The person needs to be a USC.

There is no 'second part' of the K-1. You have petitioned the US on behalf of your fiance in order for her to immigrate to the United States. Once she is approved at the USCIS she will then apply for a visa with the Embassy. It's an entirely seperate process.

If your boarding passes aren't enough to prove to the uscis that you have met within the last two years then you will be sent an RFE and they will request more proof... your passport stamps. This will come only after your petition has sat in storage for a while and when an adjuticator finally works on your case.

Most proof of on-going relationship is usually reserved for the Visa Interview at the Embassy but many will recommend sending at least some along with the initial peittion. Especially when dealing with a high fraud Embassy.

Most of the answers you are looking for can be found in the tabs and links at the top of the forums. Learning all you can about the process and the Embassy you are dealing with and then preparing as best you can is your best bet!

This is untrue. A co-sponsor can be any USC. This person does not have to be related to you or even living in the same State.

Some Embassies, including the PI, normally will not accept a co-sponsor unless this person has a vested interest in the relationship succeeding... this means a family member. Most will accept any USC. The I-134 is really only used to help prove to the CO that the beneficiary will not become a public charge once in the States. They will use the standards set by the I-864 (affidavit filed at AOS) for this purpose only. It is not enforced.

The approved I-129f petition has a validity period of 4 months (the time in which you must be interviewed). Did you request an extension(s) from the Embassy or do you have reason to believe they automatically extended it for you? Two years seems like an awful long time to have it extended.

Nobody can really tell you the answer to that. It's very much dependant on the adjuticator dealing with your case. They are not all created equally so while one may send you an RFE for something, another will let it slide.

Of course finances are a part of a relationship but when dealing with certain high fraud Embassies proof of financial support is most certainly a red flag and likely to be seen as such.

OP, this very much depends on the Embassy you are dealing with but if you have other proof I would focus on that and use the financial support only as a last resort.

Just to reiterate...photos are secondary ..not primary ..evidence. Each Embassy is very different in their requests so it's important to know all you can about t he Embassy you will be dealing with and prepare as best you can.

As mentioned above, adding at least a little proof of on-going relationship is not requested as per the I-129f BUT it is recommended. Someone recently reported a RFE for proof of on-going evidence from USCIS.

If you fill in your timeline, VJ will give you an estimated date of approval based on VJ data and usually pretty accurate.

VJ Timeline will show you the most recent approvals.

You're probably looking at at least 3-4 months from NOA1-NOA2 and then, depending very much on the Embassy you're dealing with, at least a couple more for medical/interview..etc.

Start there.

If you fill in your timeline you will get an estimated adjutication date which is based on VJ users. We are a small representation actual filers but the estimates are usually pretty accurate.

Have a look at the K-1 flowchart so you can familiarize and prepare yourself with the steps to come.

There's much more to it than just filing the petition. Each Embassy/Consulate and each case can be very different.

the visa application stage is very much dependant on the Embassy you are dealing with so it's very important to find out exactly what is required.

Do as much reading as you can. It will look complicated and overwhelming at first but knowledge is your best defense.

This is incorrect.

The above posters gave you good advice. A copy of the certified document is fine.

An original (original meaning certified long form with a raised seal for $20 or so from the County in which you were born) may be requested at the interview. It isn't for most but it was for me.

Yes..but it's 'evidence' that could potentially throw up a red flag at certain Embassies.

While sharing finances is quite normal for most couples, one of the things considered at the time of the interview is whether or not this relationship is bona-fide and if the intending immigrant is simply looking for a green card. Proof of financial 'support' from the USC could send the wrong message...again, quite dependant on the Embassy/Country you are dealing with.

There have been several law enforcement officials (and teachers...etc..etc) that have been through here, all kinds of people, and i've yet to see someone held up because of past security checks or their position with the government. Keep in mind we at VJ are a very small percentage of actual filers. wink.gif

The only issue I know of regarding this is a usc working for the government who was actually processed in record speed (normal at the time last year) but had issues at Embassy because her fiance didn't know enough about her job. Her job was actually classified and the Embassy high fraud. Very different situation.

Hopefully there wont be any issues and you'll fly through.

You need to wait. Trust me. I tried to find any way around this that I could.

In Massachusetts there is a 120 day (nisi) period after you go to court in which you must wait for the divorce to be considered 'final'. This is when you get your decree of absolute and must submit this as proof of divorce with the I129f.

It's not as simple as going to another state to marry. You must be 'legally' divorced before you can re-marry. If you are not free to marry, you are not free to petition and alien fiance.

DO NOT do as suggested above and file before this time or you will most likely not only have your petition returned but you will also lose your filing fee.

There are these fluctuations with timelines all the time.

Last year at this time VSC was taking only a matter of 2-4 weeks while CSC was taking 5 months.

Most people with a straightforward case do not need a lawyer to complete this process. Some will even tell you that it will slow you down. However, only you know for certain.

Finding VJ was the first step! Read up and then decide... do a search for 'lawer' on here and you're sure to learn more than you ever wanted to know. wink.gif

Photos of his passport stamps, itinerary, photos together, boarding pass(es) (not sure why the above poster said it was meaningless as it is more concrete proof that you were on the flight than are photos together that can be manipulated).

While he is there you can sign your G-325's (x4), get passport pictures and sign a letter of intent. These forms need original signatures so it's best to do it then.

Use the K-1 Guide (checklist) to gather all other documents you need to file the petition.

Proof of on-going relationship can often wait until the visa application stage of the process but some choose to send some with the I-129f.

During your wait, educate yourself to the remainder of the process and find out what is required from your Embassy. Start gathering all you will need to make this as seemless as possible.

passport stamps are your best proof of having met in person. As Bobby suggessted above, do not write on the boarding passes (copies) themselves but do make a note on the side regarding dates. They should correspond with the dates on your passport stamps anyway.

Not too much 'on-going relationship proof' evidence needs to be submitted with the petition but I would recommend sending some.

As already stated above, It is specifically asked for in the instructions and an original letter should have been included from both of you. Whether you receive an RFE for that, or for your passport photos, is very dependant on the person adjuticating your petition. As is the timeline if you do receive one.

Also mentioned above, your best bet is to have your fiance send you a letter of intent just in case.

This is a very touchy subject here. Of course, you want to tell the truth. Misrepresentation is a big problem when dealing with immigration.

BUT, if he even admits to using marijuanna any time in his past, he will probably face a ban that he would then need to fight. An archaic law perhaps, but we've seen enough people here banned for admitted use.

The beneficiary goes through many levels of security checks throughout the process. Whether it comes up or not is hard to say.

I would suggest contacting a qualified immigration attorney.

If you were already here on a work visa i'm quite sure they would consider the fact that you have a job waiting for you perfectly acceptable.

Like the others have stated, your work status has little bearing on your visa eligibility, however...the CO may take the fact that you have a job waiting into consideration if your fiance's finances are borderline. Each Embassy interprets the criteria for financial status differently.

The I-134 is used only to help support the idea that the alien fiance will not become a public charge once in the US.

Some Embassies can be very strict in their interpretation of the 'rules' but in NZ, for example, they cared very little about the I-134 and more about the fact that my then fiance had a great education, work history and desire to work in the US.

It's most important you know how the Embassy you're dealing with works. See the Embassy Reviews and Info links above for more on that.

It's very important to remember that we are posting with people from all over the world and although most of us can get through this without a hitch, what some people experience at interview stage is pure hell. To say it wont be a problem (especially in places like the Middle East) is just not an accurate assumption.

Some folks from Middle Eastern Countries get put in AP for years. There are home visits, there are interviews with friends, neighbors....etc. Getting a visa in China or HCMC (just to name a couple) is almost always an uphill battle and huge fight all the way.... it's not all as cut and dry for everybody.
