I-134 is the only thing that needs to be notorzied.

Letter from employer...check stubs. If he meets the requirements you dont need bank statements or letter from bank..or proof of assets.

It's all in the guides (link above) but you'll want to check with the PI folks to get the Consulate specific requirements.

You can marry anywhere... marriage is of no concern to the US government... what you can't do is marry and STAY in the US.

Lots of people come to the US and marry.

It is the intent to immigrate without a proper visa... the attempt to circumvent the immigration laws that gets you in trouble.

There is a process for a reason. You can not plan to come into the US to stay without a visa saying you can do just that. It's not that difficult to understand.

And yes, if you came on a visitor's visa, met a US citizen and decide to marry before you leave.... you can adjust. It's just the way it is.

There is already intent to immigrate here. We're not here to advocate immigration fraud. In fact, it's against the TOS.

Because there are other threads started by others who married whilst on a tourist visa and they adjusted ok does not mean it's just 'ok' to do. As I said, there is already intent. If it's proven at adjustment that there was intent they will face a ban.

I, for one, would feel awfully bad if a couple had to face something like that because of the advice I gave them. wink.gif

Pushbrk explained it well. K1 is the best route. We all want to be together 'sooner'.... it's just not the way it works.

We were approved in 120 days. 3 weeks ago there were couples from CSC who filed after us but were approved before us. The centers have all gone through big changes since last year. Vermont has been quicker historically but right now they're about the same. How it will be in a few months time is anyone's guess really. You just never know. 12 months for the process seems a bit of a stretch for most tho.

The K1 checklist is a great resource for you right now. Simply go down the list and get what you need. Use the example forms to help you fill out the forms. If you follow that, it's not likely you will have an issue.

If something is not checked off or if they require more information from you, you will receive an RFE (request for more evidence) when the adjuticator begins to go through your petition..usually months after you send it in. If you do get an RFE it's not the end of the world, most folks are only held up a couple of weeks. It does not count against you.

Use the waiting time to educate yourself to the rest of the process. There is a great group of Canadian folks here on VJ in the Regional forums that are very helpful. K1 interviews are held in two Consulates in Canada. I know one has about a two month waiting time for interview..not sure about the other.

Having a laywer can not and does not help you speed up the process at all. A lawyer, or the para-legal he has do the work, is not going to take any more care regarding your petition than you are. Of course there are people who probably should hire someone to help them but usually those are people who either have special circumstances to consider. It's just my opinion but if you are relatively intelligent and have good comprehension skills you can do this yourself and save the money for a visit with your fiance. smile.gif

Hi Laure, welcome to VJ.

Have a read through the guides and faq's at the top. Visit the links and the flow chart and learn about the process. There is a checklist for the K1 and example forms as well. It's really not that difficult to take on.

I think a lot of people here have had to find out the hard way that all immigration lawyers are not created equally. Either a document is forgotten or, like poor sara(estadia), they can really slow it down if they leave something out. That being said, there are people who have had no problems.

Consider this... you must gather everything your lawyer needs anyway. The only thing they do is check it over and mail it for you. wink.gif

You've found a gold mine of information and resources you will need in these forums ...use them. smile.gif

It doesn't matter that you're not living in your Country. You can request the interview be held in Canada. All documention including NOA's (I797's) will go to your fiance...the petitioner. You will know when it's your turn because the Consulate will send you a packet to complete before your interview.

The uscis website also has all immigration forms and even an instruction page for filling out the I-129f in pdf format. wink.gif Also, there are Example forms here on vj that you can use as well.

You can always find those, and other helpful links, at the top of the forum.

It seems daunting at first, but if you do it with the guidance here you should be all set. wink.gif People are always here to answer any questions you have any. We all started the same way. wink.gif

You are going to get a lot of posts telling you not to hire a lawyer unless you have special circumstances. Many have found the lawyer actually delays them more than anything. Simple mistakes. I tend to agree.... You still need to gather all the documents and do all the leg work. You will also want to be pro active on your own behalf and be sure the packet is put together correctly with everything included. Educate yourself using the guides here. It's a simple checklist really. Be sure everything on it is included. In essence, you will still be doing most of the work.

However, it is a personal choice and if you decide that is the route you want to go just be CERTAIN that they know what they are doing so you are not forced to wait even longer because of their mistakes. I would find a good immigration lawyer and ask for a free consult. Bring the VJ guide checklist with you and have them TELL YOU what is to be included.

I am going to move this thread to where you might get better answers....

I'm only guessing at this but I would say continue with the K1... do try the expedite (search uscis expedite criteria in google) for deployment. As long as your fiance can prove he can support you and has an address in the US he can use that perhaps you could have a proxy marriage once you enter the us? I'm not sure about this but it's just a thought and a question to perhaps ask the experts.

Also, i'm quite sure their are people who can help him handle this in the military. I forgot who specifically but i'm sure someone else will chime in. smile.gif

they 'should' have the approved petition and all documents you sent at the interview so if you sent your certified copy with the original petition they 'should' already have it.

that being said, like everything else in this process..it's a ####### shoot.

Every Consulate is very different in what they require from the couple so it's best to find out from them.

btw...the I-134 needs to be notorized which leaves a raised seal and has an original sig. I've never heard of a copy being 'ok' and I definitely wouldn't suggest it.

It's important to remember that this will expire with your I-94 (90 days). Many employers will have a problem with a 90 day EAD and/or a lapse in employment after your temp expires and until you are approved at adjustment.

The truth is that they dont care what you call each other really, they dont care how big your diamond is or how much money your fiance is willing to spend on you. They dont care about fancy clothes and that you have had a nice party with your family. They care that you are a bonafide couple. Anyone can have a party. wink.gif

Think about it... if you're going to circumvent immigration laws with a scam marriage wouldn't you go through the same things you think someone else would...even moreso?? It proves nothing really.

What it can, and has done, is create problems for the couple because the CO thinks that perhaps you are already married. True, in some cultures this ceremony is as important as the marriage and that should be respected but the CO cares only that you are following the rules and at some Consulates they make it pretty difficult even when you do everything right.

judging by the experiences of others here I wouldn't send anything having to do with any ceremony...certainly not photos with rings being exchanged.

We have a 10 year relationship and have lived together for some of that time as well. I just made a timeline and proved all of our travel together with passport stamps and boarding passes and some photos to support that evidence.

proof that you have been in that Country, passport stamps, itinerary, rental contract you have for living together, bills together.... the paystubs from the same Company are a good idea.

No, don't send them anything as it will never find your file and will be a waste of your time.

Also, you can get your EAC # from the back of your check once it's cleared your bank (if your bank has this service available).

I've seen some people go through without an RFE for the letter of intent and some RFE'd so it's a ####### shoot really...depends on the adjuticator. Nothing you can do about it now anyway so try not to sweat it.

Chad, the only number you can call is the number posted on the USCIS website.... and all you'll get is a scripted response.

The timeline you're talking about is for VJ'ers only. The USCIS wont even talk to you about your petition unless you are past their processing dates listed on their website. January '08 right now. wink.gif

Each stage of the process will need an expedite. If you want to try and push your petition through the CIS you can use this link to find out how. After it's through the NVC, you will want to contact your fiance's Embassy to request an expedite for that stage as well.

Listen to rebeccajo... Canada is a completely different experience than is the Philipines or any other higher fraud Embassy.

Yes, they need your last years tax return but the guidelines are based on your income NOW. Also, the I134 has no real rules (look for Yu and Dan's quote regarding this), some Embassy's follow the guidelines for the I864 (filed at AOS) because you will need to meet them at that point.

Your friends most likely went through the process when it was much quicker for Vermont. In January of this year some were taking less than a month to approve. Those times have passed tho. For most of us it's been 4+ months.

As mentioned above, you must be patient and find a way to keep yourself busy during this time or you'll make yourself crazy. Read through all of the links at the top and begin to understand just what you will need for your interview and even AOS. Use the time wisely so that you're not scrambling later. wink.gif

They stamped his passport and he lost his VWP priveledges. Usually they conduct a short interivew and you must sign a paper stating all the Q & A and findings which every department having to do with immigration will have/know about. Not sure they have the same procedure at land crossing.

As pushbrk stated, the fact that she lied is not good. That is your greatest battle at this stage. Be completely honest from here on out and expect to address this.

chuck, this has been discussed in great detail about a billion times here on VJ .... the confusion is understandable. The K1 does state it's work authorized but the DHS is the final word and they state that you must have EAD so basically the K1 says that you can get an EAD from the DHS. Which us K1's do at AOS. Very confusing..yes.

What it comes down to is that even with a EAD stamp at entry, it expires in 90 days (with the I94). Most employers will not hire you without EAD and will most likely have a problem with a lapse in authorization to work.

I agree, it's not worth the extra money to file for it seperately and probably only get it a few weeks sooner.

If he can provide his tax info and a letter from the new employer you may be ok. Also, as mentioned above, assets can come into play but they will need to be liquid assets (easily transferable) and x3 for every $1 short of income.

It would help a lot if you filled in your timeline so we know what Consulate you are dealing with...etc. A lot will have to do with that.

A co-sponsor can be any us resident willing to provide an I134 and the same proof you will. It is security that you are not going to become a public charge to the U.S.

If he owns his home he may be able to use the equity in that to help prove financial support. All the info you need is in the guides and faq's above.
