I would suggest not to panic. It is really good that you sent it with delivery confirmation and you will able to track it.

But it already been delievered. The usps guy told me someone sign for it. He also said that 75266 and 75222 are the same postal office. I'm a little bit confused.

I know...I know. It was always just a matter of time I think. It was just waiting on me finally making that decision that I'm ready to move on with my life. However, it looks like it's not going to be so easy to do that. I'm wondering if there are annullments in Mexico? Vismaster-I was also wondering about that. I don't know anything about divorces so I'm hoping I can at least figure out some basic info before we make any final decision.

Marriage and Divorce in Mexico

As in the United States, each state in Mexico determines its marriage and divorce procedures. You should contact the office of the Registro Civil in the jurisdiction where you plan to get married for complete information about the requirements.

A marriage that is properly executed in Mexico is valid in the United States provided the marriage would be legal in the United States. To obtain a divorce in Mexico, you must be a resident of Mexico. Usually this process takes everal months and you must reside here for at least 6 months before applying for the divorce. You may wish to retain an attorney in Mexico with experience in divorce proceedings.

I got something else to say too (and I'm sorry for hijacking your guys' thread like this). If you search back far enough you can probably find the threads where I made my announcement and posted some things very similar to what we're reading from Janet now. The key difference was that I did NOT have that support of family and friends-in fact, the majority of my family and friends to this day do not know what all went down and actually don't even know Javier was ever illegal. Janet, what you have is valuable-a home base of support, use that to your advantage! I remember feeling so lost and alone at my tender age of 22 and not having anyone to turn to but the kind (and not so kind) people of VJ. Try and get some other input as well. I also tell you this to tell you something else-I was just like you but now I'm fine. And you will be too-it's like I told you...it takes a while to heal but healing occurs. It's a process just like anything else.

We can go back 12/09. That is a lifetime away for me. 30 more months to go. What if we go through all that and they deny him AGAIN? I will kill myself? I won't be able to survive it, I'm barely surviving this.

I still feel like doing something to make them re-review the file as if he never said anything about the December thing, I know I am grasping at straws, I am just in deep deep despair, I've been killing myself for a year for this interview date and I am beating myself up about not briefing him right before the medical about the drug policy, we covered it with him months ago and I thought that would be one thing he wouldn't forget. If he only hadn't of said about December he would be here RIGHT NOW. I've been preparing for him for months and months and months and all those tears of being apart and not being able to be together I knew were coming to an end. Instead, he is kicking around down in Juarez devastated and I am here in the full throws of a complete nervous breakdown. It's such a stretch and such a sacrifice for me to give up everything to go to Juarez. I have sacrificed so much already, so so so so much. I am afraid, very afraid. I've never been so broken-hearted about anything in my life. I am absolutely inconsolable and I don't know when it's every going to get better.

I really appreciate you all trying to help me out, I really do - I really don't know if I am going to survive this. My family is telling me it's an "act of God" and all that stuff, that we aren't meant to be together etc etc....

I hope I can survive this, he has to wait so long to have opportunites in the USA, wait a damn waste. I cannot accept that there is absolutely nothing I can do to turn the decision around.

Janet, as someone who tried to do everything possible to turn the decision around I can tell you it will be a waste of what will prove to be valuable energy. Focus on your future now-that's all you can do.

PS-Just speaking on behalf of Juarez, I have had the pleasure of visiting the fine city twice and I find it very similar to the DC suburb where I was born, grew up, and have now settled in. I also never had an experience where I felt unsafe there. It's pretty much as close to being in the US as you can be while still being in Mexico (and not just geographically).

Just to put in another (probably much less popular) perspective here. Living separate isn't fun, but it's also not impossible (I know, we've been doing it for years). You actually get to the point where you get used to it and in a way, you get the best of both worlds-stability of the marriage relationship as well as freedom to live your life how you want, come and go as you please for just a little while longer. For us now, our separate situation is the norm and we do quite well-it's actually much more stressful on the rare occasions when we do come together for that week here and there. I know it's not ideal, but it does work, and in some cases, it works quite well. Just give it some thought before you uproot your entire life and move to a country that's not yours-just some food for thought, not a decision to be taken lightly.

First, Congratulations TijuanaHilton, I am very happy for the both of you Felicidades!

For our case, I see no hope. Lucy and I spoke to Edgar awhile back and told him that under no circumstances was Edgar to mention anything about drugs. Why on earth he would volunteer that information is beyond me and I am overcome with grief, I hope I don't get fired because I called out of work today as well. My hands are shaking so much I can hardly type. I got in touch with a VJ'er named Heina who had the same problem, I am going to speak to her tonight on the phone.

When Edgar told me about the medical two days ago is when I really lost it, inconsolable. I found out that he told them that he smoked a joint in December 2006 so that pretty much puts the icing on the cake. It's done and there is absolutely NOTHING I can do.

I have changed my whole life preparing for this day and now I feel like my whole world is now upside down. We have to get Edgar back home to Acapulco, he's talking to people now about crossing over anyway. Canada might be an option however, I have my house here and I don't know the first thing about trying to become a Canadian citizen. I could move to Mexico but I would lose everything that I have here.

I really don't see any options now for us, I just feel like my whole world crashed in the past two days and I am a mess. I just don't see anything I can do at this point.

Please please please don't freak out just yet. I know exactly how you are feeling right at this moment. It's important to just take a little time to figure something out. We'll talk this evening.

PSA to all the beautiful girlies present and future of CDJ:

IT DOES NOT BENEFIT YOUR FIANCE/HUSBAND IN ANY WAY TO BE HONEST ABOUT PREVIOUS DRUG USE. I'M REFERRING TO DRUG USE THAT'S FAR IN THE PAST (NOT LIKE LAST WEEK). THEY WILL SCREW YOU OVER. IF YOU DON'T MIND SPENDING AN EXTRA 3 YEARS APART FOR SOMETHING THAT'S NOT YOUR FAULT, BY ALL MEANS BE HONEST.

Sorry for the all caps. I just think this is really important for everyone to get into their minds and realize. Essentially, if it's not an ACTUAL CURRENT problem, there's no reason to suffer a punishment you don't deserve.

The reason they ask you the same questions over and over again (often worded slightly differently, but always the same question) is actually not for the reason you might think. Yes, they are mildly interested in the answer, but what they really want is for you to say something different one of those times, they're trying to trip you up so they can accuse you of lying.

Example:

CO: Where did you meet your fiancee?
Alien: It was during a vacation trip to the beach....

Later on....

CO: So you met your fiancee while on vacation at the mountains?
Alien: (without paying attention to the full question) Yes...

A friend of mine had warned me about that kind of thing which is why it's so important to tell your husbands/fiances to PAY ATTENTION to what is being asked. Most people will hear that question and stop listening after the word "vacation"-that's how they trip you up. Tell them to pay very close attention to exactly what is being said.

and kept asking him if he had ever done drugs. When he would say no, she would ask again differently or adding are you sure? ever? It is like they wanted him to answer yes :( How sad that many might have felt railroaded.

Yeah, it's no secret that they want them to answer yes. After what happened to us, our attorney informed us of an Advisory issued by the AILA in regards to the physicians in Juarez and their drug issues. Unfortunately, "railroaded" is what happened to Javy... :(

As long as they mailed it, you can go. You don't need anything out of that packet, if you've already filled out your forms, which you have. Them mailing it means your case is ready to be interviewed at the Consulate-they don't give a flying flip whether or not you actually received it. As long as you have the forms filled out.

Here's our story (the short version) for all of those who don't know me yet...

Feb, 2005-Got engaged

August, 2005-Filed I-129F

November, 2005-Went to medical and K-1 interview in Juarez. Medical went very wrong. We were sent to see a psychiatrist as follow-up but didn't know why. Consulate closed three days for Thanksgiving. Javier went to the interview the following Monday on his own. He was found inadmissible due to "drug addiction" based on two admissions: 1) he had experimented with cocaine a few times in his teenage years (approx. 10 years prior) and 2) sometime in August, 2005 he stuck his finger in a bag of cocaine and tasted it, for the purpose of determining what it was (men brought it onto the farm property where he lives and works with his family; he had seen cops use that method of determining what a substance is, so that's what he did). Javier called me around noon and said he had a 3-year "castigo." We are ineligible to receive any Visa until August, 2008.

December, 2005-Attorney filed Advisory Opinion directly with the Department of State, along with a Motion to Reconsider with the Consulate, in hopes that they would fix their mistake.

March, 2006-I get in touch with the man who adjudicates the Advisory Opinions; he doesn't have ours, requests that we re-send. Attorney re-sends.

August, 2006-I go to Mexico, marry Javier (we decided if we're going to have to wait, we might as well make the best of the wait time).

August 31, 2006-DOS man requests ANOTHER copy of the Advisory Opinion.

September 1, 2006-DOS man mails out denial notice to attorney (after all that, took him one day to decide). Contents of denial notice are at least half factually incorrect (far be it from them to practice any due diligence when dealing with people's lives).

September, 2006-We decide to stop fighting and accept the injustice that was dealt us.

September 7, 2006-I file I-130.

September 11, 2006-NOA 1 for I-130.

Now-Waiting........................

Near Future-HOPING Congress passes CIR, which would eliminate our need to file the I-601 Waiver. At that point, we file our I-212 Waiver ahead of time (after I-130 approval). Hopefully that will be approved in a timely fashion. Meanwhile, I-130 makes its way through the NVC to CDJ. It then sits at CDJ for the approximate year that it's now taking to get the interview. This timing should land us right around August, 2008, when his ban is up.

If all that happens, in August, 2008 we'll go to his interview, pay $2,000, and get his Visa. Worse case scenario, the I-212 isn't approved yet, and we would have to wait further.

If CIR is not passed, we will file I-601 and I-212 concurrently at the interview in August, 2008. We would then have to wait for those to be approved, meaning the earliest he would be home is sometime in 2009.

In the meantime, the Consulate CONVENIENTLY failed to notify Javier at his interview that he needed to undergo rehabilitation/counseling and provide proof at the next medical. We were able to find that out ONLY by e-mails from myself, the attorney, AND a Senator to the Consulate. We are having Javier undergo regular urinalysis drug tests (every 3 months) but are having a hard time getting him re-hab for a drug addiction that he doesn't have. Consulate conveniently likes to gloss over that little issue in any and all e-mail correspondense.

I hope you have enjoyed reading our fun little story. Bottom line and lesson to all-if you DO NOT have a drug problem, but experimented with a drug in the past (like most EVERYONE has, myself included) honesty is NOT the best policy in Juarez. They will get you! Beware of the psychiatrist-if you're sent to him, you're not getting a Visa. May as well split and call it a loss at that point. That is, unless you enjoy drawing pictures and writing stories for no reason other than the personal gratification and enjoyment of some deranged Licenciado out in the bad part of town. Other lesson learned-beware of the Consulate! They are STUPID and they're not afraid to show it. Mexican men have a tendency to pansy out when it comes to dealing with people of authority-don't let this happen to you! If I had been there with him, none of this would have happened. Don't be the next us!

CDJ is only closed on Dec. 25th and Jan. 1st, right?

As someone who has been there around a holiday, you can not count on their official "list" of holidays to be true. We went the week of Thanksgiving last year, and, in a string of bad luck that occurred while there, the Consulate decided to close THREE days for Thanksgiving-Wed, Thurs, and Fri. Even our attorney was shocked. Javier ended up having to change his flights and go on Monday. Of course I didn't have that choice so I had to go home while he went to the interview himself, and well, what happened then is history...

I wouldn't be a bit surprised if the Consulate decided to close that whole time between Christmas and New Years, or do what they did the day after Thanksgiving and make it an "admin" day, which means they're in there, but you're not! Also, and this is like the ICING on the cake, they gave people APPOINTMENTS for that day after Thanksgiving. Oh the ignorance!

waiting4oliverio,

You're not the only one with the procrastinating fiance, mine also barely got his passport, last week. Well, he went to go get it, but it's not ready yet, he has to go pick it up this week. It doesn't take too long to get the passport though. He went like on Tuesday of last week and they told him to go pick it up this week, so don't worry too much. Just tell oliverio to go soon. Do like I did, just tell him that you need it NOW, no more waiting, scare him a little so he goes, sound a bit mad when you tell him, I bet it will work :D

LOL oh the joys of Mexican men. When I need Javier to do something, I simply tell him if he doesn't do it NOW, he's not getting his Visa, and I MEAN IT. He usually listens, but to be honest, it doesn't work as well as I'd like it to...for whatever reason I got the hubby who doesn't really care too much about the Visa. He never asks about it or anything!

US Citizenship General Discussionmarrying someone who has overstayed
Definitely consult with a good immigration attorney. I will go ahead and recommend ours: Laurel Scott at www.visacentral.net ; she is very knowledgable about the ins and outs of this kind of immigration law. The thing that concerns me most about your case is the impersonation of a USC. When this is done for an immigration benefit, that triggers a lifetime ban with no chance for a Waiver; what exactly decides if this has been done is at the discretion of DHS.

I am not as familiar with the aspects of overstay. I have heard that time spent out of status as a minor does not count against you, nor does time before a certain year (and I believe that year is 1997). On the other hand, I have also heard that overstays are forgiven for spouses of USCs when they adjust in the US.

Best of luck in getting the information you need-the thing I would be worried the most about is the impersonation of the USC. Once you get the answer on that, you can begin to decide how to proceed.

US Citizenship General DiscussionLRP married an illegal prior to completion of HIS NATURALIZATION

Satellite,

Thanks for your response. He didn't know the complexities of petition for her. So, he was told by people that should he file for an I-130 now, it will take yrs to be approved and better wait till he's a citizen. My wife tells me that his wife is clean, never committed any crime or evaded any removal proceedings hearing. So, he is just concerned that he may not be able to complete his citizenship oath because of her immigration status. His wife has an undergrad degree in Biomedical Engineering, top of her class at Columbia Univ. She married this guy because they are like minded, love each other and hope to accomplish a lot together, but now he is really concerned about what might happen to his love life. Also, once her paperwork is straight, she wants to pursue a bio-tech graduate degree.

Kezzie, if you have nothing to say or contribute, it is better to save your energy rather offer a foolhardy response as you did.

I don't know what to suggest for your friend's situation, and I would guess probably a lot of people aren't real familiar with the particulars involved in your friend's situation. Therefore, I actually think Kezzie's advice to consult with an immigration attorney is a good idea. It doesn't have to be expensive, and your friend will know that he's getting good information. Tomorrow at 11 am Central Time have him join Laurel Scott's chat at www.visacentral.net. She is a really good attorney and very knowledgable.

US Citizenship General DiscussionFake ID's
Fake IDs and SSNs are very common because a some point you have people that work in places were you can get them for a fee. Some of the SSN's are from people that have died most likely. I had a contractor getting people off the street to come and work on a Government installation and were detained when they got to the gate for fake GC and have sence been deported.

US Citizenship General Discussionkids and citizenship
Thanks a lot.  I have been looking for this answer for a while

I don't think anything happens when a parent naturalizes, I just researched a bit on this and didn't find anything useful. I believe they will have to file when they turn 18.

This is just false.
Look at the law below:
http://www.schulzlaw...schulz_citz.php
Derivation of US Citizenship as a Minor through Naturalization of One or Both Parents
Derivation means that the minor automatically becomes a citizen when the parent or parents naturalize. There is no requirement for the minor to apply to the USCIS for citizenship, instead the minor can apply directly for a US passport.
After February 27, 2001:
The child must be unmarried;
The child must be under 18;
The child must have at least one US citizen parent (by birth or naturalization);
The child must be currently residing permanently in the US in the legal and physical custody of the US citizen parent
The child must be a lawful permanent resident of the US; and
If adopted, the child must satisfy the requirements applicable to adopted children under US immigration law.
The child can still do an N-600 to get his or her certificate if they please.

US Citizenship General DiscussionJourney Is Complete
QUOTE (Rob and Cathy @ Oct 1 2007, 10:47 PM) <{POST_SNAPBACK}>
Thanks to all who have helped with our questions along the way.

Today Rob had his citizenship ceremony and is now a US Citizen!!!!! kicking.gif

There were 50 in his "class" and they came from all over the world. Which was amazing to me as we are in what I consider to be "po-dunk USA".
The ceremony was very nice, very solemn however the judge did allow family members wanting pictures to come up front beside where he was in order to take photos of applicants as they introduced themselves and took their oath.

There was also a luncheon held afterwards for new citizens which was very nice.

We are happy our journey through immigration and naturalization is now complete.
Our best wishes to those who are still in process.

rob en Cathy

Congratulations

On it's way to TX Service Center.

Hopefully this is the end of the VisaJourney.

But wait...my stepdaughter is eligible in another 2 years.

It never ends! wink.gif

peejay

Good Luck!

It seems we are all ready in delays since they are not entering N-400 currently. Maybe these delays wake up the other place we use, but I doubt it.
