US Embassy and Consulate DiscussionK1 Petition/Fiance's residency?
I am preparing to file the K1 petition. My fiance is a citizen of Haiti but has worked (by permit/visa) in the Turks & Caicos Islands for 8 years. He IS is eligible to apply for residency there but has chosen not to. When filling out the petition, do we list him as a citizen of Haiti? Do we list his current address in the Turks and Caicos? Which consulate office will he go to, T&C or Haiti? Any advice is greatly appreciated. This stuff is confusing...

US Embassy and Consulate Discussioncriminal record HCMC consulate
Please bear with me for a lil intro. I am a US citizen and my husband is a vietnamese. I gave birth to a son in HCM and came back to the US with my son 4 months ago and I applied for the immigration visa for my husband and just received both the approved I130 and I129F letters. Now what bothers me is when we were still dating,( we met in the US while he was on his student visa ) I pressed charge on him and he was charged with second degree assault, and he pleaded guilty when he went to court. The final disposition was PBJ. SO my question is "will the criminal record affect his chance of getting the visa in Vietnam? How tough is the HCMC consulate when they interview beneficiary with a background like this? and how do the officer define PBJ since I heard it varies by country. Anyone who knows anything about that kinda issue, please advice !

US Embassy and Consulate DiscussionInterview in Jamaica
Hi Leslie On 10/6/09 I had my fiance signed the DS230 pt1 and emailed it back to me I then emailed it to the embassy at 2:24pm and at 3:25pm I got an email from the embassy with our interview date of 11/16/09. In the subject line I put 2nd Inquiry and his KNG2009#.

OK....our DS-230 was received and signed for via DHL October 1st....how long will it be before we receive an interview date? Is there a quicker way than waiting for the letter to find out the date? Will the date be sent to him as the beneficiary or to me or both? Any input would be appreciated!!! Especially if you have gone through the Jamaican Embassy!!

US Embassy and Consulate DiscussionImportance of sponsor attending consular interview?
As much as I'd love to go back to Bangkok for my fiancee's interview, with airfares what they are, I could save a lot of money if I just arranged for her to go by herself and fly out by herself (she's done a bit of international travel, so that shouldn't be a problem).

My question is: how important is it for the sponsor to be present at the interview? I know it's not required, but does it really help?

(some countries you do not have the option to pick up, it is delivered to you)

GOOD LUCK!

ugh! in the few days since I posted this question, the fares between Bangkok and U.S. have gone up an average of $1,000! I shoulda just pulled the trigger.

my fiancees ticket was one way from Vn to the US, it was 950. i bought it about 2 weeks in advance, it was right after she got the pink slip. i did risk it by not waiting untill after we had the visa in hand. but i was willing to risk that much. i wouldnt recommend buying it before the interview though. paying more for the ticket to get her here sooner if something you might have to do, ask your self: is it worth spending alot now to see her sooner? it was worth it to me, i would have paid alot more that 950 to get her here with me!

apologies, but I'm new to this: "pink slip"? what's that? I thought the interview led directly to the visa, usually within a few days. In any case, I'd probably wait until she got an interview date from the embassy.

well you know everyone thinks the same as you do, and we all want to do that, but i won;t advise it. no one is sure when the visa is going to be delievered to her address due to the difference of the speed of the service of NSO branches. good luck on the interview! wink.gif

Still, if I wait until after the interview, the flight will likely cost twice as much. Or else, I could split the difference by buying a refundable/changeable ticket now.

QUOTE (WWW @ Jul 28 2008, 07:25 PM) <{POST_SNAPBACK}>
1. A very brief courtship followed by a plunge into matrimony;

2. A marriage ceremony arranged only a short time after petitioner arrives in the beneficiary’s country and they meet for the first time;

3. No common language;

4. Petitioner resides with family members of the beneficiary in the US;

5. Petitioner is employed by or has a business relationship with a relative of beneficiary;

6. Petitioner submits phone records that show he uses a residential phone number that is listed in the name of another person.

7. US divorce followed very quickly by an engagement to foreign beneficiary is often a red flag for consular officers.

8. There is little or no documentary evidence of the relationship prior to the actual engagement.

9. Long gaps of time between the petitioner & beneficiary being together in person.

10. Failure to disclose previous marriages;

11. Failure to disclose previous petitions filed on behalf of other beneficiaries.

Hmmm. I definitely have a case of #7; however, I was separated for three years and had to wait a year before after moving back to U.S. to get residency for divorce. So, the visa was filed days after the divorce decree was issued.

#9. In October, it will have been a year, but we're waiting for the interview. I plan to be there for the interview.

#5. She worked as a part-time nanny for me in Thailand for only a couple of months -- and that was quite some time ago.

Also, W-2s? Those are required along with the tax forms? Is it easy to get copies from a previous employer?

Any suggestions would be helpful.

I have a silly question to ask. As of October 19,2009, NVC mailed out our approved petition to the Lagos consulate. I a nurse and last year I made 46,000 on my 2008 tax. I dont have any kids and neither does he. Is my income sufficent or do I need a co-sponsor? Also how long will it take for my fiancee to get packet 3 from the Lagos consulate? Thanks so much

No question is ever silly.
In regards to your question though, the petitioner's income need to be at 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA, with that said your '08 income is well above that so u good. As for your other question regarding packet i'm not quite sure since i'm dealing with a fiance in Ghana but Im sure our fellow VJs are sure to assist (my fiance is also at the stage of getting this packet 3 which we are being told to wait on a letter for appt date but 30days later we're still waiting ) but in the meantime it wouldnt hurt to shoot the Lagos consulate an email. Best of luck.
ps ive sent a couple of email to the Ghana consulate regarding my fiance's packet 3 so with fingers crossed hopefully we get a respond this week.

Thanks so much for your quick reply. I dont want to involve anyone in my business

So my question is where do I go from here? I know that the k3 visa will take longer? What is your advice? Im lost alone and confused. This is so disturbing. What a bad nightmare.

Peru filers:

Can anyone please answer any of the following questions regarding items needed for our K1 interview in Lima 2 weeks from today?

1. The birth certificate needs to be stamped by RENIEC, but does it also need to be stamped by Ministerio de Relaciones Exteriores? I read somewhere that basically each place authenticates the stamp of the other- anyone know anything about that?

David went to the RENIEC office where he lives with the info from the packet 3 and they took care of it there. They knew what to do and we had the correct paper for the interview. Does he live in a provincia or in Lima?

2. Do I need to produce tax returns for the last 3 years? I have W2s from 2005, 2006 and 2007, but I only have RETURNS from 2005 and 2007 (2006 is missing for some reason). Do I need to somehow get a hold of this? I'm not finding any official requests for tax returns, but other people say they have been asked for them. I wonder if they are confusing them with W2s. I have had the same job with the same employer for 9 years, and make more than enough money, so there is nothing weird to account for.

I brought my returns (2005-2007) and transcripts (2006-2006). They didn't even take the transcripts. Gringita had some issue with tax papers; that's why I just brought all of the actual returns. I can't remember what it was. You may want to look at her page. They wanted the actual returns?? Maybe it was for just 2007?

3. Any idea how to obtain the Certificado de Policia from a city (in Peru) other than where my fiance currently lives? Does he have to go in person to request this or can it be done via fax/e-mail?

Unforunately I don't have a good answer for you in regards to this. See what he can find out via telephone. All of the requests that David did (there are 3 police certificates that you have to do for Peru), he did in person. He went to Lima for the judicales and penales. For the policía, he's only ever lived in one place, so it wasn't an issue. He did go in person for that paper though... I seem to remember fingerprints were done?

4. The packet requests military certificates, but I have a list (don't know where I got it or if it's even correct, but I'm pretty sure I found it on VJ a few months ago and it has a US government seal on it) that says these aren't available for certain countries, including Peru. Any ideas?

Did he actually serve in the military? David did not; we brought his libreta militar, but they didn't want it.

Thanks for any answers you can provide- there is so much to think about and we don't want to miss anything!
Jennifer

Hi,

Yep, you'll need the police certificates from all the places that you've lived for 12 months or more since you were 16. It might take a while to get the documents... You'll have to check out the travel.state.gov site for reciprocity agreements with the different countries.

Here's the one for Spain. http://travel.state....ocity_3673.html

I don't know what you would do for US records... hmmm??

Yes, it will be a problem if you don't have the records. Your visa probably wouldn't be approved on the spot if you don't have them. There is another Peruvian couple on this site that had to wait to get their visa until his police certificate from Mexico came in. They still went to the interview and eventually got the visa, but it was delayed.

Hope this helps!

US Embassy and Consulate DiscussionGetting Ready for the Interview In PERU 3/12
I figured that I'd bump this checklist back up for those of you who are getting ready to go...

Here's what I brought as the petitioner.

KEY: * = they did not ask for or did not want at the interview itself

ds-156 - 2 copies for them to keep
ds-157
ds-156k English version that I got online * they only wanted the Spanish one that was sent to David
ds-230 parts 1 & 2 *
I-134 (there's a 3rd page in the packet 3 that I also signed and had notarized; have no idea if I needed to or not, but I did) - notarized
- tax transcripts * - originals
- stocks and bonds papers - copies
- retirement info (2) - copies
- letter from bank - original
- pay stubs - copies
- 2007 taxes - copy; including W-2s
- 2005-2006 taxes - copies, including W-2s
- employer letter - original
copy of I-129F originally sent *
original evidence = phone evidence, receipts from trips (air, hotel, bus, tourism, food, phone cards) *
more phone records * - I had copies for them to keep and originals with me
more emails * - I had copies for them to keep and originals with me
more pics * - I had originals for them to keep
new letters of intent * - originals
NOA1, NOA2 * - I had copies for them to keep and originals
passport *
electronic ticket *

Here's what David brought... He's receiving the visa...

OF-156K
datos biográficos (we sent it in per the directions and they wanted it again at the interview; thank god we had another copy)
interview appt letter
pasaporte
certificado de nacimiento, legalizado por la RENIEC
certificado de policía
certificado de penales
certificado de judicales
libreta militar *
2 fotos nuevas - glued onto the ds-156
cualquiera evidencia that he had *
examen médico
he needed to sign the papers that I brought; couldn't sign some of them until he was in the presence of the consulate officer
pay for the tariff - receipt needed!

Don't forget to make copies of EVERYTHING that you could hand over if you don't already have copies of those articles! smile.gif

I hope this helps whoever is coming up next for the interview! smile.gif Obviously at the interview they can ask for things that they didn't ask me for. I'm just writing what my experience was... The DS-230 was absolutely not needed, however. Don't bother sending in the datos biográficos early, like the packet 3 says. We did that and then they wanted it again at the interview.

Diana, these are three PC`s that my husband sent to NVC with his DS-230 form.
(1) a police certificate ("Certificado Policial") from the Peruvian National Police office where they live; and (2) a national record of prior sentences served ("Certificado de Antecedentes Penales"), provided by the Poder Judicial office at Av. Abancay in Lima.If the applicant is living in their country of nationality at their current residence for more than 6 months, and is 18 years old or older, then the applicant needs: three separate certificates -- numbers 1 and 2 above plus, (3) a national record of prior court appearances ("Antecedentes Judiciales a Nivel Nacional") which is available at the INPE Office located at Jr. Carabaya 456 in Lima.

http://travel.state...._3649.html#docs

It clearly does NOT state anything about the other two forms, but it does talk about the police certificate. And, it looks like this one can also be rec'd in Lima. So, maybe we did it the wrong way, but it was accepted! smile.gif

Hi Nosotros!

Your topic has already been moved by the powers that be. smile.gif

Thanks powers that be tongue.gif

The information is so fragmented. I love the guides on this site, because most of the information is on here; I also like the forums because you get the rest of the information that way.

I went to the embassy website, and sure enough it says right there that you need a certificado policial (in Spanish, ofcourse). It clearly says it is to be obtained from each COUNTRY lived in for 12 months or more, so implying that it is not from each city or region lived within the same country. So, that info is on the website, fine and dandy. But, on the same website, there's no info that says you need a certificado judicial or de penales. And ofcourse these are clearly required per the experiences of users on here.

Any way, just venting about the "ilogicalness" of the whole process.

Hi nosotros! I completely agree... the illogicalness is very real and definitely NOT clear in terms of the Embassy website or on the travel.state.gov website either as that one states that all you need is the certificado policiales! Ugh!

Anyway, here's the quote from the packet 3 on certificados policiales...

So, this to me says that it should be from every place (lugar), no? So, therefore city... I don't know. It doesn't say country. This is the only form that David got in his hometown, the other two he got in Lima. But then again the last line does say countries (países). Who knows!!??

The other two, penales and judiciales... Also from packet 3.

Penales doesn't specifiy an origin at all. "Todo solicitante, a partir de los 16 años, deberá presentar este documento." That's all it says.

Judicales is very clear that it's to rec'd in Lima. "Certificado de antecedentes judicales (a nivel nacional): Todo solicitante, a partir de 18 años, deberá presentar este documento."

I'm going to find a link to the thing I found earlier that helped me... smile.gif

AOS forum has to do with people that already have the visa, and are adjusting status in the USA, such as K-1 enters USA and has married, and is now filing for Green-Card.

Ok, now I see how this thread ended up in AOS forum. I went to my portal and clicked on the thread "Within 90 days ....", and then proceeded to create a new topic from there. It turns out that thread is in "AOS" forum.

Can some one with powers move this to the appropriate forum then, please?

And how to I start a topic in the appropriate area?

Hi Nosotros!

Your topic has already been moved by the powers that be. smile.gif

To start a new topic just go to the proper forum that you want to post it in (probably The Embassy section for now; after she gets here, you'll start posting in the AOS section) and then at the top of the page, right hand side, it'll say "post new topic" or something along those lines. smile.gif

US Embassy and Consulate Discussioncertificados antecedentes
QUOTE (Nosotros @ Apr 24 2008, 03:44 PM) <{POST_SNAPBACK}>
I know that my fiancee will need to obtain three types of police certificates, namely:- Certificado de antecedentes policiales, Certificado judicial de antecedentes penales and Certificado de antecedentes judiciales a nivel nacional. I need a clarification on what this means for someone who has lived in multiple places in Peru. Does this mean that she will need three different types of certificados for each place she has lived, or only one of the three has to be taken from each place she has lived, and the rest only come from Lima?

If so, which ones?

Thanks for any info.

Hi!

Yes, for Peru you need the 3 certificates.

David got the penales and judiciales in Lima. He got the policiales in the city where he lives.

In the directions for the packet 3, it says that she should get the policiales for every place that she has lived for 12 months or more since the age of 16.

He has only lived in one city, but the way that the directions read, it seems to me that only the policiales should be from every place.

We tried to call the Embassy a couple of times with questions; completely not worth it! On hold for an hour and then they said, "We're sorry, we're only answering questions for ____ now." It was infuriating. Oh, and they treat the K-1 as an immigrant visa there when it comes to answering questions on the phone, which technically it is NOT.

Have her send you a copy of the directions (scan and send via email) and I think that you'll agree with me on this...

Hope this helps!
