K-1 Fiance(e) Visa Process & Procedures	Do I even need a K1 as a Canadian?	To enter the US with the intention of getting married and remaining you need a K1 visa... Yes you can get married in the US but you will have to return to Canada.. If you enter on a K1 and get married you would need to file for AOS and AP to be able to leave and re-enter.. If you get married on a tourist visa and leave you stand the chance of being denied entry unless you can prove stronge ties to Canada and have no intention of remaining.... If you lie at POE by not mentioning you are married that is visa fraud... I see you options as apply for K1 and get married in US then apply for AOS or get married outside the US and file for K3.... K-1 Fiance(e) Visa Process & Procedures	Point of Entry Question	Keep in mind that if you get the Temp EAD at JFK you still need to get a SSN before you can start work.... You need to wait 2 weeks from the date you enter the States to allow for your information to be on the SS save system it then takes about 2 weeks to get the number in the mail... so there is 28 days gone from the 90 days that you are allowed to work.... most people wait the full 90 days after filing AOS to get the EAD and you have to stop work when the Temp one expires.... Once the K1 visa is in her passport the B1 is no longer valid... so if she comes in Oct that will be her entery on the K1 and she should not leave until you are married and have filed for AOS and AP.... If he did sneak over the border then the best option is for him to return to his home country and for you to file for a K1 and a wavier to overcome any ban that will come form his illegal entry.... If he was addmitted to the USA and crossed a border point and just never went home there are other options available... The K1 continues as normal and if approved the mother and baby can travel to the USA.... the baby does not need to be listed on the K1 as he/she is a USC from birth... There is nothing to stop them from doing AOS from within the US from a Student visa.... only time it might raise a red flag is if the student did not continue with her studies after the wedding.... if she plans to continue her studies then there is no reason why they cant do AOS... The AOS will ajust your status from conditional residence to unconditional permanent residence and at this point you also will apply for working permission and social security card. After 2 more years you will get an invitation for another interview and you guys will have to prove once again you are still living together. When you are approved at AOS interview you will become a conditional resient (unles you have been married for 2years+ at the time of interview) 2years after you bcome a conditional resident you have to file to remove conditions... if approved you will become a permenent resident. You will be interviewed by USCIS after filing for AOS and there is a small chance that you could be interviewed again when you file to lift conditions but most people are not... You file for permision to work (EAD) and travel (AP) along with your AOS... once you have been approved for AOS you do not need EAD or AP as Greencard hilders can work and travel on their greencard... The Greencard you get after doing K1/AOS is a normal Greencard.... it does have conditions that have to be removed 2 years after it was issued.... but you have all the same rights as any other Greencard holder....
