.... my overall feeling about your arguments that you give is that they would be well paced in a court room.... but as most of us only ever have contact with CBP and USCIS staff who being human will look at things in there own way... and the chances are we will never have to argue these points in a court of law.... the legal arguments you give will not do most of us any good... we are in there hands... but if I ever need someone to come and argue legal points I will sure give you a call...

Do things right have the wedding here in the US and then at a later date go back and have the religious wedding you so want... of course maybe the big fancy wedding service in a church is more important to you than your SO having issues at POE...

If the embassy or the officers at POE hear you have had a wedding service you may well be denied your K1 or entry at POE.... you would be better to wait and get married here in the states after your K1 and then later go back to Brazil and have the church wedding....

When they scan his passport at POE it will bring up any previous visits to the US and any visa applications he has in process....

If he want to try to come visit for the 90 days he should book a flight via Dublin as there is a US immigration post in dublin and he would clear immigration there.... so if he was denied he would only have to pay for a short flight home to UK instead of a transatlantic flight....

If you have already filled for a K1 then he had better make sure he bring lots of evidence that he is going to return to the UK at the end of the 90 days.... or he may be denided entry and put on the plane back to the UK... he sould bring letter from employer saying what date he has to be back.... proof of rental or mortgage and anything else he can get to show he has to return... because the POE officer will look at his ties to the UK and why he is visiting the US if he has ties in the US ie. you then they may say he has intent to remain...

The 90 day VWP can not be extended...

My understanding of it is that if a birth certificate is available to you you have to use that.... it would only be if the birth certificate did not exist there are other options available.... you might want to check it out with a lawyer...

I have a friend who came to visit his girlfriend in GA he stayed the 90 days left for Toronto on day 89... spent 2 weeks in toronto and tried to fly back to GA.... was denied at POE but on flight to toronto at his expence and then had to buy a ticket from toronto to london as well as pay for hotel accomidation at toronto airport....

Now he is in the process of filing for a K1 and he says himself he wishes he had done it the right way as he would have been here now.... but he can never use the VWP again because he was denied entry.....

there are others here who had filed for K1 and then found themselves in the us and decieding to just get married.... and they now have there greencard.... is this the right way to do it ? who knows..... if you can with all truthfulness say that you did not have intent to remain when you entered then it is worth the risk...

You may want to talk to another immigration lawyer to go over your options....

If the CBP officer at POE finds out you have had a wedding he may refuse entry on a K1.... I know that if it is non legal it should be ok but you know what the officers are like at POE some are very good and some are very bad... they only have to hear the word wedding and they will ask her to prove she is single... it is a very hard thing to do... it is easier to prove you are married...

Be very careful in what you get in writing if it mentions the word wedding/marriage then dont use it at POE...

As every case is diffrent you can only be guided by what happens to others that file at the same time as you... some are much quicker than others.... there are 1000's of reasons that your case may be slower to process then Jane Doe's who filled the same day.... but I would doubt that you being 21 is one of them...

You asked about a K1 and I said you can file for it from any country of the world... it will be up to you and the embassy dealing with it if it will be approved.... that has nothing to do with a B2 or a VWP...

The chances of him getting a B2 visa are very small... the embassy in london will say that the 90 day VWP is long enough for most trips to USA...so unless he can show some reason to be here longer than 90 days it would be unlikely to be granted...

Nothing to stop you filing for a K1 while he is here... if he comes over for the birth of the baby and wants to stay for the full 90 days allowed on the VWP then he will need evidence of very strong ties to Scotland or he will be denied entry.... it may be a good idea for him to fly via Dublin as they have a US POE and if he is refused it is only a short flight home....

Once you are married and you file for AOS and I-130 together your status will adjustment pending... as you live in TX you should also look for a thread on VJ called DORA I am not too hot on how that works as its is a pilot program.. but I am sure you will find others here who have done it and can help you more than me....
