when you register with uscis you will see a page that will note a date 'last updated'... if/when this date changes it means you are touched...

here's a picture of what it looks like

just so you know a touch can mean anything..or nothing. CSC does not touch as much as VSC and being touched only means your petition was scanned for some reason... again, could be anything.

One of our very active members Kim could help you with this. She and her fiance did basically what you are saying. Eventually he was denied entry so they have had a very long time apart because he wasn't allowed to come back to visit at all. I think you would be safer to space out your tourist visits with plenty of time in your home country so at least you could continue to see each other in the US. And waiting for his citizenship before he applies would allow you to come as a fiance (K1) or a spouse (K3) and then be in the US while the papers for the green card are being processed.

Even with a valid visa the immigration officer at POE will determine the length of your stay. If you have a ticket for a 6 month stay, they will definitely ask you WHAT you will be doing on vacation for so long. They will evaluate your answer and weigh it against any other info on their system about you, including any prior visiting history. So, your chances of leaving and coming back in are slim to none. wink.gif

Rather than trying to explain it..here is our timeline....

1998 - Jan - Met online

2003 - May - Russell's first Visit to US

2006 - April - Kim 2 weeks in Australia with Russell
Russell 2 weeks in US
(vacation with kids Niagra Falls & NYC)
First trip back in 3 years...only staying 2 weeks.... "welcome to America"

2006 - June - Kim & kids 6 weeks in Australia with Russell

2006 - Aug - All travel to NZ for 2 weeks

2006 - Aug - Kim, Russell & kids fly to US
he left his job (great job), his home, his life so we could spend time together as we waited out my long divorce. We even told the lady checking us in and she took our email address to try and help us find a way for him to stay in America with me. In hindsight..a bad move. laughing.gif

2006 - Nov - Russell home to NZ (90 days up)

2006 - Dec - Russell back to US (luck)
Happy New Year! Lucky there is no questions about having just been in the Country for 3 months.

2007 - March - Kim & Russell to London, England for 3 days
Back to US together
For this trip I had broke my ankle and, because the airport was so big, they pushed me through immigration/customs and all checkpoints in a wheelchair. I think that probably helped. TG for small miracles. wink.gif

2007 - June - Kim & Russell to Reykjavik, Iceland for 3 days
Back to US together
The immigration officer did not want to let us through. I saw him looking through all of Russell's stamps, shaking his head and asking more questions so I basically 'shmoosed' our way out of it. wink.gif Again...very lucky. whistling.gif

2007 - Sept - Russell to Dublin, Ireland from Boston
Denied entry to US in Dublin
Russell back to NZ
What's that? You've been in the Country for the past year living with your longtime girlfriend as she awaits her divorce. Yeah, 'sorry wodga' you can't come back in...intent to immigrate. He was taken into a seperate room and questioned...treated very nicely btw..none of this handcuff and jail for a night bs that goes on sometimes. wink.gif In any case his VWP priveledges were taken away. We were heartbroken. crying.gif This is when he got his A# tho. laughing.gif Yeah...we can laugh now that it's almost over. wink.gif

April 14th...divorce finally final!!!
April 15th...allowed to pick up the decree absolute...made a copy and put it in with our petition and overnighted to VSC. wink.gif

So, three weeks in the past year i've been with my love after quite a long time of living together. (NZ isn't really the kinda place you pop over to for a few days...it's $2,000+ r/t and 20+ hours of flight time) Yes, we took advantage of the visitor's visa and have no regrets in doing so as we have had the opportunity to live together and start our lives BUT we were VERY lucky to have the time we did.

I understand your wanting to be together as well as anyone but it's very unlikely you will be able to stay together as you await your visa. There is a chance, if you even get a visa, that they would let you stay for 6 months but even that is going to be a hard one to explain me thinks. wink.gif Perhaps a shorter stay with a request for an extension when the time comes. wink.gif

If you are denied entry for fear of intent to immigrate, and there are no other circumstances, then you are usually allowed to withdraw your petition for entry and it has no adverse affect on your K1. wink.gif

I found these good folks at VJ ages ago but when Russell was denied entry I came back, joined, and made my first post asking for help or a way for us to be together asap. Believe me when I tell you that I explored every option. Short of moving there to NZ and staying on a valid visa with my kids for 6 months and then marrying and filing for DCF... there is no other way. wink.gif

The wait...the time apart... is very hard, I know. But these are just the cards we're dealt because of the times we live in. Now that we're headed into the homestretch I can tell you that, even tho I nearly lost my mind at times, it was worth every single second of heartache to get him here legally and for good. smile.gif

Yes, it's normal for CSC not to have updates. Sad..but true.

For some reason some people from CSC also seem to be taking longer to get entered into the system at NVC. You should receive a letter from them stating they have received your approved petition and that they will be forwarding it to the Consulate. Then you get another letter stating they have forwarded it.

You can call NVC... 603-334-0700, 1, 5 to talk to someone (k1's are not entered into the automated database) and they can tell you if your case has made it there yet. Don't be too discourages if they dont show you there yet...seems to be happening.

There is far too much information to start answering your questions. Everything you need to know is in the tabs above.

If you are the USC you will need to show that you can support your fiance and that he/she will not become a public charge to the US government upon arrival. You will need to prove this again at adjustment period after she is here and you are married. Might want to think that quitting the job thing. wink.gif

You need to fill in your timeline so that others here can answer your questions better. The interview experience of this journey has everything to do with the Consulate you are going through.

As far as travel, it is 'allowed' but, of course, having a US fiance (if they know about you) will add more scrutiny to her entry. The best you can do is have her travel with plenty of ties to her home Country and perhaps have a backup plan. Considering she was already pulled into secondary they will have all of the information she told them the last time in their system. They will usually not know about the K1 unless you tell them. They don't 'need' to know but if asked, you should always be honest. Misrepresentation is not taken lightly. You will want to be certain she can prove she is going home.

My love was denied entry a year ago but we had taken advantage of the VWP and he had been basically 'living' in the US on that visa for a year. Even with a valid visa it is at the discretion of the POE officer to allow your fiance into the Country. If he/she believes there is immigrant intent she may not be allowed in.

October seems a bit early for a K1 filed through CSC at the end of July. Right now you're looking at at least 4 months to approval then more time to interview.

After your fiance is here and you marry you can file for AOS (adjustment of status). Included in the AOS cost ($1010) is EAD (work authorization from DHS) and AP (advanced parole..allowing her to travel). She can leave the Country (US) to travel home as soon as she has AP...usually 2-3 months.

Keep in mind... if she leaves before AP, she will most likely not be able to get back in as K1 is a 1 time entry only visa. You will need to start the process over with a spousal visa. wink.gif

Do you mean I864? I864 is the financial document you file when you adjust status in the US. I134 is needed for the interview stage but not with the initial petition.

If a check does not bear a date, it is considered dated as of the time it is tendered by the drawer. (UCC 3-113).

However, as I said previously.. it is up to the discretion of those processing payment. I'm sure they have guidelines to follow but I can tell you, for instance, that Vermont will often return a check when the address of the petitioner on the check does not match the address of the petitioner that's on the form...CSC doesn't seem to care. It's a ####### shoot really. Fingers crossed for you!

Nothing wrong with entering the Country and marrying..lots of people do that. The problem is staying. You can not enter the US with the intention of marrying AND STAYING.

sure people do it but, as stated above, at adjustment the burden will be upon the couple to prove they had no intent when the beneficiary entered the Country. If you misrepresent yourself to the government you can face a ban.

You put the name she uses now. If she has ever changed her name you put whatever other name she's used. For instance, I put my maiden name on 'any other names used'.

You can type it or write it out...doesn't matter. You can also add a supplement to the back of each page and note that you did that on the form. Use the example forms (link above) to help you fill your forms out. That and the instructions listed on the USCIS website for the I129f are sure to answer all your questions.

It's probably a waste sending in your I134 now. They dont care about it at uscis. You will need to do it again and have it notorized after you receive packet 3 (information packet) from the Consulate.

Most Consulates follow the financial guidelines for the I-864 (that you file at AOS) since it will have to be done but, New Zealand is very lax when it comes to the I-134. They care more about the NZ citizen being able to support his/herself in the U.S. They even ask to see your CV/Resume at the interview.

There is much talk recently in the NZ thread regarding that.

California isn't as good about 'touching' as Vermont. You'll be lucky if California updates your case when you're approved...or even in the weeks to follow. So just don't put a lot of hope into the touches.

Because they have no record of it at DOS yet does not mean it hasn't been approved. wink.gif Some approved petitions are still taking some time to get the NVC from the USCIS in California. There doesn't seem to be any rhyme or reason to it but some folks are just having to wait longer. If your paperwork was returned on Aug 15th then, depending on the address they tried to send it to, you could have been approved just days before you got the (returned) notice. We were approved last Wednesday and just got our hardcopy yesterday. wink.gif Try NVC or DOS again in a couple, two, three days. wink.gif

Keeping my fingers crossed for you and, like asian man, frustrated for you as well. We pay for a service and it's certain not fair that we can not find out what's going on with our petition at all times.

The problem is the USCIS site is inconsistent their with updating for California filers.

When you call uscis you're talking to the call center 'misinformation' line who give standard replies. You could call NVC or DOS ..give them your case number and see if a new one has been issued. DOS can also tell you if and when the petition was sent off to the Embassy as well as if/when a package 3 has been sent out or an interview date sent. wink.gif

Each are approved independently. AP looks like it's taking about 2 months for most but that could easily vary.

I've heard of others calling their service center and having it expedited.

Either way you're cutting it close.

It's true the US gov't doesn't care about credit but some banks in the US are actually affiliated with international banks so don't take the risk.

If your credit is good you will want to bring to the US a copy of your good credit standing in your Country to help establish credit in the US.

I-134 is the only thing that needs to be notorzied.

Letter from employer...check stubs. If he meets the requirements you dont need bank statements or letter from bank..or proof of assets.

It's all in the guides (link above) but you'll want to check with the PI folks to get the Consulate specific requirements.
