Oh, thank you! Yes, we had a blast! His whole family traveled from all corners of Nigeria just to meet his American wife! It was very a very traditional Nigerian wedding and party...when he gets here, we will have a traditional Jewish ceremony with all my people...should be very interesting! :)

the K3 takes as long as the CR1/IR1 now and the Govt will close the K3 in favor of the CR1/IR1. also after the CR1 is complete you have ssn green card and right to work while with a K3 you then have to do an AOS at an extra cost between 1000 and 1500 if i remember right. so as has been stated many times and I have come to believe the standard IR/CR visa route is best and most economical way to go.

I am currently in the process of gathering information to send out I-130 packet.

I have a question under Section D, Other Information, question 2:

Have you ever before filed a petition for this or any other alien?

I previously filed K1 Fiance Visa for my ex-husband. He did not received legal permanent residency since we got divorced. So I am not sure if I should still add this information on this question, even though it was a different type of Visa.

Any input would be greatly appreciate it.

Congressional inquiry is where you contact the constituent services office of your Representative or Senator(s) and they file an inquiry with USCIS as to the status of your case. It is NOT a request to expedite, as someone mentioned. It is simply the best way to get the most information about your case possible-they will often be more willing to speak with the Congress people than with you.



I'm that someone,you can quote me...i have no problem beeing corrected..for the best info...But i said that because i have seen some that have also requested to expedite their case...so maybe they do both..But ultimately...if digg more deep, in short, i just wonder why we can not communicate more freely with USCIS, without being necessary to ask Senators for help...if they say we can contact them...that's so contradictory...I can speak for myself and give the arguments..i don't need to ask another God to do it for me..lol..well ok...just a thought...maybe too naive


If you want to do it yourself, more power to you. I've already been through this entire process for a K-1 that we didn't get so I'm a little familiar with the way things work with these people. I would never waste my time making an inquiry on behalf of myself. Let the elected officials do what I'm paying them to do...

Just my thoughts on the March thing...I think I read somewhere that if you go 6 months without so much as a touch or anything, you can do a Congressional inquiry. I know our 6 month mark will fall in March, so that's what I was planning to do.

I tested out MD's new Senator...Ben Cardin. At least he tried! Here's his response to me:

Thank you for your letter regarding the delay in processing of applications filed on behalf of your husband. I was sorry to learn about this matter and appreciate your concerns.

The Vermont Service Center reports that the lengthy backlog in the processing of certain petitions has been caused by numerous situations. Initially, the Service Center had to address Congressional mandates to timely process those applications filed for those seeking or continuing Temporary Protective Status (granted by the Congress to those foreign nationals who cannot return to their country of citizenry due to natural disaster or war, etc.), and then routine retirement of experienced adjudication officers and training of new officers has impacted the Center. I am enclosing the processing times for various applications processed in the Vermont Service Center. You may access the same information on the web site for the U.S. Citizenship and Immigration Services at www.uscis.gov.

Additionally, I have made an inquiry to the USCIS, Headquarters, Washington, D.C. to express my great concern of the significant backlog of immediate relative petitions filed by U.S. citizens on behalf of their family members. I will forward the response to you when Headquarters responds.

Well I hope we've all learned the valuable lesson that you don't get anywhere calling VSC (if I weren't so nice I'd say I told you so LOL). PLEASE friends, as I had suggested a while ago, once you hit the 180 days mark go to your Senator. Don't call VSC, it's a waste of your time. Niagara, don't worry about what they told you-just contact the Senator and let them deal with it. To the rest of us-our day is coming in NO TIME! Get those privacy release forms filled out LOL!

I've just been looking through this thread and I can't believe what I'm seeing. My 130 has sat at VSC since July 12, 2006 with no movement at all and people with dates in August, September and October have approvals?? I'm glad for them but this is getting a bit ridiculous. And what's this about calling USCIS after 6 months have passed? I reread my paperwork and it only refers to them having to complete it in the processing time posted on the web which still sits in March 2006. My wife called the info line and they said the same thing. Am I missing something?

Hey Tom! This is where it gets a little iffy...technically, we should defer to the processing date that they post on the website HOWEVER sometimes you'll get one of them on the phone who will actually tell you, it normally takes 180 days to process an I-130. It's sort of an unspoken guideline that 180 days is how long you should wait before doing any inquiry whatsoever, and I don't recommend continuing to try and do it yourself-you'll only keep getting the same answers and not much info. Your Senator can get much better info for you-I would recommend requesting an inquiry with them asap.

I know since we're all in the middle of a seemingly never-ending process right now, the tendency is to think that they are going "so slow" but here's some food for thought...I was told last week by our attorney that just a few years ago, a couple filing an I-130 could expect to wait up to 3 years for it to be adjudicated. Just recently have processing times for I-130's gotten much shorter, and I can even remember when I was new to this site (in 2005) people would wait 6-12 months and that was considered normal.

You may be surprised. Even though I haven't always had the best luck getting GOOD info from the Senators (all the times I've contacted them so far have been for really complicated issues), they have always been rather prompt, relatively speaking. What will hold them up is getting a response from USCIS.

No, actually I think the opposite. It just so happened that there were several members who filed both I-130 and I-129F around the same times that we all did (and some even later, into November I think) who had both petitions approved on the same day. I think that actually serves to speed up the process. If we could get any benefit out of it, I would file the I-129F to force them to speed up, but since we have a ban anyway, I would much rather Javier come in on an IR-1 than an K-3...



Hi!! Which part of MD are you from? I also filed the I-129F and VSC doesnt have a list of processing dates for that as it was transferred there. The lady from the customer service said to visit the local office for processing date. The hubby just got back from visiting me here in Australia a couple of days ago, so hopefully he can follow that up soon.

I am from Laurel, MD. It's a little bit closer to DC than to Bmore. We have a 3 year ban that we didn't earn. Basically, when Javier went for his medical for the K-1, the physicians were (and actually still are) zealously seeking to apply the title of drug addict to everyone who comes into the office. So we got it for him having experimented in his teenage years (which was almost 10 years ago) and for an incident a few months before the interview when he stuck his finger in a baggie of cocaine and tasted it (it's a long story, but his purpose was to identify it, and to keep the guys who might have attempted to solicit his younger siblings off the property). The law says you have to be free from any drug use for 3 years, which we clearly are, but they decided to consider the tasting incident a usage. Our ban is up in August, 2008. In the meantime, he has to undergo re-hab for a drug problem that he doesn't have in order for them to be satisfied.

I am also waiting in VSC since 9/11, my hubby is from Bmore, MD too! I called them about a week ago, and I got the same spiel about waiting until the date on the website changes to September. Fingers crossed they catch up with the rest of the SC, as they are processing July 06 applications.

And she basically said that they probably got a lot of cases in on that day. Imagine how long we're going to have to wait if it takes them 3 months to do 1 day's worth??? But I can't imagine that the date won't change this month. It has to change. No matter what, once that 180 days mark is hit, I'll be contacting my Senators and I would recommend the same for you. They have to at least let us know what the hold up is.

Just to clear up a few things, because we are also going through a similar situation where the Visa was denied and we were not even given the opportunity to file a Waiver. When the Visa is denied for some other reason, that's pretty much the end of the road. They won't even allow you to file a Waiver, regardless of what the circumstances. The CO's decision is final. The Waivers can be filed only by those eligible to file. It appears that the CO found the OP ineligible to file. The only way to overcome a CO's decision is to file either 1) Advisory Opinion with the Department of State...or 2) Motion to Reconsider with the Consulate.

Im in the process of getting my AOS docs in order. I have the vaccination record for my husband and he did his Medical in Jamaica on November 3rd, 2009. My question is: Will the Civil Surgeon need to do a full Medical or can they just transcribe the vaccination info onto Form I-693?
