Hey guys

OK.....I have a question that maybe no one really knows but I'll throw it out there.....Gary just called Knights bridge and they said that he PASSED his medical and they are forwarding it to consulate. Gary then called consulate and they told him once they receive the medical he will , " be taken out ofadministrative processing and contacted again". At his interview his officer said he realized the urgency of his case and would reunite him with his family as soon as possible. Am I grasping at straws here or do you think he is done? Why will they be contacting him again? What does it mean when they say they are going to take you out of administrative processing? From what I've read that is a good thing? UGGH..... I"m certain I have irritable bowel syndrome from all this.....Posted ImagePosted Image

i think gary can start packing his bags....

I SOOOOOOOOO very much understand your feelings! My house is not empty but I am like a Zombie from this whole process and it does feel criminal to do this to people. I cry almost every night now, hide myself away in the bathroom so I don't upset my mom or son who are here with me. My mom is staying here right now until Gary gets back. Some days I don't even want to get out of bed and to make matters worse, I DON"T have a job anymore. I had a complete breakdown. I"ve always been a very happy go lucky person but this torture we have been put through has messed me up. Nothing will be ok until I have my Gary back home. Gary is going thru hell himself, living in a small bedroom in his moms house, he can't work because he needs a job HERE, not England. I sometimes wonder if I am a weak person and too sensitive, I always thought I was strong.

Take care everyone....sorry I sound so miserable, Being so very much in love with someone is a very scary place to be in times like this. You just want that person safe and next to you. Ok, I sut up now..Posted Image

geeze Val I just cant imagine how you felt hearing that the interview wasn't the end of your journey, I know I would just be a mess. Diana is in the same boat right now no place to live of her own her and jack are splitting time at a friends her brothers and her mothers house, but she keeps moving around so that she doesn't become a burden on anyone but its taking a huge toll on her.

Just read celldoc's reply and yes I remember when we all used to get so happy but after month and months of such tiny steps they even lose there shine.

But hay try and keep your spirits up you have found your soul mate and even though this journey is HARD it will be worth it in the end and like all journeys it has to come to and end. Gary will be home with you soon and life will be good then.

I have been thinking once we have our loved ones safely home, we should all write our stories and send them to someone and try and get this process changed it just doesn't make sense, the talking heads in Washington want to talk about immigration reform well they can start but fixing the family visa process. maybe if we all coordinated a mail campaign to some of the big news shows someone will pick up on it and bring it to light. though we all sort of had each other we were still silent stories going on as far as the rest of America is concerned.

but don't apologize for venting some on here, sometimes good therapy to get the emotions out and writing about them can be a great help.

cheers from your fellow traveler

hello all
I finally got my SIF today for both wife and step-sons cases. Feel like a huge weight has been lifted, I actually started suffering from depression during this wait, all I seemed to be able to do is work then go home to our empty house and stare at the TV till I fell asleep then get up and do it all over again. So i appologise for not being a good VJ'er. But congrats to all that have moved on past the NVC. I never expected the emotional toll that this process can put you through. Its almost criminal they way they do this for a family visa it just isnt right. but i am actually smiling now and it seems that this long journey is finally coming to a close. again congradulations to all that have already moved on, and to thoes still waiting keep up the faith though I know its hard.

Hello everyone, been away for a few days. congrats to all new approvals. I had to send my wife back to australia as her 90 day travel visa is up. On sunday got two messages from USCIS botm my cases have been moved back to "Initial Review". USCIS is so lost, my cases were split with one getting approved and set to NVC while the other was given an RFE ( this is for my wifes underage son) now both cases are back to step one.....I have no idea what I can do I already know that the "Customer Service Center" is useless. Does anyone have a suggestion maybe someone I should email....

huge troll alert on choey/nataliyaandron/1lovingyou2 many other aliases this person is probably using

This was sent to my inbox, I almost died from laughing so hard:

"but you can be sure i will do everything i can at TSC to hold up your case if i have to talk to Angela ...EVERYBODY I HAVE E MAIL ADDRESS FOR in USCIS in washington that your case is is possibly denied for not ligit marriage

I dont care of they ban me and so what

but every body could be affected by this to you all new and you better tell all i said it also
i will hold all back some how some way

count on it "

Ignore this person please, do not reply to them...you dont want to feed the trolls. Although this is quite amusing, we should put an end to these antics right away because we are all going through a long visa process, while this person is not going through anything. Just another loner on the internet.

http://www.prweb.com...rweb4157054.htm

See above, this Class Action Lawsuit may be a promising development in this issue.
I have not been following the 'returned petition issue' closely because fortunately, we refiled and were granted our K-1, got married, etc. Our first petition which was denied and returned to USCIS is STILL PENDING. It's laughable really, I think it's been about three years now.

For those of you who remember me, you all told me not to refile until USCIS ruled on our first case; I ignored that advise and followed my attorney into unknown territory. I filed a new K-1 and my husband is here now!!!!!
Desperate times call for desperate measures.

I'm still waiting for USCIS to respond to my rebuttal of our first K-1 denial from April 2007.
I sent them everything in January 2008. My case is STILL pending.

Morocco is probably hip to this, so refiling there with a pending petition won't work, but it may work at other embassies where the fraud isn't as much of a problem....and I would advise ANYONE working with another consulate that is not a high fraud post to REFILE!!!

It will be interesting to see how long USCIS finally takes to rule on our first petition.....we originally filed October 2006. If I had waited, I probably would have jumped off a roof somewhere by now. We got married in September of last year and I coudn't be happier.

Hi, congratulations first off. What was your first K1 sent back for? What steps did you do to resolve? We were considering re-filing for a K1, but now are leaning towards getting married in September and filing for CR1. Your input is greatly appreciated, as you are the first K1 I have heard that refiled a K1 and received a visa. Very intriguing. yes.gif

Our visa was send back for not being a bonafide relationship. We had a lot of red flags and I had only made one trip there to see him after we became engaged. Getting married is a good idea and re-file, but we wanted a ceremony over here and when USCIS had the terrible slow down in visa processing, I just didn't want to wait another 12 months for an approved K-3 petition.
Now, again, we got lucky, this is not the norm for those embassies with high fraud such as morrocco and hochimihn (sp?) but if I were in any other country where there is a small to moderate amount of K-1 and K-3 petitions, I would absolutely refile.....of course when we did it only cost us $175.00, it's considerably more to refile now.

I followed all of the advise here:
1-I contacted the embassy to determine the 'real' reason for the refusal and begged them not to send our petition back, I offered to send more proofs or whatever they wanted.
2-When the embassy refused to keep our petition, I contacted my congressional reps for help. They told me the real reason for the refusal (not bonafide relationship) but they couldn't get the embassy to keep our petition
3-I asked for the number of the diplomatic pouch, the embassy refused
4-I made and FOIA request
5-I contacted and hired an attorney
6-I moved to Albania for (4) four months, went into debt and nearly lost my job
7-I stayed in contact with the embassy when I was over there, continued to beg for help
8-I contacted newspapers, radio and totally exposed myself to the world in an effort to get some justice
9-Four months after the initial refusal, I refiled another K-1
10-I prepared and submitted the rebuttal for the first denied visa petition
11-Finally, I attended the second interview and the visa was granted. I basically told them that I did not intend to leave that country until we got it and I would go to any lengths to get it.
12-We won.

Best of luck to you all.......dont give up. These returned petitions are the best chance these embassies have to ensure that these relationships fail, legitimate or not.

IR-1 / CR-1 Spouse Visa Process & Procedureshusband coming for the interview or not!?Any sugestions

I checked out the Embassy page for you and both of you can attend the interview, though I am unsure if having both of you there is absolutely necessary. If it makes you feel any better it would seem that people have an easy and smooth time at the interview.

If you want to take all the guess work out of the equation, at stated in a earlier reply, contact the embassy and/or simply read the consulate reviews from people who have attended the interviews in your country both together and seperately. For sure, the requirements for each country are not the same

hello everybody,we just got the interview day,it's on july 12 in Bucharest and we don't know what to do,if to go both or just me it's fine?thank you

Our interview is on June 14th, My work schedule will not allow me to attend so my fiance will go alone. From everything I have read, I do not see this as a big negative. I am sure the consulates realize that alot of people cannot take the time off on such short notice or choose to take the time off from work when their fiances arrive. Some consulates do not allow the petitioners to attend the interview. You should research your countries portal and read through some of the interview comments. I am sure you will find all of the information you seek. Best of luck you with your interview

same here.. I received my NOA2 May 31. I call NVC at least 3 times a day and I have also spoken to operators on two ocassions but they still have no record of my case. Per conversation with both operators it could take 9 to 15 business days for the NVC to receive our case.. then case number is generated. I have hope that this should happen this week.
