I would really apreciate if anybody helped me with this:

we got married in US a few weeks ago and came back to Germany, because my husband is stationed here (Air Force). I went through K1, so we could get married in Las Vegas. I left US without AP-we didn't have 3 months time for that. Later when we will be going to move US, I will apply for a spouse visa.
The question is: I don't have EAD (only have K1 still valid). I am waiting for my command sponsorship papers. Am I eligible for work on a military base?

since you are a citizen of the country he is stationed in....why not? Also you are married to a US Citizen. On post here in Wuerzburg I could work as well. Contact the people on post for those information, since they know best about the rules. It varies from post to post though.

Another post got me thinking that this might be possible...

OK, first of all, before anyone gets twitchy, I AM NOT GOING TO DO THIS. Nor do I IN ANY WAY suggest that anyone do this - I think it's morally questionable and maybe illegal as well. But since this is a forum, I'm just kind of curious what everyone thinks.

Is it really impossible to send in the I-130 petition before you get married? Don't the petitions sit in a box for several months, and then when the adjudicator finally looks at it, if something is missing, doesn't he/she then send out an RFE? Couldn't you send the marriage certificate at that point? Especially if you had a lot of other supporting eveidence of an ongoing realtionship...

Or would they chuck the whole thing if they see that you sent the main petition before you actually got married?

I don't know whether or not you have to. I remember reading somewhere in the past that if you declared income the year before, you must file the next year, even if you don't owe anything. But again, not sure.

But it's not exactly a big deal to file your taxes if you have no income, and if it saves you possible future hassle with IRS or at the interview, I would just do it. You can download the forms online.


DCF = Direct Consular Filing. Specifically, filing the I-130 petition at the consulate abroad. Many consulates no longer accept petitions, but USCIS offices abroad will accept petitions from some USC's. Ends up with a Cr-1 or IR-1 Visa

I think that my fiance (then husband (L) ) should be able to take a quick trip to Canada shortly after he arrives in the USA and activates his CR-1 visa (gets his temporary greencard in his passport) but before the final Green Card arrives in the mail. But does anyone have any actual experience with this? Or know where USCIS/immigration officially states this?

My wife in Romania should be receiving her DS-3032 this week. From everything I've read, it's really to be used if you're using an attorney. Since many of you have gone through this process successfully, is it best for my wife to continue receiving the mail directly or should I become her 'agent' and receive her mail here in the States? She does speak and read English fluently so language is not an issue. Is there an advantage to doing one way vs. the other?

Hey guys....yes, USCIS sucks with customer service. I waited 1/2 hour once, to ask a question, only to have the representative hang up on me, mid sentence, within the 1st minute...becuase he's an idiot and wasn't really listening to my question....regardless....

I don't think ANY negative comments should be made to anyone on here, regardless if their justfully made...or whether the person was feeling sorry for themselves, for whatever reasons, because in all honesty, we are here to support each other...and lean on each other, because we don't have anywhere else to go....NO ONE understands what we're going through unless they're going through the same thing, or have gone through.

We all feel sorry for ourselves at some point or another, and we all miss our spouses/fiance so much, we'd sell our souls to the devil to be reunited faster...(I know I would.) But I think to help us all, to help HOPE prevail, we should ALWAYS be supportive of one another, and damn it...sometimes, we do just need a "hug" or someone to say "I feel your pain."

Now, let's all be friends, and take one day at a time....because as each day that goes by, we're one more day closer to our loved ones. (Though I know I won't always believe my own words...somedays, even a little right now, I doubt my words...and become lost in depression...but I have to just keep pretending, lying to myself..whatever to make the pain go away; to find that little bit of hope again, and start over. And each day, try to make the hope grow bigger...)

And I find hope through YOU ALL....that's why I'm here. That's why, I need to, and newhampshire needs to, and everyone else needs to hear about whatever hope, whomever has at that moment. Otherwise, why are we hear really? If we didn't feel so afraid, or alone, or frustrated, we wouldn't need a VJ forum to turn to.

I agree wholeheartedly. We're all here for support and information and if any of us feel like venting, I think we have the right to do that. We just need to do it respectfully.

As for waiting for NOA2, I waited almost 6 months for mine from the VSC. Even after talking to both my senators, and my congressman who of course could do nothing at all.

Yes patience is the key to getting through this process with some sanity. In some respects it's easier for us in the States to cope than for our loved ones overseas who often don't understand what the delay is. I give my wife in Romania regular updates even if there's nothing new. Just so she knows I'm staying on top of it. That actually does help her morale a bit so it's worth doing.

Your letter is fine but don't expect them to do much of anything for you. I too wrote my congressman and senator. I got my senators staff to write me back and they were so kind to me that they repeated exactly what I had told them. As for my congressman, even knowing his office director didn't help any. Yes, they all say they'll help with immigration issues although I'm not sure what that mean any more. But hey, it's always worth a try. Maybe your congressional representative will actually do something for you. You never know.

As for all the negative comments posted here, just ignore them. I've noticed a trend by some people to be more negative than others. They're not worth getting upset over.

Hey Reddy,

As others have said, if you're above the 125% threshold for the number of people in your household (see the table that came with the form), you don't have to list assets and your wife isn't supposed to sign it. There's no room for the beneficiary to sign the form anyway.

I agree with Zyggy. Being outside the US for so long while in Med School can pose a risk to your wife if she's outside the country for too long. You had better consult an attorney on that one to be sure. You don't want to mess up and end up in a bind.

Since you're a consultant and don't get pay stubs, you should receive a 1099 for tax purposes. Copies of that form need to be included along with your latest tax return.

Did you imply that you have an I-130 pending for your wife? So you'll be a co-sponsor for your sister and at some point you'll have to be a sponsor yourself to bring your wife over? That could get complicated so be careful that you include as much documentation as possible each time making sure they fully understand how much you make or can make, and that you're over the poverty line by an appropriate amount. A cover letter doesn't hurt either. Be sure to read the I-864 guidelines listed here by Aussiewench. They really are helpful in understanding the process.

I had the same question when I started and yes, Simple-Male is right. It takes less time for you to get the documents and express mail them to your spouse than for the NVC to do it. Plus, you get the added benefit of being able to see what they're actually sending, any additional instructions, etc. I made copies of everything in the packet before I sent them overseas to my wife.

The fun is just beginning :D

I personally believe that the more documentation you send in, the better. So even if your wife's income alone is insufficient, send it all in anyway. I'm sure they'll be looking for it. Plus, include a cover letter explaining everything, that you're including her documentation along with your co-sponsor's, etc.

The best rule to follow is the more documents you can send in to support your case, the better. So yes, you'll need your latest W2, and your latest tax return to match. Since you're using a joint sponsor, you'll have to include his W2, and latest tax returns as well. A letter from your employers confirming your employment and salary is always a good idea as well. Remember, the purpose of the I-864 is to show that when your spouse gets here, you'll be able to support her without state aid (welfare). Aussiewench has included some useful tips on this subject too so check out what she has to say.

To me the big question is whether your wife paid U.S. income tax on her UK income. If she did, you should declare it. I don't see anywhere on the form or the instructions where it says it must be U.S. generated income. Also, is your wife going to work when you all come to the States? If she already has another job lined up, a letter from her new employer will help stating that she will be starting such and such job on such and such date for x amount of salary.

I think putting 0 dollars on the income line will red-flag your AOS.

I'd like to see what others on this forum have to say about your predicament.

I was just looking over the I-130 to make sure we'll be prepared to file after our marriage. I have a couple questions...

Section C, question 17 asks List husband/wife and all children of your relative.

Do they want me to list myself since I'll be the wife or is that already assumed?


Same Section, question 21 wants you to list the last address you lived together.

Since we have never lived together is this going to be a bad thing?


Also, I have moved since we filed the I-129F for the K-1 but I never updated my address with USCIS. Will this be a problem since my new address appears on the I-130?

Pittman, I'm glad you're trying to be proactive in helping your wife. That is definitely what she needs. Believe it or not, moving to a bigger city is not going to cure her issues. The issues will follow and she'll find something else that upsets her. That's the nature of the beast. The most important thing for both of you is going to be a change of thinking. If it's a mental illness that she has, she does not have the power to make herself better or "be better," anymore than someone with diabetes can cure themself. It's an illness and requires treatment to get better. It took me a long time to get my fiance to understand this. He used to say "why don't you just stop being lazy" or "why don't you TRY to feel better"? The thing is, I was trying, but the ability was not in my grasp. He would be convinced that a good day meant I was getting better, only to be followed by another bad day. The bad days can get bad. I know you wouldn't want for her to end up hurting herself or anyone else. I urge you to not wait, and to seek treatment for her right away. Remember, moving is not the answer and you may come to find she can be happy in her surroundings once she's happy with herself. I have also recently learned that mental illnesses may progress if left untreated. A friend who was diagnosed with major depression was upgraded to Bipolar II recently. Please don't wait!

Not to sound like amateur psychiatry hour but you might want to read up on the possibility of her having bipolar disorder. It sounds like she has some of the symptoms (spending issues, taking off with strangers, depression, etc.).



I agree. I lived with someone who had bipolar disorder. When she was in her mania, she would spend crazy amounts of money and invite total strangers over to the house. I attend support meetings for my depression with a group called DRADA. There are several bipolar members and all of them have been hospitalized at some point in their life. As out there as that may sound, it's the thing some people need to put the brakes on an out of control situation and get going on the right track. Until then, she more than likely is a danger to herself, you, and most importantly, the children. To those people who just assume she doesn't love/care about them...let me tell you, a mental disorder can cause you to do many things uncharacteristic of a loving/caring person, but that does not reflect your true feelings or intentions. I don't think he's crazy to want to stay with her and work things out-actually you may be the best thing to ever happen to her. By the way, something such as a move is a traumatic life experience that can certainly trigger what I call "episodes"...when the mental illness manifests itself.

Has your wife contacted USCIS? Haveyou received any paperwork from USCIS? If you have receipt number go to USCIS website and register to receive updates on your case. Why did you use an attorney? Is there something strange about your case? I would probably look at firing your attornety. I cant understand why they said they cant do anything and just wait it out. THIS IS JUST MY OPINION AND PLEASE DONT DO ANYTHING WITHOUT CHECKING INTO YOUR CASE YOURSELF.

Hey guys,

I have a few questions about how to do the next steps, while the visa is processing.

1) How long is the health check good for I make at my local doctor? Would it be ok to do the check before the embasst will get the approval?

2) I have got a chronic lung disease in my medical medical records. For the last three years there was no new inflammation according to this disease again, and I dont need to take medications for it at all. Even my pneumologist says it is well again. Will I have trouble with that at the medical exam?

3) I have got a depression as well....for three years now. Im still taking medication, but Im very well with it actually. Im able to work etc. Any problems with that?

4) The worst part is that I have an uveitis intermedia, that is a chronic inflammation inside my eyes with an edema in one eye as well. Because of that I have a pretty low vision on that eye. When it is not that bad it is about 30% and when it is really bad (during an acut inflammation) it is lower than 1%. The other eye is much better with about 80% vision. I also need to take medication to keep that disease under control. Will that be a problem? Im really afraid it will be.

5) I intend going to a doctor for the medical examination the embassy is requesting, of course. And my question is if I could make it while the K3 is still processing? How long is this exam good for?

6) What else will fasten the visa process? Any advices?

7) Very important questions what of my former medical records do I have to translate?
