You do not need to have the police records / birth certificate translated into English for the Embassy phase of the process at all. All of these materials can be in either English/Spanish.

The only thing that I have translated up until this point is our evidence materials (emails) for the initial submission to the Service Center for the K-1 (to go along with the I-129F). I also wrote in English next to all receipts for the evidence the basics of: item, date, etc.

That was it for translations!! I also wrote the "I can translate this" letter that Kid Brooklyn mentioned to go along with the I-129F packet, initial submission to the Service Center. Yes, I had this letter notarized.

I'm at the Embassy phase of this journey as of now. Maybe later for the American phase (AOS) of it you'll need translations?? I personally am worrying about this part of it later. I've got enough to do!

Nothing needs to be sent back early. You can just take it all to the interview on a K-1.

Hi, put USC as you are one.

I am also naturalized. I did not include my A#, I am no longer an alien; neither are you.

Weirdly enough, when I got David's NOAs, they included my A#. I was like, what?! So, they'll probably add it anyway. Just ignore it. Not important to your petition. As a current USC, you have the right to ask for the same benefits as any other USC.

This is exactly what me and my SO are doing. I filled it out on the computer and sent it to him to sign as he doesn't have ready computer access. I know it adds another step in your process, but i wouldn't risk sending it without a signature. I'm learning from reading others stories it's always better to err on the side of caution with this process. Good luck!

I met my wife in the US and then later we went to the USVI started dating via phone and e-mail, we were apart for 3 months, met in London, got engaged the next time we saw each other, and are now married. You just have to prove by the letters, pivtures, etc that you are both serious. My wife and I also have a 20 year difference.

I am one of many United States Citizens perplexed by the extensive delays
in the processing of K-1 and K-3 visas at USCIS all service centers.

When I began this process, I was pleased to find that our application would
be processed through the service centers quickly and efficiently. Since
April onward of this year, this has not been the case.

We are members of an on-line community who share information and
experiences related to the immigration of our loved ones. We have been closely
following the changes that USCIS has undergone, including a substantial
rate increase in the fees associated with processing of applications and
petitions. While we understand the need for fee increases and some
restructuring at USCIS (training, hiring additional staff, prioritizing the
processing of applications, etc.) to create a more efficient and customer
friendly organization/agency, there are several issues of concern shared by
many of us that we would like addressed as soon as possible. It is obvious
to us that especially since April 2007, things at USCIS appear to have
gotten worse instead of better. For example, at the Vermont Service Center,
the average time for our community members to get their K1 VISA NOA 2 has
gone from less than 30 days in May 2007 to over 100 days now.

Some of our concerns include:

1.) Significant delays in the processing of petitions. Many of us who filed
in May through the date of this letter are noticing that an extremely small
number of petitions have been processed/approved. Many of our community
members are close to the 120 day mark (At CSC, past the 6-month quoted
timeframe) in waiting for a decision on our petition. Some of us are
receiving RFE’s long after NOA 1, thereby re-starting the clock.
2.) Many of our members have not received a notice of receipt (NOA 1), even
though the On-line Case Status confirms the receipt of our applications.
3.) Information provided by your agency’s out-sourced call center employees
is often misleading, incorrect or incomplete.
4.) We feel it is entirely inappropriate to prioritize WORK visa
applications over Family-Based, Non-Immigrant Petitions.

Dr. Gonzalez, we understand that Immigration Benefits are a privilege and
not a right, but as a United States citizens, we deserve accurate
information AND the opportunity to have our concerns addressed by
knowledgeable officials who can give us FACTS (not in-accurate time
estimates and scripted misinformation designed to appease nervous and sad
callers). We also understand the need for security checks, as we are aware
of our national security issues, but we do not believe this is the source
of the most recent delays. Only the truth and some swift action on the part
of USCIS can alleviate some of the stress associated with this process. Our
lives, along with our loved ones abroad, are on hold and we have no idea
when this first part of the immigration process will conclude.

The wait for a petition to reach NVC, then the appropriate Embassy and,
finally, the attendance of the beneficiary at scheduled interview can add
an additional 3 – 12 months to an already excruciatingly slow process. The
USCIS needs to set a reasonable goal of 90 days and/or have expedited
processing available for K1/K3 VISA applicants.

The strain of this process (both financial and emotional) is taking a
serious toll on the health and well-being of many US law abiding citizen’s
who are trying to follow the laws to bring their loved ones to the US by
legal means. Our frustration level with USCIS' inability or unwillingness
to ease/improve this process is reaching a critical point.

We, as a collective, have some expectations which include:
1.) A formal response to our concerns,
2.) Improved processing time for petitions, we believe the USCIS goal
timeframe of 6 months to process a K1/3 VISA at the service centers is
inadequate for our needs. As with any company, if the 90-day standard
cannot be met with good management and talented professionals, then the
organization should increase staff or streamline processes,
3.) Accurate and detailed information from your customer service
representatives and,
4,) The immediate issue of NOA1 hardcopy receipts for all received
petitions.

We respectfully request your immediate involvement to drastically improve
this process.

Thank you very much for your time in reading our letter and we sincerely
hope you can initiate immediate and long lasting improvements in this
aspect of USCIS.

and do some reading.

But first, make sure they aren't requesting additional information that you can send in or hand carry to the consulate to get your visa. Sometimes these things can be solved fairly easily, but if they have decided that there might be some fraud involved in your case, they might be sending your petition back to the United States and you don't want that...BELIEVE ME!!!

YES, get an attorney BEFORE he leaves the UK and returns to Albania. There are others on here who's fiances immigrated from countries in which they were staying ILLEGALLY (ie. Italy and Greece). So, do your homework and find someone who is experienced with Petition Revocations, or for that matter, avoiding them.
I regret NOT having one when I started this process. I have one now, but only after a BIG mess.
Ideally, find an attorney with some experience with the Embassy either in Tirana or the UK. Best of luck to you. I'll be watching to see how your case progresses.

Hi~ My fiance and I are about to file I-129F and I have a question about address and I'm hoping someone can provide an answer.
My fiance has a student visa that expires on January. Once her visa expires, she has to go back to her country to take care of few family issue. We've decided to file now so that we she could re-enter USA sometime next year (summer?).
The question is, Part B 1 of I-129F and G-325A both ask for her current address. If I put her current address down, which is in US, and on January if she goes back to her country(address in question 15, 16 of I-129F), will she have any problem of her getting whatever paperwork necessary? Or any other problems? helpsmilie.gif

The state Court House where the Divorce was filed is where u can obtain a copy of the decree, it will provide all of the info needed/also you might want to submit a original copy of the divorce decree since it was a while ago- make sure it has the raised seal from the court clerk.

Just adding my two cents, as my fiancé just literally had his interview at the Dutch Consulate today (approved btw smile.gif). The Dutch Consulate is pretty fast with processing Packages 3 and 4 in my opinion.

We knew going in that it would be a lengthy process and figured on sometime in May/June, so we wouldn't get our hopes up if something went wrong. We started unoffically planning after we got package 4, just to make sure we got a nice wedding site, etc, but I haven't done anything as of yet (I will start soon though!) that was non-refundable or that couldn't be changed.

I think the only reason our interview was so far after package 4 is because the Consulate called him and asked him what his plans were, and he said he wanted to come over in late March/ early April because he has a few things to take care of between now and then. They told him "Since it's so far away... yada yada yada.. your interview will be 2/11".

I'm going to talk with him when I get home and try to get a review of the Consulate out of him for the site.

It is for a beneficiary who will interview at a US Consulate.

Does the "J" visa have 212(E) stamped on it?

Best case scenarion - he's got a J visa, not subject to 212(E).
Worst case scenario - he's got a J visa and is subject to 212(E).

In #1 you can marry him and adjust in the US.
In #2 you can marry him here or wait and
sponsor him as a fiancee when he returns to
his home country.

There are waivers to the 212(E) home residency requirement.
You should contact a lawyer near you who handles them.

The DS-157 must be completed by males 16-45 years old (with some exceptions, but the K1 is not one of those exceptions) - a down loadable one is here on VJ.

We're just days away from Juan's K1 interview in Juarez, Mexico. I keep going through the Fiance Packet to check and recheck that we've completed all of the right forms... and in the right way!

In doing this, I refer to several sources:
1) the paper Fiance Packet that I received in the mail;
2) the portion of the Juarez Consulate website that is dedicated to the Fiance Packet; and
3) the homepage of the Juarez Consulate (which I started reading really carefully this morning...)

One would hope that all three of these would contain the same information *and* the same forms... but that doesn't seem to be the case.

In re-reading the homepage of the Juarez Consulate I realized (it seems) that it's not acceptable to have completed DS-156 form available as a PDF download on the Consulate's own website
(at http://ciudadjuarez....ml#fiancepacket, then scroll down to Fiance Packet)
-- that we must, in fact, complete the EVAF version of the DS 156 form online (link is on the Juarez consulate homepage at http://ciudadjuarez.usconsulate.gov/)

We'll do this, of course, and have BOTH versions on hand with us next week-- but I'd like to know if anyone else can confirm that the PDF version (even filled out and printed on a computer) of DS-156 is not accepted (at least at Juarez).

NOW, for my main question-- about DS 157...

It's not mentioned in the K1 fiance packet at all (not on paper, and not on the Juarez consulate website under "Fiance Visa Packet"), but I see on the homepage (along with the EVAF notice for DS 156) that DS-157 is for "males between 16-45 years of age".

Do we need to complete DS 157 for Juan's K1 interview?

I don't think the web site is wrong. The issue at hand is not HOW the individual enters the US but with what INTENT. To enter with the intent to stay is illegal and you run the risk of facing a bar on re-entry if they decide that's what she's doing. The burden of proof would be on you to prove that she had no intentions of staying and it just happened that way, which would be really difficult after she just got done severing all those ties to Canada.

I would strongly suggest that you bring all the documents that you had translated for the visa process and you medical records especially shot records, translated copy of your driver's license if you have one, police cert with translation and any school records.

Any other documents that you may bring please make sure you get it translated there because it is so expensive to get things translated in the United States.

Whatever you do don't refer to your Fiance as you "WIFE". That is one sure way that they WILL NOT let you into this country.

My husband did not have a problem at all. If they don't stamp your i94 with work authorization please ask for it.

Not to sound rude, but a number of people told you that your debt doesnt have an impact on your visa process. We all have some type of debt. You just have to make sure you are above the proverty line as perscribed bu USCIS.

THE GOVERNMENT DOESNT CARE THAT YOU HAVE DEBT FOR THE VISA PROCESS.

If the Gov't cared most of us would not have out love ones with us now.



Its encouraging to me to hear others which have become married to their foreign fiancee's tell me that the debts and loans won't matter in the process. Thankyou. Can anyone give me some more specific information about a situation similar to mine that worked out fine? Did anyone else apply for a fiancee visa with a similar amount of debt and a similar income? How much did you owe? Did they say anything about it? What do you think about my situation, will it be difficult?

My best guest would be "No" they will not tell you anything for security reasons. Just make sure he doesn't refer to you as your wife if he is coming in on a K1 Vias.

Please do it yourself. Refer to the guides on this website and search the K1 message board from this site. Don't waste the money unless you have some things in your past that may come to light.

We finally receiced our NOA2 approval. I opened my email at 12:30pm and saw 10 emails. Then I called my beautiful Marie and let her know the good news, even though it is 2:30am there. I just could wait. For everyone still waiting, good luck and be patient.

Maybe this is a silly question, but won't the interviewing officer be suspicious when they see that the engagement came before the first meeting in person? Is that ok? Is it allowed?

i should be filling the I-129f next week after i get the g-325a signature and letter of intent from my gf in Mexico. Everything is ready to go on my behalf but now that I think about it, will they be suspicious when they know that she's 31 and I'm 25? (L)

She doesnt look that age. Actually I look older but in reality shes 6 yrs older than me. Will this be a factor down the road?

But seriously, I can imagine a 6 year difference will be problematic no matter which of you is older.
Think about it...when the 'old' one is 98....the 'young' one will be 92....doesn't seem like much of a difference to me.
like others have said, a genuine relationship can be shown to the interviewer and the age question may or may not be thrown out there. My guess is that if the interviewer asks, they are only trying to see if you are easily rattled which could be a sign that you are hiding something.

I forwarded our K1 visa application to Vermont service center on 23rd March 2007 but I have bot received an acknowledgement of the receipt of my application from the service center. I am worried about this and I would like someone to help me out on what to do because it is almost 30 days now.

easy way to check is to look to see if your check was cashed.
Did you send the package recorded delivery? Then at least you will get a receipt of when it was receieved etc.

Just curious, how did you send your petitions? Express mail, Priority mail, FedEx? Also, in my delivery confirmation for Express mail it says that the item was signed for by M S - is this the only person who signs for the packages at Texas Service Center? Seems like few others were also signed for by M S. For some strange reason the Address of Recipient on the delivery confirmation is a wrong P.O. box number - I sent it to a different P.O. box! Is this normal?



How ever you choose to send your stuff, make sure you have a return receipt and a way to track it, cashed check etc. The secret to successis a detailed paper trail and many copies. I sent mine Fed-Ex.
