January - Visited Canada
March - She came here
May - She's coming here.

So far we haven't had trouble, but I still worry.


See thats part of it.....Canada is a whole other ballgame. You can come and go as you please. Thats not the case with other countries....

You do realize it is actual May and not April.  Could be originally it was sent April 14th and updated to April 30th, so it may be a good thing and not a bad thing.  You may want to call and verify it was April and not May as you wrote.

You will need the actual marriage certificate in order to file for a marriage visa. This you will get at the registry. Be prepared there is a waiting period between apply for the license, I believe 21 days before you can actually do the marriage ceremony at the registry to receive the marriage certificate, unless of course you know someone inside....smiles

Ask your current employer for a letter of employment, stating your start date, rate of pay and hours worked weekly. Also keep copies of your pay stubs. The embassy will need proof of ability to provide and these will show that you currently work and have an income. They will not just take your word for it.

I have my W2 and tax return filed from last year with my previous employer. That's covered.
My question is do I need to show proof from my present employer that I am presently employed with a new company or does the embasy take my word for it as listed on my 864EZ under conditions of perjury? In other words will they need proof from my new job that I work there?

Yes, I'm sure. Did you not read the I-864 instructions? Please re-read them (or read them for the first time, which I hope isn't the case). It states in the instructions that an employment letter and pay stubs are optional, they're just to prove current income.

She will need proof of income for this current year' a transcript from the IRS for only:, 2011 will not show current ability to support. If she does not receive current pay stubs due to beng PDN, try getting a letter from her employer, stating date, hours, rate of pay, and copy of her direct deposits from associated employer.

Happy New Year to all of you here at VJ!! Wishing you much happiness, success, prosperity and LOVE in 2013!

Here's an update:

Today I called the USCIS and I was told that today makes 4 days PAST THE NORMAL processing time!! SO....
I asked them for a SERVICE REQUEST and obtained a Referral ID number.

Within 15 days, the California Service Center will contact me in regards to my petition. They will review my petition and advise me
of any questions or concerns that they might have (I thought they were already doing this the past 6 months...)

If I don't hear from them in 30 days, I need to call the USCIS back.

How many of you are at a similar point as we are? Do any of you have any suggestions, advice or concerns regarding this part of our petition process?




For those of you who have experienced having a SERVICE REQUEST made and receiving a Referral ID...did that expedite your petition approval?? Or prolong it?
Did anyone have their petition denied after doing a SERVICE REQUEST?

We are still waiting for our NOA2....

I am nine and a half months out, contacted congressman, service requests made, also directly to VCS and still keeping hearing it is being worked on and to wait 30 days for a response. This has been going on for several months..... But I wish the best of luck and hopefully yours will not take nearly as long as mine appears to be taking.

The Alien number for your wife should be on the I-797 you received when your petition was approved. It would be listed next to her name.

Hi folks,

My wife just got her approval and picked up her visa Friday. I am trying to pay the immigrant visa fee, which is $165.00. I went online and it asks for the case number, then the "A" number. According to her, the only number with an "A" has about 13 numbers with it and doesn't sound like it would be the correct number. When will she get the alien number? I don't know whether to just put "none" and pay the fee or not. Are we missing something?

After you pay the AOS fee online and it shows as paid, print the paid receipt and cover letter and forward the AOS documents to the NVC. You will get an email regarding this.

Hi guys, luckily we got contacted by the NVC on the next steps of our journey. We recieved notification a few days ago that our case has been approved for further processing. Now i have a few questions and would appreciate any help. First, the embassy which we will go through is Cd. Juarez. The information i got from the NVC is i must initiate communication between the the NVC and us and choose an agent, which could be me. It looks like i can do this by simply sending an email following these instructions:

•NVC case number entered in the subject line of the message
•The full name and date of birth of the principal applicant
•The full name and date of birth of the petitioner
•The names and e-mail addresses of all persons who are to receive correspondence from the NVC
•The name of the person submitting the request

Or filling out the DS-3032 and sending it by mail?

The NVC will then stop sending paper letters and instead send e-mail messages to the e-mail address(es) provided in the request

Now, comes the confusing part. I also recieved an invoice for the AOS and how to pay such fee at their website. I can follow those instructions just fine, but what im confused about is when do we actually send or provide the AOS form? Do we pay first and then my wife takes the form filled out to the consulate?

The second part is, according to this page( http://travel.state..../info_5165.html), if my case starts with MEP i have to do Electronic Processing (WHich im assuing would be email communication?) and Online Forms DS-260/DS-261(which would be that email with the information above on who will be designated as the agent? Thank you in advance for any information. Just lost on where to go next.

Me and my Wife are about to file form I-864 and are confused about the filing of the I-864A. My wife doesn't make enough money to sponsor me all by herself recording to the last W-2 form. So i asked my friend to do it and he agreed. My question is now, do both of them have to file I-864 or only my friend, or does the I-864A work without us having the same principal residence?

I hope you guys can help me with this, thank you very much!



Both of them would fill out a form and submit supporting documentation. They do not have to live at the same residence.

Most couples I know in this world can copy their partner's signature and it is totally fine with them. Would it be an issue if u signed the documents yourself (forged ur wife's sign).

 

I would have done that.

 

 

Not the best advice to give to a member of an already tough country to get through.  Also any signing of another persons signature is fraud, husband, wife, fiance, whatever.......

 

Like I suggested, my husband only went with the scanned copies and since the CO already had the AOS sent from NVC, it should be sufficient.

You can use either the I864 or the I864EZ, if you are filing just for your husband, using your income and previous income, and are not using a sponsor.  I just did the I864 for my husband. The I864A is if you are using a co-sponsor or sponsoring more than one person from overseas. The I864W is if you are using your qualified 40 quarters of coverage from SSA as earned. From my understanding.

 

You can get the instruction sheets from the uscis.gov website, giving indications for each form on when they should and shouldn't be used.  Based on what you have said, either of the two I mentioned would be acceptable.

What this means is, now that it us updated sure to his us citizenship u will not need to wait for a visa to become available. They will process your case either approve or deny. If approved u will be scheduled an interview. If it goes well and approved u will have a visa issued. LPR petitioners have to wait for a visa to become available, where as us citizenship petitioners don't. Your process should hi allot quicker and another now.

As it appears, the responses here feel like teasing a room full of tigers. We have waited so long. I am seriously very concerned about our being penalized because of the delays--having to redo medical exams or whatever, for example. Costly penalties. This week marks 2 years that we made our very first steps in this process. If only we had known then...



The OP posted in the CR1/IR1 forum, not the K1 forum. So the answers they have received are correct. The K1 process is different... all together..... honestly you seem to be getting upset, when in fact you are looking in the wrong forum.....

The I-129F petition fee is $340, not $350. The visa application fee is $350. I-129F petition fee is paid to USCIS, $350 visa application fee is paid to DOS.

NVC handles immigrant visa appointments and the embassy handles non immigrant. Just like NVC collects the AOS for immigrant visas. K1's are non immigrant and are handled by the embassy

However, I am wondering how it works for interviews for the visa's in Nigeria. Ok, I see everyone talking about R/T tickets from the country the immigrant will be coming from, but my question is this.....Can a R/T ticket be purchased from the U.S. because it is cheaper for them to fly here and use only the ticket returning to the U.S? Example.....My finance flying with Arik air from Nigeria would pay approximately $2000 U.S. for a ticket one way to JFK, however, if purchased as R/T from JFK to Lagos, and back it would cost just $1000 U.S.....Now would that be an issue?

Buy the cheapest; it doesn't matter to Immigration.

I had an overpayment with the IRS in 2009 for $3500. I am currently on a payment plan and it hasn't been an issue in this process. I am guessing the only problem would be not having the IRS tax returns when showing ability to support. So, I don't know if they actually do check with the IRS and as far as lexus nexus...because I used to be a bill collector, it is used basically to skip trace a person to find out telephone numbers and addresses of people, and where they hold accounts. LEXUS doesn't show the amount you hold with any company.

The problem I was having with my cellphone record is that when ever my fiance calls me his number never comes out as NBR Unavailable, it use to show up but since I changed my contract to unlimited in t-mobile it doesnt show up....When the time comes for me to send my fiance prove show I just send it to him like that and have him explain how since it is an international number it doesnt appear on my phone record..



I have Tmobile Unlimitted plan and most times than not his number shows, only on rare occasions does it come up unavailable, so I would check to see if it is an issue with his phone or his company.

I wonder about this too....my Tmobile bill has both my number and my daughters number so the bill is very long....I was wondering if omitting the pages from her phone number and log would cause a problem because the pages are numbered......It just seems pointless to send extra pages that have nothing to do with us.....



So with that being said, I pose the same question? Is not really about the amount/length of time I am referring to cos I have almost a years worth of phone records. But what I am wondering is if it is "Necessary" to send every page that comes in the months phone bill cos some of mine have 12-15 pages.

I would suppose it would depend on how you sent it....registered or regular mail. Also when you sent it. I sent mine registered mail and I received a text message within a few days and received my NOA1 within a week to 10 days. It doesn't take long. You will know especially if you mailed a check. Has the bank cashed the payment yet?


Does anyone know how long it usually takes to get a 1st response after sending the initial I-129 fiance visa package? I have been checking my mail every day (of course! :), but haven't heard anything yet. I am anxious to receive our number or whatever it is that we are supposed to get so that we can start tracking our progress. Thanks!

This may not be true...I received the same two emails the same day, and it was a clerical/computer error. It just means it was returned to be looked at. Does not necessarily mean it was approved. Mine is still in review.

You can change your address at uscis.gov, there is a link on the right side.... Change Your address online. Complete that and you will get a letter in the mail at your new address stating that you changed your address as verification. I moved prior to my NAO2 and this is what I received. The NAO2 once completed was sent to my new address.
