It would help a lot if you filled in your timeline so we know what Consulate you are dealing with...etc. A lot will have to do with that.

A co-sponsor can be any us resident willing to provide an I134 and the same proof you will. It is security that you are not going to become a public charge to the U.S.

If he owns his home he may be able to use the equity in that to help prove financial support. All the info you need is in the guides and faq's above.

When you read posts regarding extra evidence..etc.. people are normally dealing with a higher fraud Consulates in which they really should provide all they can.

original signature on I129f, all four copies of G325's and letters of intent...

it is suggested you make a copy of the entire packet (inc forms) for your own records and 'just in case' and also to send to your fiance for reference at interview time.

K1's are not entered into the automated system at NVC. You need to press 1 and then 5 to get a human and it's best to do so about 10pm est. You give them your WAC and they will give you a new case number and tell you when/if it has been sent out to the Consulate.

go down the K-1 checklist and mark off things as you go. Use the example forms for reference.

Your p.o. box is fine.

If you're going for a visit soon why not start the process soon? You do know it's going to take several months to complete? Also, don't have her date the documents too much before you send the packet.

Fill in your timeline and then you can visit your portals link (at the top) to find others who have gone through your Consulate. Every Consulate is very different in how they handle the interview stage of thie process so it's best to learn from others who have walked in your shoes. Sometimes it's better to send overwhelming evidence initially and sometimes they could care less.

Just be honest on the forms. You will want to check the IMBRA forum for more specific advice on how to deal with pass charges although, I believe you just need to note it on the form.

This is very common to happen in CSC but i've not heard of anyone from VSC not being updated in the system. Very interesting. It may sound like a silly question but are you sure you have the right number? If so, this is good news for other VSC'ers.

If the Embassy has notified you then your case has already been sent there.

NVC isn't the best at notifying. My case was stuck in AP there for 3 weeks. I got two letters, with two different dates, stating they received it and would send it out in a week. I've yet to receive a letter stating they sent it and it's been there a week. My fiance has his interview on Wednesday. Dont worry about the NVC. Your case is in Manilla and you're good to go. Be sure to check out the PI forum and Sherriff Ulings sticky post regarding the process there.

Also... fill in your timeline. It will help others here as well as help us to answer your questions better.

I think what your friend was recommending is a wonderful idea but the problem is that not enough people really care about immigration issues. I consider myself a relatively intelligent person who has never missed a vote but I will also say that I never took the time to care much about what those running for office had to say about immigration until I was forced to deal with it myself. We just don't have a loud enough voice.

When I first started coming to VJ, and long before I was able to file for my love, I contacted all representatives in my area and voiced my concerns regarding the process...not just the timelines, but the disparity between the centers (at the time) and the transparency of the process...etc. I feel it's my obligation as an American citizen to do so. I wasn't expecting anything done with our case, I simply wanted to be sure that immigration issues had a name/face to it when it came time for them to vote. I have a friend in office and I know sharing my exerience with her effect her decisions when it comes to all immigration issues.

I encourage everyone here to do the same. It may not move mountains but at least it's one more voice....and better than sittin around just b|tchin about it. wink.gif

slap someone in the face for giving you advice? huh.gif I dont see the humor. Nobody can tell you for certainty that a person will be allowed in at POE. Every port, every officer and every situation is different. It's a risk you take, sure, but many people can and do travel whilst awaiting the K1.

Marrying is legal anywhere. It's staying in the Country without authorization from the government that is the problem. It's the same way everywhere. The US just takes longer than most because there are more applicants and security issues to contend with.

If you come in with the intention to mary and do so, you still can't stay without a proper visa.

I don't know where you got the idea that they wont let you travel into the US on the VWP whist awaiting your K1. People do it all the time. True, you could be scrutinized more at entry IF they even know about the K1.... which, btw, they wont unless you tell them. wink.gif Still, many people do it.

It may not be 'fair' but it is what it is. To come into the Country with the intent to immigrate is illegal. When you have a partner that lives in the US, it's only common sense to assume there is a risk of that.

You need to have a return ticket, plenty of ties to show you are going back to your home Country. I would bring a copy of your NOA1 and show them only if they happen to know or find out you have a k1 in process. Be honest but you don't need to say 'oh i'm going to visit my fiance'...they may push... if they do you need to tell the truth. Misrepresentation is a much bigger issue than being denied entry.

Most of us here are living apart. We have been seperated for a year after living together for a long time. (He was denied entry because he was coming in and out of the Country way too much and can no longer use the VWP.) It's just the way it goes.

The uscis processing times shown on their site are to cover their own butts. they claim to be the earliest petitions they are currently dealing with... but, we at VJ know that is really just more BS because we have folks stuck a lot longer than that. If your petition was filed before the dates they post you are allowed to then inquire about your case. Anyway, pay little attention to what their timelines say unless you are past those dates listed.

As fwaguy suggested, you don't NEED to call. The approved petition moves with or without your intervention/inquiry.

But, if you're obsessive about these things like some of us... whistling.gif ...then I found it best to call after 10pm est. 603-334-0700, 1, 5 to talk to someone. You will be asked for your EAC/WAC number, beneficiarie's name and date of birth, petitioner's name and date of birth, they will give you your new case number and tell you if/when it was received and if/when it was shipped. Then, if you're truly obsessed... you can track it to Manilla with DHL.

I notice a lot of people get an RFE for part C, question 2, on the I-129f. I guess because it's asked after question about military people think they don't have to answer it and simply don't check the box. sad.gif

Your fiance will file the I129f petition with the uscis at either the Vermont or California office. Vermont is historically faster for processing but is taking 3+ months to approve petitions at this time. California is closer to 4-5 months. Check the timelines (links at the top of the forums) to get a better idea. Once your petition is approved it will be sent to the National Visa Center (NVC) and sent off to the U.S. Embassy that you will be interviewing with. How long that Embassy takes varies. You will want to create a timeline (my assistant > add/edit timeline) to get an estimated adjutication date based on VJ users. You can also check the Embassy link (also at the top of the forum) to see how long it usually takes in Holland.

Be sure to read the Guides and the K1 flowchart (also top tabs) to familiarize yourself with the process.

I got this from another post a while back...

(202) 663-1225 Press 0, then Press 1. The robot that answers the call talks forever, so just press 0 to bypass him. Same for the second robot that comes on...skip him with a 0 and the next answer is a live person. There's no music while you wait for Mr. 0 to come on the line...just dead silence. It took about 2-3 minutes for him to answer. The DOS can tell you if your Packet 3 was sent out, if the embassy got it back from you, and if an interview has been scheduled.

Besides the obvious help the guides provide, I would contact the Embassy in Pakistan to see exactly what is required for the interview as each USEM is very different. You can also ask some former us / pak couples and read the reveiws from their interviews (if you haven't already) to give you a little more idea.

It's really not requested at the initial petitioin stage to have that supporting evidence.... most of us send a little, like phone, chat & emails, just in case there is any question and/or to help support the having met in the last two years requirment.

The security checks that make sure you are both who you say you are and that you are both free to marry are what they check for at the uscis level. What they care about is that you are legally able to petition for this person and that this person is not a threat.

True, its likely not cause any problems but why not call the Consulate and explain what happened? Perhaps it's common? Either way, this couple has not even filed their I-129f, there is time to take care of this.

My grandmother spent her entire life thinking her name was Doris and found out only a few years before she passed away that her name on her BC was listed as Mary. It's interesting to me this happens.

As mentioned above, you wont need it until a latter stage and I'm not too sure how the Phillipines Consulate will view it. Perhaps your best bet is to call the Consulate and ask. I've read here more than once that the women that handle the calls are very helpful. I'm sure they can help advise you.

It has everything to do with the officer at POE so it's hard to say if he or she will even ask for ties to home. If they do ask and does not have a job or an apartment he may just face that fate...or as Russ and I call it "das boot" . wink.gif

Be honest and explain the situation. It's not unfathomable to understand that he would want to be there for some time with you and the baby. And it's also understandable that someone would consider leaving his job and apartment a few months early in order to spend time with his new family before returning home for the last few steps of the K1 process and immigrating.

I'm not sure about the border crossing. You might be best served by asking in the Canadian Regional thread.

This is a list of people still waiting at CSC. You will find there are still some with your NOA1 date waiting. Keep in mind there are probably several who have just not updated their timelines. sad.gif

I have no idea if being Naturalized will slow things up at all. There are all kinds of levels of checks so it could be anything.

Most likely they will tell you that you are still within the processing times listed on their website but it doesn't hurt to call...maybe you'll get a nice operator. wink.gif

He may not even be asked for proof at POE... it's a ####### shoot really. My love was allowed in 5 times with no ties to home....

Don't feel too bad. We weren't aware we were doing anything 'wrong' either. I was awaiting my divorce (years of this) and we just wanted to be together. My poor love has a master's degree and he's stuck in NZ right now.. not having worked in his field in two years. sad.gif Hindsight is a b!tch! wink.gif
