Some people get them...some dont. I'm assuming you are the UK citizen.

Are you able to use the VWP??? If so, you can travel and stay in the US for up to 90 days with that.

Even if you have a valid visa it is still possible to be turned back at the border. Just keep that in mind if/when you travel. It is all at the discretion of the POE officer. There are threads all over regarding evidence you can bring to prove you will return to your home country until the process is complete.

As stated, not easy to get a visitor visa from Nigeria in the first place. Even if you did get a visa, it is still at the discretion of the POE officer to let you in the country ...or not. If you state your intentions of staying you will be turned away. If you overstay your visa you will risk a ban from the U.S. and then have to file a waiver proving you did not have immigrant intent when you entered... something you can't really do.

You have to have met your fiance in person before filing for the k1. There are very few exceptions to that rule. Your best bet now is to visit each other 'somewhere' and then part again to wait out the process like the rest of us.

We've bought several tickets to NZ/AUS and always with a stop over in LA. There have been times we have been issued a boarding pass for the next flight and other times we have not. All with partner airlines. All of our travel has been purchased online and not once have we had a problem. *knocking on wood*

Try not to worry too much.

She has her itinerary. She has her visa stamp in her passport. They have no reason not to send her on.

I'm sorry I don't have any advice other than maybe talk to someone else or perhaps you can call and speak to someone with some authority. Maybe the USEM where the visa was issued can help you? Surely the airlines would know the K1 visa and what it means ....but really nothing surprises me anymore. sad.gif

boobah, every consulate is different so your best bet is to call/email where he'll be going for his interview to see what exactly they request from you as far as financial documentation. Do you mean that your home has $50,000 in equity that you could access if you needed? That would probably work but again, it's up to the USEM you're going through to decide. Every consulate seems to have different 'rules'.

After you are approved your petition will be sent to the NVC and from there it will be sent to the consulate your fiance will be interviewing at. They will send him a packet 3 which he needs to fill out. He'll need a medical and then he will be interviewed and hopefully receive his visa. Every consulate works differently so it's important you look through the portal page (top of the forums) and find out from others going through (London?) what exactly is required from him/you at this stage.

You don't need to 'find' your 'husband' to divorce him. As pushbrk stated, you can file and if eh doesn't respond to the publication, they will grant you the divorce. Every state is different. You may also have a waiting period for the divorce to be considered final as well as a waiting period afterwards until which you can marry again. Know the laws of your state and get that decree. That is your first step!

Since you have to have them for the adjustment period you may as well do it. Many people have translated the supporting documents themselves having only certain things notarized. Some consulates are quite particular, regardless of what it says on their website. Your best bet is to check your 'portal' (top of page) for others who are going through Ecuador and get your information from them.

You didn't mention any I-129f or all copies of the G-325A for both of you. Also...ummm the check. wink.gif You may have just left them out of your post because they're obvious but I figured I should mention it since many people here have been misguided. Also, your 'proof of having travelled'... is this the copies of your passport stamps that show your entry/exit to Ecuador? Do you have any proof that it was HIM you went to see? Proof of having met in person is one of the most important details for the petition part of the process. Be sure to check out the guides.

If your union, or those whose contract you're under, pay your taxes and handle your pension then you are not self employed. You must get some kind of paystub or something to the effect that shows earnings, deductions..etc? You are a contractor who works through a union.

Even though I work for several companies, I am self employed. I file 1099, pay my own taxes and handle my own benefits. No fun. wacko.gif

There is no speculation on my part about why the check has not cleared. Based on others timelines comparible to the OP, the check should have been cleared by now.

Based on the other information in the original post, there could be any number of things going on which is why I said what I did.

As is often the case, we really need more information. My response was intended to address issues brought up in the original post without speculation BUT while keeping in mind what could be obvious circumstances.

In any case i'm not going to be the one telling them to sit back and wait it out only to find out that it never got there and they have to re-file yet again. Not when everyone else who has filed by that date is well on their way. There is no reason they can't call to see if the petition has at least been received.

Ummm ...ok so if you filed in December and have an NOA1 date from then why did you file again? You say it's a 'long story' but you can't just submit another application without withdrawing the first and i'm sure that takes some time.

The 'backlog' you mentioned is from last years July fee increase. Both centers are pretty much caught up except for a handful of those still waiting. There are people from December still waiting.

So I guess if you did withdraw your initial application correctly and filed again for whatever reason your check should be cashed by CSC by now and I would surely call them about it.

When you file for adjustment of status (2 year green card) you also file for advanced parole (travel) and ead (work). They are all included in the cost ($1,010). Once her AP is approved she will be able to travel. It's usually only a matter of a few months but you can check the AOS timelines for more accurate data.

The uscis website forms page asks that the checks be made out to the "Department of Homeland Security" however, the I-129F instructions state that it be made out to "U.S. Department of Homeland Security" (do not abbreviate).

It's how the US views your 'ceremony' that matters so you may want to check with your USEM. It is at the discretion of the CO to approve your application for the K1. Many people have had non-binding ceremonies before their visa was approved but many other's have been denied for less so you want to be CERTAIN you do not get legally married and you should probably use the 'don't ask..don't tell' philosophy when dealing with the consulate later. wink.gif

No, it is not standard for the petitioner to be called for an interview at CIS but it has happened.

You do NOT need to send a copy of your entire petition. DO mark on the outside of the envelope that it is a RFE for an I-129 petition.

All of the information you need is in the guides...

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum,
but the more you can provide the less likely you are that you will receive an RFE. 1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.

2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.

3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)


You need to send all of your travel documentation. Passport stamps should have been sent with your original petition so they are a must!

I'm so sorry this has happened. You are not the first. sad.gif It is possible it was lost anywhere along the way or even after it got to the uscis. If they don't have a record of it i'd surely send it again. Be thankful you have copies! wink.gif

As mentioned above, we too used usps with tracking and I tracked it from the moment it was shipped from MA and until it was delivered the very next day in VT. Had email, as well as snail mail, confirmations that it was delivered. That was only a couple dollars more. Whatever service you use be sure to have confirmation of delivery!

This is just one of many bumps along the way. Hopefully the process will go extra fast for you!

If that's the case, i'd leave the March date. If you know for sure it was 'final' in January then i'd change it. Someone from the Philippines could probably help you more.

Expedites are quite rare.

You are filing a K1 not a K3 so your approved petition will most likely move through the NVC and on to the USEM relatively quickly. You will not file for AOS until after you are married.

Wow, i'm glad you all are here to correct such false information.

To the OP, you got great advice from everyone here except the misguided poster. You are perfectly free to come in and marry your love in the U.S. as long as you do not overstay whatever visa you are coming in on (vwp?). As also mentioned, you will need to know the laws for marriage in the state you will be wed to know what you'll need to get your marriage license. We have a member in our NZ regional thread who did this last year and went back home. She just recently was approved for her spousal visa and will be on her way back here to the U.S. to be with her husband for good very soon. No problems whatsoever!

Your only concern is coming over the border. As pshbrk mentioned, dont offer more than is asked but if you are pushed..do tell the truth. The couple that I spoke of in the NZ thread did mention they were getting married and also had ties to show they were going home and they got over just fine. As i'm sure you know by now, it's not always so easy. Just bring your proof that you will be returning to UNI and whatever else you can think of and hopefully you will be good to go.

If you are considering a spousal visa to the U.S. when your schooling is done you will probably want to start putting together your information now as it can take some time and much of what you will need you will have when you are married in August. wink.gif

It seems they do routinely stamp a K1's passport with EAD at JKF ...but nobody can tell you that they will for sure.

The EAD stamp is just temporary so unless he receives his work authorization (filed with AOS after marriage) before it expires there will be a time he is without authorization to work from the DHS. IMO it's not worth it.

No matter what POE he arrives at the U.S. he will just follow the same procedures as when you travel....cutoms/immigration. They will know what to do with the documention you give them.

The uscis doesn't really care how you package it. They do recommend on their website not to use staples, to use ACCO fastners and if you tab off the sections to have the tabs at the bottom instead of the side. Some have simply used those large clips to hold sections of paper together. Once it's there, they will package it in a universal container and place it with the others. Do send it with signature authorization and use a personal check (with your correct home adress) if you want your EAC number off the back asap.

Make sure the data in your I-129f is correct.
Be sure you have all 4 copies of your G325 filled out and signed.
Attach your passport photos to them.
Your signed original letters of intent.
Declaration of how you met
Your proof of having met in the last two years. (copies of passport stamps...boarding passes... etc)
Cover letter
Copy of Birth Certificate
Copy of Divorce Decree
Copy of Marriage Certificate if needed (to show proof of legal name change)
If there are any court/police records and/or IMBRA info
..oh and most importantly...the check for $455 ! wink.gif

Yeah, I think it's a tad extreme to think he/she would face similar circumstances...especially where it was less than a year and another visa was at least in process at the time. Overcoming this to receive the K1 and be able to enter legally is part of what he/she is asking. Not if he/she comes for a visit and is then detained and deported.

If you're coming in on a K1 and have been approved then you obviously would have already taken care of the overstay with a waiver to receive the visa and you will be set to enter.

An overstay of 180 days to 12 months is an automatic 3 year ban. An overstay of more than a year is an automatic 10 year ban.

Ast stated above, they may approve you initially but you will most likely need a waiver which could take some time. See a good immigration attorney.

With your petition the uscis is looking for proof of having met in the last 2 years. Copies of passport stamps, boarding passes, itinerary..things that show you in the same place at the same time.

While photos, emails, chat, phone records..etc... may help to support that requirement as well, they can be easily doctored and are more proof of ongoing relationship which comes later at interview stage.

You need to be sure you are allowed to travel on the VWP after having your B cancelled. I'm not sure how it works when another visa is cancelled but I know that my SO can no longer use the VWP...doesn't matter how long he waits. He was questioned, had to go through administrative proceedings at the airport. He was refused entry and his passport was stamped for being inadmissible to the U.S. under the VWP as an intended immigrant. INA Section 212 (a) It also clearly states that he can not enter unless he has another valid visa but was told it would be extremely difficult to get one because he's already shown intent.

My guess would be that anyone who has been refused entry as an intended immigrant on any visa would not be able to use the VWP. You should check with the US Embassy to perhaps safe yourself some hassle at the border.
