You think you have a long wait today..... just look back 3 years and see how long people were waiting then.... While any delays are hard on the people effected, USCIS is working faster than they did before, so there has been some improvment to the service...

The fee increase is ment to help speed things up even more but you have to be fair and give it time to improve.... new staff need to be hired and trained and the mass filling to beat the fee increase has to be cleared....

When you have waited years like some people then you would be justified in trying to take action...

Once your fiancee is here and you have got married you can apply for Advanced Parole along with her AOS... this will allow her to re-enter the US if you go back to Mexico... once she has her Greencard she will no longer need AP to travel outside the US the greencard is enough....

Do not let her leave the US without the AP or Greencard or she will be abandoning her AOS and will need a new visa to re-enter....

Mark if she is going back to the UK for six months the fact that she has a british passport means that she does not have to show that she has enough funds to support herself while there...

For her to be able to file for a K1 for her boyfriend she would have to be a US citizen and meet all the requirements...

When you file for AOS the fee payable includes the cost of getting an Employment Authorization Document (to allow you to work) and Advanced Parole (allows you to travel outside the US and return).... all you have to do is fill in the forms and include them with your AOS packet... Well, I married, but I don't have proof of my marriage! if you don't have proof of your marriage you can file I-129f as a fiancé which is I did.. I married in sharia.. and i couldn't married by that country law! and another point I had to make a quick decision because my fiancé she well have no family in state and she well be disappointed and depressed so I did weeding ceremony to make her happy while we were there....! Which I explain the situation in my I-129f files!

You can be married without evidence of proof of married by certain country and rules! you can be married and still not married by religions!

as muslim I am married my wife but it still it be a fiance , i cant proof that with any type of doc which we are married!

so sample!


Lets wait and see the result of your actions before you go recomending them to others..... It is very easy to prove you are married but it is very hard to prove you are not.... lets hope your interviewing officer understand what you have done and that you have some form of proof to show them that you are not married....

Because the consulate are not the people who are going to inspect you at the POE that would be CBP.... you could try phoning the POE CBP at the airport you plan to fly into and ask them if you will be refused entry on the VWP if you have already been denied a visa to the USA....

Just remember that if you come to the US on a VWP and you get denied entry then you will be returned to the UK at your own expense on the first flight available and you will be charged at most expensive price for your ticket....

I had the same problem.... my mum remarried when I was 9.... I was known as my step-fathers last name and like you I had my passport, NINO and bank details in that name.... I had never used my birth last name as an adult....

When I completed all the forms I had to use my legal birth name as my maiden name but I had to put my know as last name in the box for other names used.... I also had to have my marriage licence here in the States in my legal last name...

I explained all of the above to the interviewing officer and it was no problem.... but I did get my passport changed as soon as I was married that way my birth certificate and marriage certificate and passport all linked together....

No its not 90 days in 12 months..... You are admitted for a maximum stay of 90 days then you must leave, but you could come back for another 90 day stay 3 months later.... My parents have used the VWP to visit me 3 times durring 2007, each stay was for 85 days... they had no problems but were told that they must be spending more time n their own country than in the USA in any 12 month period or they could be denied entry based on the fact that they are residing in the USA longer than they are in their home country....

The answer will depend on several things.... is your ex-wife still in the US? Was she approved for a greencard? has she worked in the US?

If you filed for AOS for your ex-wife then you are still bound by the Affidavit of Support unless on of the following happens...

1. She leaves the US permenently

2. She earns 40 Social Security Credits (10 Years of working)

3. She becomes a US Citizen

4. She dies.

5. You die..

Divorce does not cancel the Affidavit of Support.... So you may well have to count her in you calculations of Household totals when completing your new Affidavit of Support....

NO you need an EAD or EAD stamp on your I-94.... SSN is not enough to legally work in the US... JFK is the only airport that gives out the EAD stamp, there are some land crossings from Canada that will give it too...

The EAD stamp is only valid for 90 days from the date of entry and then you are no longer Employment Authorized until you apply for and recieve the 1 year EAD that you will file for along with your AOS... so ther will be a gap where you will not be authorized to work....

To refer to her as your wife is a big mistake.... if she were to refer to you as her husband at her interview she may well be asked for evidence that you are not already married.... or if she were to refer to you as her husband when at POE they could deny her entry on her K1 because you must be unmarried to enter on a K1....

The onus would be on her or you to prove that you are not married....not on USCIS to prove you are.... that is not an easy thing to do....

I too am awaiting my divorce to be final here in the States. My SO is from New Zealand and had travelled back and forth on the vwp several times throught the past year and a half so that we could spend time together as I worked out my own mess. On his last attempt to enter he was turned away at the POE and told he would have to wait for the K1.

You could file for a waiver or a new visa but that takes time too and even then it's still up to the CBP at the POE who will already know about you in the system. You could get lucky but that's alot of money and emotion to put on the line.

I'm sorry. sad.gif I know just how difficult this is. We will need to wait until April to even begin the K1 process to get Russell home.

It is very important to be honest...without offering more than what they ask. If he brings enough eveidence to ties at home he shouldnt have a problem but it is at the discretion of the poe officer who has the power to deny him entry. Good luck to you!

The processing time varies a great deal based on which service center she sent the petition to. Vermont is much faster right now although there are exceptions. You need to be aprpoved at the service center before the petition is sent to the National Visa Center and then off to the consulate.
