I've been waiting years for my divorce to first get filed and now for it be final. That happens two weeks from Monday! I've already called the registrar of deeds in my county to have my decree waiting for me to file the K1 on Tuesday!

Hi, I am finishing up with the filing of the K1 visa, It has been very stressful but I was wondering if I write none or leave blank..

1 for the I129F if for where it says you have kids could I leave that blank or do i write none

2 for if fiance doesn't use another alphabet do I write none or leave blank

3for the armed forces question do I write not in the service or leave blank

I printed it out and left those blank but on the example for from this site they had put those answers, did anyone else leave them blank and not had a problem?

and for the g-325A where it says applicants signature on the 4 pages do I put mine, and for my fiance's 4 pages he puts his? on all of them thought below we his information in the box and said none for alien registration number. was that right?

If you aren't satisfied with them and it's noticeable, I would get them redone, but that's just be.

That being said I have heard of petitioners that are on public assistance being denied, even though they have a qualified co-sponsor. But I do not feel that this has any bearing to our particular situation.

1) I am on MEDICAID ... state govt health insurance... I began receiving it while I was pregnant with my SON and to this day (7 yrs later), both myself and my son rely on govt assistance medical insurance 100%...

I am hoping that

a) it's ok that I have a son and he is not legally my fiance's biological son??????????

and

B) I am on medicaid.. state govt insurance because I have been a fulltime college student and not been working .... (I plan to change that as I'm looking for a FULLTIME JOB ASAP however... only due to the visa issues)


Thanks again.... I am hoping at least that I can go back to ghana with my son to stay with my dear fiance at least a few wks prior to his interview date... and hope to stay through his visa so we can fly over the ATLANTIC TOGETHER!!!!!! biggrin.gif

I have heard on here that it helps extraordinarilly to have the USC fiance there during the interview (not to mention I am sure it doesn't hurt the SO for emotional support!) wink.gif

But I am worrying that at the interview they may ask him "How many times has your fiance visited you here in ghana?" and I have only come one time..... :/

Then again, I have to work in order to prove I can financially support him (even though I have a co-sponsor who is very financially well off... my father!???)..... so how can I work FT and visit him for interview??? Unless I can get a 2 week paid vacation from the job I DONT YET HAVE!!!!! blush.gif

AUGH.... SO FRUSTRATING!!! Anyone have any MORE advice for this discussion?

Any advice on the pros and cons of the American fiance traveling to and STAYING OVERSEAS during the approval process???

How does immigration feel about this??

Hi, I'm new to this site. I had some concerns about my girlfriend and I. She is from Taiwan and has just currently renewed her student visa for another semester. She has finished a certification program as a medical assistant. She does not have a bachelor's degree but has aspirations to be a nurse. Unfortunately, she cannot acquire a work visa because it is costly to sponsor one. Also we do not know if it's possible to be sponsored if she were to work as a medical assistant. From our understanding, you need at least a bachelor's degree to obtain a sponsored work visa. To further make our situation difficult, I am not quite ready to marry because I am in graduate school and not working full-time.

I was wondering if anyone had any input or ideas that we could pursue aside from considering marriage. I care about her very much and want her to stay in the U.S. She also wishes to stay and is worried about having to go back to Taiwan.

I appreciate any feedback. Thanks for your help!

I think the best way forward is for my fiance to apply for his citizenship and then go ahead and file for a K-visa for me. One last question, once the k-visa is appoved do we have to get married in USA or can we get married elsewhere??? It has always been our plan to get married in Nigeria which is where our parents are from.



Thats where the citizenship came in......

You may want to check out the timeframe people are talking about so you understand that it is likely you will have to wait about 2 years before you will get a K1.... about 1 year for him to become USC and then 9 months to a year for you to get a K1....

If you arrive here on a Visa Wavier Programe and you are asked why you have come so close to having your baby... you are likely to be refused entry and put on the first flight back to the UK at your own expence.... The VWP does not give you free entry to the States it just means you dont have to file for a tourist visa... but you are still inspected at entry and subject to the same rules as anyone else....

How do you plan to pay for the delivery of your baby.... it is very expensive here...

An LPR/Greencard holder can not file for a K visa... you would have to be married and even then the wait would be a long time....

Sorry I cant give you better news..

So what you are saying is that in the UK I could get a priest to do us a wedding service... "I now pronunce you husband and wife" then fly away on honneymoon for 2 weeks then on my return return I go to local registery office with the paperwork from the priest to register the marriage... and you are saying from the date of the wedding service until I file those papers I am not married.... wow amazing that the government would say I was married... they will even issue you with a passport in advance in your married name from the date of the service...

I wonder how many people did not know they were not married on hooneymoon ??

If you stand before someone who is legally allowed to conduct a wedding and you say all the vows and they say those majic words "you are now husband and Wife" then yes you are married... you just have not registard it with the registary office....

Some friends of ours did what you are thinking of doing... they had the church wedding but did not sign anything with a plan to get married here in the states in front of the local Judge... at their K1 interview they were honest and explained what they had done.... the interviewr asked if it was a normal wedding service as done in the Church of England... it was...at that point the interviewr informed them that even if they did not sign anything the were married and that it was recognised as such under UK Law.... the are now waiting for K3....

Be very careful is all I can say....

The rules about being here legally are that you were inspected at a POE so if you were checked at the border and waved through then yes you were ispected and are here legally.... if you swam across a river or were hidden in the back of a truck then no you could not do what you need to do now....

You are canadian and many many canadians cross the border eveyday without getting a I94 or a stamp in there passport in fact I beleve all you need is your Canadian Drivers Licence and something with your address... I may be wrong...

For doing the AOS you would include a leter epaining your entry to the USA giving your point of Entry and the Date....

if you can get yourself organised and get married asap there is no reason why you would not be able to have your AP before the end of the year....

There are many Canadians who file for AOS without I-94.... you have a B2 visa that is your evidence that you entered the country legally.... go get married and file ASAP and get your AP and then you are all set for your plans...

if you were filing for AOS now you would have your AP by the end of the year.... check the timeline data most people receive it with 60 -90 days..... you still have 4 months until the end of the year...

Think I would take that risk before I would risk what you are hoping to do...

I have evidence of strong ties to Canada, so that's not a problem. Also, ties to Canada are necessary to establish your non-immigration intent, correct? Doesn't the fact that they are engaged evidences their obvious immigration intent? I am not sure that I see the difference between that and my situation.


They have to return to their own country to complete the K1 process what better tie than that.... But you have clearly shown that you dont want to belive what we are trying to explain..... I as said before maybe an appointment with an immigration lawyer will put you right....

Or you can do what you intent to do and them sort it all out after you are refused at POE....

ok you just dont get what I am trying to say... so here goes again

1. To be able to do AOS from VWP/B1/B2 you enter then country with no intent to remain and on the spur of the moment you get married.... you wish to remain in the US.... It is allowed for you to file AOS... but you canot leave the country until you have either AP or Greencard...

2. You enter on a VWP/B1/B2 and get married and go off to another country to have a wondeful honeymoon... to re-enter the USA you would need a K3 visa.. you can not re-enter on VWP/B1/B2 and then do AOS as you would have immigrant intent on your last entry....

Nobody is saying you cant do AOS.. as you are in the States and you did not enter with the intent of remaining so yes once you are married here in the States you can file for AOS.....

What we are saying is you cant leave the States and then re-enter unless you have filed for AOS and have AP or Greencard....

If you do then you will most likey be denied....

All of the things you listed do not show strong ties to your home country.... do you own a house there? do you have a job to return to? Children waiting for you?

A return flight ticket means nothing, nor does your car, nor a bank account, and nor your birthday....

Maybe you should go and speak to an immigration lawyer....

To enter the US with the intention of getting married and remaining you need a K1 visa...

Yes you can get married in the US but you will have to return to Canada..

If you enter on a K1 and get married you would need to file for AOS and AP to be able to leave and re-enter..

If you get married on a tourist visa and leave you stand the chance of being denied entry unless you can prove stronge ties to Canada and have no intention of remaining....

If you lie at POE by not mentioning you are married that is visa fraud...

I see you options as apply for K1 and get married in US then apply for AOS or get married outside the US and file for K3....
