K-1 Fiance(e) Visa Process & Procedureshow long does it take to get NOA1?
I was told the same thing about the Holidays and it makes sense because this is when a lot goes on the mail. I sent mines on November 25, right after turkey day and have not got anything back nor have they cashed the check ..so just hold on and like everyone said, this is nothing for the months that lie ahead..

Please stop typing in all CAPS. It's considered yelling and is really annoying to read.

Read the I-864 instructions for household size. If you didn't claim any of the children on your 2010 tax return then you don't need to include them in the household size. If they were your children it would be a different matter though.

Hey sorry about the caps, bad habit right? Anyway, I did claim only one for 2010 so I will place him as a dependent even if I am not claiming him for 2011?

First, what did the guardenship papers from the court entail, second if you filed for the children on any tax papers then you accepted financial responsibility for them. The child that is no longer being filed, is it because they are filing a seperate tax for themselves.

THE PAPER STATES GUARDIAN OVER ALL MEDICAL AND SCHOOLING DECISIONS FOR THE CHILDREN, BUT THE PARENTS HAVE RIGHTS AND CAN STILL STEP IN. tHE CHILDREN ARE BOTH MINORS AND i FEEL LIKE MY LOVE FOR HELPING IS GOING TO AFFECT MY BEING WITH MY FIANCE

Only if they are on your most recent tax return.

oK THANKS SO THE ONE CHILD CLAIMED LAST YEAR, WILL BE ADDED AS A DEPENDENT? THE OTHER CHILD I DO NOT INCLUDE BECAUSE I HAVE NOT FILED WITH THAT CHILD SINCE 2009? AM I GETTING IT RIGHT?

Do you claim them on your tax returns?

I have in the pass but not in 2 years for one of them and only one time for the other what does that mean ..do I have to include them in my household since they are not mine?

If you are a guardian to a child or children not yours biologically, and the parents still have legal rights to the child/ children, do you have to claim them as a part of your dependents when you do the Affidavit of Support?Or only your biological children?

1 year tax return is all that is needed (where does this three year thing come from over and over, there is no such requirement)

I was just going though this and when i saw you, I knew I would get the right answers..I was wondering the same thing about the 3 years of taxes??I heard this so much it made me nervous cause what i did two years ago and how much I earned two years ago is different do to changes in the cost of living..,So thank you so much.I feel a lot better about my situation.

K-1 Fiance(e) Visa Process & ProceduresQuestion for Newbie :)

Wow. What a great question! Look up the information on people who have or are coming from both his country of citizenship AND where he is working. This will give you a heads up on the things they ask for.

I have been doing this but nothing as far as his citizenship and work status in another country.

Be sure that you have friends that know you both that can write affidavits about your relationship in English.

I do! My best friend and her family were ALL in T&C with me as we went for her sisters wedding and they ALL met him. They always ask when he's coming to visit and anxious to see him when he comes. He also talks to my best friend on the phone occasionally when him and I are talking. (he likes to thank her for bringing me with her which allowed us to meet)

Get tickets to things with your names on them, if you can. Train rides, boarding passes from flights, concerts together.

I have kept my original boarding pass from my trip there where I met him. Of course I did not know I was going to meet him so I kept it as a souvenier of sorts. Not sure it will hold any significance, but I do have it. I also advised him to keep his tickets/receipts of his trip here to Maryland.

Go ahead and copy every page of each of your passports while you are together.
This we can do!

Lots of people also have stated that they were requested to have phone records of calls. You might go ahead an get a calling plan (or he can) where you can have a printed record of actual, regular-timed phone calls to show how often you contact each other.

I have printed my monthly phone records, highlighting ALL calls to and from him. He sometimes calls from a blocked number while at work but most calls are from his cell.

Go ahead and fill out EVERY document for immigration that you can while together. In duplicate. This way you don't have to wait for snail-mail which can be a killer emotionally.

Thank you for that advice, we will do that!

Good luck!

Thank you for all of your help!!

K-1 Fiance(e) Visa Process & ProceduresQuestion for Newbie :)
Hello, my name is Kimberly and I am new here. I am just beginning this process and have a long way to go. I have been researching and gathering information about the process and I have a few questions before submitting the fiance petition and could use some guidance and feedback.

Gesi (Gesner is his name) and I met while I was vacationing in Providenciales, Turks & Caicos. Since, we have talked everyday and he will be here to visit Dec 7th-11th. He works for a resort there but is there on work permit and has been for 8 years. He is a citizen of Haiti. So once we decide to file for petition, will we have to go to Haiti for the interviews, his medical exams, etc? Or will he do that in T&C since that is where he is living now? I am trying to get as much information as possible before he visits because that is when we will start working on gathering information and deciding when to submit the petition.

Is there anything else you suggest and/or advise as a beginner in the process? I greatly appreciate any and all feedback.

Okay, thanks for the info so far, but being that he already has a tourist visa, will he lose that once the K-1 has been submitted? Can he still travel using his tourist visa while it's pending? I understand that he could be turned away at POE but just curious if he can still travel or will he lose it?

ALSO, He is a citizen of Haiti but has lived and worked in the Turks and Caicos Islands for 13 yrs through an annual work permit. I was told everything would go through Haiti being he is a citizen there. But he travels to and from T&C Islands when he comes to visit me.

He has a tourist visa already, he was just here and left this morning. Will he lose that once I file the petition for the K-1?

K-1 Fiance(e) Visa Process & ProceduresService Request Results :(

I've tried to put in a service request but so far no luck. The first time I called I was told that VSC's estimated processing time is 6 months, not 5 as stated on the uscis website. The agent told me that because my petition has only been pending 5 months I should call back in a month and then try to put in the service request because my case would not be considered overdue until it's been pending 6 months. According to their records (this was last Friday, Oct 11) they were currently looking at cases received on Sept 11, 2010.

I of course was not about to wait another month to call back. I called again today and this time around the agent said that my case was past the normal 5 month processing timeframe (these people need to get it together! is it 5 months or is it 6?!?!) and asked if I wanted to put in a service request. I said I would but when she checked the system it says they are working on cases received Sept 25, 2010. She suggested I wait 17 days and call again to put in the service request.

Am I going to wait 17 days?...I don't think so. Maybe when I call next week they'll finally put in the service request, but from the looks of it not even that will help! I've also made 3 trips already since I filed my petition. I can't afford to go again until the interview...whenever that is and if it ever happens...who knows at this point.

If I were u I'd call back tomorrow and keep calling untill they put in a service request for you. I called and got my first service request befor I even reached my 5months....i believe i still had a week and a half to the 5months and they put it in for me...i didnt even know about a service request i was just calling to check on the petition and the rep suggested i put one in. Keep callin for your sake and ur spouses sake. Good luck!

Has anyone received this response for a service request? And is so how long after this response did you get ur approval? Did you really have to wait 60 days?
CinFemaleDominican Republic2011-03-16 20:09:00
K-1 Fiance(e) Visa Process & ProceduresService Request Results :(
Ok so this is now the second service request I have put in and I received an email today with the following response:

"The status of this service request is:

Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283."

Now keep in mind that my petition was received on Sept 10, 2010. So, I have been waiting for 6 months and 1 week. I'm absolutely appalled that they want me to wait 60 more days. I am NOT by any means "HATING" on those that have already received their approval but this is really unfair and just not right. You patiently wait 5 months without bugging them or anything and then when ur 5 months are over they want you to wait longer. I'm really disappointed in this whole process. Since putting in my petition have traveled 2x's and next week will be my third. I can no longer be away from my man. I'm seriously considering moving to Dom. Rep.

K-1 Fiance(e) Visa Process & ProceduresFINALLY NOA2....WHAT NEXT??

Congrats on your approval!!! Below are the steps you need to take. Be Proactive!

After your case gets to NVC and forwarded to the Embassy, you must begin gathering evidence for your case and the "required documents" needed from Interview.

The current wait time for interview to be scheduled could be 2-3 months. I'd estimate your interview being around June. (judging from others with similar timelines.)

The Embassy will then send the beneficiary (Dominican born) a list of instructions similar to this one:

http://santodomingo....structions.html

Additionally, follow these steps here. It's a lot but, its worth it.

After you receive your NOA2 (approving your I-129f petition), you will receive a letter from the NVC telling you that they are processing your case and it will mailed to the appropriate Embassy. During this time your case is examined then repackaged and mailed to the Embassy handling your case.

To get valid information just wait 1-2 weeks and call (toll-free) the Visa Specialist (Department of State) in Washington D.C. Call 202 663 1225. Press Option 1 then Option 0 to speak to a visa specialist. (Do not waste your money calling the Embassy). They will tell you when your case was mailed and when your interview date is.

Also keep checking the Interview list (Currently they have February & March posted) to see when your interview is. Just type in the Case # that was printed on your NVC Notice (SDO2010...)

http://santodomingo....pointments.html

Your packet will be mailed by the mail service in Dominican Republic (Inposdom). Which may take forever. Just keep calling and checking the interview list. So people never receive it, so be proactive. If you have not received anything around 2 weeks before your interview, call the Embassy and schedule a day to pick it up before your interview. The medical cannot be done if you do not receive your appointment letter that comes inside of Packet 4. Also, there is no way to track your case online at this point. So keep calling and checking the interview list is your best options.

Financial Docs:
Once your NOA2 arrives, you need to complete the affidavit and get a letter from your current employer (stating you have a job with them and you make $$$ a year), also you need a letter from your bank (stating how much money you deposited in the past year), and also your 3 months of recent pay stubs and 3 years of tax returns.

Their are 2 affidavits (I-134 and I-864). The I-134 is very easy to complete and is usually needed for the K1 interview. The I-864 takes longer to complete and more evidence and its usually only needed for AOS but sometimes asked for during the K1 interview.

To be safe just do them both and prepare. When your fiance(e) gets her Interview Packet, it will tell you what form you need to bring. For now I would just complete them both and wait until 2 weeks before the interview date to get a letters from your employer and bank.

Also, your Dominican born fiance/fiancee needs to begin completing the forms (you can practice at this point and finalize later; they are available online), get their birth certificate (long version), passport photos, etc.

My fiancee and I did all of these things while waiting. Try not to drive yourself crazy. Just use this to prepare. Also gather all the evidence you will need for your interview (phone records, email, pics, travel documents, etc). The last thing my fiancee and I did was update our forms. She got her police report (30 days within interview date), reprinted visa forms, and I updated my income/employment documents.

I had everything done 2 months before the interview but had to get new letters (dates closer to the interview). Interviews are being scheduled much faster now...so you may have less time.

Hello to all,

As some of you know we have our interview date set to June 16,2011. I however am very lost as far as what I need to take with me. I have heard that I need a letter from my employee, letter from bank, 3 years worth of income taxes and affidavit of support. I just can't find this proper list of things I need. Where do I find it? I'm afraid i will forget something and m very OCD when it comes to things like this. K-1 Fiance(e) Visa Process & ProceduresCan you interrupt with the K-1 with a marriage?
Hello,

If you have already filed for the fiance visa, stick with it. The spouse visa is no faster.

I have a friend from Colombia who has relatives who tried for a tourist visa, (to actually visit New york for New Year's celebration.) They were lawyers, had strong ties in Colombia, owned property, everything they are looking for in a tourist visa, but were still turned down. They are looking for strong ties to the person's home country. Remember, a tourist must return when the visa expires.

For the fiance visa, we also, have considered going ahead and getting married in Honduras, but we will need an I-601 for him to come to the U.S. We are in a stronger position if I keep my job here in Maryland and my property and connections with my doctors here. If we go ahead and marry and I move to Honduras, they will say 'what's the problem. You are already married.'

If they turn us down, we marry, and get to try again with the spouse visa. It gives us a second chance, just in case.

K-1 Fiance(e) Visa Process & ProceduresA few questions

Thank you. This makes it much easier on us.
If the fiancee visa isn't absolutely necessary, why do most people still opt to get it before getting married?

We chose to do the K-1 first on the theory that if they turn us down for the fiance visa, we can get married and try again. If we were already married and they turn us down, we have no recourse. I don't know if this is right or not, it is just what we thought.

K-1 Fiance(e) Visa Process & ProceduresExpired?
:help: We had our interview in November 2011. Because my fiance was subject to the 5 year ban, they said 'try again in Aug 2013'.

Since then our situation has changed. The judge reversed the case against him and he no longer has the five year ban.

We need to file the I-601, which is now centralized (at Vermont I think) as of June 4th 2012. But now our visa application has expired. Will we be able to get an extension, or do we start all over again filing another I-129?

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?
My fiance is under the ten year ban, so if we don't get an I-601 approved, we have to wait until 2018. When I said, if they turn us down, do you want me to move to Honduras, he said, 'Yes, I just want us to be together.'

Also, at the interview, they are pretty good at figuring things out. If they turn him down, don't fight it.
PoolsharkFemaleHonduras2012-08-24 17:28:00
K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?

I am so happy i found this site. I filed a petition for my fiance for a k1 visa. Recently i have been having doubts about him being genuine. Now that his interview is coming up, he is acting very strange,he always starts argument with me for no reason. He even made a few comments about he doesn't need me bugging him anymore and he will soon get his visa so he doesn't have to deal with me bugging him. We met february of 2011 and I know that he has applied for about 7 tourists visa, all were denied, is this suspicious?. I don't know what to do, my sister told me i should end things before he commits fraud. What can i do at this stage? How do i know he is planning fraud? Thanks.
